Biden’s Curious Capital Punishment Stance is Vintage Biden

The decision of President Joe Biden to clear the federal death row has caused an uproar in some quarters and praise in others. There are good-faith arguments on both sides. However, there was a curious element to the Biden pardons for 37 people on death row. There were 40 people on death row. Three remain.

In making the announcement, President Biden declared that he had sympathy for the families of the victims:

“But guided by my conscience and my experience as a public defender, chairman of the Senate Judiciary Committee, vice-president, and now President, I am more convinced than ever that we must stop the use of the death penalty at the federal level. In good conscience, I cannot stand back and let a new administration resume executions that I halted.”

It was an odd statement because, for most of his career, Biden was an advocate of capital punishment. Indeed, in 1991, when Biden was still positioning himself for a run for the presidency, he condemned President George HW Bush’s Justice Department for being soft on crime and not sending enough people to death row: “He’s only four times a year put someone in prison for life and only once gotten the death penalty.”

Previously, Biden showed the same fervor in demanding the death penalty.  In 1992, he bragged that his sponsored crime bill included new death penalty offenses and did “everything but hang people for jaywalking.”

Of course, Biden can claim that he has finally seen the light at the very end of his political career. Yet, his sweeping declaration does not match up with the scope of his commutations.

It will not stop the death penalty or prevent the executions on death row. Three remained: Dylann Roof, Dzhokhar Tsarnaev, and Robert Bowers.

It was vintage Biden: a sweeping claim of principles that ignores the exceptions. He is opposed to the death penalty and wants to stop it entirely, except for three of the most unpopular people scheduled for execution.

For the families, the distinction is a precious one. It includes

•Brandon Council who murdered two in a bank robbery.

• Edward Leon Fields, Jr. who stalked and killed an older couple camping in the Winding Stair Mountains in Oklahoma like game.

• Len Davis, a former New Orleans police officer, who killed a woman who filed a civil rights complaint against him. Davis was known as the “Desire Terrorist” who led a criminal gang that protected criminals and locked up innocent people.

• Brandon Basham and Chadrick Fulks who were sentenced to death after escaping from prison and kidnapping and killing 44-year-old Alice Donovan and 19-year-old Samantha Burns. Donovan was raped and Burns was never found.

• Marvin Charles Gabrion II who sexually assaulted and murdered Rachel Timmerman before the nineteen-year-old was scheduled to testify against him. She disappeared with her eleven-month-old baby, Shannon, who was also presumably murdered by Gabrion who threw Timmerman’s body into a lake.

• Daniel Troya and Ricardo Sanchez Jr. who killed a family of four, including two children aged four and three in West Palm Beach, Florida, in 2006.

The point is not that Biden’s current stance against the death penalty is manifestly wrong. Rather, these cases are also considered horrific. The question is the principled line of separation for Biden who stated a desire to end all executions but then exempted some death row inmates from his sweeping commutations.

It is classic Biden. Sweeping in its claim, but conflicted and qualified in its application. He wants to end executions except for a select few without explaining the principled basis for the distinction. Even in the final days of his presidency and political career, principle still seems awkward and incomplete for Biden.

  1. The first sentence has it wrong! These commutations were not biden’s decision; he does not have the mental capacity to put 37 in one group and 3 in another or to author a press release. The puppeteers made the decisions and wrote the press release. And … it is nonsensical to claim that his “experience” as a public defender shaped the decisions. A short stint after finishing law school? How many murder cases during that time? I’m surprised he didn’t attribute the decisions, specifically, to the rosary in his pocket. Maybe doing these awful deeds is what has gotten him his audience with Francis? The press release excuse is just another lie by biden.

People and governments need to stay in their lanes and embrace the principle of ‘live and let live.’ The rise of anti-Semitism is alarming and often met with indifference.     A reading of the report makes you sick to your stomach. The report says Gaetz “violated House Rules, state and federal laws, and other standards of conduct prohibiting prostitution, statutory rape, illicit drug use, acceptance of impermissible gifts, the provision of special favors and privileges, and obstruction of Congress. And Gaetz “took advantage of the economic vulnerability of young women to lure them into sexual activity for which they received an average of a few hundred dollars after each encounter…”. Never in the history of the House have we seen such an indictment of a sitting member of the House.

    Yet, this is the person DJT wanted to inflict on the American people as the chief law enforcement official! And it was apparently Elon Musk that recommended Gaetz to DJT. In an early post Musk said this: “Matt Gaetz has 3 critical assets that are needed for the AG role: a big brain, a spine of steel and an axe to grind. He is the Judge Dredd America needs…” For Musk moral depravity is not a disqualifying factor for those that will serve in the Musk/DJT administration!

      1. This part of Alford’s story doesn’t really add anything to what we already know about Kennedy. Nor does it really change my opinion of the 35th president. But this part does:

        Dave Powers was sitting poolside while the President and I swam lazy circles around each other, splashing playfully.         I would be surprised if Bondi never used illegal drugs. Trump is apparently a TeeTotaler – not even alcohol. But I would be shocked if Biden did not use druges, Obama has admitted that he did, as has Harris, and Clinton. Bush likely did, certainly family members did.

        If we rule out illegal drug use – we would have no one in public office.

    5. He is no longer a politician. He has not had his day in court. This is little to do about nothing in the political arena. It is a hit job.

      This has been in the news recently – and as a result – for those who actually bother to check things out, the reasons that the DOJ did not go after Gaetz have come to the surface.

      First, DOJ investigated lots of this and found that significant claims were demonstrably false.

      Gaetz claims not to have had says with the woman who was “underage” – regardless, no one has claimed that any sex Gaetz had was not consensual.
      And the underage woman had procured and used a false ID form a left wing source that may have been trying to setup Gaetz, Regardless, False ID’s are a crime and it is not possible to have criminal intent when you are deceived into beleiving that the alleged victim was not underage.
      That of course presumes the event even took place.

      As to the rest of the claims – are you saying that two people who are seeking a relationship must go dutch on everything ?
      If you want to try to make a sex for money claim – probably you should have an actual prostitute or escort, paying for plane tickets for a girlfriend is not soliciting, it is not illegal.

      Further, most of the sources for these claims are NOT the women in question, or NOT women who are prepared to testify to any of this under oath or even to make these claims in public. Gaetz (like Hegsoth) has made it clear that anyone making false public claims about him will face defamation lawsuits.

      Regardless, lets presume that what is in the report is True.

      So what you have is Gaetz a single young straight man having consensual sex with other consenting adults – with ONE case in which the person in question not only lied about their age but produced counterfeit documentation to support that.

      It is pretty evidence why DOJ did not try to prosecute.

      What DON’T you have – allegations of sexual assault, allegations of sexual harrassment.
      You do not even have allegations of infidelity or adultery.

      Put simply – if EVERYTHING you claim is true, Gaetz conduct is legal and LESS immoral than that of FDR, JFK, RFK, Clinton, and Biden – it is even less immoral that what you claim Trump and Hegsoth have done.

      Finally – lots of us are wondering – why Given that the House under Pelosi paid out over 100M in settlements for sexual harrassement and sexual assult claims by members of the house (of both parties). Why THIS report must be leaked to the public ?

      Why are you not making public the reports of other members of the house that have sexually harrassed, or Raped people ?

      This is exactly what it looks like – a hit on Gaetz, because he is a maverick who has pissed off important people in both parties.

      It is my understanding that Gaetz is now angling for an appointment as a Special Counsel to investigate the payoffs over allegations of sexual misconduct that took place under Pelosi.

      If you beleive EVERYTHING in it – Gaetz does not even reach the level of “one day in the life of Hunter Biden”.

      The core to this is that Gaetz appears to have had alot of consensual sex and bragged about it, as well as using illegal drugs – like unperscribed viagra.

      This does not even reach the level of the PROVEN allegations against Se. Al Franken. Who took a picture of himself groping the breasts of an uncounscious women that he had no intimate relationship with.

      You do know that pretty much everything in this report has been run in the news repeatedly before – except the spin.

      First – much of this is STILL allegation not FACT. In most instances the women involved will not testify under oath and would not even make these claims publicly.
      Why ? Because lies under oath are a crime, and lies in public are perjury and Gaetz has tolld all the supposed people involved that they are free to tell the truth but if they lie about him – he will go after them for Defamation.

      And that is why there are no statements under oath or in public.

      That alone should have killed this – and it is alteast part of why DOJ did not prosecute.

      Presuming that Gaetz actually had sex with the 17 year old – a claim that has been arround for over a year, but that still has NOT been substantiated.
      What HAS been substantiated is that the woman in question had a counterfeit ID that she used on multiple occasions – not just with Gaetz.

      As to the rest – young women are not vulnerable because they agreed to consensual sex. That is just spin. And Wow, Gaetz, took them to diner, paid for Travel, paid other expenses.
      That is called DATING.

      As I said before Pelosi had the house pay out over $100M in settlements over sexual assualt, ad sexual harrassment claims against members of the house.

      Where is the report on that ?

      Are you actually trying to claim that a Congressmen who had consensual sex with several women and gave them gifts, is much more serious than many congressmen who engaged in workplace sexual harrassment or sexual assault ?

      So what we have is the house releasing an ethics report – that Gaetz and his lawyers were not allowed to participate in that says that a single congressment dated young women and gave them gifts

      But absolutely nothing on congressmen who raped, sexually assaulted or sexually harrassed women ?

      You can not be both a prostitute and a “vulnerable young women”.

      Conversely if these women were NOT prostitutes – then they were DATES and what we have is the House Ethics committee investigating the consensual sex life of a political enemy.

      This is the house ethics committee – there is a reason these investigations are secret.

      Like police investigations – they are not under oath, there is no right of the accused to present their case or cross examine,

      To be clear – all this is fine. But just as we do not release anything from the police unless there is a trial in which case ONLY those things that are sworn under oath and otherwise admissible are made public,

      We do not make police investigations public to protect the innocent.

      But it was just as immoral to do so, as to make public information from any other police investigation that does not resulit in indictment or trial.

  6. Hammurabi’s Code was the codification of an ancient Mesopotamian legal system that predates 2,000 BC. It contained principles that are still followed in American courtrooms such as innocent until proven guilty. The code mandates, for example, that in order to find someone guilty of a crime, evidence needs to be gathered and proof established, The code expressed the principle of reciprocal justice, measure for measure. This code of reciprocal justice, measure for measure, predates the writing of the Hebrew Bible and “an eye for an eye” as a commandment found in the Book of Exodus 21:23–27.

    Ancient Saxon/Germanic law began with the justice system of bot and wergilt. Basically, the criminal paid the price of the harm they cased to their victim. In an example such as one of those Biden just pardoned, an animal who raped and tortured a woman and her 12 year old daughter for three days out in the woods before butchering them, the wergilt would have been suffering at the very least execution, and quite possibly a similar death. Criminologists generally believe it was a rough but effective system of justice as far as deterrence and eliminating recidivism for other crimes went.

    These were effective justice systems and predated numerous criminal justice systems today, including American, Canadian, and British.

    Fast forward to a century ago, and capitol punishment for deliberate murderers, child rapists, traitors, etc was a punishment where the convicted had recourse to appeals – BUT they didn’t get two or three decades to string those appeals out before sentence was carried out.

    Capitol punishment, with the sentence being carried out in a relevant time frame to when the crime was committed was an effective deterrent. And recidivism was nonexistent.

    We are now at a point where capitol punishment MIGHT be carried out perhaps within 15 years or so of when the sentence was pronounced (which might be several years after the actual offense). The execution of death row convict last week was for a conviction back in 2007 for a heinous murder.

    There is unlikely to be a deterrent effect when you mangle the criminal justice system similar to “defund the police” to delay carrying out the sentence to the point where the nation cannot see an immediate cause and effect between crime and carrying out the sentence.

    Now those who have brought the justice system to where capitol punishment is a dead letter tell us that they have now proven it is ineffective, horribly expensive, a waste of resources, and thus should be abolished.

    “Better a guilty man go free than an innocent man should hang” is an absurdity, whatever the crime and the sentence. The cost of sparing that innocent man ignores the creation of many future victims and costs through recidivism on the part of the guilty set free and those who commit crimes because they were not concerned about the possibility of the sentence.

      1. It is indeed the case that mental competence is not one of the qualifications listed in the constitution, and the courts have found repeatedly that no one can add to that list. ANYONE who is a natural born citizen, over the age of 35, and has lived in the USA for 14 years, can be elected president. If the people elect someone with a mental age of 10, that’s their business.

    3. First of all, Hur did NOT find that Biden is incompetent, but that he can convincingly play the incompetent, and would probably do so to a DC jury that was in any case inclined to be sympathetic to him and looking for an excuse to acquit him.

      Second, he is clearly not incompetent at all times. We’ve seen him perform well on occasion, probably immediately after a nap. A recent report says that he has good days and bad ones. Given that, there would seem to be no way to prove that he was incompetent at the time he made the pardons. The only one who would have standing to challenge them would be Trump, and the onus of proof would be on him; I don’t see how he could possibly meet that onus.

  9. @Dennis McIntyre: Jonathan: Among western democracies the US is the only one that still has the death penalty. In a civilized society the death penalty has no place. That’s because vengeance does not solve the problem of deadly violence.

    If you grounded your five year old child a year after you discovered whatever it was they had done, would you then claim: “no civilized society allows parents to ground their children – it doesn’t solve the problem and is nothing but vengeance!”?

    First Democrat neo-communists (that Dennis trolls here on behalf of) break something like immigration enforcement or criminal sentencing, and then they say it didn’t work and was inhumane anyways.

    The only thing missing in Dennis’s Democrat Moralizing is any mention whatsoever of not just the victims of these monsters and the manner in how they were butchered – but their surviving family, friends, coworkers, etc. Democrats like Dennis only have empathy for Joe Biden, Hunter Biden, MS-13, Crips, Venezuelan drug cartels… the usual suspects.

    Why would any rational adult believe any sanction for offenses would work when they aren’t predictable, consistent, and applied in a timely manner after the offense was committed? Carrying out capital punishment 20 years later on a violent thug whose violent lifestyle predicted he probably wouldn’t live to see age 50 is a deterrent?

    Every heartless allegedly superior socialist who makes that claim takes great pains to mention that one subset the countries of the world has found that the death penalty is a powerful deterrent to it’s members committing offenses that would result in the death penalty. That would be criminal gangs.

    So while Mexico as mentioned here has abolished the death penalty, Mexican drug cartels have found it such a powerful deterrent to it’s members violating the cartel laws that it is almost impossible for police to get a member to turn informant.

    Ditto for outlaw biker gangs. Again, they will go to prison for long prison sentences rather than face the gang’s capitol punishment.

    Same for the Russian gangs here and Canada up north which was also mentioned.

    BTW, while the original Trudeau did abolish capitol punishment back in 1976, Dennis lied by omission by not telling you that when he did his “research”, he found that the Canadian population favors a return of capitol punishment. Just like Americans here are opposed to importing tens of millions of Illegal Alien criminals as our government does exactly that.

    These are the retards that never consider that when you allow appeal after appeal, motion after motion, and the longest delaying tactics as possible, when an execution actually DOES take place 20 years later… yeah, maybe it doesn’t work as a deterrent! Imagine that!

      The meaning of the death penalty was lost with atheism. It’s sending the killers to a place they belong.

      “Deterrents” are for those who cannot be educated but can be trained. Most likely shock treatments can work just as well. Sort of a dog collar approach.

      Then there’s malformation of the amygdala preventing a development of conscience. They can be trained, also.

      It’s difficult to imagine what kind of mind those killers have. Joe felt empathetic. Bizarre.
