No, Trump Should Not Sue CBS

In an interview with podcast host Dan Bongino, former President Trump said he “thinks” he will sue CBS after it was found to have edited an interview with Vice President Kamala Harris, only the latest such allegation against mainstream media. I hope that he will think again about this latest threat of litigation. I agree with the criticism of the media, including CBS, in the bias shown in the election. However, such a lawsuit would be legally groundless, in my view. If it is any solace, the media is doing enough damage to itself.

Many have criticized CBS for its editing of the interview with journalist Bill Whitaker after the network shortened portions of Harris’s answer to a question about the war in Gaza in its initial broadcast. It later provided a full transcript of her remarks online. (For full disclosure, I worked twice under contract with CBS as a legal analyst).

Trump, however, took the matter further in his interview, stating, “[s]o I think I’m going to sue them actually. I think so. No, you know what, they can’t defend it and if they do and even if they win it’s going to be very embarrassing.”

Such a lawsuit would fail. The media is allowed to engage in such editing. Indeed, bias itself is not generally actionable. Moreover, there were moments where Whitaker did press Harris in sharp contrast to most of her interviews on shows like The View, Howard Stern’s SiriusXM show, as well as on Late Night with Stephen Colbert. There were some tough moments where Whitaker pushed Harris to give more than soundbite answers.

I have been a vocal critic of the mainstream media for its embracing of what I refer to as “advocacy journalism” in my book, The Indispensable Right. Many in this country view mainstream media as a de facto state media due to the bias shown against Trump and for Democratic talking points. Indeed, the mantra “Let’s Go Brandon!” was embraced by millions as a criticism of the media as much as it was a criticism of President Biden.

However, the threats of harassing lawsuits destroys any moral high ground for Trump. It is also entirely unnecessary. As I wrote this weekend, “journalism has become a ship of fools who increasingly write for each other rather than the dwindling numbers of actual readers.”

CBS was widely criticized for the performance of Norah O’Donnell and Margaret Brennan as moderators in the presidential debate. That includes reneging on a pledge not to “fact check” and showing manifest bias in their treatment of the candidates.

Television and print outlets are experiencing a sharp decline in revenue and audiences across the industry. As discussed in this weekend’s column, the public is going elsewhere for news. Trust in the media is at a record low. There is no lawsuit that could do the damage that the mainstream media is doing to itself.

Despite my criticism of the rise of mainstream or “legacy” media, I still believe that we need a strong “fourth estate” in a democracy. We need a neutral and objective media today more than ever. CBS is a network with a history of true legends in this field. It has served this country well in its tireless pursuit of important stories, including the disclosure of government abuses.

The current reporters and editors are destroying American journalism with their overt bias and hostility. However, it will be the public and the market (not lawsuits) that will ultimately hold the media accountable for the abandonment of neutrality principles.

  1. Jonathan: I don’t disagree. DJT has a snowball’s chance on hell of successfully suing CBS. But DJT erroneously thinks by acting the bully he can intimidate the press. His “strike” suits against the press have uniformly failed miserably. But he keeps trying–thinking like the insane person that if he tries and tries again their will be a different result.

    So DJT rants and raves saying the FCC should revoke the broadcast licenses of NBC and CBS because he doesn’t like what they say about him–mostly because they actually fact check his lies. The FCC has resisted DJT’s demands because DJT is no longer in office. But what happens if DJT wins the election. We know what DJT would do. He would simply issue an executive suspending the Constitution, declaring martial law and shutting down the press and silencing any opposition. This is what Putin has done in Russia and Orban in Hungary. DJT admires “strong” authoritarian types so he would emulate them here. And what would stand in the way? The courts? The Roberts “immunity” decision gives broad and sweeping powers to the executive. As long as any executive order by DJT falls with the category of “official acts”, or those presumptively deemed “official”, DJT could not be held accountable in the courts. A frightening prospect.

    DJT is the last person to complain about CBS. He ditched the “60 Minutes” interview–even though CBS agreed to DJT’s demand to shift the venue for the interview to Butler, Penn. A week after the CBS offer DJT found another excuse for cancelling. His spokesman, Steven Cheung, said his boss was bowing out because “They [CBS] also insisted on doing live fact checking, which is unprecedented”. Well, not exactly “unprecedented”. During the first CNN debate between Harris and DJT he was fact checked twice by the moderators. DJT complained endlessly about that and why he refused a second debate with Harris.

    In contrast, both Harris and Walz sat down with “60 Minutes”. Harris even sat down for an interview with Fox. That shows Harris and Walz are willing to sit down and take tough questions from anyone. DJT is a coward. He runs from the battle when he can’t control the questions asked. He wants only softball Qs from “friendly” moderators. Is this the guy we really want sitting in the WH?

      Trump is now trying to “run up the score” – While Harris is trying to climb out of a hole – these are different strategies.
      It appears Trump is going on Joe Rogan. That will pressure Harris to do so. She should, but I doubt she can hold up to a 3 hr joe rogan interview. Trump can.

      Trump said he won the first debate and that he therefore did not need to do another. He used a prize fighting analogy.
      That has proven correct.

      Harris is the one demanding more debates – That means she needs them.
      Trump has the luxury of picking and choosing interviews NOW.
      he did lots of interviews before. Now he is looking to run up the score.

      If you do not like this – you should not have allowed your candidate to fall behind.

      In all contests, like sports the team in the lead gets to dictate how things proceed.
      They can try to run out the clock if they want.

      When your own downballot candidates start distancing themselves from you and getting closer to your oponent – the race is over.
      The best polls are showing Trump with a 2pt popular vote lead. That could open up to 4-8 by election day.

      Many are noting that this is not like 2016 or 2020 when Trump gained 4-7 pts in the last 3 weeks, but starting to look like 1980, When Reagan went from behind to a massive landslide in the last 3 weeks.

      But the core problem is that no one trusts you, democrats, or harris – because you LIE over and over.

      Druckenmiller observed that the stocks with the most significant rise are those most harmed by Biden and most likely to gain if Trump is re-elected. Investors are buying in anticipation of a Trump victory.

      While I a NOT prepared to claim that a rising stock market means a Trump victory, market analysts are saying that not me.

      DJT may rise more – it may fall – the factors driving that are incredibly complex. I think it is possible that DJT may drop eventually as a result of Trump’s election and rise if he loses – because DJT is likely to run counter to effort o censor Musk.       At the same time I think there is little doubt that DJT stock is a good long term investment. Trump’s net worth will have increased by atleast a Billion as a result of getting into Social Media, and depending on how the future goes his investment could tripple or more his networth.

Turley doesn’t explain why the edited material is important or just HOW editing the content establishes bias on the part of CBS.   6. Professor Turley, you and I agree on most things but on this occasion we differ. You and I both know that Trump is not going to sue CBS. Trump is simply pointing out that CBS as is the common practice of the MSM held out some of the most damning evidence that proves that Harris has changed her positions in order to win the election. The parts that CBS left out were her stammering and stuttering when pressed on not doing anything about the border for three and a half years. The threatening to sue by Trump has effectively brought attention to CBS putting its thumb on the scale by editing out the most embarrassing moments in Harris’s answers. Without Trump threatening to sue it would have been successfully swept under the rug. The American people deserve to see who Harris really is not just part of who she is. Leaving part of who she is on the editing room floor does not allow the American people to know the entire story. Propaganda by omission is still propaganda and Trump using a threat of a lawsuit has indeed brought attention to the incident. His threat appearing on your forum is proof of my assertion.       The case would likely be dismissed quickly and that would harm Trump alittle.

      At the same time the THREAT to sue draws more attention to the biased and unethical practices of the media – in this case CBS

      60 Minutes is a brand that has established a reputation for integrity – the reporter doing the Harris interview did a surprisingly good job.
      But 60 Minutes by editing the interview in deliberately very deceptive ways effectively changed the answers.

      They should be embarrassed. Trump and others should do as much as possible to embarrass them.

      This is and should be damaging to the brand.

      One the whole I eschew threats to sue people – Sue, don’t but do not threaten.

      At the same temp threatening a lawsuit is itself a form of free speech,
      it calls attention to something you think is seriously wrong.

      Turley notes that HE and others have criticized CBS – and that is the remedy.

      And he is correct, But NOT he alone. Trump is free to weigh in too, and his legal threat is part of the criticism of CBS.

      It makes it clear this was a serious mistake that harms CBS, its viewers and its reputation.

      There are times for threats – even if actually carrying them out is wrong.

      1. Fox News does the same thing all the time. Why won’t Turley criticize them? In Brett Baire’s interview with Harris, they showed a video of Trump cutting off the part Harris was talking about.

        Fox News does what Turley is critical of regularly. Only when left-leaning news organizations occasionally do it is when it becomes news to those on the right. Fox News is not criticized because they do it all the time. CBS, CNN, and MSNBC are criticized because they do it occasionally.

    Lately the courts are less a forum for resolving disputes with law and reason [insofar as that may be possible] than they are become weapons. Certainly the most prominent recent examples are the actions against Trump, but there are many others. They are spiked clubs.

    But how long will you be beat on before picking up and swinging your own spiked club? The deep state now openly fears that a victorious Trump will do to them what has been done to him. Good. They have shown that they will not be restrained by custom or law or decency or even the need to preserve our nation. Perhaps the club will work. Go get them.

  9. Let’s say that CBS edited the interview and put out a transcript of the EDITED interview, in an effort to cover-up Kamala Harris’ word salads and gaffes. Let’s say CBS motive is political infowarfare, which is currently legal unless someone is defamed. Trump’s instinct is to sue.

    Mine is too. But the difference is, I recognize we would have to pass Public Frauds legislation establishing the ability to haul a media firm (and co-conspiring political figures) into court for attempting to defraud the public for political gain (and noone is defamed by the whopper). That legislation would need to confront certain tactical loopholes protecting the powerful….first, by creating Fast Public Frauds Courts offering plaintiffs Rapid Due Diligence. That is necessary to prevent the accused infowarriors from delay tactics in answering subpoenas and giving compelled depositions.

    Another loophole to be closed is making public officials equally exposed to Public Frauds lawsuits as any other citizens.
    Being a Member of Congress or Administration official cannot be an exemption, since the greatest threat to our freedom are liars who make it to the top, and then employ artful falsehoods (false narratives) — with sympathetic media amplifying them — to “opinion shape” the citizenry. That is exactly what Russia has become under Putin, what China has became with Mao Tze-Tung’s CCP, what Venezuela became under Hugo Chavez, and what every free society dare not ignore as an ever-present threat from within.

    Trump’s heart is in the right place on the need to put the brakes on activist journalism, although he is too solipsistic to realize how reasonable measures like Public Frauds lawsuits would also apply to himself and his media allies. The question is whether he’s be willing to put aside his double-standard, and have to stop waging his own deceitful infowarfare. So far, I don’t think he’s capable of seeing a path forward to tame leftist media which would equally apply to the deceits advanced by right (e.g., his big lie).

    But just because he’s only looking at the law from his perspective, there is nonetheless a germ of common sense in his idea that CBS is defrauding the public, and that needs a way to be challenged (besides mere complaining about it).

        From what I’ve researched, the 2020 election was not “free and fair” because of the deceitful infowarfare pushed out by the Biden campaign (Biden, Blinken) with professional PsyOps assistance from Mike Morell, the 51 spies that lie, and the media mainstream who ditched journalistic integrity and got behind the “Hunter’s laptop is Russian-intel hacking”. Post-election surveys (equipped with truth about what Blinken-Morell actually did) indicate around 10% would possibly have voted differently if they had known in time to matter. (I’m proposing people being able to confront such whoppers by filing a lawsuit immediately, to blunt the infowarfare impact).

        Only NPR radio has apologized to its audience for running with the false narrative pushed out by the Biden campaign with CIA expert help. But that was well after the damage was done.

        To claim that the actual voting was “rigged” (organized ballot fraud on a massive scale) is just a false narrative with no evidence. Using a vague accusatory term like “rigged” or “stolen” is typical infowarfare, because it appeals to emotions (victimhood, outrage) instead of intellect (“What specific illegal actions were committed?”)
        Do you see the difference? People who are determined to have fair voting processes first study how they work, and ask “Where are the possible scams, and what are the countermeasures to detect them?”
        People who equate election fairness with their favored candidate winning?….I’ll let people decide for themselves what adjective best fits.

        We can argue until we’re blue about what is true vs. false, but in disagreements of large consequence, we have a tradition of Courts, adversarial presentation of evidence, subpoena and compelled deposition/testimony to sort out fact from fiction. Under this system, JURIES of 12 Americans, not biased journalists, are the finders-of-fact.
        Juries have a tremendous record of “getting it right”…you can point to the worst failures of juries, but when stacking those up against the thousands of jury decisions rendered every day which the public accepts, you have to admit, it’s a great system. Our Founders gave us that means of resolving conflicts over facts.

        Is it wrong that I make the connection between that system of truth-deciding, and the problems we are struggling with fake media? Also, what’s wrong with “working both sides of the fence”? There won’t be any reforms acceptable to both factions unless they come from a position of neutrality and fairness. Whatever reform one side enthusiastically backs the opposition will dig in to thwart — nothing will get done.

      Defamation is ALSO supposed to require real harm – but as we have seen int he politically weaponized defamation cases, it is easy for politicized courts to get arround that.

It means the court will have officially said CBS and the rest of the mainstream media may lie with impunity about anything and everything.     Professor Turley: you might find it appealing if Republicans continue to be noble and moral losers of political campaigns in the vein of Romney and McCain losing to ugly Democrat winners. But an enormous number of Americans will take no comfort in your moral version of Trump losing to the immoral Democrats who defeated him. The only significant check on them is what percentage of the population rejects them.

    If so, Trump certainly got the result of keeping media dishonesty in the public eye. Professor Turley isn’t the only one publishing columns and opinions about Trump suing CBS for dishonesty and keeping that dishonesty in the public eye.

    If that wasn’t another throw-it-out-there line, I would much prefer that Trump instead spend every last minute remaining focusing all attention on Border Czar Harris’ record over the last four years, how she lied to Americans that Joe Biden was ‘sharp as a tack’ and continues that lie, etc. Contrast America under his four years in the White House with Biden/Harris’s four years in office.   14. Jonathan: I’ll get to your column but first a round up of this week’s news. For starters, there was an “Oops” moment for Fox’s Bret Baier. He now admits he played the wrong DJT clip during his interview of Kamala Harris on Thursday. Baier says he meant to to play the previous Fox Maria Bartiromo interview where DJT warned about “the enemy from within”. That interview showed DJT has gone very dark authoritarian–claiming immigrants are really not the threat but “radical left Democrat lunatics”. He would suspend the Constitution and use the military to go after them. Harris tried to point this out during the interview while Baier kept trying to interrupt her. Frankly, I think Baier tried to fall on the sword for the producers who decided not to play the relevant clip because that would have supported Harris’s talking points.

    Then, DJT campaigned yesterday in Latrobe, Penn., the birthplace of the famed gofer Arnold Palmer. DJT praised Palmer as “All man, and I say that in all due respect to women. This is a guy that was all man”. To emphasize the point DJT referred to Palmer’s genitalia. That was really weird! Seems DJT also suffers from penis envy. Probably with justification. Just ask Stormy Daniels.

    Psychologists and psychiatrists say a deranged sociopath invariably projects his own personality disorders on others. Want further proof? At a rally in Detroit on Friday DJT told women MAGA supporters to “make sure you vote and bring all our friends that want to vote for us. Tell them, Jill, get your fat husband off the couch, get that fat pig off the couch. Tell him to go and vote for Trump…”. For a guy who is borderline obese it’s all projection. Now I don’t know about you but if I was called a “fat pig” I would think twice about voting for DJT!

    Finally, Ryan Wesley Routh, the man who waited in the bushes to try to assassinate the former president at his Palm Beach golf resort, has raised an interesting defense in his indictment. Judge Eileen Cannon has been randomly assigned the Routh case. She is the same judge who dismissed Jack Smith’s Mar-a-Lago docs case (now on appeal).

    On Thursday, Routh’s defense attorneys argued Cannon should recuse herself: “Were he [DJT] to become President in the future, he would have authority to nominate Your Honor to a federal judgeship on a higher court were a vacancy to arise. Taken together, these unprecedented facts and circumstances might create an appearance of partiality in the mind of the public. Accordingly, the Constitution and the federal recusal statute requires Your Honor to recuse herself from this case”. A pretty compelling argument since Cannon showed extreme partiality when she dismissed the Jack Smith case and she will likely be slapped down for a third time by the 11th Circuit. Will Cannon recuse herself in the Routh case? Stay tuned.

      Reality check for you – the Election of Trump IS going to result in purging of left wing nuts from positions of power.

      It IS going to result in dismissal for cause for government employees who acted to infringe on the rights of others.
      It MAY result in a few criminal prosecutions where OBVIOUS criminal conduct is exposed.

      It is unfortunately NOT going to make a DENT in the left wing nut abuses of power inside this country.
      Nor is that going to be the goal.

      It is also NOT going to be the priority of a Trump administration.
      The priority – which Trump has heavily campaigned on and which his victory will provide a mandate for

      He not only unequivocally said there would have been no Ukraine war with Trump, but that even if there had it would have ended quickly.
      That the Ukraine war is entirely on Biden – that Neither Ukraine nor Russia actually wanted the war, that Biden provoked it and that peace is impossible so long as Biden is in power.

      That Joe Biden sought to be remembered for forcing Putin out of power and that he created the conflict and will not let it end until he has removed Putin.

      That and those who support that are “the enemy within”.

      Harris agreed to be interviewed on Fox – that means Baier – the reporter controls the interview.
      That HE gets to decide what is asked, what his viewers wish to hear – not the interviewee.

      The same is true when Vance Trump, Mcdonald, Cotton, Hawley, …. go on CBS, NBC, CNN.

      They have to figure out how to answers reporters questions in the way that also gets their message out.

      Harris FAILED. Baier was far more forgiving and polite that most left wing nut journo’s.
      He allowed Harris to get away with far too much.

      At the same time – Baier actually did a service to Harris – had he allowed her to go off on her rants – she would have looked worse and with near certainty stepped into schiff.

      Harris did badly – but less badly than 60minutes, and the view and oprah.

      If she keeps up the tough interviews in a year or so she MIGHT actually get good at this – practice does improve people.
      But she does not have a year.

      The good news is that the interview did show that Harris can improve.
      Though it still went badly for her.

      It was especially bad – because her goal – what she NEEDS right now is to actually go to Fox, and to the places were undecided voters or even hostile voters are and to persuade them.
      Personally I think Harris is between a rock and a hardplace – if she moves to the center – she alienates her left flank.
      But she desparately needs centerist voters. And in 2024 centerists are a really really hard sell for Harris. Especially as she constantly embraces Biden’s policies. Biden has been a disaster as president,.

      While I do not think Joe Biden is a left wing nut – the bait and switch in 2020 was to takevery nearly a blue dog democrats who could appeal to the center and persuade the left wing nuts that were going to vote for Harris, or Warren that Biden was a secret left wing nut.

      That strategy worked well enough to each out a 40,000 ballot victory in swing states.

      But it is not repeatable. Independents were lied to, to get their vote and in 2024 what we are seeing is “We won’t be fooled again”

      Harris needs to move HARD to the center AND do so beleivably – and that is not possible.

      Independents are breaking for Trump. That was always to be expected.

      Trump is seeking to be remembered – as is Harris, and Biden and Obama.

      I do not know the details of the allegations against Routh or the law.

      I do not know if you are correct regarding the 11th circuit. They seem to be stalling. They seem to be trying to stay out of the news.

      If they uphold Cannon – Jack Smith is gone – not just from FL, but from DC.
      If they do not uphold Cannon, this goes to SCOTUS, and Jack Smith is gone.

      Personally I think we have a major problem with SC’s that we can not solve – I am not sure a constitutional amendment will solve it.

      The older IC act was allowed to expire because it was likely unconstitutinal.
      But the IC act was likely less unconstitutional than the current SC regs.

      My guess is that SCOTUS is going to split the baby – they are NOT going to find the SC regs unconstitutional – even though they are.
      Because if they do, there is probably not a constitutional way to investigate a president. And we actually do need that.
      i would note that Cannon did NOT find the SC regs unconstitutional – though they clearly are.
      She found that Jack Smith’s appoinment did not meet the reuquirements of the regs AND the constitution.

      If I had to bet the 11th circuit is going to dismiss Smith’s appeal as moot after he is fired in January to avoid having to decide the issue.
      Because Cannon is likely to win before the supreme court.

      Regardless the only reason Cannon Recuses from Routh is she does not want the case.
      Routh’s argument is BS and applies to every federal judge that takes any case that a potential president has an interest in.

    Trump succeeded. Professor Turley is discussing it, Bongino is discussing it, the press is discussing it, and leftists on this blog are apoplectic and discussing it. Trump does this all the time. This is a media strategy. It is not haphazard but intentional. He makes a statement with words that cause angst from his followers and others but simultaneously opens his thoughts to the public through the press, wishes to undermine his chances of victory, and wants to ruin his chances. That is how Trump controls the discussion where the media is biased. We saw much of that in 2016, and this strategy continues to be effective.

His thought processes are disorganized–so said multiple members of his former administration. Because he only deals with the last thing he heard, they had to strategize on how to get him to attend to the important things. He has a short attention span, which is why they had to “dumb down” the presidential daily briefings to no more than one page–either that, or he just didn’t care enough about the business of the United States to bother to pay attention. As a citizen I’m more pissed at the bias, distortions and lies that their force feeding Americans.   18. I still believe that we need a strong “fourth estate” in a democracy. We need a neutral and objective media today more than ever.

    Well duh! But this “ship of fools” ain’t it. I’m not sure where a truly neutral and objective media even exists anymore. It appears that the ideological divide in this country mirrors that of the media.

    One thing we don’t need is a Fourth Estate with stronger 1st amendment protections than that of our citizens.
