The controversy began in 1967 when the Tennessee Valley Authority started constructing a dam on the Little Tennessee River, roughly 20 miles outside Knoxville. Environmentalists and locals opposed the project and, in 1973, a zoologist at the University of Tennessee named David Etnier went snorkeling with his students and found a possible solution. He spotted a small fish and called it a “snail darter” because of its movements and eating habits. He reportedly announced “Here’s a little fish that might save your farm.”
Dr. Zygmunt Plater, an environmental law professor at Boston College, represented the snail darter before the Supreme Court. He did an excellent job and, in 1978, the Supreme Court ruled that “the Endangered Species Act prohibits impoundment of the Little Tennessee River by the Tellico Dam” to protect the endangered snail darters.
That was then.
The Times now quotes Thomas Near, the curator of ichthyology at the Yale Peabody Museum who leads a fish biology lab at the university, that “there is, technically, no snail darter.” Worse yet, it was actually just another member of the eastern population of Percina uranidea, or stargazing darters, which is not considered endangered.
Near and his colleagues have published the results in Current Biology
In other words, years of litigation and millions of dollars were spent on what was a false claim, and the courts accepted the claims hook, line, and sinker.
Under the ESA, the snail darter was listed as protected and therefore triggered Section 7 of the Act barring federal agencies from undertaking actions that could jeopardize a species’ survival or destroy any of its critical habitat.
In Tennessee Valley Auth. v. Hill, 437 U.S. 153 (1978), Chief Justice Warren Burger noted that the finding of this “previously unknown species of perch” changed everything on a legal level. He added:
“Until recently, the finding of a new species of animal life would hardly generate a cause celebre. This is particularly so in the case of darters, of which there are approximately 130 known species, 8 to 10 of these having been identified only in the last five years. The moving force behind the snail darter’s sudden fame came some four months after its discovery, when the Congress passed the Endangered Species Act of 1973 (Act), 87 Stat. 884, 16 U.S.C. § 1531 et seq. (1976 ed.).”
Plater insisted that Dr. Near is merely a “lumper” who tends to rely on genetics rather than being a “splitter” who proliferates new species. Dr. Plater added that “whether he intends it or not, lumping is a great way to cut back on the Endangered Species Act.”
That was a particularly revealing point from the law professor since it suggests what could be an overwhelming motive could be legal and not scientific in declaring the new species — the very objection raised in the litigation and denied by many advocates.
Roughly three years ago, the government declared victory in restoring the snail darter and the Fish and Wildlife Service proposed removing it from the ESA list of threatened species.

Jonathan: The snail darter controversy has been a thorn in the side of the GOP ever since 1967. What you ignore is that the legislation to allow the completion of the Tellico Dam was signed by Jimmy Carter, the President who was honored today.
Since that controversy the GOP has wanted to abolish the ESA or severely restrict its mandate. During the first DJT administration there were attempts to weaken the ESA. But the ESA survived. Now, under DJT’s Project 2025 he has a more ambitious plan. The term “climate change” will be stripped from all federal documents. The ESA and the Inflation Reduction Act, the biggest plan by Biden to cut carbon pollution, are on the chopping block. This could result in 2.7 billion metric tons of more carbon to get into the atmosphere.
Project 2025 also calls for eliminating the National Weather Service and making it private. That means in an approaching hurricane or a wildfire you will have to pay for weather updates. Project 2025 is all about wiping out federal funding and oversight of government efforts to protect the environment, ensure clean water and air–and to prevent the extinction of important native species. In the last 50 years, we have lost 60% of all wild animals on the planet. For over 40 years the ESA has been incredibly successful in protecting imperiled species.
I doubt DJT voters have bothered to read the over 900 page Project 2025. If they had I doubt they would have approved of the draconian plans DJT has for his second administration. DJT wants to throw out the wash with the bath water. And in your attacks on the ESA it appears you back DJT’s plans to dismantle agencies and laws that exist to protect the environment and counter the worst aspects of climate change. That’s lamentable for someone who likes to hike and enjoy the outdoors–and all that it offers–thanks to the ESA!

Many years ago I worked in forest management, a ‘brush ape’, cutting brush and doing controlled burns and it was easy to see that if these people in California didn’t do the same they were going to have some hellacious fires. And now they do.
All the wild fires I worked on were caused by lightening but many of the fires in LA are started by ‘homeless’ [we used to call them bums and vagrants] and California has turned ‘homelessness’ into a lucrative industry. Billions are spent on it and the more they spend the more they get and the more organizations devoted to increasing the supply of the homeless…and their fires in the piles of untended brush and fuel they set on fire on a regular basis.

The NEJM arrived in my inbox today, and the above opinion piece is over the top and histrionic politicization. Yes, patients should take vaccines most of the times. They should also lose weight, exercise, have monogamous relationships, meditate/pray, eat nutritious meals, cease addictive behaviors and more. I’ve been telling my patients for decades to lose weight. A small percentage have done so. Although they suffered medically and succumbed to early death for not heeding my advice, there was no need to lament loudly, beat my chest nor wail. My conscience is clean. People make their own choices.
Like the snail darter “scientist”, insipid scientific promulgations endure. Brow beating patients doesn’t work when it comes to weight loss, nor will it work in recommending vaccines. Frankly having an obese body imperils all obese patients; vaccines however not so much.

I had the pleasure of canoeing down the Little T (Little Tennessee river) before the Tellico dam was completed and the valley was flooded. Upstream from where we put in near the outflow of the Lake Chilhowee dam, Alcoa had constructed a number of power generating dams with impoundment lakes going west to east through much of the Appalachians into North Carolina – all of which are quite scenic. The remaining free stretch of the Little T meandered through mostly lonely and quite lovely sublime pastoral lands to a junction with the Tennessee river. One of the primary reasons given for the need for the Tellico dam was to protect Chattanooga, which up to that time was one of the most vulnerable cities to floods, from seasonal flooding of the Tennessee river particularly in areas of well known flood plains. The basic conflict was drawn between TVA with its economic development and flood control mandates and mindset versus the free river crowd augmented by the Cherokees not wanting to inundate old village grounds near the historic British colonial Ft Loudon sited along the banks of the Little T. It was widely understood that the discovery of the “endangered” snail darter was merely a tactic used in this conflict. No one, on either side, really cared or had any use for the snail darter, except perhaps the good professor who discovered it. Even after the courts concluded that the Endangered Species Act prevailed, the Tellico dam was completed as planned through an amendment to the act signed by Jimmy Carter. Although it is difficult to counter the Bentam type “greater good” argument for the dam, I am saddened that we have forever lost a bit of America by inundating this beautiful valley.
As you mentioned, there were multiple dams upstream, and there were already two main river dams downstream of the Little T confluence, so I’m not buying the Chattanooga flooding reason. And the increase in power generation through one more dam was negligible. I am truly thankful for most of what TVA did overall. The damage of Hurricane Helene basically stopped at Douglas Dam. But Tellico was simply a project pushed for no reason other than the perpetuation of TVA. It was one of the last big projects, but like the uncompleted Columbia dam and multiple uncompleted nuclear sites, it was simply a bad decision. In addition to the loss of river valley, what still infuriates me to this day is the thousands of acres TVA took that was not actually needed for construction of the dam or reservoir that was then “sold” to developers.

Most of this year’s disasters are naturally occurring events and are understood to be a risk to the population and their infrastructure. Two resent examples: the torrent of rain from a hurricane and the swelling of drainage channels causing overflowing banks and modification of drainage channels. The current event of a raging fire in a metropolitan complex is really beyond belief.
I use those two examples to say: “How could any government allow these events to become disasters”. The point of the prodigal son parable is that God is always ready to forgive our sins, and that those who haven’t sinned will receive their reward as will those who repent and change their ways. The same message is in the parable about the man who hired men to work in his vineyard–he gave a full days’ wages to each of them, those hired last received the same as those who had put in a full days’ work. The owner of the vineyard explained that they weren’t getting cheated–that those who worked the full day received the wages that they had agreed to, and that if he is generous to those who did less work, that wasn’t taking anything away from those who worked all day.

I was in my 20s, working with cardiothoracic surgeons in the Operating Room (OR) at the Univ of Florida, one of whom, the chief, was a former Lutheran minister. (I later attended medical school at UF until my near fatal head injury forced me to withdraw.) When I arrived to the OR the morning after Carter’s speech, it was then I learned that the Gainesville Sun, the local Gainesville, FL paper, covered Carter’s speech and that they had quoted my question to Carter, and characaterized me as a hostile questioner. As I entered the OR suite, masked, about to be gloved to assist at the table, everyone stopped talking b/c the Chief was about to say something. Most of the surgical technicians / scrub techs, were black ladies, all Gospel, Bible believing, and they had always treated me well when working with them at the OR table, knowing my background. It was the white liberals in the OR, the OR nurses, some scrub techs, female medical residents, that took umbrage with my question. One scrub tech in particular, one of the more talented ones, white liberal attractive young woman, decided to argue the Carter point in the OR hallway in front of everyone. I was taken aback by her aggressiveness and naturally I pushed back just as hard. She and I had worked together and we worked well.
The gist, in those days, for pro-aborts was “viability”. Thus she argued that the baby in-utero was not viable. By then there was a significant number of OR personnel in the hallway witnessing the exchange between this attractive popular scrub tech and me. These were individuals who were not working in an OR suite at that moment so that they had time to kill. I scoffed at the “viability” argument. I told her it was lame and dishonest, which seemed to get her going as well as some people watching in the hallway, particularly the female residents (surgical and anesthesia residents). When their furor reached fever pitch, I stated matter of factly, “if viability is your metric, then across the nation, all Opertating Rooms and all Emergency Departments should be closed. None of the people who come to us under emergent circumstances are viable. Trauma patients are not viable without our intervention. Thus, you are willing to let people die who sustained a gunshot wound, a lethal knife wound, a vehicular accident, because without our intervention they would die, meaning they are not viable”

Perhaps my point is that, if Jimmy Carter truly was a committed Christian who attempted to live the life of his faith as a Christian, he didn’t have much fear of knowing that there would be a moment where he would have to stand before his Christian God and justify that life he lived of deliberate vicious Anti-Semitism – while at the same time he was defending and embracing murderous Islamic Arab terrorists.

This put the country into a recession. The Cure was painful and not instant. We all want quick fixes. But in reality when you have screwed up for decades, it takes a few years to clean the slate. Following Volkers advice, combined with mishandling Iran not only cost Carter re-election – but did so dramatically, and Carter KNEW that was a risk when he agreed to Volkers austerity program.
Reagan gets credit for the turn arround of the economy in the 80’s that lead to the “great moderation – a period of sustained stable growth that continued through until the housing bubble burst – ANOTHER example of bad keynesian policies followed for decades destroying the economy.
Reagan absolutely deserves credit for continuing Carters/Volkers austerity measures. He could have stopped, He would have ended the recession and had a successful presidency.
He likely would not have lost congress in 1982. But we would not have had the 30 year period of economic growth and stability that followed.
But it is Carter that took the bigger gamble – he defied the conventional wisdom of the worlds leading economists without knowing that what was being done would work and while he won for the american people he lost personally and politically – that is a profile in courage.

As noted Obama and Trump were very friendly at the funeral. It is BTW extremely common for ex-presidents VPs and other significant US leaders to be friends, sometimes close freinds. I do not know what the relationship between Jill Biden and Trump is but they have been seen in very freindly conversations at several public events. The Personal vitriole that the Pelosi’s and Hillary have for political enemies is the exception not the rule.
