There is an interesting defamation case out of New York in which the Second Circuit upheld the dismissal of the lawsuit by Louis Farrakhan and the Nation of Islam (NOI) against the Anti-Defamation League (“ADL”) and individual defendants Jonathan Greenblatt, the Simon Wiesenthal Center, and Rabbi Abraham Cooper. Not only did the court reject the claim that canceled speeches resulted from alleged defamatory statements, but it also noted that the statements about NOI are protected opinions.
In Farrakhan v. Anti-Defamation League, Judges Susan L. Carney, Joseph F. Bianco, and William J. Nardini upheld the lower court’s dismissal of what they described as Farrakhan’s “sprawling allegations.”
District Court Judge Denise Cote (S.D.N.Y.) first dismissed the case, noting that it was based on a publication that quoted Farrakhan at length. She also noted that, after quoting Farrakhan, the ADL post titled “Farrakhan Predicts Another Holocaust” was clearly an opinion piece. The so-called “Ticketmaster Letter” ended with the hyperlinked statement that “[y]ou can learn more about Louis Farrakhan and the Nation of Islam on our website.”
The actual quotes from Farrakhan made this action doubly difficult:
“A Jewish man said to me, ‘You know, we say never again. Never again will we be in the oven. Never again.’ I said, ‘Hold it.’ You can say that to men, but you can’t say that to God. Because the Bible says, behold the day cometh that shall burn — as a what? —as an oven. And those who do wickedly, He will slay them and leave them neither root nor branch…The War of Armageddon is to decide who will live on this earth.”
“I’m saying to the Jews: if you want salvation, if you want to get back into the paradise of God, come with the Messiah, that’s your ticket. Some of you have already recognized your brother as that. But that’s an invitation to them to break them apart from those who are about to be destroyed. God is not unjust; when he kills you, you know you deserved it.”
The Second Circuit rejected the causal effect of the publication in leading to Farrakhan being blocked on two speech platforms run by third parties — Morgan State University and Vimeo. It found that the claims were mere speculation on the underlying nexus.
It also found no concrete injury from acts like ADL-supported creation of the “U.S. National Strategy [t]o Counter Antisemitism.”
The panel, however, then held that the objections to Farrakhan as pushing anti-Semitic views were protected statements of opinion. The court ruled that whether Farrakhan and the NOI are anti-Semitic is a statement incapable of being proven true or false. It is left to the judgment of the reader and the perceived meaning of the quoted statements themselves.

Jesus was a so called “Jew.” Jesus preached the Old Testament and to obey its laws. The ADL’s “opinion” of Minister Farrakhan cannot be proven right or wrong, therefore, it’s not defamatory? While the court got it right – we need to end all this defamation lawfare, at the same time – though private sites are free to exclude NOI, we would all be better off if they were critised rather than censored.
Further while I have very serious problems with NOI, at the same time they have turned many peoples lives around.
I am surprised that Farrakhan does not sue the Southern Poverty Law Center. They are really down on him, and the whole Nation of Islam. Personally, I think it will take a strong Black man, a Black Hitler, if you will, to correct the downward trajectory of African Americans in the country. It won’t be nice, and it won’t be pretty, but white people are not able to fix what is horrible and rotten in the black community. White people theoretically can end welfare, which would only address a small part of the problem, as the problem exists in 2024. But that fix should have happened in the early 70’s, before the black “community” went completely to pot.
White people theoretically could end the offshoring of jobs, bring back factories to the USA, and end the illegal immigration problem in a big way. That would provide jobs for black Americans. And, we could end all affirmative action programs, and many of the anti-discrimination laws, which I think have ended up doing as much harm as good, and maybe even more harm than good, by removing incentives to excel. But that would have to come with some Bad Boy White Attitude, openly saying “We are fed up, and tired of your black crap! We are sick of your stupid excuses. You want to get into a university? Then get off the basketball courts, and do your damn homework. You want to have illegitimate kids? Fine, then YOU pay for their food. You pay for their rent. You want to sell drugs. Fine, then we will begin executing drug dealers, just like they do in Singapore. Black, white, brown, Asian, native-American – it don’t matter – we are going to execute every one we catch, even if the number is in the millions.

They begin chasing black women out of their housing units, and make them walk their kids to school. They begin massive protests at trashy black shows, where trashy people sing trashy songs, and dance in nasty ways. They begin beating the crap out of the saggy-pants boys, and twerking girls. They set up their own black schools, where the kids either behave and do their homework, or get the crap beat out of them. And no more passing a grade by getting one year older. And their mothers get a beat down, too. And when these chicks get pregnant out of wedlock – shotgun marriage time. They set up their own construction companies, where unemployed black men start cleaning up their own neighborhoods, and renovating torn up houses. Race hustlers like Joy Reid and Al Sharpton would be chased out of the community at the point of a gun, or worse. Pretty soon, you would have an actual, functioning Black “community” again. With black businesses and shops. White people could safely shop there, and eat there, and their money would be welcome.
That scenario would have a lot better chance of working – a strong black patriarchy, as opposed to the current black matriarchy.

I have always been curious as to where, and by whom is the line drawn between freedom of speech and that ill-conceived hate-speech legislation. You either have the right of free speech or you don’t. I do wish the SCOTUS would look into this censorship by government fiat.
There IS no “censorship by government fiat”. There is no such thing as “hate-speech legislation”.
Please remember, when the founders made free speech a reality for citizens, that speech came with consequences. You had to back up what you said, there were duels, azz whoopings, canings, etc. that came with running your yapper.
