On Tuesday, President Donald Trump stated that the roughly 1500 pardons and commutations for J6 defendants issued Monday night are not the final resolution of cases. The President indicated that some commutations may be converted into full pardons. What is now clear is that the executive action includes violent offenders. That is wrong regardless of any excesses in the handling of these cases.
Many of us have previously stated that any executive relief should not extend to violent offenders, particularly those who attacked police officers. Among those was Vice President J.D. Vance who said “If you committed violence on that day, obviously you shouldn’t be pardoned.” However, that advice appears to have been discarded in the issuance of these pardons and commutations, including members of extreme groups like the Proud Boys.
In my book, The Indispensable Right, I explored the J6 cases and what some of us view as the excesses of the Justice Department in the treatment of many defendants. That included sentences and conditions that contravened free speech as well as terms that seemed driven by the promise to carry out a campaign of “shock and awe.” (While the book calls for the elimination of sedition-based crimes (which include seditious conspiracy charges used in a small number of J6 cases), that is a matter for Congress.
Nevertheless, the book stressed that violent offenders and groups involved in the attacks warranted severe punishment. When Trump campaigned on granting pardons, many of us believed that such action should not extend to such figures. January 6th was a desecration of our constitutional process. Those who attacked officers and engaged in violence were justifiably hit with heavy penalties.
The prosecutors originally charged roughly a third of the cases with violence against officers. Even when you remove the violent cases, the majority of cases still included hundreds of prosecutions without violent elements. If there were to be pardons and commutations, those cases should have been the focus.
Instead, this action extended to violent cases. This included Isreal James Easterday, who received 30 months for pepper spraying an officer. It also included Daniel Joseph “DJ” Rodriguez, who was sentenced to 151 months for not only calling for violence before the riot but then attacking an officer.
It also included Thomas Andrew Casselman, who was sentenced to 40 months for pepper spraying an officer and Curtis Davis who was sentenced to 24 months for punching officers.
There are clearly others.
President Trump clearly ran on this pledge, though it was not clear what the scope of the relief would be. There were many citizens who wanted to see closure. However, polls also showed that voters routinely drew a line at those who engaged in violence.
Supporters point to the fact that both Presidents Jimmy Carter and Bill Clinton pardoned figures who attacked the Capitol. However, that is no justification for this relief. Even if you believe that relief is warranted, it should not extend to those who attacked officers. Moreover, to convert commutations to full pardons for these cases would only compound the wrong. These officers fought to defend the Capitol and the constitutional process. Those who attacked them warranted convictions and punishment.

Before she died, she had already committed multiple crimes on his behalf. Capitol Police Officer Byrd were sworn to serve and protect Congress against people like Babbitt. When she started through the window, she forced his hand–and lost her life as a result.
The sad truth is that Babbitt died for nothing because MAGA media still lies, Trump still lies, and there is serious reason to believe that she may not be the last person to die for Donald J. Trump–who never did, and still doesn’t accept any blame whatsoever for her death. Just like the crimes he committed and got away with by lies spread by billionaires who own MAGA media, Trump’s army of Proud Boys, 3 Percenters, Oath Keepers and others got away with committing crimes on his behalf, and they are still standing by.

I’ve come to think that the DC bar should be dissolved and the DC courts closed or scattered. The only court required by the Constitution is the Supreme Court. All other federal courts are created by Congress. Once appointed federal judges serve for life but there is no guarantee that they will have a courthouse in Washington. It’s not mere whimsy that led Jack Smith to try to consolidate Trump cases in Washington. He knew Trump wouldn’t get a fair trial there. He was counting on it.

The J6 prosecution was tainted by politics (and controversy about the event itself such as who instigated it). The Congressional investigation into the incident was irregular and illegally destroyed all of their evidence. The whole thing is tainted beyond repair.
Therefor, all of the J6 political prisoners should be pardoned and released to restore faith that we have a government by and for the people. Do it right, or do not do it at all.
Bottom line is these PATRIOTS are free. Violence begets violence, the federal government incited violence against a legally assembled protest. They had operatives embedded in the crowd to incite and entrap. Like I have said, Stolen corrupt elections have consequences.
While the actions of violent police officers can not and should not be overlooked and should prosecuted to the full extent of the law, on the other hand, for the J6 offenders who were violent and jailed, the executive order/pardon should not have extended to those who did the actual violence.
Isn’t it true that Biden’s pardons, those pardoned from death row, were not released but instead received life in prison? That would mean the violent offender has more time to think of the harm they caused to move around and more freely amongst other prisoners until their death instead of solitary confinement, whereas Trump’s pardon meant those who committed violent crimes are free to walk amongst everyone else in the free population of the United States. That is a difference and they most certainly should not have been freed.

An argument that Trump’s pardons were MANDATORY – an excerpt”
The issuance of a pardon imputes guilt and acceptance of one, which is voluntary, confesses guilt (Burdick .v. United States, 1915.) The reason you must voluntarily accept a pardon is that once pardoned you cannot assert 5th Amendment protections as the risk of criminal sanction has been removed. Thus you must accept it voluntarily in that you are giving up Constitutional Rights, but in doing so you also confess to the truth of the offense(s) in question.
There is no means to expunge a federal offense. Once convicted the only way to remove it from your record is to prevail on appeal in which case the offense itself is voided. Many states have a process for expungement, which is a formal and legal removal of a conviction; no such thing exists for federal crimes.
A pardon does not erase an offense — that is, the offense of “parading” or whatever have you that a person was convicted of from Jan 6 is not “gone”, however, it is undisputed, because Biden pardoned all of the Jan 6 committee members, that the government and members of Congress obstructed justice which was used to deny said persons a fair trial. That issuance of the pardon by Joe Biden imputed said guilt and the acceptance thereof confessed to same by the committee members.
That doesn’t make the actions of those who paraded (or stole and destroyed, for that matter) into “not occurred.” They did take those actions, and they were charged or convicted as the case may be. But the trials were not fair as justice was obstructed so whether the original sentences were reasonable (or whether, for example, probation or a modest fine under misdemeanor penalties was a more-appropriate penalty in the case of someone who’s crime was mere presence in the Capitol building) was never lawfully and fairly adjudicated.
Trump’s pardons and commutations thus might objectively be considered “wrong” except for Biden’s action on the way out of office, in which he pardoned obstruction of justice, witness tampering and willful destruction of evidence by persons who led to those prosecutions, all of which were part and parcel of the original charges and trials and due to the acceptance of Biden’s pardons by those committee members is in fact a confession of guilt to those federal offenses.
As a direct result Biden’s preemptive pardons make the Jan 6 pardons by Trump not only objectively reasonable they became, at the moment Biden issued them, mandatory.
One can’t believe justice should be served on an even-handed basis and yet a prosecutor who deliberately destroys evidence gets to keep the penalties imposed on those adjudicated guilty under that circumstance after the persons who destroyed the evidence and committed obstruction of said discovery confess to their offenses — and prior to Trump signing those pardons they did!

There was no proof that any of them committed any crimes, especially members of Congress who investigated Trump’s crimes on January 6th. The anarchist took over here in Seattle. Six square block. AR 15’s. 12 people were murdered during the true insurrection. However, we didn’t really hear of any trials. We also had numerous riots in the streets where hundreds of police officers were hurt. The same in Portland. For a month, they tried to burn down a federal courthouse with police inside.
The party of the J6 political prisoners was above board and correct. There’s still so it should be pardon though. Jeremy Brown, a Green Beret was not involved in any of this. His crime was when the FBI came to talk him into being a informant for him during the Trump rally, he refused to do it and released the videotape taken by his Ring door camera of the FBI talking to him about it.
Conveniently later, they decided to rate his home with no probable cause other than he refused to be a part of their game. They found two short bell rifles and two hand grenades. However, when the DNA testing was done on the hand grenades, there was zero DNA from anywhere in his house. They also charge him with holding classified documents. Then it was discovered that what they were calling a classified document was a template he used to be able to fill out the information later on a secure computer. It contained zero classified information. He was convicted on that, though by a jury and convicted of having two grenades which Kat zero DNA or fingerprints from him.
I mean because cops like Lila Morris seen on video beating an unconscious woman laying on the ground are definitely a credit to the uniform and the law the swear to uphold. Same with those 5-6 officers seen on video beating a defenseless man laying on his stomach. Or the one who shoved an old lady with her hands up down the stairs and countless others who knowingly engaged in wrong doing that day.
The message here is that violence and disregard for the law are acceptable as long as you wear an LEO uniform.

Professor Turley, you are wrong. The civil rights of every single J6 defendant, including those few who may have engaged in some sort type violence. The entire investigative and prosecutorial process in the case of every single J6 defendant was corrupted the criminal DOJ, and as I pointed out in my comment in your previous story about the J6 pardons, some of that violence against rotten cops may very well have been justified.
You can’t overlook the criminal behavior of the cops that day, and the totally corrupt DOJ’s illegal methods in prosecuting these cases, and just carte blanche condemn those J6res without a careful case-by-case analysis.
I think we need to see exactly what a given action is regarding a given individual. Did the guy who got 2 1/2 yrs for pepper spraying a cop serve the time and is now being pardoned, or has he served a portion of the 30 months and is now having the sentence commuted? Same for the guy who got 12 1/2 yrs. Exactly what did he do to warrant the sentence and how much of it has he served? Like many of this flurry of EO’s the devil will be in the details —- to coin a phrase.
