The United States Court of Appeals for the Fifth Circuit has issued a major ruling on the Second Amendment, declaring that federal prohibitions on gun sales to adults between the ages of 18-20 are unconstitutional. The case is Reese v. ATF. For gun rights advocates, it may have been better if this decision had been handed down during the Biden Administration. The Trump Administration will likely support the ruling and might not appeal to the Supreme Court.
The case concerns 18 U.S.C. §§ 922(b)(1) and (c)(1), and related regulations, including 27 C.F.R. §§ 478.99(b), 478.124(a), and 478.96(b). These provisions are the basis for the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to bar Federal Firearms Licensees (FFLs) from selling or delivering handguns to adults under the age of twenty-one.
Writing for the panel (with Judge Jennifer Walker Elrod, a George W. Bush appointee. and Judge Rhesa Hawkins Barksdale, a George H.W. Bush appointee), Judge Edith Hollan Jones relied on the 2022 decision in New York State Rifle & Pistol Association, Inc. v. Bruen to find that the prohibition was not grounded in the historical tradition of the amendment:
Ultimately, the text of the Second Amendment includes eighteen-to-twenty-year-old individuals among “the people” whose right to keep and bear arms is protected. The federal government has presented scant evidence that eighteen-to-twenty-year-olds’ firearm rights during the founding-era were restricted in a similar manner to the contemporary federal handgun purchase ban, and its 19th century evidence “cannot provide much insight into the meaning of the Second Amendment when it contradicts earlier evidence.
…In sum…[statues which ‘prohibit Federal Firearms Licensees]…from selling or delivering handguns to adults under the age of twenty-one. and their attendant regulations are unconstitutional in light of our Nation’s historic tradition of firearm regulation.”
The decision reverses the ruling of Judge Robert Rees Summerhays of the United States District Court for the Western District of Louisiana, a Trump appointee.
The case involved some interesting historical arguments about how some states set the age for the militia at 21 rather than 18. The effort to ground the provisions in a historical context proved unavailing since most states set the age at 18.
“The government’s theory inverts historical analysis by relying principally on mid-to-late-19th century statutes (most enacted after Reconstruction) that restricted firearm ownership based on age. Then the government works backward to assert that these laws are consistent with founding-era analogues focusing on the minority status and general “irresponsibility” of eighteen-to-twenty-year-olds.”
Instead, the court found ample support for the right of young adults to bear arms:
“[C]ontrary to the government’s recitation of concerns expressed in the colonial and founding eras about the “irresponsibility” of those under twenty-one, these young individuals were expected to keep the peace rather than disturb it. In addition to serving in the militia, eighteen-to-twenty-year-olds could be obliged to join the posse comitatus, for which the minimum age was often fifteen or sixteen, and bring “such arms or weapons as they have or can provide”…Before the emergence of standing police forces, the posse comitatus was made up of civilians who accompanied sheriffs or other officials in pursuit of fugitives. … In early colonial America, the posse was “transformed . . . from an instrument of royal prerogative to an institution of local self-governance” that “all but precipitated the American Revolution.” Citizens could be called to “execute arrests, level public nuisances, and keep the peace;” they faced fines or imprisonment if they refused. Instead of refusing to arm young Americans for fear of their irresponsibility, founding-era regulations required them to be armed to secure public safety.”
Everytown for Gun Safety, a gun control group associated with former New York mayor Mike Bloomberg, called upon the Trump Administration to appeal the decision: “We hope the federal government will fight this reckless ruling by seeking rehearing en banc, or taking the case directly to the Supreme Court.” There is an argument for the Solicitor General to defend the federal law as a matter of course. However, the ruling is consistent with the views of many in the Administration.
Had this decision come down under the Biden Administration, an appeal would likely have been taken and this could have strongly reinforced the Court’s Second Amendment jurisprudence. Success at the Supreme Court would have extended this precedent nationally. Of course, there is always the unknown of how Chief Justice John Roberts would react to such limits. Roberts has previously signaled his willingness to entertain reasonable limits.
The case, however, will add persuasive authority for challenges in various states to age limitations.
I’m probably in the minority here, but I’ve long believed that there should be one age of majority in the United States. If you’re old enough to join the military and put your life at risk at 18, get married, and vote, you should be old enough to buy a beer or a firearm.

That could be justified only by an active draft (which itself constitutes “involuntary servitude” and as such is a violation of the 13th Amendment). These are chromotypes found in large populations at rare frequencies. But do you understand what steers the fetus in the direction of male or female? There are specific genes almost always found on the Y chromosome that steer toward male development. Absent these genes, you get a female.
But there are cases of Y chromosomes with missing male genes, and when this occurs, you can get an intersex baby (indeterminate genitalia). 1 out of 5000 babies are born intersex.

The presence of a Y chromosome renders a mammal male, regardless of how many X chromosomes are present, and regardless of the phenotype. Biologically, any mammal with a Y chromosome is male. Studies have shown that removing the gonads during fetal development of male rabbits can lead to the development of a female phenotype. Those rabbits are STILL genetically male. No matter the phenotype of the rare intersex individual, the presence of a Y chromosome means they are male.
The overwhelming majority of transgender people are NOT intersex. They suffer gender dysphoria, a mental health condition, not a genetic abnormality. It is the ultimate identity crisis. Biologically, however, their gender was determined at fertilization.
There wasn’t any doubt on this until fairly recently.

I interact with undergrad and graduate/MD/PhD STEM students regularly. Less than half have the emotional and developmental maturity that their cohorts. My interactions with young men and women who have been taught how to use firearms at a young age and firearm safety, they are far more mature than those who have not. I am glad for this ruling. If anything, we need more shooting sports for young people to give them a level of training and discipline. I hear Poland is now having mandatory firearms training for children in high school.

I have met amazingly mature and capable youth. They also have social lives, personal experiences,attend school and work. The best employees I have ever worked with came off the ranch or farm. They understand work.

When I was a teenager in the 60s, the NRA was pro gun control. The organization asserted that no one should be allowed to have a gun without a safety course.
There was a significant period of time when the NRA was definitely not a pro-Liberty organization. I also clearly recall when, in the 1950s and 1960s, it tried very hard to sell the idea that the 2nd Amendment was exclusively about hunting. The NRA grew and thrived on marketing, and behind the scenes politicking to undermine its competition, before that competition could get a foothold. Then, more recently there was the scandal of its leader, Wayne LaPierre, misappropriating millions of dollars over many years for personal aggrandizement that was donated for 2A advocacy. I was an NRA member for a short time, and only because the range I chose to utilize then was NRA-affiliated, and required that membership. There are at least a half-dozen other pro-2A organizations that I will support and donate to before I give a dime to it.

To put it in medical terms for you, just because a patient was hospitalized for hypertension 7 years ago does not mean that this prior condition was responsible for his cause of death. You would expect a medical examiner to conduct an autopsy before rendering an opinion, wouldn’t you? Well, ask yourself, did Trump wait for the autopsy? The black boxes were just found hours ago.

Jonathan: Bodies are still being pulled out of the frigid waters of the Potomac and DJT held a press conference yesterday to address the crash. DJT declared the cause of the crash was due to the “diversity” hiring policies of the Obama and Biden administrations. When a reporter asked him how he could make such a claim without any evidence DJT responded “common sense”. Common sense tells me to wait until the NTSB completes its investigation. But not DJT, who is quick always blame someone else or some policy of a prior administration for some tragedy that happens on his watch.
After the first major airline crash in 15 years DJT was asked if he would go to the site of the crash and review recovery efforts. No was his response. In a sarcastic comment DJT said “…you tell me, what’s the site? The water? You want me to go swimming?”
And this crash occurred when their was no acting FAA administrator. That’s because Mike Whitaker, the FAA administer appointed by Biden and confirmed to a 5 year term in 2023, was forced to resign on DJT’s inauguration day. And DJT waited until yesterday to appoint an acting replacement.
So what was the reason for Whitaker’s resignation? Two weeks before DJT’s inauguration a Musk SpaceX rocket exploded mid-air, showering the Caribbean with rocket debris. Musk was excited by the explosion, calling it “entertaining” despite the fact that the FAA had to divert dozens of flights from the area–and as the residents of Caribbean islands were dodging the debris. The day after the SpaceX explosion the FAA grounded Musk’s Starship program. This action came after the FAA fined SpaceX $633,00 last September over safety violations by Musk’s company. So the knives were out to get Whitaker. In an X post on 9/25/2024 Musk said “He needs to resign”. Whitaker saw the handwriting on the wall after Musk, the richest person in the world, took charge of the federal government on Jan. 20. We can expect the new acting FAA administrator will go easy on Musk’s latest plaything.
In DJT’s second term the billionaire oligarchy will get what it wants. As for gas, egg prices and other essentials, that is not part of the Musk/DJT agenda. For the MAGA voters out there you were scammed again!

And, just like with COVID, if someone at the FAA or NTSB dares to contradict Trump, he will fire them, MAGA media will attack them–“they are liars; they are politicizing the NTSB and FAA”–the MAGAs will harass them, there will be death threats, demonization—we’ve seen this cartoon before.
So, now, how is this handled? MAGA media will downplay the fact that Trump is an inveterate moron who just HAS to dominate attention when there are cameras and use every opportunity to engage in culture wars and to attack his perceived enemies. It really comes down the interpretation of jurisdiction and what that means. Remember those amendments were written to deal with the Slaves who were now freed. The SCOTUS could determine one way and an executive order is ok, or another way and legislation is necessary or a 3rd way and maybe a constitutional amendment would be necessary. Think of it as a negotiation has been started with the court system and primarily the SCOTUS. Outcome-to be determined.
