Call it the Mark of Kaine. The heated dispute between the Biden Administration and the State of Virginia just took a curious turn after Virginia lawyers released support for the effort to remove alleged noncitizens from the voting rolls ahead of the presidential election. The main witness against the Biden Administration may prove to be Sen. Tim Kaine (D., Va.) who is on the ballot this election.
The Biden Administration sued to stop the removal of 6,303 alleged noncitizens from Virginia’s voter rolls before the election, which is expected to be close in the state. It relies on the National Voter Registration Act (NVRA), or the “Motor Voter Law,” which bars “systemic” removal of voters from the rolls less than 90 days before an election.
Gov. Glenn Youngkin ordered compliance with existing laws, citing Virginia code 24.2-439, requiring the removal of noncitizens whose names were added under false pretenses. It also cited Virginia Code 24.2-1019, requiring registrars to immediately notify their county or city prosecutor of such situations.
The NVRA has exceptions for removals within what the Justice Department calls the “quiet” period before an election, including the removal of individuals who are “ineligible to vote because of a criminal conviction or mental incapacity, or for “correction of registration records pursuant to this chapter.”
However, the state argues as a threshold matter that these are not systemic removals. The state argues that these are individual actions triggered automatically by citizens identifying themselves as noncitizens but then joining the voting rolls. It is a crime for a noncitizen to vote in the election.
The state notes that the voter is notified of the problem and allowed to correct any errors to remain on the rolls. If they do not correct the problem, they are removed from the rolls. However, they can still vote on election day with a “provisional” ballot to challenge any removal.
Virginia is not targeting any group and does not know how these voters might vote. It is responding to a notice coming from the Department of Motor Vehicle of a possible ineligibility and potential criminal act if the person actually votes, which is admittedly rare for noncitizens.
While the Justice Department insists that some of these individuals are actually citizens, the system allows for those citizens to remain on the rolls by simply correcting the DMV record.
I understand concerns over changes close to the election, but there seemed to be a host of options for the Justice Department short of this lawsuit, including working with the state to be sure that this relatively small number of voters are given ample opportunity to correct their records.
This weekend, Virginia added a new wrinkle in the litigation. The Virginia law has been on the books since 2006. The bipartisan legislation was signed into law by then Virginia Gov. Tim Kaine. It has been used without any objection for all those years.
However, it now appears that Kaine’s administration specifically asked the Justice Department to determine if the law was compliant with federal laws, including an express inquiry about the NVRA.
On December 16, 2006, the Justice Department completed its review and found no objections to the Virginia law though it added that it reserves the right to object in the future to any such laws.
Gov. Youngkin further told Fox News that past governors continued to use the law within the 90 days period without a peep of objection from the Justice Department.
These facts distinguish the Virginia case from the Alabama case where a court enjoined removal of names of suspected non-citizens.
Now, Kaine is on the ballot and there is a close election for the presidency. The Biden Administration is suddenly claiming to be “shocked, shocked” that there are alleged noncitizens being removed from the ballot.
In July, in an interview with WJLA-TV , Kaine insisted that “voting should be reserved for U.S. citizens.” When pressed recently, his campaign issued a non-statement statement that, again, insisted that “it is illegal for noncitizens to vote” while adding that “just as we want to block noncitizens from voting, we need to keep eligible voters from being purged from voting rolls, particularly just weeks from an election.”
Youngkin agrees that the state must “block noncitizens from voting” and is using the very law Kaine signed (and the Justice Department approved) for that purpose.
In the end, these votes are unlikely that to change any electoral outcomes. However, there is a broader fight building over a variety of election integrity efforts.
States have complained that the Biden Administration has harassed and sued them at every turn as they sought to require voter identification or other laws.
Florida is now suing the Biden administration for allegedly obstructing the verification of immigration records so the state can remove any non-citizens. The state alleges that the Biden Administration has simply refused to supply required verification information.
These are just a few of the over 165 election-related lawsuits filed in the days before the election by the federal and states authorities and various public interest groups.
Some local officials are sparring with state officials. Fourteen states do not require voter identification. Despite the opposition from the Administration and many Democratic leaders, Gallop and other polling show Americans overwhelmingly support voter identification laws. In California, the state actually made it illegal for local election officials to ask for identification from voters.
The key about the lawsuits filed close to the election is the first round is often the last round. Whoever wins these fights for injunctive relief is likely to remain the prevailing party in the final days before the election.
There is now a virtual army of lawyers deployed by both parties to secure or to protect the expected small margin of victory in the election. Indeed, lawsuits like the Virginia action constitute a type of “harassing fire” to push back on states on identification and eligibility efforts.

Notice that this is all on the state. They are responsible for gathering the information and transmitting the information after asking.

I already explained earlier why this would not apply. So I will again. To violate this statute the state must prove the person attempting to register “knowingly” made a false statement or claim that he/she is a U.S. citizen. Since they already got their license as a non-citizen with all the required documentation and the state official still asks them if they want to register to vote they can’t be “knowingly” making a false statement because a state official is asking them if they are wanting to register to vote. Some may assume they can based on the fact that a state official asked them would make them believe it’s ok to do so. That would not prove they “knowingly” attempted to provide a false statement. It’s the state’s responsibility to verify eligibility after all proper documentation has been provided.
If some non-citizens end up on the voter rolls it’s the fault of the state. That’s not the fault of the registrants. It is also not a guarantee that those non-citizens will indeed vote.

1. non-citizens may not vote in local, state, and federal elections
2. proof of citizenship must be provided when an individual registers to vote and that it is the responsibility of local,
state and federal govts to maintain systems which assure that births are properly recorded and certified.
3. DMV’s must be interfaced such that a voter registration in one jurisdiction immediately cancels/removes that
individual from all other jurisdiction. In the fashion of the issuance of a driver’s license, a state issued identification,
either can be used to verify identity when presenting to a polling place. Verification of identity is a matter of fact in
the present day in many venues where the public is served and is generally provided without complaint.
4.Absentee ballots must be officially requested by the voter and renewed periodically.
5.Wholesale mailing of ballots should be deemed unlawful.
6. States must purge their voter rolls in the year of a Presidential election and certify they have done so no later than
90 days prior to the date of the primary vote in that state.

The state depeartment knows everyone who has a passport, But many citizens do not, and the state department properly does not share that.
Social Security knows who has an SS# and who has a green card – but it does not share that information – for good reason.
The State Department tracks naturalizations, but the only record it has of those born here are if thy get a passport.
Further as of 2000 you can be born in a foreign country and never be “naturalized” and yet automatically become a US citizen – if you are adopted by Parents who are citizens.
A US birth certificate is proof of US citizenship – but those records are kept in the county you were born – not by he federal government or the state you reside in.
There are many ways to prove citizenship – but no way that works for all people at all times.

and those agencies that have partial records are properly barred from sharing those records.

In every state with voter ID – government issued photo ID that identifies you and confirms you reside where you are voting is acceptable.
Military ID, Passport, Passport Card (this is a federal Photo ID like a DL or pasport that can go in your wallet, that can be used as a substitute for a DL are photo ID and SOMETIMES as substitute for a passport, Global Crossings ID, TSA Pre-Check ID,
99.99% of americans already have ID that meets Voter ID requirements.

Put the security envelope into an outer envelope with you name ID information and Signature, and turn he ballot back to the county election official.
There is a slight variation for those working for governmefasciliy in foreign places. They go to a consulate, or military request the ballot fortheir particular home precinct, that is shipped to a consulate or military office, you vote the same as in county absentee, and the consulate or military office returns it to your county.
In ACTUAL absentee voting – the ballot NEVER lease the direct suprevision fo someone in governent.
The citizen never has control of the ballot outside of government offices.
This is a very important anti-fraud measure and it is an absolute requirement in the 38 states with secret ballot constitutional amendments.
If a Ballot is mailed to the voter – it is NOT an absentee ballot, it is a mailin ballot and it is ilegal in all states with secret ballot constitutional provisions.
Mailin ballots should not be allowed. There is no way to prevent mailin ballot fraud.

Why have the few states that have had mailin voting for a long time not had significant fraud ?
Because there are specific conditions that make election fraud viable. Outside those conditions there is no incentive to do it.
The first and most critical is that you must have an election close enough to makefraud useful.
If one candidate is leading in the polls by 10% – the other candidate winning by 10% would autmatically be highly suspicious.
The larger the scale of fraud required the exponentially more likely you are to get caught.
And therefore the less likely you are to engage in it.
This is also another major problem with early voting and mailin voting – there are no exit polls.
Election day exit polls are an incredibly important anti-fraud measure. But as we have seen in 2020 and 2022 – they are now near useless in the US. They no longer form an informal and out of band audit of the election.
Anytime Ballots leave the control of election officals you have a huge number of vectors for fraud.
The moment a voter possess a ballot outside the polls, they can be coerced or induced into voting.
By freinds, Family, spouses, unions, employers party bosses, anyone who can threaten or bribe.
This is also why it is generally illegal to photograph your filled in ballot. In the late 19th century political parties were paying the equivalent of $1000 today for ballots voting for the desire candidates. The amount political parties spend trying to eak out the last marginal votes is much higher than that.
Ballots outside of the control of election officials can be forged extremely easily – and today that can be done with very very few people.
Any state that has mailin voting and anything less than PERFECT chain of custody for every single ballot – and no state comes even close to that, can have fraudulent ballots injected in many many different ways at many places in the voting system.
One person acting alone can inject as many as 200,000 ballots into a mailin election without geting caught IF

The courts allow ballots to be counted with less than perfect chain of custody.
Ballot drop boxes are unattembeded (and have no CCTV)
Voter registration records are available to the public or for purchase.
And that is just ONE form of election fraud that Mailin voting makes easy. There are others.

State citizenship records are often inaccurate. Prince William County VA, for example, earlier this year canceled 162 voters using this same process, and of that group 43 were inaccurately identified as non-citizens. That is a false positive rate of 26.5%!
Using that rate as a guide, we might expect around 1,670 citizens to be improperly swept up in this systematic purge. That is simply unacceptable, especially this close to an election.

Yes, two weeks is unreasonable. Federal law sets 90 days as the minimal allowed and that is more reasonable.

For those on this blog who depend on SS in whole, or in part, your standard of living would be directly impacted by DJT’s. policies. And not for the better.
