There is a chilling case of censorship out of Clarksdale, Mississippi, where a court ordered a local newspaper to delete a publication that the city claimed was libelous. It is not clear that The Clarksdale Press Register editorial by publisher Floyd Ingram did constitute libel. Ultimately, the city backed down, but the actions of both the local officials and the court remain troubling.
Ingram’s article, “Secrecy, Deception Erode Public Trust,” criticized the mayor and city council of Clarksdale for the lack of public notice before it passed a resolution to establish a 2 percent tax on retailers selling alcohol, tobacco, hemp, and marijuana.
Ironically, Ingram supported the “sin tax” to support “public safety, crime prevention, and continuing economic growth in the city.” However, he objected that, before the government “sent [the] resolution to the Mississippi Legislature,” it “fail[ed] to go to the public with details about this idea.” He added, “Maybe [city commissioners] just want a few nights in Jackson to lobby for this idea—at public expense.”
The city went ballistic. The city council voted unanimously to sue the Press-Register for libel. Mayor Chuck Espy declared “I would like for the record to reflect, even though I did not vote, I am in full support, and I am fully vested in the decisions that the four commissioners unanimously said.”
Of course, these politicians could set the record straight by simply responding publicly to the allegations. Interestingly, the clerk appeared to confirm that the public notice on the resolution was a snafu. During the litigation, the clerk confirmed that “I customarily e-mail the media any Notice of Special Meeting. However, I inadvertently failed to do so.”
So, the premise of the column was confirmed. While I understand the sensitivity over the suggestion of a desire to travel to Jackson, that line is clearly protected opinion.
On February 13, the city council voted unanimously to sue the Press-Register for libel over its editorial. “I would like for the record to reflect,” added Mayor Chuck Espy, “even though I did not vote, I am in full support, and I am fully vested in the decisions that the four commissioners unanimously said.”
Judge Crystal Wise Martin of the Chancery Court of Hinds County ruled in favor of a temporary restraining order that required the paper to “remove the article…from their online portals and make it inaccessible to the public.”
Epsy celebrated the decision, posting “THANK GOD! The City of Clarksdale WON today! The judge ruled in our favor that a newspaper cannot tell a malicious lie and not be held liable….Thank You, God, for a judicial system.”
The role of the government in bringing a libel action is particularly controversial and chilling. In New York Times Co. v. Sullivan, the Supreme Court observed that “for good reason, ‘no court of last resort in this country has ever held, or even suggested, that prosecutions for libel on government have any place in the American system of jurisprudence.'”
The Court added that such a role “has disquieting implications for criticism of governmental conduct…A State cannot under the First and Fourteenth Amendments award damages to a public official for defamatory falsehood relating to his official conduct unless he proves ‘actual malice’—that the statement was made with knowledge of its falsity or with reckless disregard of whether it was true or false.”

Tough negotiations are common when dealing with tough situations. This however was a blatant disrespect of the office of the President of the United States.
First, Zelenskyy arrived dressed slovenly. I know he has something he is stating about solidarity with his clothes. He could have worn a black suit, black tie and white shirt.

Sure, he is tired, but in his interview with Brett Baer he three times refused to apologize. So, he thinks he scored some points. He finished his political career and caused harm to his people. There are many more components to this story than meets the eye, namely trying to keep Russia and China from forming a deeper alliance.
Ukraine has done an amazing thing. There are now an estimated 1,500,000 wounded, dead or missing on both sides. There is no clear victory nor plan to end the war. Biden couldn’t do it and so it is time to negotiate. Those who “side” with Ukraine are welcome to pick up a rifle, sidearm and pack and head up to the front. I am sure they would be welcome.

The US has ALOT of leverage with Putin and Russia. But the REALITY is that no deal can be made that paints Russia and Putin as evil – even if that is true. Zelensky is not a war monger. Much of what he said was right. It is just irrelevant. Absent a committment from the US or EU to send troops top fight, Ukraine will slowly lose this war. The oval office explosion today was ignited by Zelensky. The meeting was winding up, and Vance concluded with anodyne remarks about diplomacy and the prospect for peace. At that point Zelensky decided to intervene, saying that without a US security guarantee, any diplomatic solution would fail. There was then some back and forth between Vance and Zelensky. Trump was just listening. But that changed when Zelensky said that even though there was an ocean separating the US from Europe, the US would feel it. That triggered Trump, who does not accept that Putin would necessarily violate a peace agreement and take over the rest of Ukraine and attack Europe. He refused to buy into the notion that the war in Ukraine is useful to the defense of the US. This is the fundamental difference, and is the reason Trump will not give a security guarantee. He will not put the US at risk to stop a local dispute of great importance to Russia but of little importance to the US. He also believes that once Zelensky has a security guarantee in place he will be less likely to make or preserve peace. And from then on it was all down hill.

So Daniel, your point is that Trump is offended that Ukraine wants a security agreement because a) Trump doesn’t want to risk a confrontation by having our boots on the ground or our word at stake and b) Trump is offended because Putin would never violate the peace that Trump negotiated. Ukraine is NOT and has not ever been int he US national interests.
It does not even appear to be in Russia’s interest.
There is no possible guarantee that Putin will not do this again.
But there is reality – While Russia is at GREAT COST winning this war – Without boots on the ground from the EU or US Ukraine will just loose slowly. We have given them EVERYTHING short of nukes and troops and they have fought incredibly, But this is the Alamo and they are losing.
But there are multiple edges to that reality. This has been a GREAT COST to Russia. They have lost a million men they can not afford to have lost. They are already one of the worst countries in the world demographically – and the worst with respect to a shortage of young men.
Europe is not defending Ukraine – because they do not need to. This is Russia’s last gasp.
That is NOT a security guarantee – it is reality.
I can not prove that Putin will not invade again after Trump has left.
But the odds are TINY – if that was not so – Europeans would be providing Ukraine troops now.
I am NOT trying to blame Europe or Trump for the choices they are making.
I am saying that they have made a judgement of the risks – on that is likely correct,
Personally I think Ukraine will get all of its territory back in 10-20 years are Russia weakens.
And likely without firing a shot.
While Russia proved stronger than Ukraine a country 1/5th Russias size.
Russia ALSO proved it was a dying superpower – barely even a regional power anymore.
Trump’s view is that preserving Kiev’s rule over the five regions Putin has annexed is not of great concern to US security. On the other hand, restoring normal diplomatic and economic relations with Russia is of great importance, for many reasons. He believes stability along the Russia Europe border is far more important than perpetuating instability by supporting a losing territorial war in Ukraine. He also does not believe that Russia is an inevitability expansionist power, bent on further conquest, including of countries already in NATO. He also thinks Europe should play a bigger role in managing its own security. Finally, he does not want to risk US war against Russia by providing a military guarantee to a country that is not important to US security and that could provoke Russia as it has in the past. Zelensky not surprisingly has a different view on all these points.
Trump and Vance should not be abusing their power and authority to fulfill their sick fantasies. If cops treated a suspect like that, there would be a civil rights investigation.

Musk has applied the same logic since. He thinks the judges here who have now ruled against him and his DOGE should be impeached and removed. Musk apparently has never studied the US Constitution that includes a tri-partite system of governance in which the judiciary has the duty to declare whether acts of Congress or presidential orders are legal. That concept is alien to Musk’s thinking. He believes there should be no limits on his power. He wants America to emulate El Salvador.
Fortunately, judges in this country are not beholden to Musk. They serve only one master–the US Constitution!

In Brazil the SC has made itself the legislature, the executive, and the judiciary.

I fully agree with Musk that the US Judiciary has a problem – this continued lawfare against Trump is failing fast.
But I disagree with Musks solutions. We should not begin impeaching judges – though SCOTUS should start disciplining judges for completely stupid and unconstitutional decisions. It is one thing to get it wrong, it is another to be batschiff crazy wrong.
Congress can take the executive to court if it does not believe that the executive is meeting its budgetary obligations. Congress has not.
The courts exist to adjudicate cases and controversies. Congress is the only plantiff with standing to challenge the budgetary coices of the executive. These cases should all have been tossed.

With respect to the judges in the US – the left wing nut lawfare against Trump is a big loser.
Doge is popular – with broad support. Trump was elected to do this.
And he is near certain to ultimately win in court.
