In an age of advocacy journalism, April Ryan has long been a standout. Ryan routinely engaged in diatribes in White House press conferences during the Trump Administration and has openly opposed all things Republican or conservative. Now, the MSNBC contributor and Grio White House correspondent has declared that President Joe Biden was a “standard-bearer for what the Founding Fathers put in place.” The reason? His much-criticized and partisan veto of The Judges Act. While even stalwart Biden allies like Delaware Sen. Chris Coons criticized the President for vetoing the badly needed, bipartisan measure to add new judges, Ryan declared it the work of a modern George Washington.
When the MSNBC host noted that The Judges Act “had bipartisan support” and was needed to relieve the overloaded courts, Ryan responded by saying that an obstructionist partisan move is precisely what the Framers would have wanted:
“It’s simple this President Joe Biden, didn’t want to give President-elect Donald Trump a chance to add more conservatism into our courts, bottom line. I mean, you have so many people talking about how everything is weighed down right now. The White House on January 20th at noon will be Republican, the House, the Senate, what? Republican and the Supreme Court leans Republican. So this president wanted to ensure checks and balances.
…He is the standard bearer for what the Founding Fathers put in place. He wants to make sure everything goes well. And think about this, even though it wasn’t a federal judgeship, think about what happened with Merrick Garland. Think about the fact that Merrick Garland never got a chance to even have interviews with some senators because they rebuffed, they did not want to have a Democrat on the U.S. Supreme Court. In some ways this is that as well, this is trying to hold the line, to make sure once again that fairness and equal play and checks and balances are in place.”
Ryan mixes rationales of avoiding adding conservative judges to retaliation for prior votes as a noble cause that harkens back to the founding.
Of course, as discussed in The Indispensable Right, some like John Adams used the Alien and Sedition Acts to arrest their political opponents, but few point to that as the gold standard for the Founders. Ironically, I have previously drawn comparisons between Biden and Adams.
Other Founders like Washington did not even support the creation of political parties, let alone endorse raw partisan moves by presidents. Indeed, Biden became the very thing that Washington wanted to avoid in saying that political partisanship:
“may now and then answer popular ends…by which cunning, ambitious, and unprincipled men will be enabled to subvert the power of the people and to usurp for themselves the reins of government…”
The move by Biden is a disgrace. Our courts are overwhelmed by dockets that leave parties without any resolution for years. In 2004, the number of cases in district court pending for more than three years was 18,280. This year, there are 81,617.
If justice delayed is justice denied, our court system is becoming a tar pit of injustice, with litigants left without verdicts or relief for years.
Every responsible and independent group in the area supported this bill as essential to supporting and maintaining our legal system. The White House did not oppose the bill until Democrats lost the election. (Some Republicans also withheld their support until after the election).
Before the election, both Democrats and Republicans supported the bill in an all-too-rare moment of bipartisanship. Biden then vetoed it because he did not want a Republican to appoint new judges (even though the new judgeships would be added over a ten-year period).
In vetoing the act, Biden once again shredded any claim to being a president who could put the public interest ahead of petty political interests. It ends his presidency on a cynical, obstructionist note.
Nevertheless, Ryan and others on the far left are applauding the act as just what they want to see in a president.
It is one thing to discard any sense of integrity or responsibility, but do us a favor: leave the Founders out of it.

Sure, they would have added the judges over a ten year span – but the insensate potato currently occupying the oval office doesn’t know that – or what he was signing, assuming he actually signed anything.
He signed a veto and Turley and Republicans are upset about it because it robs them of the opportunity to appoint more conservative judges. Now Democrats are not supportive of the legislation and Republicans with their tiny majority cannot pass it without help from Democrats. So they can hold off on it until the elections for congress in two years.

For more than 20 years leaders of both parties have ignored AG Ashcroft’s “Cointelpro On Steroids”. Ashcroft created the environment to restore J. Edgar Hoover’s war crimes program – justified by insurrectionists and the Vietnam War. The textbook definition of a war crime.
This is a consequence of the design of political parties themselves. Any political party is focused (by design) on “popular” issues with the voters. The Judicial Branch (courts) were designed to resolve “unpopular” issues that the average voter has no concern, morality or ethics.

In 1919, the vast majority of voters (all men) had no interest in allowing women to vote or supported equal rights for women. Neither Republicans nor Democrats cared about women’s rights. Those rights were led and won by “plaintiffs” in the non-partisan courts (Judicial Branch).
The crisis today is we have too many partisan political judges, that never corrected AG Ashcroft’s “Cointelpro On Steroids” – a potentially much more lethal program than J. Edgar Hoovers due to modern computer technology.
Where is the U.S. Supreme Court in correcting AG Ashcroft’s gross abuses of power (what a federal appeals court ruled denouncing Ashcroft’s abuses of power). This requires making Ashcroft’s war crime victims whole again.

In response to Biden’s veto of this bipartisan JUDGES bill, the new Republican-majority House and new Republican-majority Senate should pass a bill in the new Congress that creates the new judgeships and that allows the new President to appoint all the new judges immediately and not over 10 years. Case closed, and thank you very much.
Those “majorities” are super slim, so passing much legislation is gonna be a struggle. In the House, the Republicans are just one seat ahead. Plus, they’re probably gonna need Democratic support most of the time over the next couple of years. It really depends on how chaotic Trump gets once he’s in office, too. Right now, there’s gonna be a big fight among Republicans over who becomes the next speaker. If they can’t figure it out, the January 6 certification could be delayed by a few days.

They need 60 votes in the Senate. To get Dems on board they would likely need to keep the 10-year period. Even with that, they may not get enough. I suspect “Biden” vetoed this because of concerns that Vance will be elected after Trump, possibly for two terms. Dems in the Senate may share these concerns.
Daniel, Anonymous below offers a practical suggestion. Alternatively, in two years, Congress might return to a centrist stance and pass such a bill. However, given how often the Democrats have disregarded established norms and standards of conduct, it might be time to respond in kind while simultaneously enacting anticipatory legislation that ensures progress in a positive direction.
The Senate passed the bill back in August, giving the House ample time to approve it before the election. Democrats were on board with the legislation when they anticipated a Harris victory. However, Republicans intentionally delayed action until after the election, fully aware that they didn’t want Biden making liberal federal judge appointments. They were holding out for Trump to take that role. This critical detail is what Turley conveniently omitted from his so-called criticism.
Once Democrats lost the White House, the situation shifted. It no longer made sense for the legislation to move forward, so Biden exercised his prerogative to veto the bill. This is precisely the kind of maneuver Mitch McConnell would have made. Was it partisan? Absolutely. Was it illegal? Not in the slightest.
Biden recognized that Republicans were stalling the vote until after the election, rather than addressing it months earlier. The blame for the current predicament rests squarely on the Republicans. Biden acted within his rights, and yes, it was partisan. A Republican president would have done exactly the same thing. That’s the truth that Turley refuses to acknowledge; he would have defended such a move instead of criticizing it.

In the body of the Fox article that Professor Turley linked to, Chris Coons blames the outcome on House Republicans waiting to take up the bill until after the elections.
Turley overlooked a crucial detail: the legislation was passed back in August. House Republicans did not take any action on it until after the election, when they felt confident that Trump would be in office. Rep. Jim Jordan was questioned about this a few days ago and essentially admitted that they delayed the legislation until after the election, despite having the opportunity to vote on it beforehand. Their strategy was to avoid passing it while Biden was in office, as that would allow him to appoint more liberal judges.
Republicans would have kept existing vacancies open until after the election to enable Trump to appoint more conservative judges. This is why they chose not to vote on the legislation before Trump took office; they didn’t want Biden to make those appointments. Biden vetoed the bill specifically because Republicans were not genuinely concerned about the backlog; their primary focus was on appointing conservative judges. So, who is really stacking the courts, Professor Turley?

Republicans are aware of their limited options, which is why Turley is voicing his discontent with the veto; he understands the challenges the party faces in addressing it.
And Biden is “fully within his rights” to pardon his son and commute the sentences of death row inmates. It doesn’t make it right.

My views are about as far from a “double standard” as you can get.

But I am less fearful of left wing nut censors than Turley is,
Because for a large variety of reasons censorship HARMS those who engage in it.
It is frustrating to the rest of us and censorship does harm to people who do not deserve it.
But the greatest harm is to the censors.
There is a danger to censorship – but the danger is that as it fails, sometimes it is the extreme voices that gain power during the collapse.
Censorship ENHANCES the credibility of censored views. When people KNOW they are being censored they tend to attribute truth to all censored positions – especially because the views that are allowed expressed lose credibility do to the failure that always comes with inability to self correct and adjust and improve from criticism.
The problem is that as an example those opposed to unrestricted immigration gain credibility from being censored, but so do actual racists.
Censorship is one of the causes of Trump’s victory, but rather than Trump – the left COULD have caused an Actual fascist to gain power.

The likely consequence will be a new bill in January passed by a Republican house and Republican senate and signed by Trump that will expand the judiciary and allow Trump to appoint ALL the new judges.
This was just a stupid move by Biden.

Correct, but the same bill can pass in January and Trump will not veto it.

They hold the largest majority one party has had in the senate in decades. Further several Democrats including bothe Sanders and Fetterman have promised to work with Trump where there is common ground. This was a bipartisan bill – there is common ground. Beyond Fetterman and even Sanders numberous senate democrats who won by the skin of their teeth by emphasizing their cooperation with Trump in the past, will now be expected to cooperate with Trump.
There are some things that Trump and Republicans will have difficulty with, but far less than you imagine.

Republicans can pass anything that is primarily fiscal. Democrats have already interpreted reconciliation broadly.
The big problem with reconciliation is that the non-fiscal part of a reconcilliation bill must expire in 10 years.

Whether you like it or not Republicans have a GREAT deal of power in January just not completely unfettered power.
There is alot that Trump can accomplish unilaterally.
The emergency funding the CR just gave to FEMA can be used to “build the wall” – SCOTUS already ruled on that in Trump’s first term.
Trump was able to substatially decrease illegal immigration in his first term with an ICE/CBP budget smaller than right now.
Further he can declare the situation at the border an emergency and reallocate emergency funds – like the FEMA emergency funds to support illegal immigratns to be used to deport illegal immigrants. Regardless if he slows the border down to a couple of hundred thousand at most, and deports the 1.4M/yr that were done in the peak year under Obama, that would be 6M deportations by 2028.
Democrats may be difficult about SOME government cuts that Trump wants – but the american people have spoken, even democrats – lots of democrats are behind reducing government spending.
There is another vehicle that Trump can try to reduce spending – that is to just not spend the money. Nixon tried that and was shot down, But SCOTUS only stopped Nixon on the details, The general principle that presidents are not obligated to spend everything budgeted has not been tested in the supreme court and was commonplace before Nixon.
This supreme court may limit Trump’s ability to not spend money, but they are not going to require him to spend everything.
The power to significantly cut regulations is also within exectutive powers. There is going to be a fight early on regarding this.
The CRA allows congress to with a simple majority vote undo any biden regulations passed since August.
Worse still if Congress votes them down something substantially similar can NEVER be enacted by the executive again.
Trump can also get rid of pretty much any regulations he wants – but he must follow the APA, and that takes about 6months to get rid of a regulation solely through executive action and nothing precludes the next president from bringing it back.
I would note that the current CR fight was really a test of Johnson’s ability to control house republicans. Trump is going to have more problems in the house than with the filibuster in the senate.
Republicans in the house can probably get 200 votes for just about any spending cuts. But it takes approx 217 votes to actually pass a bill i the house.
Republicans were able to get 2 house democrats to vote for spending cuts. But they lost about 20 house republicans – not because they opposed cuts, but because the cuts were not deep enough.
That is Trump’s big problem – not the Fillibuster, the 30 or so house republicans who are extreme ultra MAGA and see a once in a lifetime opportunity to make HUGE changes.
Trump is going to make BIG changes – but not near as big as they want.
For the most part I support those that want draconian cuts to government. We need Milei type of change to the federal government.
But the perfect is still the enemy of the good enough.

Ryan sounds like another reason to avoid MSNBC. I used to watch MSNBC a little in the morning while getting ready for work, but stopped about 10 years ago. I had only started watching it because of it’s proximity to CNBC, which I continue to watch along with other business channels, but MSNBC stopped being worthwhile to me.

That was my first thought. In that eventuality, the Democrat’s rearguard action will be the filibuster. The Democrats enthusiastically floated the idea of dumping the filibuster. Now they’ll be shameless defenders of it!
After the new Congress convenes, I would suggest having a vote to end the filibuster right after votes to fund the judges and to fund the wall. “Democrat Obstructionism” would make for an interesting debate on ending the filibuster. Showcasing the Democrats’ absolute hypocrisy would also be popcorn worthy. Alternative media would have a field day with this.
The Democrats are constantly over reaching to their own peril… think of the Trump advance with three Supreme Court Justices!
Attempting to thwart new Judges plays right into Trumps hands (thankfully) as he can simply create a new non-partisan opportunity to increase conservative, constitutional Judges!
The ACLU, Southern Poverty and DNC have shopped Judges, often knowing the Soros implants is a free ride around the law!
The problem they always have is they have no relationship with logic or common sense!
Taking away guns or blocking free speech or killing babies in live birth situations… even welcoming a massive influx of Latinos to create a replacement dependent voting block to replace the Black dependent voting block!
Latinos are definitely not monolithic, but more importantly, they are largely religious and more often Catholic, therefore they are more likely to vote for Trump!

Last night at Dinner, eldest daughter of a neighbor came to the table with her customized water bottle….made noticeable drawings from it in a manner to display the stickers on it….one emblazoned saying “Protect Gay Babies!”. She is a graduate of UNC Chapel Hill and has two Master’s Degrees neither of which provide her any kind of employment but she has living off government down to a science. Her efforts to provoke a discussion of politics were foiled with her Mom having clearly stated that would not be the done thing under her roof. Thus, that daughter entertained herself by studiously attending to her cell phone the entire evening. The other daughter was a joy to talk with who is very successful in her life’s endeavors and maintains an excellent relationship with her boyfriend soon to be husband….he just just does not see that coming yet.
