Below is my column on Fox.com on the bizarre controversy surrounding New Jersey Gov. Phil Murphy and his suggestion that he was housing an illegal migrant in his home. It is a new version of Murphy’s Law on how virtue signaling can turn into a virtual nightmare for Democrats over immigration.
Here is the column:
For years, engineers have cited Murphy’s Law that “anything that can go wrong will go wrong.” The law is attributed to aerospace engineer Edward A. Murphy Jr. from the 1940s. However, this week, the law seems re-written by New Jersey Gov. Phil Murphy, who is under fire after suggesting that he may be sheltering an undocumented woman above his garage.
Murphy was being interviewed by the liberal group Blue Wave New Jersey and thrilled his Democratic base by indicating that he had given sanctuary to an undocumented person in his home. It was a curious moment when, after promising sanctuary, Murphy not only appeared to out his guest but then taunted ICE to come and try to take her.
After seemingly staking out the immigrant like a sacrificial goat in a lion hunt, Murphy’s virtue signaling summoned the authorities. And now, the Iceman Cometh.
Trump’s border czar Tom Homan vowed to “look into” the Governor’s house guest.
The interview illustrated how some strive to prove their progressive bona fides at the cost of those they claim to be protecting. It is akin to the good people of Martha’s Vineyard singing to undocumented persons just before shipping them off to a distant military base.
Of course, Murphy appeared to struggle with calling her an undocumented migrant, let alone an illegal alien. Instead. she was described by the governor as a person “whose immigration status is not yet at the point that they are trying to get it to.”
Murphy explained how
“Tammy and I were talking about – I don’t want to get into too much detail, but there is someone in our broader universe whose immigration status is not yet at the point that they are trying to get it to. And we said, you know what? Let’s have her live at our house above our garage.”
You could almost hear the cooing from the crowd. Murphy then added the taunt to the tell: “And good luck to the feds coming in to try to get her.”
Of course, the most important “details” for the woman are her status and location.
The most important detail for Murphy was to suggest that he and Tammy have a real live undocumented person housed above their cars. Not a poster or pamphlet on undocumented entry, but a real undocumented person. Of course, what can be lost in such moments is not just the person’s identity but her humanity. She did not seem like a real person at all . . . more like some prop or novelty item to brag about.
What was so striking about the interview is that ICE is not generally rounding up undocumented persons. Rather they have focused on aliens who have committed criminal acts. While Murphy and others have issued chest-pounding declarations to defy the federal government, the public is overwhelmingly in support of the effort. Murphy previously declared that he would “fight to the death” against Trump’s agenda.
A recent poll by The New York Times and Ipsos found that an astronomical 88 percent of citizens supported “deporting immigrants who are here illegally and have criminal records.”
Within days of the Trump Administration coming into office, thousands of such targets were located and arrested.
For other immigrants, there is still a comfort in numbers. With millions allowed into the country under President Biden, most are keeping a low profile in the knowledge that they are not the priority for ICE.
However, when a governor openly taunts the government and advocates the use of private homes as sanctuaries, he forces the hand of the government.
It is even more problematic if this is the governor’s public residence or under the protection of state officers. Murphy may be using such state resources to violate federal law.
It was not clear what the status of Murphy’s guest was. The governor’s breathless account of his own courageous stand suggested that she would be subject to deportation, if discovered.
Under Section 1324 of Title 8 of the United States Code, it is unlawful when anyone “conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation.”
That is when Murphy’s law kicked in with a vengeance.
After his boast about “hav[ing] her live at our house above our garage,” a close associate later suggested that it was all a type of liberal projection. It is now claimed that he never actually made the offer to the person, but “mentioned to someone else that they could move in if they want, so I think that’s where some of the misunderstanding was.” The source also added that “The person wasn’t undocumented. The person was a legal resident of the United States of America.”
Ok, let’s get this straight. Murphy did an interview with a liberal group on how he agreed to “have her live at our house above our garage” but could not share any other details to be safe. Nevertheless, Murphy warned about the reception if “the feds com[e] in to try to get her.” Yet, his associate is now claiming that there is no harbored illegal to get. Not only was she never in the garage, but she is perfectly legal and is not subject to deportation. It was like Murphy bragging that he has Chris Christie living above his garage. It is hardly the stuff of Harriett Tubman and the Underground Railroad.
The bizarre controversy, however, has greater importance in what Murphy was struggling to convey. He and other governors are pledging to bar any cooperation with the federal government in the deportation of unlawful immigrants. The latest example was Wisconsin Gov. Tony Evers, who pledged to continue to defy federal enforcement even at the loss of substantial state aid.
As with Murphy’s faux resident refugee, the declarations in states from Illinois to New Jersey to Massachusetts will force the hand of the federal government. While the federal government cannot “commandeer” state officials in the enforcement of federal law, it also does not have to subsidize those officials in frustrating enforcement efforts. The Trump Administration is expected to move to block funds for sanctuary states and cities. So, in addition to billions being spent on housing and benefits, these states will lose billions in federal aid.
What is most striking is that it never mattered if the Murphy claim was true or not. For many, it was another “I am Spartacus Moment” from a New Jersey Democratic politician that fell comically flat.
Gov. Murphy’s law should be a cautionary tale for all of his Democratic colleagues in state houses. Virtue signaling can summon costs not just for themselves but for their states.

All countries that I am aware of, including Mexico, have federal immigration laws, and will deport those who defy those laws, sneak in, and try to live there.
I have never heard a good reason why the US should be the only country on the planet with an open border.
That said, I don’t blame illegal aliens for coming here. Democrats have invited them for years, and former President Biden blatantly told them to come. I’m not angry at anyone who took him up on that offer; I’m angry at Democrats for plowing the infrastructure of the United States into the ground.
Don’t blame the mess on those cleaning it up.
Actually, blaming Democrats is misguided. Illegal immigrants are the most profit making labor force on the planet. They don’t cost employers benefits, employers can pay cash and escape payroll taxes, employers don’t need to invest in or provide safety measures, and employers don’t have to follow any labor laws. They can fire them on the spot for no cause and not owe them anything, not an uncommon practice to have them work a final day or a final week for free. Employers know illegals immigrants fear deportation and there’s nothing they can do about it.
Who’s to blame? American business.
They are also low skill, do not speak english, pose huge communications problems. Pose an enormous risk of huge fines, and even jail for hiring them.
In the ACTUAL economy – rather than your head the profit margin for ANYTHING is driven exclusively by the risk.
High profits mean high risk.
This should be obvious to you.
If you think that hiring illegals is high profit and low risk – start your own business, If you are correct – you will “Get rich quick”.
Separately off course illegal immigrants have something they can do about it.
They can do exactly what any other employee can do – they can quit.
This is one of the stupidest delusions of leftists.
The laws of supply and demand are IMMUTABLE.
Do not like the price of gas – don’t buy it. Find cheaper gas, Drive less.
Absolutely guaranteed if YOU and money others do the same – the price will drop.
The price of EVERYTHING is what a willing buyer and a willing sellor agree to.
Whether that is gas or labor.
Every single time two people agree to a free exchange BOTH must have decided they are better off. Or the exchange would not happen.
This is the most critical thing about free markets – – every choice is FREE.
There is no promise that you will get the price you want.
But BOTH parties are ALWAYS free to say NO.
That comes with consequences.
Farmers hiring farm labor have crops that must be harvested – and little time to do so.
Conversely illegal immigrants can not command the wage they could if they were legal – because hiring them is Risky.
You claim that hiring illegals is profitable.
If hiring illegals was both high profit and low risk others would be rushing to higher them – offering slightly more money for just lsightly lower profits until risk and profit balanced.
That is not happening. That means that risk and profit are ALREADY balanced.

Want to stay in a distant city – someone needs to invest the capitol to build and operate a hotel for you. A significant portion of those are owned and operated by east asians – are you saying they are all republicans ?
Want to go out to dinner – someone has to invest capitol in the restaurant.
Want to eat – big farms someone has to invest in the farm.
Don’t live next to a farm ? Someone has to invest in a meat packing plant.

Regardless – want your home, or a hotel, or a resturant, or a meat packing plant – someone has to invest to build those things,
Want a clean hotel room someone had to invest in the housekeeping company.
Want to be able to afford any of these things – someone has to operate them efficiently.
Rising standard of living – means more of what you value for less human effort.

Universally standard of living is raised by those people you despise investing capitol to produce the things you want and need for less cost. That means either greater efficiency, automation, or lower skilled lower cost labor. That is how costs are lowered and standard of living is raised.
The reason that communism and socialism do not work is that they destroy the incentive for anyone to find a way to produce what YOU want for lower cost.
Every means know to lower costs – and hence RAISE standard of living requires someone to risk capitol to produce what you want and need more efficiently and therefore at lower cost to you.
Destroy the incentive to invest – and you assure that standard of living declines.
Regardless, the people who employ others – whether they are illegal immigrants or rocket scientists, have a name – they are called investors.
Some of them are billionaires like Musk. But a massive portion of investors are YOU. They are YOUR pension, YOUR 401K, your bank deposits,

Jonathan: Kudos to NJ Gov. Murphy for standing up to DJT’s insane and cruel deportation policies. But I seriously doubt he has an undocumented person living in his garage. Murphy has made it clear he does not oppose the deportation of immigrants who have committed crimes. But in a statement Murphy said “That’s very different from the blunt-instrument mass deportations. Including very innocent individuals who escaped, seeking asylum because they were being persecuted or physically threatened [in their own home countries]”. Murphy reiterated his commitment to NJ’s “Immigrant Trust Directive” that prohibits state police and prosecutors from cooperating with ICE raids.
And Gov. Murphy’s apparent offer of asylum to an undocumented person in his garage is just the tip of the iceberg. There is reporting that Americans across the country are also stepping up and offering to provide temporary shelter to those whose only crime is being undocumented. Americans are willing to defy the law to protect innocent immigrants. It’s the modern equivalent of the “Underground Railroad”–organized by Frederick Douglas, abolitionists and the Quakers to provide safe houses for slaves trying to escape to freedom. Ironically, it is the Quaker community that first stood up to DJT by filing a federal lawsuit to prevent ICE from raiding Quaker churches, schools and hospitals.
As to your claim that ICE raids focus “on aliens who have committed criminal acts”. That claim is FALSE. ICE is picking up many immigrants who have committed no crimes. On Jan. 26 ICE arrested 1,200 people in Chicago–48% of which had committed no crime. In its raids ICE is racial profiling–picking up members of native tribes. Even Puerto Ricans in NJ, who are US citizens, have been detained. No wonder Gov. Murphy is upset!
There is another incident which highlights the problem with these mass deportations. NPR is reporting today that in Texas ICE raided a home where “Carlos”, a 19 yr old Nicaraguan undocumented immigrant, lived with his parents and cousins. ICE agents went into the home without a search warrant to make the arrest. The agents told Carlos’ mother they had a video of Carlos with firearms and drugs but they refused to show the mother the video. NPR could find no record of any crimes by Carlos in Texas. Carlos is now being held in an ICE detention facility in Taylor, Texas. The parents are distraught. The father said in a statement to NPR “We are good people. We are not hiding any criminal and no one who lives in this house had committed a crime in the US”.
The problem for Carlos, and many other immigrants, is that he entered the country legally–under the CBP One program–a mobile app that allows immigrants coming across the border legally and apply for asylum status and track the status of their cases. Carlos was in the middle of that process when DJT abruptly cancelled the CBP One program in one of first EOs. That turned Carlos’ life and that of his family upside down. He is now “undocumented”. Is that fair and humane treatment? Not in my book!
Sir, do you accept that DJT took an oath of office … to protect citizens … defend the border.. follow the laws … paraphrasing. Deportation of any person not here legally is following the law, not insane and cruel policies, just the law.

Murphy’s own statements are sufficient to grant a warrant to search his place. Who knows what might be found.

If you are being persecuted or physically threatened in your home country – go to the US consultate and seek asylum.
If that is not safe – got to the US consulate in an adjacent country.
If that is not possible go to the consulate of a country enroute to the US.
if that is not possible – then come to an official US border post and request asylum.
The US has laws regarding Asylum. If you do not like those laws – change them.
Though I would note asylum laws across the world are much the same.
Further if you are faced with a threat to your life in Venezuella – that entitles you to asylum.
It does NOT entitle you to asylum in the US. There are atleast a dozen countries that are closer to you than the US.
Those countries speak the same launguage, and most of them are NOT a threat to your life.
Neither those countries – nor the US are obligated to give you asylum.
Further the rules for asylum are strict. on average about 22,000 people are granted asylum in the US each year.
Nearly all those applying for asylum are rejected – because the truth is they do NOT face a threat to their lives from their government.
There is no economic right to asylum anywhere.
If you want to immigrate to the US for economic reasons – we have a legal immigration system that accepts a million people a year.
Your odds of getting permission to legally immigrate are far far far better than the odds of getting asylum.
But that process stars at a US consulate in your country of origen, and involves waiting in your country of origen for permission to immigrate tot he US. The odds of getting that – are about 1:7 but that is several orders of magnitude greater than your odds of getting asylum.
We are not happy with the governments of many south and central american countries – but very few are threatening the lives of their citizens.
I personally do not like US immigration law. If the US adopted my prefered laws we would have far more legal immigrants.
We would accept anyone who could get a sponsor – but sponsorship would be a meaningful committment.
We would not have quotas, we would have very limited asylum. We would have a border wall in the south. Because letting anyone with a sponsor in is NOT letting anyone at all in.
But we do not have my prefered law. And if I want that – I must persuade congress to change it.
Just as YOU must.
Trump, Noem, and Homan are obligated to enforce the law we have – not what You or Murphy wish we had.
If you think the law we have is cruel – change it.

I am not sure what that means. Regardless EVERYONE in the country is REQUIRED to cooperate with federal law enforcement.

If you wish to engage in civil disobediance – Go for it. But just like many in the “underground railroad” risked death or imprisonment – you would be breaking the law and you could go to prison. And unlike those in the underground railroad, you would not be fighting for anothers freedom.

I would note ICE is also enforcing existing deportation orders – there are 1.3M of those outstanding right now.
If ICE encounters you and you have been ordered deported – you will be deported.

Nope. Carlos and all those using CBP one crossed ILLEGALLY – there is no provision in the US immigration law to request asylum through an App.
You do so at the closest consulate to your home country. While Nicaragua is not a nation the US has cordial relations with, it is also not a nation where you stand much chance of getting asylum. Carlos was not fleeing death trheats from the Nicaraguan government – he was here illegally.

You are not allowed to enter the US because you claim to be seeking asylum. You would have to be a moron to accept that.
If that were the case EVERYONE trying to enter the US would “seek asylum” and we would be overrun by millions of asylum seekers.
What you are describing has a Name – it is called MORAL Hazard. It is where you provide a benefit to someone else with no cost.

Correct – CBP One is illegal. Carlos was NOT in the middle of a legal process. You apply for asylum outside the US.
You wait outside the US. In very very rare instances where you can prove a threat from a foreign government OUTSIDE the US you are allowed to wait INSIDE the US, if the law were followed – you will be detained while waiting.
You must think the people who drafted US immigration laws were complete morons.

Even in the 19th century when we had “open boarders” – you still entered at a border crossing – like Ellis Island.

I would further note that while I do not know where Carlos was arrested – but if an illegal immigrant is caught within 100miles of the border – they can be deported immediately.
Next – even if the courts decide that CBP One is a legitimate means of reqesting asylum. It is NOT a grant of asylum, Honestly those of you on the left really do not seem to grasp how incredibly unlikely it is that someone requesting asylum will get it. Millions of people apply – about 22,000/year are granted.
Democrats have encouraged illegal immigrants to apply for asylum they will never get in the hopes of forcing the rest of the country to accept them anyway or deport them after they have been here for years waiting for asylum.
Regardless, you are NOT be law entitled to wait for asylum inside the US.
In the event the courts decided that Carlos’s CBP One application for asylum is legal. he can still be removed from the country waiting for an asylum hearing, allowed to enter temporarily for his asylum hearing and then removed when that request is denied.

I am sure that half the country of Nicaragua would like to come to the US. But there is no right to do so.
Carlos got to be here briefly. That is more than he was entitled to. Had he been allowed to stay until an asylum hearing – which with certainty would have been denied, How would that be “more fair” ?
How is any of this “fair” to those who follow the rules ?
Regardless – in the end LIFE IS NOT FAIR.
YOU won the lottery of life. You were born in the US, you are white, you are male, and you are a citizen. You did not earn any of that.
More than 7B others did not get that lucky. That is not fair.

Nor can you make any system of govenrment work that elevated “fairness” to a right.

Musk established quickly that 90% of USAID spending is in the US.
That should not be surprising. Why would anyone think a govenrment charity would engage in real charity serving the real people that is was supposed to serve ? Why would anyone beleive that Congress – EITHER party would actually want that ?

When government takes on the duty of charirty – it enters the domain of religion. And wherever govenrment goes – it pushes everything else out.
The left decides we have a right to healthcare and that healthcare includes the right to abortions.
The result – catholic hospitals are forced to abandoned their duty to care for the sick, or abandon their beleif in the sanctity of life.
All this because government ventured into a domain that is outside its scope.
We have a plethora of SCOTUS cases where govenrment was in conflict with religion. SCOTUS has striven valiantly to define how government and religion can coexist.
But the fact is that Government is barred – both by the first amendment and by the constraints of the legitimate scope of govenrment from entering the domain of religion – Charity.
The exposure of USAID is a massive embarrassment for Democrats.
Many of us have probably heard that USAID was involved in not just indirect but often direct support of Hamas and terrorism in Gaza – and likely elsewhere.
But few realized this was not just a NGO run amuck, not just a government funded NGO, but an actual US Government agency run amuck.
Why are democrats circling the wagons around USAID ?
There are strong suggestions that USAID funds made their way directly into the hands of democratic politicians.
This would be the equivalent of the Military Industrial Complex “self licking ice cream cone”.
Congress budgets money to USAID. USAID then uses those funds to pay Congressmen, their staff, other democrats with that money.
Musk found that over 90% of USAID money was spent in the US.
While Democrats are far better at this type of corruption that Republicans – neither are immune.
Trump is now talking about a soveriegn wealth fund.
This is a HUGE mistake.
We already have government pensions that are being used to leaverage the investments they make for political objectives.
In what world does anyone think that a Trillion dollar govenrment investment fund is a good idea.
Trump talks about the Government owning 50% of TikTok. It is a hugely dangerous idea for Government to OWN any parts of the economy in anyway. Ownership of the means of production is LITERALLY the socialism that Trump has vowed NEVER will come to the US.
Regardless of Trump’s sincerity a soverign wealth fund will ultimately be no different from USAID.
Another self licking ice cream cone. And pretty much guaranteed, over the long run it is the LEFT that will come to control that sovereign wealth fund. And it is the left that will use that power to expand the domain of govenrment and to shrink the private domain of individual freedom.
I started this by noting that rights are things that impose no duties on others – the protection of rights is the domain of govenment.
Free speech is a right.
Duties are just another name for charity and charity is the domain of the individual – or religion – even secular religion.
I do not care if it is the little sisters of the poor or the Democratic Socialist of america that are running a soup kitchen – though the evidence is that conservatives engage in 2-3 times more private charity than progressives. Conservatives give more of their money, and they give more of their time.
Regardless, private competition in fulfilling Christs exhortation of the duty to care for those less fortunate than we are is served – whether those doing so beleive in a god or do not.
But when Government steps in – religion is forced out – that violates the first amendment.
Separation of church and state is NOT a restriction on churches. It is a restriction on govenrment. Government may not enter the domain of charity. Doing so infringes on the practice of religion and more importantly corrupts government – as we see with USAID.
Rubio taking over USAID and moving it into the State Department is NOT a solution – Government Charitable aid MUST be terminated – entirely.
Whether from USAID, or the state department.
Separately fromt he fact that is it not a legitimate role of government – Government universally fails at it.

Government is abysmally bad at charity. It ALWAYS turns corrupt, but even when it is not, it is always a failure.

The real issue is that what Musk is finding at USAID is what he is likely to find Everywhere.
First – power corrupts. The history of govenrment throughout the world for 7 millenia has been rife with corruption.
Finding corruption in govenrment is like finding water in the ocean.
When our institutions – government as an example are somewhat divided, each party has the incentive to thwart investigations into corruption.
To thwart bringing the sunlight in. When an institution is divided 70:30 – both parties have enough of an incentive to thwart investigations.
When an institution becomes 95:5 – and those holding outside power flip – that institution becomes a massive juicy fat target.
And there is nothing that can be done to preclude exposing its corruption.

The problem with the Palestinians in Gaza is that they have been radicalized for decades. Since the formation of Israel, terrorists and their supporters have wanted one thing – the destruction of Israel. This wasn’t about an Arab State. All of the Middle East is comprised of Arab states, with only teeny, tiny Israel being the only Jewish state, despite Judea being the birthplace of Judaism. This wasn’t about a Palestinian State. The lion’s share of Judea, which was renamed Palestine by the Romans, was already given to Arab Palestinians in the formation of Jordan, and parts of Syria and Lebanon. Parts of Jordan are comprised of a very large majority of Palestinians, yet Jordan declined to make a separate Palestinian State. Muslim Palestinians who want to live in Muslim controlled parts of the region of Palestine can move to Jordan.
Palestinians have rejected offers of land for peace over and over again. They don’t want peace. They want to kill all the Jews. They were handed land in Gaza, with latch key first world greenhouses, an established export businesses, water infrastructure, and coastline just like Tel Aviv. They were given a first world piece of property, and they turned it into a third world dilapidated mess, dismantling the billions of dollars in water infrastructure to make bombs and then demanding Israel give them free water, and stealing billions in aid to fund terrorism.
So Trump isn’t interested in negotiating with them.
He went right over their heads, and said he would negotiate with other Arab nations, on getting the people of Gaza the heck out of there. Resettle them elsewhere. Then he would rebuild Gaza and turn it into a riviera.
As for the complain that this was the Gazans’ homes, it was also homes to Jews. Israel forced Jews to move out of Gaza, when they gave it to the Muslim Palestinians. They used it for a terror base, so now they can get the heck out.
Now, personally, I’m not interested in spending American taxpayer money rebuilding Gaza. I assume the next Democrat in office will hand it over to terrorists to ruin, just like they did when they first moved into Gaza. That said, Hamas is now freaking out, because the Trump figures it’s pointless to negotiate with them at this point. Israel isn’t going anywhere, and Hamas, and a majority of Palestinians in Gaza won’t accept that reality, so they don’t get a seat at the negotiating table any more.
