
The decision of President Joe Biden to clear the federal death row has caused an uproar in some quarters and praise in others. There are good-faith arguments on both sides. However, there was a curious element to the Biden pardons for 37 people on death row. There were 40 people on death row. Three remain.
In making the announcement, President Biden declared that he had sympathy for the families of the victims:
“But guided by my conscience and my experience as a public defender, chairman of the Senate Judiciary Committee, vice-president, and now President, I am more convinced than ever that we must stop the use of the death penalty at the federal level. In good conscience, I cannot stand back and let a new administration resume executions that I halted.”
It was an odd statement because, for most of his career, Biden was an advocate of capital punishment. Indeed, in 1991, when Biden was still positioning himself for a run for the presidency, he condemned President George HW Bush’s Justice Department for being soft on crime and not sending enough people to death row: “He’s only four times a year put someone in prison for life and only once gotten the death penalty.”
Previously, Biden showed the same fervor in demanding the death penalty. In 1992, he bragged that his sponsored crime bill included new death penalty offenses and did “everything but hang people for jaywalking.”
Of course, Biden can claim that he has finally seen the light at the very end of his political career. Yet, his sweeping declaration does not match up with the scope of his commutations.
It will not stop the death penalty or prevent the executions on death row. Three remained: Dylann Roof, Dzhokhar Tsarnaev, and Robert Bowers.
It was vintage Biden: a sweeping claim of principles that ignores the exceptions. He is opposed to the death penalty and wants to stop it entirely, except for three of the most unpopular people scheduled for execution.
For the families, the distinction is a precious one. It includes
•Brandon Council who murdered two in a bank robbery.
• Edward Leon Fields, Jr. who stalked and killed an older couple camping in the Winding Stair Mountains in Oklahoma like game.
• Len Davis, a former New Orleans police officer, who killed a woman who filed a civil rights complaint against him. Davis was known as the “Desire Terrorist” who led a criminal gang that protected criminals and locked up innocent people.
• Brandon Basham and Chadrick Fulks who were sentenced to death after escaping from prison and kidnapping and killing 44-year-old Alice Donovan and 19-year-old Samantha Burns. Donovan was raped and Burns was never found.
• Marvin Charles Gabrion II who sexually assaulted and murdered Rachel Timmerman before the nineteen-year-old was scheduled to testify against him. She disappeared with her eleven-month-old baby, Shannon, who was also presumably murdered by Gabrion who threw Timmerman’s body into a lake.
• Daniel Troya and Ricardo Sanchez Jr. who killed a family of four, including two children aged four and three in West Palm Beach, Florida, in 2006.
The point is not that Biden’s current stance against the death penalty is manifestly wrong. Rather, these cases are also considered horrific. The question is the principled line of separation for Biden who stated a desire to end all executions but then exempted some death row inmates from his sweeping commutations.
It is classic Biden. Sweeping in its claim, but conflicted and qualified in its application. He wants to end executions except for a select few without explaining the principled basis for the distinction. Even in the final days of his presidency and political career, principle still seems awkward and incomplete for Biden.

Elevating rights of office not granted, acting as a judge of morality, if the decision had been to pardon all, then a claim of morality could have applied.
There is no rationale for sparing the exceptions except pure politics. These are people who are so famous and whose crimes were so publicized that most of us are aware of who they are and would be outraged to see their sentences commuted. Perhaps the Biden camp should have introduced legislation to amend the federal criminal code to end the death penalty “except for, you know, really, really bad people whose crimes are so well known that a lot of people would feel bad about if they were spared.”

Murders of Channon Christian and Christopher Newsom, Knoxville, TN, January 6, 2007
On Saturday, January 6, 2007, Christian and Newsom planned to go for dinner together and attend a friend’s party. That afternoon, Christian went to a friend’s apartment to get ready. At around 8:00 pm, Christian’s friend went to the party, and Christian stayed behind and waited for Newsom to pick her up. Newsom arrived, and he and Christian went to the apartment complex parking lot. The assailants observed Christian and Newsom standing close to Christian’s vehicle in an embrace. They then decided to attack the couple. Both were forced into the backseat of Christian’s SUV at gunpoint, had their hands tied behind their backs, and were taken to Davidson’s house at 2316 Chipman Street. Both Christian and Newsom were raped. Newsom is believed to have been raped inside Davidson’s house. According to the testimony of the Knox County Acting Medical Examiner, Newsom was sodomized with an object and raped by at least one of the perpetrators. He was then taken to a set of railroad tracks where he was forced to walk barefoot to the location where he was murdered. Prosecutors believe a mangled dog leash found on a hillside leading up to the railroad tracks was used to force Newsom to walk to his death. When Newsom was murdered, his hands were bound behind his back, and his feet were bound together. He was blindfolded with a bandana and gagged with a sock. He wore only a shirt and underwear. Newsom was shot in his neck and the back. Newsom survived this shooting initially, but later was shot again in the head. The fatal shot was fired with the gun’s muzzle against his head above his right ear, and it severed his brain stem. After killing Newsom, the assailants wrapped him in a comforter, poured gasoline on him, and set his body on fire. Christian was held prisoner inside Davidson’s house, mostly in the north bedroom. Prosecutors believe that Coleman held Christian captive while the male offenders were murdering Newsom. After murdering Newsom, the assailants returned to Davidson’s house where they beat and repeatedly raped Christian. The medical examiner testified that Christian died after hours of sexual torture, sustaining severe head injuries and suffering severe injuries to her vagina, anus, and mouth due to sexual assaults. Her injuries were consistent with being raped with an object. According to the medical examiner, the sexual attack Christian endured was “extreme” and “much more than a simple sexual assault.” Prosecutors believe that Christian was tied to a chair and orally raped by Davidson and Cobbins. Christian was also anally and vaginally raped. She was also beaten, kicked in her groin, and beaten on the head. Christian suffered extensive hemorrhaging to her head and groin. Additionally, Christian suffered bruises and carpet burns on much of her body. According to Davidson’s confession, during Christian’s captivity, she said she “didn’t want to die.” While Christian was still alive, in order to remove DNA evidence, Christian’s attackers poured bleach down her throat and scrubbed her body, including her bleeding and battered genital area, with bleach. Christian was bound in a hog-tied fashion with curtains and strips of bedding. Her face was tightly covered with a small trash bag, and her body was stashed in five large trash bags. Christian, who was naked except for her camisole and sweater, was tied in a fetal position, placed inside a residential waste disposal unit inside the kitchen of the home, and covered with sheets. The medical examiner testified at trial that there was evidence that Christian slowly suffocated to death. Christian died between the afternoon of January 7 and the afternoon of January 8. As Christian was suffocating to death, Davidson left to spend time with his girlfriend and gave her Christian’s personal items. Davidson also used Newsom’s cellphone and was seen wearing Newsom’s shoes.

Presently, I’m against capital punishment because a.) the obvious shortcomings/failings in the U.S. dept. of Justice (evidently, they can indict a ‘ham sandwich’.) and b.) death is too easy way out for some of these people.

My wife is a public defender and a criminal appellate lawyer. She is “death penalty qualified”.
Those cases are by far the WORST she has to deal with.
Oddly they do not usually involve the Worst offenses or the worst offenders.
The vast majority of the violent offenders she deals with are not good people, but are still “oversentenced”
But there are a small number of her clients that should absolutely never be in public again.
And there are a tiny percent that are so evil that the only acceptable punishment is death.
Oddly they are usually NOT the ones thatface the death penalty.

And defense lawyers and NGO’s that are civil rights purists will work together to make that as true as possible. The defense lawyers have an excuse: they are to mount the most zealous defense of their client by any means possible. There is nothing about “justice” in the defense lawyer job description: their client can tell them that they repeatedly gang raped a six month old child and they can offer a plea of “not guilty” if they believe that will best serve their client.
That is NOT the objective of the criminal justice system and prosecutors. Their main objective is to attempt to obtain justice – not the very best outcome for the accused.
One stealthy way for those who want police and prosecutors to suffer the emotional damage of further emotionally damaging victims’ families is by telling them that the monsters who did the crimes will live is this:
Work with defense lawyers to ensure you retard, corrupt, obstruct, and by any means available make it impossible for capitol punishment to be carried out in a predictable, uniform, timely manner where there would be a direct connection between committing the crime and sentence being carried out. Shoot for a delay in carrying out the sentence of about 20 years. Perhaps more!
After accomplishing that, THEN you can criticize capital punishment as a massive waste of money and destructive of our criminal justice system. Just don’t go into how much of that spending you created looking for every delay you could think of.
After all, somebody like President Biden might come along to commute capital punishment cases while they had that ability. Problem solved!
Also, NEVER make any mention of the second and third order effects of future money spent and the death and destruction from violent criminals who don’t see themselves facing potential capitol punishment the way an MS-13 gang member fears capitol punishment if he turns informant.

I support the existance of the death penalty. As Turley notes from the Becker work – incentives do have an effect on crime.
But I would reserve the death penalty for the most heinous offenses – several of those Turley noted that Biden commuted meet the criteria for the death penalty.
