Universities Announce Plans to Defy Federal Immigration Enforcement

With the election of Donald Trump, the federal government and both local and educational authorities are on a collision course over immigration policies. Many states and cities have reaffirmed that they will oppose any deportation efforts, including another recent chest-pounding interview by Illinois Gov. J.B. Pritzker. It is likely that the federal government will squeeze federal funding for sanctuary states and cities, though such efforts can trigger “commandeering” and other legal challenges. Universities may be in a more precarious position, but some like the Los Rios Community College District in California are doubling down on plans to oppose any federal enforcement efforts.

Various university and college presidents have reaffirmed their support for undocumented students and staff, including most recently Fordham University President Tania Tetlow. However, the Los Rios Community College District seems to have laid out a more concrete plan to oppose federal enforcement, a plan that was referenced in a January 28 email.

The District covers American River College, Cosumnes River College, Folsom Lake College, and Sacramento City College.

The email states that “[t]here have been reports all over the country of increased immigration raids in association with Executive Orders tied to immigration enforcement.” It seeks to address the “[f]ear … widespread throughout the undocumented and ally communities about their safety and the safety of their families and loved ones.”

Just after Trump’s election, Los Rios published a “Compact in Support of Undocumented and DACA Students and Employees,” including the possible concealment of immigration status.

Here are the eight commitments:

Los Rios will do everything in its power to fight for the rights of our immigrant and undocumented students and employees and will always do everything possible to uphold the values of our institutions.

Los Rios stands with state and local leaders who have pledged to do everything possible to defend the rights and protections of immigrant and undocumented Californians.

Los Rios commits to advocating for a permanent legislative solution to the Deferred Action for Childhood Arrivals (DACA) and a pathway to citizenship for our immigrant communities.

Los Rios will immediately provide additional resources to our Undocumented Resource Centers.

The Los Rios Police reaffirms its commitment to not participate in immigration-related activities, including arresting and/or detaining students, consistent with organizational values and state law.

Los Rios will protect students’ rights and confidentiality and will not share the immigration status of students or employees.

Los Rios, its colleges, and partners will do a full review of internal policies and regulations to ensure that we are doing everything possible to protect the rights of students and employees.

The Los Rios Colleges Foundation will create Dream Center Funds with resources for each college, administered by the Undocumented Resource Center on each campus. The Foundation will encourage other community members, employees, and private and corporate funders to give support to undocumented students to help remove critical barriers to their success, such as paying for DACA renewal fees, legal fees, purchasing laptops, and additional resources.

Number 6 is particularly interesting in promising an active role to conceal or withhold immigration status information.

We have been down this road before. Schools previously fought this battle over efforts to bar military recruiters. While I have been a vocal supporter of gay rights on many fronts, I was one of those who opposed the litigation that my law school joined. At the time, I stated that it was not only a clear loser on the law but also represented a type of hypocrisy: We insist that we cannot allow discrimination, but if money is at stake, we will allow it.

In Rumsfeld v. Forum for Academic and Institutional Rights, Inc., 547 U.S. 47 (2006), the Supreme Court unanimously ruled that the federal government, under the Solomon Amendment, could constitutionally withhold funding from universities if they barred military recruiters from interviewing students.  The Solomon Amendment denied federal funding to an institution of higher education that “has a policy or practice … that either prohibits, or in effect prevents” the military “from gaining access to campuses, or access to students … on campuses, for purposes of military recruiting in a manner that is at least equal in quality and scope to the access to campuses and to students that is provided to any other employer.” 10 U. S. C. A. §983(b) (Supp. 2005).

It is easier to limit funds for universities, but it can still raise constitutional problems from free speech to associational rights.

In Rumsfeld v. FAIR, Chief Justice John Roberts noted that such laws could run afoul of the unconstitutional conditions doctrine “if Congress could not directly require universities to provide military recruiters equal access to their students.”  He then added:

 “This case does not require us to determine when a condition placed on university funding goes beyond the ‘reasonable’ choice offered in Grove City and becomes an unconstitutional condition. It is clear that a funding condition cannot be unconstitutional if it could be constitutionally imposed directly. See Speiser v. Randall, 357 U. S. 513, 526 (1958). Because the First Amendment would not prevent Congress from directly imposing the Solomon Amendment’s access requirement, the statute does not place an unconstitutional condition on the receipt of federal funds.

The Solomon Amendment neither limits what law schools may say nor requires them to say anything. Law schools remain free under the statute to express whatever views they may have on the military’s congressionally mandated employment policy, all the while retaining eligibility for federal funds. See Tr. of Oral Arg. 25 (Solicitor General acknowledging that law schools “could put signs on the bulletin board next to the door, they could engage in speech, they could help organize student protests”). As a general matter, the Solomon Amendment regulates conduct, not speech. It affects what law schools must do—afford equal access to military recruiters—not what they may or may not say.”

The coming challenges could raise the question left open in Rumsfeld v. FAIR. However, the question is whether universities, particularly state institutions, want to go down this road of confrontation rather than cooperation.

  1. Hillsdale College does not accept any federal aide – not directly, not indirectly.

    As a result it is free to set its policies however it chooses, like any other totally private entity.

    I fully support any private college whether on the left or the right that wishes to forego federal aide to do so.

    When they do so they are then exempt from any of the Federal constraints that are placed on federal aide.

    Trump breifly imposed a blanket pause of federal funding – excluding assitance to individuals – such as social security and medicare – and though not mentioned by name that also included Medicaide.

    What REALLY needs to be done is as much federal subsidies as possible need to be eliminated or phased out – including Student aide.

    We KNOW that the cost of education and the cost of medical care has increased lockstep with Federal funding.
    Medicare, Medicaid, and Student loans are just federal giveaways to colleges, Healthcare and Health insurance.

    English intended to kill “‘Nazi’ Secretary of Defense, Peter Hegseth, and/or the Speaker of the House, Mike Johnson, and/or burning down the Heritage Foundation,” the affidavit stated. “These actions were specifically to ‘depose’ these political offices and send a message.” After stopping in a library in Chevy Chase, Maryland, en route to the capital, English changed his mind about who to target upon learning about Bessent’s confirmation.

We shall see how they stand up when funding is frozen or cut. While I certainly understand DACA and even understand their views on undocumented students, I also understand these are people without legal status. They do not belong here and if they followed the procedures, they would have status and a leg to stand upon.

    When it comes to putting their money where their mouth is, it will be interesting to see where they stand. I am betting with the money.

They enhance national security by making sure the country has essential industries in case the supplying country becomes hostile.

The problem now is that we have exported almost all of our manufacturing overseas so tariffs would prove problematic at first until manufacturing returns.   8. Jonathan: Illinois Gov. Pritzker has made it clear that he supports the removal and deportation of immigrants who commit crimes. What the Governor “finds disturbing, is that they’re [ICE] going after people who are law-abiding, who are people who are holding down jobs. who have families here, who may have been here for a decade or two decades , and they’re often our neighbors and our friends”.

    It’s pretty clear that states can’t be compelled to work with ICE to deport the undocumented. Enforcing immigration laws is the sole responsibility of the federal government. (See 10th Amendment and Arizona v. US, 567US387(2012)). But DJT’s “border czar” Tom Homan is all outraged that “sanctuary cities”, like Chicago, are making it difficult for him to do his job because immigrants are “educated” about their rights. That’s because Chicago Mayor Brandon Johnson and immigrant rights groups have informed immigrants that if they are visited by ICE they do not have to open the door unless presented with a valid warrant signed by a judge.

    Now DJT and Tom Homan want to deny federal aid if cities don’t cooperate with ICE in deporting the undocumented. DJT tried this during his first administration. This involved California where sanctuary cites refused to cooperate. A federal judge ruled DJT’s order was unconstitutional. One of his first EOs this time around was to try do the same thing. It’s an form of extortion and states with sanctuary will no doubt fight DJT’s orders in the courts.

    As to the Los Rios Community College District in California they are doing what sanctuary cities have decided to do–to protect the legal rights of students and employees. No. 6 of the Los Rios “Compact” provides that “Los Rios will protect students’ rights and confidentiality and will not share immigration status of students or employees”. This position conforms with FERPA, “a federal law that prohibits schools from disclosing personally identifiable information in a student’s educational records to a third party without the consent of the student”…etc. Los Rios position also conforms with California state laws the ensure the privacy of student or employee records. I doubt a federal judge will compel Los Rios to violate both federal and state law because ICE wants to conduct a fishing expedition of all student or employee records to ferret out some one who may be undocumented!

WHY would you believe, even before the bodies have all been recovered, that the FAA controllers were not qualified or were “dumbed down” AND that this is the responsible cause for this collision? I saw an interview with a retired FAA controller who said that to work at DCA you had to have: 1. additional special training over and above the usual training for air traffic controllers; 2. considerable successful experience as an air traffic controller at other airports. This is because of all of the air traffic at DCA and the surrounding areas–2 military installations that constantly fly helicopters on intersecting paths with the approaches to DCA runways, BWI, Dulles, and Andrews AFB. There has been criticism for years about expanding traffic into DCA because of all of the traffic and near-misses.

        And, I’d like to know exactly how far Trump can go with his lies and politicization before even you MAGAs are offended. Trump actually tried to blame Obama–if something Obama did or failed to do created danger, why didn’t Trump fix it when he was in office? He tried to blame Biden–based on what facts? Is it OK with you MAGAs that Trump trades on the loss of life to play politics over a tragedy like this even before even the dead have been collected, the black boxes have been secured and the wreckage inspected? And, it’s clear what happened–a military helicopter hit the rear of the American Eagle plane that was on its final approach to runway 33. The air traffic controller asked the military pilot whether he saw the plane, and he was probably confused, thinking it was the plane that had taken off from runway 1, that had already climbed above the altitude of the helicopter. The fact that Trump would use this tragic event as an opening to criticize DEI, without any facts whatsoever, ought to give any reasonable person pause to think about the implications of such a despicable thing to do.

                When Jesus spoke about moral behavior, he was addressing what private individuals should do in their private interactions with other private individuals, such as turn the other cheek. He was not saying anything at all about the responsibility of governments to protect their citizens. So, for example, after the bombing of Pearl Harbor, the US government was not required to say: here you go, Japanese, bomb New York harbor too, we won’t stop you. That would be ridiculous.

                The first responsibility of government is to enforce the laws and protect its citizens, which are two sides of the same coin. By analogy, a parent who does not provide for those in his household “has denied the faith and is worse than an unbeliever” (1 Tim. 5:8). The government’s protective responsibility toward its own citizens includes protecting them from illegal invaders, whether in an army or individuals.

    Now they can’t interfere or even talk w them.
    However if they came across one… they’d have to sit on it and call in a supervisor to come and monitor the situation.

    So its one thing to do nothing and to let ICE do their jobs.

    Its another to willfully obstruct ICE, which is illegal.

    Now if you read the actual announcement, they, the universities, pledge to do whatever they can within their power to legally aid their ‘undocumented’ students and staff. (BTW DACA members are afforded some legal protections …)
    So either the universities are blowing smoke, or they intend to obstruct.

    If they obstruct, they can and should lose federal funding.
    Those obstructing should be charged for their crime(s). [depending on what they actually end up doing. ]

    1. It has been explained, over and over again, that there is NO right to bail–it is at the discretion of the trial judge. Also explained to you, over and over again, is that many of Trump’s army of insurrectionists had criminal records, some were violating terms of probation, some had active arrest warrants or were out on bail under the condition that they not commit further crimes.       1. The biggest issue I have with modern jurisprudence is the reliance on precedent. Just because a prior ruling exists doesn’t mean they ruling was made on Constitutional grounds.

        As you say, the Constitution is plainly worded and is the law of the land, not the way a judge ruled prior.
