Call it the Mark of Kaine. The heated dispute between the Biden Administration and the State of Virginia just took a curious turn after Virginia lawyers released support for the effort to remove alleged noncitizens from the voting rolls ahead of the presidential election. The main witness against the Biden Administration may prove to be Sen. Tim Kaine (D., Va.) who is on the ballot this election.
The Biden Administration sued to stop the removal of 6,303 alleged noncitizens from Virginia’s voter rolls before the election, which is expected to be close in the state. It relies on the National Voter Registration Act (NVRA), or the “Motor Voter Law,” which bars “systemic” removal of voters from the rolls less than 90 days before an election.
Gov. Glenn Youngkin ordered compliance with existing laws, citing Virginia code 24.2-439, requiring the removal of noncitizens whose names were added under false pretenses. It also cited Virginia Code 24.2-1019, requiring registrars to immediately notify their county or city prosecutor of such situations.
The NVRA has exceptions for removals within what the Justice Department calls the “quiet” period before an election, including the removal of individuals who are “ineligible to vote because of a criminal conviction or mental incapacity, or for “correction of registration records pursuant to this chapter.”
However, the state argues as a threshold matter that these are not systemic removals. The state argues that these are individual actions triggered automatically by citizens identifying themselves as noncitizens but then joining the voting rolls. It is a crime for a noncitizen to vote in the election.
The state notes that the voter is notified of the problem and allowed to correct any errors to remain on the rolls. If they do not correct the problem, they are removed from the rolls. However, they can still vote on election day with a “provisional” ballot to challenge any removal.
Virginia is not targeting any group and does not know how these voters might vote. It is responding to a notice coming from the Department of Motor Vehicle of a possible ineligibility and potential criminal act if the person actually votes, which is admittedly rare for noncitizens.
While the Justice Department insists that some of these individuals are actually citizens, the system allows for those citizens to remain on the rolls by simply correcting the DMV record.
I understand concerns over changes close to the election, but there seemed to be a host of options for the Justice Department short of this lawsuit, including working with the state to be sure that this relatively small number of voters are given ample opportunity to correct their records.
This weekend, Virginia added a new wrinkle in the litigation. The Virginia law has been on the books since 2006. The bipartisan legislation was signed into law by then Virginia Gov. Tim Kaine. It has been used without any objection for all those years.
However, it now appears that Kaine’s administration specifically asked the Justice Department to determine if the law was compliant with federal laws, including an express inquiry about the NVRA.
On December 16, 2006, the Justice Department completed its review and found no objections to the Virginia law though it added that it reserves the right to object in the future to any such laws.
Gov. Youngkin further told Fox News that past governors continued to use the law within the 90 days period without a peep of objection from the Justice Department.
These facts distinguish the Virginia case from the Alabama case where a court enjoined removal of names of suspected non-citizens.
Now, Kaine is on the ballot and there is a close election for the presidency. The Biden Administration is suddenly claiming to be “shocked, shocked” that there are alleged noncitizens being removed from the ballot.
In July, in an interview with WJLA-TV , Kaine insisted that “voting should be reserved for U.S. citizens.” When pressed recently, his campaign issued a non-statement statement that, again, insisted that “it is illegal for noncitizens to vote” while adding that “just as we want to block noncitizens from voting, we need to keep eligible voters from being purged from voting rolls, particularly just weeks from an election.”
Youngkin agrees that the state must “block noncitizens from voting” and is using the very law Kaine signed (and the Justice Department approved) for that purpose.
In the end, these votes are unlikely that to change any electoral outcomes. However, there is a broader fight building over a variety of election integrity efforts.
States have complained that the Biden Administration has harassed and sued them at every turn as they sought to require voter identification or other laws.
Florida is now suing the Biden administration for allegedly obstructing the verification of immigration records so the state can remove any non-citizens. The state alleges that the Biden Administration has simply refused to supply required verification information.
These are just a few of the over 165 election-related lawsuits filed in the days before the election by the federal and states authorities and various public interest groups.
Some local officials are sparring with state officials. Fourteen states do not require voter identification. Despite the opposition from the Administration and many Democratic leaders, Gallop and other polling show Americans overwhelmingly support voter identification laws. In California, the state actually made it illegal for local election officials to ask for identification from voters.
The key about the lawsuits filed close to the election is the first round is often the last round. Whoever wins these fights for injunctive relief is likely to remain the prevailing party in the final days before the election.
There is now a virtual army of lawyers deployed by both parties to secure or to protect the expected small margin of victory in the election. Indeed, lawsuits like the Virginia action constitute a type of “harassing fire” to push back on states on identification and eligibility efforts.
The Biden Administration’s move against Virginia shows how one person’s voter integrity is another’s voter suppression. Indeed, the man who signed this state law is now supporting the Administration seeking to limit its use.
Yet, the mark of Kaine on this law is an indelible reminder of how even long-standing practices are now being challenged in this hair-triggered environment. For voters, they will have to be careful when picking their line at their polling place. The longest line is likely the lawyers waiting to get inside.

If you attended the 2024 DNC Convention you were protected by thousands of police, they erected a tall fence around the building and required photo ID to enter the building but requiring protection for citizens only voting is racist.
This is the federal statute that Virginia is alleged to be violating.
“ Section 8(c)(2) of the NVRA, also known as the Quiet Period Provision, requires states to complete systematic programs aimed at removing the names of ineligible voters from voter registration lists no later than 90 days before federal elections. Turley states that the Virginia law has been on the books since 2006 and has had no issues until now. But Turley neglects to mention that previous purges of voter rolls using this Virginia law were not done this close to an election. That can be why there was never an issue until now when they sought to purge the voter rolls of 6,303 alleged non-citizens just weeks away from the election which is not allowed by federal law.
There is no way to determine if any of these alleged non-citizens will indeed vote. The state essentially wants to purge those alleged non-citizens on the assumption that they MIGHT vote. That reasoning may not fly in court. Particularly if they don’t even know if those voters are indeed non-citizens.

With slim margins comes increased scrutiny of who is doing the voting. Compounding this issue is the millions of illegal migrants that have been curiously exported from distribution facilities along the border to a city or town near you, many of which are in the so called swing states.
What is most egregious is the “democracy-saving” Biden/Harris DOJ suing states trying to prevent these illegal migrants from disenfranchising eligible voters.
The most rational approach by the DOJ would be an all-of-government effort to prevent, not enable illegal voting. But alas, Harris and the Democratic party desperately need warm (or cold) bodies in these swing states to explain how “voter turnout” set new records.

Did Youngkin actually say on Fox that Virginia had in the past applied this law WITHIN the 90-day quiet period, as Turley said he did? I did not hear him say that, and I don’t know if it did or not. Would be good to know, though it is not relevant to whether these are “systematic” removals or, if so, whether any of the exceptions apply.
A solution to noncitizens voting would be to make registering to vote by a noncitizen a crime punishable by mandatory jail time and/or deportation. Aiding and abetting a noncitizen to register to vote should also be made a crime to include a substantial fine and jail time. If the abettor is proven to be a noncitizen, jail time and deportation should be mandatory.

It is indeed ironic that just yesterday, JT brought us a case of SCOTUS’ remand and reference to the Gonzalez case and its predecessor Nieves,( in which was created an exception pursuant to a defense showing that similarly-situated individuals had not been prosecuted).

52 USC 20507(c)(2) provides the following exceptions,

(B) Subparagraph (A) shall not be construed to preclude—

But I do not see where either Youngkin or VA atty Richard Cullen has particularly referenced this statutory set of exemptions, i.e., expressing that the subject Virginia list contains only persons who fall under these exempted categories (of particular interest is “(ii)”.

Want to hold a politically fractured country together? Well, one good way to aid this endeavor is to insure that elections avoid even the appearance of impropriety. Also make sure that elections can be audited — not just recounts of ballots including the suspicious ones, but an honest-to-god audit. Many problems that make elections not auditable and suspicious had been addressed over the year, but the dam broke in 2020. We should have tackled this problem head-on in 2020, but Democrats fought every effort to do so then, in 2022, and now.

I also remember protests where leftists pushed young men into moving against the police so they could get footage of the police cracking heads open or, better yet, for one of the naive to be killed. The law in question is not Virginia’s. It’s federal law that is the issue. Federal law does not allow states to purge voter rolls 90 days before an election. Given how close this election will be purging voter rolls over alleged non-citizens. It is not certain that the alleged non-citizens are indeed non-citizens or there is no proof that those alleged non-citizens will vote. There are already safeguards against non-citizens voting at the polls. Also to get a state ID you must have proof of citizenship.
In Virginia, non-citizens are issued a Driver privilege card that allows them to have a Virginia-issued driver’s license. It is used to identify a non-citizen who is allowed to have a state ID. That card has specific markings that identify the holder as a non-citizen.
I don’t see how they are able to register if they cannot prove citizenship when applying for a state ID. That is why Turley emphasizes that these voters are ALLEGED to be non-citizens. They most likely are since they managed to register to vote despite all the safeguards. If perchance someone did end up getting registered it is likely a human error or a mistake. If any one of those alleged non-citizens has a Virginia driver privilege card they will not be able to use it at a polling place to vote. People don’t realize how many safeguards there are to ensure those who are not allowed to vote don’t vote.

There is only one reason Dems openly persist in paving the way for illegals to vote. They support voter fraud. The end justifies the means.
The question is, how did 6000 non-citizens get on the VA voter rolls in the first place?
That was my first thought when I read the column. Obviously is not against the law to register to vote as a non-citizen. Why are there no safeguards against registering? A simple notice in big bold letters reminding would be registers that non-citizens are not allowed to vote would suffice.

So state officials don’t know the law. Cool. So the blame rests with state officials who approved the registrations in the first place. If state officials at the DMV ask non-citizens if they would like to register to vote and proceed to register them if they say yes then it’s on them. State and federal law requires them to prove they “knowingly” or “intentionally” registered to vote or provide false statements.

AVR is when people get a license or in some states when you register as a resident you are AUTOMATICALLY registered without being asked.

I am only wrong on the number of states, big deal. Only 44 states use the National voter registration law or “motor voter” law to register voters. This means at their their DMV’s they ASK voters if they want to register to vote. So what if it’s not every state, BUT it’s a majority of states ,(about 88%). My guess is non-citizens in VA got themselves registered to vote the same way non-citizens in PA (and several other states) did.
When Al Schmidt was a Philadelphia City Commissioner in 2017, he explained during a PA state Senate hearing how he had been briefed on a study that had identified around 100,000 registered voters who may be non-citizens.
PA allows non-citizens (green card holders, foreign students with visas, etc.) to obtain a lawful driver’s license. To obtain a driver’s license, the non-citizen must literally hand their immigration documents to a government functionary employed by the DMV to review. The government employee flags an indicator in the system noting the driver’s license holder is a non-citizen. That status is then printed on the hard copy of the driver’s license. So far so good. The researchers who did the study then compared the DMV records to voter rolls.
Despite the DMV employees literally holding the DL applicants’ immigration paperwork in his hands, non-citizens were asked if they’d like to register to vote. Over several decades, 100,000 of them said “yes”, believing it was legal for them to do so.
At best, it was government incompetence (surprise, I know). At worst, some government employees in the DMV willfully chose to register people they knew were non-citizens.
Yet Schmidt characterized it as a “glitch” in the system. So the Public Interest Legal Foundation asked for the state to produce all the documents about this so called “glitch”. It’s been seven years, and the state has refused to hand over any documents.
