There is a chilling case of censorship out of Clarksdale, Mississippi, where a court ordered a local newspaper to delete a publication that the city claimed was libelous. It is not clear that The Clarksdale Press Register editorial by publisher Floyd Ingram did constitute libel. Ultimately, the city backed down, but the actions of both the local officials and the court remain troubling.
Ingram’s article, “Secrecy, Deception Erode Public Trust,” criticized the mayor and city council of Clarksdale for the lack of public notice before it passed a resolution to establish a 2 percent tax on retailers selling alcohol, tobacco, hemp, and marijuana.
Ironically, Ingram supported the “sin tax” to support “public safety, crime prevention, and continuing economic growth in the city.” However, he objected that, before the government “sent [the] resolution to the Mississippi Legislature,” it “fail[ed] to go to the public with details about this idea.” He added, “Maybe [city commissioners] just want a few nights in Jackson to lobby for this idea—at public expense.”
The city went ballistic. The city council voted unanimously to sue the Press-Register for libel. Mayor Chuck Espy declared “I would like for the record to reflect, even though I did not vote, I am in full support, and I am fully vested in the decisions that the four commissioners unanimously said.”
Of course, these politicians could set the record straight by simply responding publicly to the allegations. Interestingly, the clerk appeared to confirm that the public notice on the resolution was a snafu. During the litigation, the clerk confirmed that “I customarily e-mail the media any Notice of Special Meeting. However, I inadvertently failed to do so.”
So, the premise of the column was confirmed. While I understand the sensitivity over the suggestion of a desire to travel to Jackson, that line is clearly protected opinion.
On February 13, the city council voted unanimously to sue the Press-Register for libel over its editorial. “I would like for the record to reflect,” added Mayor Chuck Espy, “even though I did not vote, I am in full support, and I am fully vested in the decisions that the four commissioners unanimously said.”
Judge Crystal Wise Martin of the Chancery Court of Hinds County ruled in favor of a temporary restraining order that required the paper to “remove the article…from their online portals and make it inaccessible to the public.”
Epsy celebrated the decision, posting “THANK GOD! The City of Clarksdale WON today! The judge ruled in our favor that a newspaper cannot tell a malicious lie and not be held liable….Thank You, God, for a judicial system.”
The role of the government in bringing a libel action is particularly controversial and chilling. In New York Times Co. v. Sullivan, the Supreme Court observed that “for good reason, ‘no court of last resort in this country has ever held, or even suggested, that prosecutions for libel on government have any place in the American system of jurisprudence.'”
The Court added that such a role “has disquieting implications for criticism of governmental conduct…A State cannot under the First and Fourteenth Amendments award damages to a public official for defamatory falsehood relating to his official conduct unless he proves ‘actual malice’—that the statement was made with knowledge of its falsity or with reckless disregard of whether it was true or false.”
After everything that his country has been through, kicking a man when he’s down is the last thing that Zelensky needs. It was tough to see this heroic freedom fighter, the George Washington of Ukraine, getting scolded like a bad dog by men who have lived relatively comfortable lives, never having to do what Zelensky has been doing for three years, protecting a country from an invasion. The aid provided by the US was in the form of weapons and aircraft–not cash–and the weapons and aircraft were all manufactured here in the US, which supports the US economy. He also lied about what countries gave Ukraine the most help–our EU allies provided over 60% of the aid–but the fat one lied about that, too. He is a worldwide laughingstock–everyone sees him for the arrogant liar and bully that he is–they applaud when Macron and Zelenskyy stood up to him. Jonathan: Well, the brothers Andrew and Tristan Tate are safe back in the US–courtesy of DJT. What’s that about?
Andrew Tate is a former kick boxer champion and self-styled “misogynist influencer” with millions of young men followers online. He has been charged in Romania with sex trafficking and tax offenses. The brothers are dual British-US nationals. When living in the UK Andrew came to fame when he appeared on the UK version of “Big Brother”. But he was removed from the show after a video emerged that appeared to show him attacking a woman. The brothers are charged in the UK with sexual abuse of a number of women. That’s when the brothers fled to Romania, taking up residence and pursuing their misogynist agenda.
Fast forward to last year. Romania authorities charged the brothers with crimes similar to those filed in the UK. The brothers were ordered to home confinement. Then something strange happened. Richard Grenell, DJT’s special envoy at the Munich Security Conference earlier in the month, met with Romanian ambassador and “convinced” the Romanian government to release the brothers back to Florida. That involves US tampering with the justice system in Romania and a violation of Article 41 of the Vienna convention that prohibits diplomatic intervention into another country’s domestic affairs.
So why DJT’s interest in the fate of the Tate brothers? Since 2016 the Tate brothers have been big supporters of DJT. The tangled web of connections between the brothers and DJT is quite revealing. Paul Ingrassia, one of the lawyers representing the brothers in their human trafficking case, was recently sworn in as the WH liaison for the DOJ. According to Ingrassia conspiracy theory the Tate brothers were “sacrificed on the altar of the Matrix under the banner of egregious crimes they never committed”.
DJT has called the brothers detention in Romania “absolute insanity”. JD Vance also backs the Tate brothers. Elon Musk backed Andrew’s plan to run for PM in the UK. Alina Habba, who is DJT’s highest-ranking political advisor in the WH, is a “big fan” of Andrew Tate. As The Guardian points out in an article: “Trump and Tate have a lot in common. They are disinformation virtuosos, having sought to delegitimize criminal allegations against them through information lawfare…they learned that while truth and integrity get you nothing, controversy, lies and extremism can easily be transmuted into fame, wealth and power.”
For DJT and his inner circle it doesn’t matter the Tate brothers are credibly charged with operating a webcam sex business–accused of either trafficking, raping, grooming or abusing at least 48 women–one as young as 15 years old. DJT wants the brothers back in FL where they can hang out at Mar-a-Lago. Next month the Tate brothers are due back in Romania for another court hearing. Will DJT allow the brothers to return to face justice? That’s the big Q. Given DJT’s support for Jeffrey Epstein and his own court record of the sexual abuse of women we pretty much know how he will come down when it comes down to the Tate brothers!

I have little interest in the Tates one way or the other – but Romainia was pressured into targetting the Tates, and they are back in the US because that pressure ended. If as is claimed the Tates have treated women badly – the Tates are wealthy and can be sued in US courts where they likely will lose – if there is a real case.
I would note that very few of the allegations against the Tates are actual criminal allegations – and those that are have no evidence to support them.

A Mississippi judge on Wednesday lifted an order she had issued that required a newspaper to remove an editorial from its website, ending a case that had drawn national attention from press advocates who said the order was a blatant violation of the First Amendment.
The judge, Crystal Wise Martin of Hinds County Chancery Court, lifted the order after Clarksdale city officials voted earlier this week to abandon their libel lawsuit against the local paper, The Clarksdale Press Register.
On Thursday, Wyatt Emmerich, the president of Emmerich Newspapers, which owns the The Press Register, said that he planned to republish the editorial at the center of the case.
“As I warned them, it blew up in their face and it created a national outcry,” he said. “It embarrassed the city, and they realized what they had done was a mistake.”
Originally published on Feb. 8, with the headline “Secrecy, deception erode public trust,” the editorial accused city officials of failing to notify the news media before they voted to push for a tax increase in the Mississippi Legislature. It suggested they might have advanced the proposal because they “just want a few nights in Jackson to lobby for this idea — at public expense.”
Clarksdale city officials sued The Press Register for libel on Feb. 14, saying that the editorial “chilled and hindered” the mayor’s ability to lobby for the legislation in Jackson, the state capital.
On Feb. 18, Judge Martin granted the city’s request for a temporary restraining order and required the newspaper to remove the editorial from its website.
“The injury in this case is defamation against public figures through actual malice in reckless disregard of the truth and interferes with their legitimate function to advocate for legislation they believe would help their municipality during this current legislative cycle,” she wrote.

David Rubin, a lawyer at the Foundation for Individual Rights and Expression, a legal advocacy group that represented The Press Register, said in a statement that the demise of the case was an important victory.

It does seem to be a species of prior restraint since removal would take place prior to some number of days that the speaker wanted to have it be online and thus published to the world.
It has been decades since my First Amendment class, but I have never been one to let ignorance stop me before! Since the judge already found the speech to be un-protected speech, that is defamation, then prior restraint would not apply.
Perhaps. It seems like an issue that has not yet been resolved and should be litigated. I can see good arguments both ways. Do courts really have the power to restrain speech, rather than awarding damages after the fact? And even if they do under the US Constitution, that doesn’t mean they also do under the state constitution. There is a trend ever since Marshall and Brennan advocated for it, to interpret state constitutions as more restrictive of government than the federal one.
