“Precedent…Doesn’t Matter Anymore”: Democrats Dispense with Pretenses and Principles in Pennsylvania

Below is my column in The Hill on the growing distemper on the left after the loss of both houses and the White House in this election. In Pennsylvania, the politics of despair has stripped away all principle and pretense. There is a concerted effort to reelect Sen. Bob Casey by any means necessary. Even the Washington Post is now criticizing the effort.

Here is the column:

“People violate laws any time they want.”

Those words, shrugging off an alleged unlawful move last week, did not come from some Chicago gangbanger or Washington car thief. Those words of wisdom came from Democrat Commissioner Diane Marseglia in Bucks County, Pennsylvania.

They came in response to the fact that the Democratic majority on the election commission had decided to ignore a binding state Supreme Court ruling in an attempt to engineer the election of Democratic incumbent Sen. Bob Casey (D-Pa.).

Rather than prompting a degree of introspection, the loss of both houses of Congress and the White House has had a curious effect on many Democrats, dropping any pretense of protecting democracy over partisanship.

Despite polls showing that the public trusted former president Donald Trump more than Vice President Harris in combatting threats to democracy, Democrats made “saving democracy” the thrust of this election.

The polls reflected a certain common sense of the public when harangued with predictions from President Biden, Harris and a host of politicians and pundits that this would likely be our last election. Few believed that after over two centuries as the most stable and successful democracy in history, all three branches would collapse in unison and embrace dictatorship. Even fewer believed the predictions of the rounding up of homosexuals, journalists and political critics for camps in what some described as an American Third Reich.

American voters are not chumps and what they saw were strikingly anti-democratic positions from those claiming to be the defenders of democracy, including:

• Seeking to strip Trump from ballots under an unfounded theory rejected unanimously by the Supreme Court.

• Fighting to block opponents of Biden from ballots in the primary and general elections.

• Suing to keep Robert F. Kennedy on ballots after his withdrawal in swing states, in order to confuse voters and reduce the vote for Trump.

• Calling for blocking dozens of incumbent GOP officials and legislators from ballots as “insurrectionists.”

• “Protecting democracy” through the most extensive censorship in history and the blacklisting of opponents.

• Engaging in open and raw lawfare in the prosecutions of Trump in places like New York.

Each of these efforts ultimately failed to stop Trump and was opposed by a majority of voters even before the election. So now, Democrats are dropping the pretense for open partisanship.

That was evident in Bucks County, when a motion arose to reject a challenge to count provisional ballots, including undated or invalidly dated mail ballots.

It should have been easy. To its credit, the majority-Democratic Pennsylvania Supreme Court had already refused a Democratic push to change the rules shortly before the election and to ignore the plain language of the election laws.

In ordering the rejection of ballots without dates, Justice Kevin Doughtery (joined by Chief Justice Debra Todd) wrote a concurrence declaring “This Court will neither impose nor countenance substantial alterations to existing laws and procedures during the pendency of an ongoing election.’  We said those carefully chosen words only weeks ago. Yet they apparently were not heard in the Commonwealth Court, the very court where the bulk of election litigation unfolds.”

It is apparently still not being heard. In the Bucks County hearing, Marseglia spoke as she and Democratic Board chairman Robert Harvie, Jr., dismissed the earlier rulings in order to accept ballots without required signatures or mandatory dates.  She declared that she would not second the motion to enforce the rulings “mostly because I think we all know that precedent by a court doesn’t matter anymore in this country and people violate laws any time they want. So, for me, if I violate this law, it’s because I want a court to pay attention to it.”

That was a lot of words to say that she does not really seem to care if this is lawful. For his part, Casey has shown the same abandon as he clings to his Senate seat at any cost.

That cost, in this case, was an alliance with Marc Elias, the controversial Democratic lawyer at the center of the infamous Steele Dossier scandal. Elias has been sanctioned in court and criticized for his work to flip elections. He is known for baselessly blaming voting machine errors for electing Republicans and pushing gerrymandering plans rejected by the courts as anti-democratic.

Casey is unlikely to change the result without counting defective or challenged ballots. Fortunately, law and precedent “does matter in this country.”  There are still officials who can transcend their political preferences to maintain the rule of law. After the last presidential election, many Trump appointees ruled against the former president, and many Democratic judges rejected the effort to strip Trump from ballots.

That does not mean that Democrats who value the weaponization of law will not continue to embrace lawfare warriors like New York Attorney General Letitia James (D).

Others will use the rage of these times as a license to ignore legal and ethical obligations altogether. They are arguably the saddest manifestation of our political discord. They are people who have not just lost faith in our system but in themselves. They have become untethered from any defining principle for their own conduct. This election has left them adrift in a sea of moral and legal relativism, with only their rage as a following wind. They cling to that rage as reason vanishes like a distant shore.

For the rest of us, there is work to be done as a nation committed to the rule of law. We cannot win at any cost when that cost is the very thing that defines us.

    So, with Mourning Joe’s and Mika’s pilgrimage to Mar-a-Lago, I wonder if we are seeing the beginnings of a different propaganda campaign against Trump, one with less “Trump is Hitler!” over-the-top hyperbole, and more subtlety? Because that clearly did not work. Because the Legacy Media can no longer operate in the dark. Alternative media has shown a light on them, and the main stream media has nearly zero credibility. If so, that re-marshalling should result in a change in the messaging from our resident blog trolls from the DNC.

          1. There are two POSSIBLE very small problems with the conduct of the OK sec. ed.

            First – we do not know the powers delegated to the OK Sec. Ed – so we do not know if he can mandate viewing.
            That has NOTHING to do with religion – just the powers of the OK dept education – regardless this would be a tempest in a teapot.

            The second is that SCOTUS’s line regarding school prayer is that while public officials can pray, they can not mandate prayer and they can not even ask for voluntary prayer,
            they can only make the opportunity for it.

          Government officials can pray publicly – for whatever they want including the success of a president or government – it occurs every day in congress.

          The thrust of the mandated video is informing OK schools students of their rights of religious freedom in OK – which is ALSO perfectly legal.

          There are TWO portions of the First amendment regarding religion – the FIRST is that government absolutely can not interfere in the PRACTICE of religion within the US.
          The second is that government absolutely can not advance the ESTABLISHMENT of any specific religion.

          There are some areas of interplay between those two requirements that SCOTUS has resolved.
          Those in government can pray. Students can pray. They can pray for pretty much whatever they want – including the success of government and leaders.
          But government can not MANDATE prayer. it can allow th e opportunity for prayer, but it can not suggest that oportunity is for prayer.

          I think SCOTUS got that wrong. But it is a relatively close issue.

          But you have NOT demonstrated that the OK sec ed is on the wrong side of that issue.

          SCOTUS has REPEATEDLY found that the establishment clause does NOT require that religion is barred from public life – mandating the absence of religion ALSO violates the establishment clause. The absence of religion is itself religion, and worse it is interference in the practice of religion.

          If this is your idea of some egregious conduct by those on the right or Trump supporters – you are a barkjing mad loon.

          Is this your idea of totalitarianism ? Of Fascism ?

          That you might be required to respect the religious freedoms of others ?

      The US congress as well as many states have long ago passed the Religious Freedom Restoration Act – which SCOTUS has established is constitutional.

      If the OK dept education Religious Freedom department turns into something that does the OPPOSITE of what its name, title and mandate say – then there is a huge issue.
      That has happened – but the NORM is that government agencies – particularly those run by republicans do exactly what they are mandated to do.

      Next, Just about ever major institutional function in the US begins with a prayer. Sometimes by a Rabbi, sometimes an immam, or any of the many religions represented in the US.
      This has REPEATEDLY been found constitutional.
      No the sec. ed of Oklahoma can not compel people to pray. It can not ask others to pray. But he can pray publicly.

      Cam the OK sec education make this video required viewing ?
      That seems to be squishier, and likely depends on the powers the OK law gives to the Dept Ed.

      Obviously the OK department of education can mandate somethings – that is why it exists – to dictate SOMETHINGS to local schools – otherwise what is the purpose of the Dept. of education ? We are likely to have just this debate at the federal level shortly – the US dept. Ed does NOT have any power over state and local schools – short of blackmailing them with federal money -and even their in Finding that the ACA was constitutional the supreme court majority also severely limited the federal government ability to use money to coerce states to do as it wants. The point is that the US department of education is impotent and expensive. The cost of public education in the US is several trillion dollars The US dept of education is a tiny portion of that. The few programs that it administers that are required by law can be transfered to other departments.

      There is not now, nor never has been a justification for the US department of education – it is outside the scope of the powers the constitution gives the federal govenrment and it is impotent and a waste of money.

      Comversely the power of a STATE department of education is determined by that STATES laws and constitution.

      I do not know the extents or constraints of the OK law and constitution on its state department of education.
      If the OK constitution delegates powers locally in the way the federal constitution delegates them to the states – then the OK dept of education is impotent and can not mandate anything. In my experience that is NOT how states function. As a rule all power within a state is vested by the state and SOME is delegated locally – to varying degres – different in different states. and even different within states. In my states SOME cities have SOME power to make their own laws, most do not.
      State laws and constitutions tend to dictate some kind of local state power sharing – with highly variable lines and scope.

      Can the OK dept of education require the viewing of a video ? I do not know. Can they require specific things like Phys. Ed. or Sex Ed. to be part of the curiculum ?
      I suspect so, and if they can, then they can require viewing a message by the OK dept Ed.

      The the OK AG says no – this can not be mandated.

      There is also the complexity that while public officials can pray. They can allow prayer. But SCOTUS is clear they can not even advocate for voluntary prayer.
      Depending on the exact words of the Sec. Ed. he may have crossed a line – if the video is mandatory and it encourages prayer. rather than allow it.

      In the end – this is all a tempest in a teapot.

      If the OK sec. ed has overstepped – that overeach is tiny.

      I would note that while the sec. ed can not mandate an opportunity for voluntary prayer,
      it is near certain he can mandate that Students be informed of THEIR rights to religious freedom.

    Mexico will only accept deportees if they are proven to be Mexican citizens. Mexico has sovereign rights just like the USA.
    The burden for proving that a deportee is Mexican falls on the US. Obviously the deportee can deny being a Mexican citizen, and can easily destroy any evidence of such citizenship in his possession. That leaves the US in the position of having to prove the deportee’s citizenship. Mexico has no reason to cooperate with proving the deportee’s citizenship.

    The scenario will play out as follows.
    Immigration agents will take a bunch of deportees to a border crossing and demand that Mexico accepts them.
    Mexico asks, “are they Mexican citizens?’
    Immigration agents say “Yes”.
    Mexico says “prove it”.

We can coerce the illegals (threats of force and/or cash, don’t really care), set it up so they are physically unable to return (barriers, armed squadrons, A-10 Warthogs, don’t really care) and thereby force Mexico to deal with the situation. That is pretty much what Mexico (at the behest of the Democrats) did to us. I don’t even care if some of those we force back into Mexico are Haitian, or ethnic Chinese for that matter, again, that would be their problem. If Mexico decides to incarcerate or otherwise “dispose” of any returnees whom they deem not to be citizens of Mexico, then that is on the Mexican government.

          There are THREE huge differences between US foreign policy under Biden and Trump

          First – Trump is most definitely not freindly to neocons – With Trump as president the US will not be seeking to create conflicts accross the world.
          And make no mistake – one way or another Biden CREATED the war in Ukrain and even the mess in Israel. I t may not be going as he had hoped,
          But that does not change the fact that he wanted conflict – even if different from what he got.

          TWO Trump is far more muscular in foreign policy. Trump WILL weild the tremendous ECONOMIC rather than military power of the US to get what he wants, and he will do so successfully. That may not make freinds of foreign leaders – but it does get things done.

          THREE Trump’s foreign policy is “America First”. Those of you on the left should listen to Putin who makes it perfectly clear that his decisions are driven by RUSSIA’s interests.
          All rational actors in the world act in their own interests. Self government depends on it, the economy depends on it. That is why communism and socialism do not work – they require people to place often vague undefined interests of others of the state above their own. Regardless. Trump acts in the US interests.
          This is also why he is successful in foreign policy, and why often that success benefits BOTH countries. Trust is critical in all deals and trust is easy when the party you negotiate with beleives the outcome was in their interests. Again something those on the left fdo not understand. No one in a free market enters into a deal a transaction unless they beleive they “win”. Winning is NOT besting the other party – nearly all free market transactions are win-win or they do not happen – they are voluntary people rarely choose to lose when they can do nothing.

    5. Why do you assume they will be deported to Mexico? They will be sent to their countries. They don’t have to accept them but then the US can stop all the aid $$ they receive (as they did last time Trump was the President) and then most of them will change their minds (as they did last time)

I would support excluding all foreign nationals in our nation illegally from receiving any social services or benefits including allowing their children to attend our schools.       Trump can then cut Mexico off from the billions in foreign aid they receive every year.

      Embargo ALL money transfers from America with an ultimate destination in Mexico, unless those money transfers are first done through a Trump regulatory body that confirms it isn’t untaxed income or the proceeds of crime.

      Cut off student visas to Mexican citizens to attend American colleges and universities.

      Tariffs on Mexican products.

      Announce sanctions on Mexican products to their other trading partners: trade with America or trade with Mexico – you won’t do both, so choose wisely.

    10. It doesn’t matter whether they’re Mexican citizens or not. If they came from Mexico, if Mexico deliberately allowed them to pass through and cross into our country, then Mexico has to take them back.

      If it refuses we have many ways to force it, up to and including capturing a beachhead on the Mexican side of the border and physically dumping them there, then retreating. Anyone on their side who shoots at us will be killed. We have the ability to do that, and if the president decides to do it then we have the right.

      Not that it’ll come to that, since there are many lesser ways of forcing Mexico to do whatever we demand.

      But isn;t that precisely what Trump is seeking to do – preclude those who can not prove they are citizens or otherwise have a right to be in the US from entering ?

      I would note that there is a massive amount of international politics involved in deportation – an I strongly suspect that Mexico will choose to accept people that Trump deports.

      But even if they do not – Deportations are typically one way trips to the country of a persons origin – not specifically mexico.

      I would further note that there is no loophole in US imigration law that says that if ICE can not establish beyond any doubt a persons country of origen they get to stay.

      They WILL be deported Somewhere. That may be their country of origen – oif that can be proven or if that country does not fight it.
      Or it could be any other country that the US government can persuade to take them – and Trump is SO persuasive that:

      Mexico is already sealing both its southern and northen borders,
      The EU is already buying more US LNG.
      Iran, Houthis, Hezbola, Hamas are already seeking to avoid Trump’s IRE.
      and on and on.

      Do you really think that you have found some giant loophole to bar deportation ?

      Illegal immigration from Mexico ended with NAFTA.

      The issue with Mexico is that it is the land conduit for illegal immigrants from other countries.

      And the socialist government of Mexico is sufficiently concerned that it has ALREADY sent troops to the US border to STOP illegals from crossing into the US from Mexico.

      The scenario will play out like this.

      Those seeking asylum – and Biden has encouraged ALL illegals to seek asylum – MUST claim a country they are seeking asylum from.
      They will be denied, and they will be returned to that country.

      If that country does not accept them or if the illegal fails to provide a country of origen and thereby disqualifies themself for asylum and sets up immediate deportation
      then they will be given a choice of a bunch of H311Holes to be sent back to, where there are governments that either accept them willingly or are unwilling to stand up to the US.

      Biden claims to have created 17M jobs in the past 4 years. almost 8M of those purportedly went to US born, almost 6 went to LEGAL foreign born.
      There have been between 11 and 21M illegal immigrants in the past 4 years. At most 3M of them have gotten jobs – atleast that we see in government stats.

      We KNOW BTW that despite left wing nut claims that while a bit more than 50% of farm workers are immigrants – that less than 1/4 of those – or less than 1 in 8 total are illegal immigrants, and many of those have been here since Obama was president.

      If the majority of illegals had jobs – they would not cost the Federal government alone $152B/yr. That does not count the 4B/yr it is costing NYC

      The fact that we are paying probably well over 200B nationally means these people are NOT mostly gainfully employed.
      The economy is not going to collapse without them.

      But that also means their not staying if the money is cut off.

In some states by law, and in some only by honor, but either way that is the only bond on them. The only thing the ballots determine is who is an elector, and that’s not always clear by the time they have to vote, so it’s completely in order for them to vote just in case they’re the real electors, and if they turn out not to be then their votes are irrelevant.
