  1. So this is the Democrats version of Project 2025? Except seems to be a lot more people are not only on board with these bucket list of un-Constitutional acts but seems some high level Democrats are on board with it too based off their recent comments about the 1stA.
    To what degree are they willing to go to if Trump wins? As we have seen by their TDS, they are not exactly rational.

    1. While I do hope that the progressive march is halted, temporarily, by a harris loss – I dread to think of the national super-tantrum that will result when these infantile prog/left sheeple are forced to deal with a refutation of their delusional dream.

      1. If their massive voter fraud operation fails next month, I predict their minions of lawyers will file hundreds (if not thousands) of lawsuits challenging the election in every possible way. Then, they will demand an alternate slate of electors when it comes time for the Electoral College to cast their votes on December 17. These are hardcore committed Marxists who will stop at nothing IMHO.

        Well the first go around of 2016, they proclaimed white supremacists around every tree, a fascist police state, increase in sexual assaults, the end of all our rights and Trump would declare himself dictator and el presidenti for life. The white supremacists thing never happened. The police state was exposed by the Twitter files, not Trump. Sexual assaults? After Trump was out of office and being committed by illegals Biden/Harris let in. Seems there are some who are trying to take our 1stA rights away and it is not Trump. Trump is currently a presidential candidate. But the Democrats are bringing out the el presidenti threat, again. And now we got some calling for Biden to commit all kinds of un-Constitutional acts to “save democracy!” Trump wins, I expect them to go full on, level 12, TDS. They will run around, screaming the sky is falling while the rest of us just look at them like they are crazy. I fully expect to see mental health professionals to see another up tick in TDS patients like they did during the first Trump admin. Yeah, that really happened.

        1. The sheeple could be easily contained, but the soros funded legal teams will wreak havoc on our governmental systems and caste grave doubt as to the legitimacy of our election. Even if we gain control of all branches, those little prog/jihadis will continue their destruction of whatever they touch. We need to disinfect our nation of these America-haters first thing after we close the border.

  2. Why has Tribe not been prosecuted in the exact same manner and for the exact same reasons as used to criminally prosecute Trump Lawyers?

    Knowingly giving bad advice, advice that is counter to existing laws and the Constitution by Tribe is just as bad as it was for those other Lawyers.

    Yet, of course, the Left is immune from such prosecutions.

    How long before the Democrats go that one step too far and trigger a response they and no one wants but would be well deserved?

        He gets to prove election fraud
        And he has encyclopedic knowledge of all the fraud in 2020

        If you challenge him on the law or the e constitution
        He knows both and the history

        What the left constantly refers to as fake electors is what federal courts a century ago told candidates was the constitutional way to challenge elections

        Eastman also has the advantage that his advice to trump is based on a legal memo by tribe to Hillary about how to challenge the 2016 election

  3. I doubt anyone on this site is surprised by the ravings of the noted constitutional scholars Michael Moore and Keith Olbermann. It would be nice if those 2 could even read since the Scotus decsion does say what they are preaching. And Tribe teaches about like a house afire. As we get closer and closer to the election the screeching only get gets louder and more panicked. Soon the Dems will tell what they really plan to do. Likely a lot worse than what they have already said. However there was much such screeching in 2016 about leaving the country but no mass migration occurred.
    Main migration I have seen recently is in colleges in some parts of the Northeast cutting back staff as prospective students head south or to the midwest. In early summer here in the Midwest there was a sudden influx of 600-1000 students to Purdue University over what was expected. No rioting and such on campus here in the past spring.
    This may all be sound and fury and signify nothing. We shall see.

    2. MIchael Moore is a constitutional scholar? He’s a filmmaker and the majority of his documentaries have not been wrong. He’s entitle to his opinion just as you are.

        I know Michael is a filmmaker. I even saw Roger and Me. I don’t even have to agree with him or like him and he has his right to air his opinions but I can air mine and point out the weaknesses in his opinions and I don’t agree with your statement his documentaries have not been wrong. It often turns on your point of view but his productions seem to have less and less reason to be seen any more.

  4. There needs to be severe consequences for unconstitutional actions or votes. The penalties need to be so severe that the risks overwhelm the rewards. With a nation of 230+ million people, we are certainly not lacking in talent and expertise. What we do lack is the constitutional character we need in our public servants.

    If done by an elected official, implement some type of 3 strike policy. 1st offense is a warning and loss of voting power. 2nd offense is loss of eligibility for reelection. 3rd offense is removal from office and loss of all retirement benefits.

    If in an appointed position, zero tolerance. Immediate termination of service and loss of any potential retirement benefit.

In Obama’s second term, when voters could no longer hold him accountable, he publicly declared he planned to usurp Congress’s legislative authority and he’d use his “pen and his phone” to impose his will. Worse, he conspired with the Senate Majority Leader, Harry Reid, to nuke the filibuster for judicial confirmations so he could stack the judiciary with activists he hoped would rubber stamp his abuse of power, knowing SCOTUS would not be able to grant cert. for all of the lawsuits to follow. Obama and Reid followed through on their plan. Reid got radical activist judges confirmed on a mostly partisan basis to sit on the DC Circuit where most of the lawsuits would be heard. And Obama used his “pen and his phone” to unilaterally change immigration law with DACA; he literally stole BILLIONS of dollars from the U.S. Treasury not appropriated by Congress to pay off the insurance companies he bribed to support Obamacare; and he used the EPA to impose his “Clean Power Plan” because Congress refused to do so.

    Several years later, a handful of Democrat elites decided to nullify the votes of several tens of millions of Democrat primary voters to steal Biden’s presidential nomination from him. Like Obama was when he entered his second term, Biden is no longer accountbale to voters. He very well may follow Obama’s example and give his middle finger to the Constitution and Congress and follow the advice of nutbags like Moore and Ogremann.

    Does anybody know see the danger term limits present? When egomaniacal presidents like Obama are no longer accountable to voters, they can and do impose their will against an unwilling Congress. Now far left authoritarian nutbags are encouraging Biden to do the same on his way out the door and is no longer accountable to voters.

    If voters don’t like “career” politicians or power mad egomaniacs with a God complex like Obama – and I personally hate them all – then vote them out. That’s how to hold them accountable.

  8. I must take issue with the phrase “gutting the Constitution and assuming the powers of a monarch.” Virtually every current monarch is bound by a Constitution, written or composed of precedent. The crimes of the twentieth century were committed by self-proclaimed revolutionaries, most of them claiming to represent “democracy” or “the people” in some form. Note that Michael Moore (a living advertisement for Slim Fast) talks of satisfying the desires of “the people.”

  12. It is all what you call “Unconstitutional.” In the late 20th century, when postmodernism entered the landscape of thought, emotional viewpoints took on an equal footing with critical thinking. This viewpoint has invaded the law like no other. We now have activist lawyers, judges, pundits, and even elected officials willing and able to reassess the law in favor of their preferred outcomes. Even professors, some very distinguished (e.g. Laurence Tribe), have been drawn in to predominantly emotional thought. To them, it is simply a realignment of rigor with an emotional component. So, what you say is not surprising. However, postmodernism is now so embedded in legal thought, the law seems to be beyond the point no return.

This will get worse until the Congress enacts hash penalties for willful and malicious violations of the Constitution. Those penalties must include prison time for those involved and the disbarment of any Lawyer that supports such violations.   17. Of course they are not joking. I will never understand why you will not just say what they are, fascists. I expect many of them to want this to happen, and would not be surprised if Biden acted on it, at least with some outrageous last-minute decrees. But it is hard to predict and I could be wrong. Believe me when I tell you, if Trump takes office, these same fascists will say they were only kidding, or it doesn’t apply to him b/c (fill in the blank). As for Prof. Tribe, it is a shame to see someone who earned so much respect become purely partisan. The presumption must be that any supposedly legal statement he makes is tainted by it.

    1. I would characterize Tribe as bitter and partisan because of it. Promised a seat on the Supreme Court if and when Clinton won in 2016, Tribe like millions of Americans were flattened by Trump’s victory. Many, including Tribe, could never recover and today suffer deep-seated and pernicious Trump Derangement Syndrome. They are an unhappy group whose brilliance – to the extent it was ever present – is but a sad memory in the minds of others.

We even see the J6 radical DEM’s who call for persecution of any one/Trump supporter who were in Washington to be arrested in thrown in Jail for life but it is OK that the Radical DEM’s do the same thing if Trump is elected. Just look at our Left Wing DEM politicians like Raskin who states he will not certify the election unless its Harris? If Trump is elected expect the Left Wing Radical Dem’s, Antifar etc to hit the streets and lets see what the FED’s do? will they arrest and prosecute, defend Democracy or turn a blind eye? Appears we are in for some interesting times ahead.

    1. That’s what I have said several times I the comment section of this blog. If Trump wins, the risk is high the dems will not accept it. First, we will see lawsuits in every swing state where the result were close challenging the outcome in hopes of overturning the election. If that does not work, second step will be efforts to not certify the elections on January 6. If that does not work, expects riots in DC and every major city on adjuration day. Be prepared.

DD: Yes, the Democrats will be disappointed and yes, some will try to seek relief via the courts as they pursue the classical phases of grief: Shock; Denial; Anger; Bargaining; Depression; Acceptance and, finally, Hope. The courts denied Trump’s many cases, mostly on the basis of standing. The cases were tossed before ever reaching the merits of the charges. The same will likel;y happen with the Democrats’ cases. Chjeif Justoice John Roberts of the SCOTUS has signaled on occasion that courts should not decide elections, that the Constitution is claear that the people and only the people should decide elections. Absent a flagrant and egregious law violation, courts should stay out of the matter. This may be one of the greatest legacies of a second Trump administration – that we return to rule of law and stop using the mechanisms of government to stifle government.

One of the wisest things Chief Justice Roberts ever said was in response to the arguments about “Obamacare.” He said that the courts cannot be used rectify the results of peoples’ electoral choices — make better choices or at least work vigorously toward better choices in the first place. So, I agree with your view that courts should stay out of elections to the extent that these really are elections. The 2020 election should have been audited in the swing states at least, and perhaps nationwide. The suspicion that it was not an honest election will remain as a source of poison in our politics for a very long time; perhaps permanently. The matter should have been settled honestly in a timely manner, but Democrats and never-Trumpers couldn’t take that risk apparently.

        2. I do not expect lots of court challenges

          The urban/rural split between parties makes organized fraud by republicans impossibly difficult

          I do expect that whatever lawsuits Ds manage will get into courts

          All the same legal impediments to trump will magically disappear for Harris

          But the cases are going nowhere

          I also expect trump to win the popular vote by atleast 2% and possibly 4%

          That will quell some lawfare

        Axios is reporting some Democrats are going to refuse to certify the election if Trump wins by cheating. But they do not really explain how he would cheat.
