“Defamiliarizing” the Border: Professors Denounce Borders in Opposing Trump Immigration Policies

For years, the mantra on the left was “reimagining” everything from policing to free speech to defense. Reimagining often was a synonym for defunding or limiting the subject matter. Now, Georgetown Law Professor Sherally Munshi and others are attacking border enforcement as “ethically indefensible.” Munshi calls it “defamiliarizing” the whole concept of borders, which she and others in higher education now find morally reprehensible.

Munshi’s talk, “Unsettling the Border,” is an example of how radical many law faculties have become. She is by no means a standout in such theories. While schools have purged their ranks of conservative, libertarian, and dissenting faculty, there is no limit to faculty writing on the far left.

Munshi insists that “there is nothing natural or inevitable about the United States’ contemporary borders.” She mocked the whole notion of “the so-called border crisis.” Millions of unvetted people just walking over the border is not a crisis… at least not for the country. It is failure in ourselves; “a crisis of imagination.”  Accordingly, she is calling for reimagining or defamiliarizing borders:

“Our task, as I put it, is to unsettle the border, to defamiliarize, disenchant, and recontextualize it by critically evaluating the historical processes, the legal developments, the discursive formations that naturalize and legitimate the border.”

It is, of course, racist to want to have secure borders:

“Rather than redress the fact that the international border regime is practically unsustainable [and] ethically indefensible, majorities in the whitest and wealthiest nations are embracing an increasingly authoritarian form of nationalism and exclusion.”

Borders, according to Professor Munshi, are just a construct “within the American imaginary, the southern border divides white from indigenous, purity from heterogeneity, civilization from savagery, settler from Indian.”

Of course, this reimagining of borders will have to extend back a tad further than the American founders. The concept of the nation-state with sovereign borders was recognized in documents like the Treaty of Westphalia in 1648. It was credited with maintaining a Westphalian peace with nations able to maintain their own territory and governing systems. That, in turn, allowed nation-states to form international bodies and further stabilize global relations.

I have heard other faculty present papers along these same lines, dismissing the very concept of border enforcement as racist, privileged, or archaic. It is far more rare to hear conservatives on campuses arguing for border enforcement and deportations. It is even less common to find such advocates on both faculties.

In my book “The Indispensable Right: Free Speech in an Age of Rage,” I discuss the intolerance in higher education and surveys showing that many departments no longer have a single Republican as faculties replicate their own views and values.

The problem is not that there are radicals teaching at law schools, but that most faculties seem to run only from the left to the far left.

Perhaps it is time to . . . wait for it . . . reimagine or defamiliarize law school faculty appointments.

  2. Jonathan: …Some final thoughts on DJT’s address last night. At one point DJT declared that “the days of unelected bureaucrats are over”. That got a big laugh from the Democratic side of the aisle. They stood up and pointed to Elon Musk–the “unelected bureaucrat” who is running the country. Elizabeth Warren later quipped on X: “I agree with Donald Trump that an unelected bureaucrat should be fired. Let’s start with Elon Musk”. But the MAGA Republicans bizarrely cheered the Orange Man and convicted felon–not recognizing the dripping irony in his statement.

    And while Musk was glowing in DJT’s praise for his work with DOGE to dismantle the federal government this “unelected bureaucrat” was ignoring the serious problems with his own companies. Tesla shares lost another 3% yesterday. China reports that Tesla’s February wholesale numbers dropped 49% since DJT took office. In February Tesla sold only 30,688 NEVs in China while the Chinese EV maker BYD sold 318,233 of its cars. And Tesla’s sales in Europe plummeted 45%.

    Even Fox News has admitted that DJT’s tariffs are having an inflationary impact on our economy. Fox sent one of its reporters, Jeff Flock, to Pennsylvania yesterday to find out what DJT’s tariffs are doing to car and truck prices. Flock stood next to a Dodge Ram truck and found the price had gone from $80,000 to $100,000!

    The speech last night revealed the cowardness and depravity of MAGA Republicans. They are facing outrage from their own MAGA voters in townhall meetings about the rise in prices on everything. So what has MAGA Speaker Mike Johnson told his colleagues? Just cancel any further town hall meetings. In the face of fire MAGA Republicans run for the hills!

  3. Jonathan: There were so many disconnects in DJT’s speech to the joint session of Congress last night. Too many to cover in one comment. But here are a few highlights.

    During the campaign last year DJT promised that on day one he would bring down inflation. We’re now in March. Anyone seen the prices of eggs coming down? Or the prices for anything else? DJT told the American people last night his tariffs would “Make America Affordable Again”. See any evidence of that? The CEO of the Ford Motor Co. said yesterday that DJT’s tariffs will “blow a hole in the auto industry we’ve never seen before!”. The prices for new cars and trucks have already gone up. See the disconnect?

    DJT also said “I love the farmers”. But his tariffs are causing American farmers to pay more for everything–from seed to farm machinery. China has already imposed reciprocal tariffs on American soy beans and other agricultural products. How is that helping our farmers? See the disconnect?

    On foreign policy DJT says he is trying to avoid WW3. Yet last night he repeated his demand to take back the Panama Canal and take Greenland from Denmark “one way or the other”. Threats of military action against Panama and Denmark are not exactly the way to avoid another war. See the disconnect?

    Then DJT pointed to a young boy in the audience who is suffering from cancer and applauded him for wanting to be a police officer. Yet, DJT is cutting NIH funding for pediatric cancer research. See the disconnect?

    DJT’s speech was a complete disconnection from reality. He lives in a bubble of lies. He has no plan to reduce inflation. The stock market is tanking and people are losing their 401K savings. Everything costs more now as a result of DJT’s disastrous trade wars–while he threatens our allies. DJT admitted in his speech that his tariffs will cause more inflation. But he calls that a “little disturbance” but “we’re not worried”. See the disconnect?

      Yes. We know there is going to be some “disturbance.” That was a given. We also know what a disaster Bidenomics was and that due to it, we are facing serious economic headwinds and possibility a recession. Nothing that Trump did. That was all Bidenomics and Bidenflation. It may take years or a decade to fix. But, with all that re-shoring of companies, investing in America, more American jobs, DOGE cutting waste, fraud and abuse, cutting the government of useless or redundant programs, those economic headwinds might be short lived.

      Dennis, no one is going to care about Tarriffs until they have actually been effect for months so that we can TRULY see their long term impacts. Though I would note that the mere threat of Tarrifs is both getting serious concessions from foreign countries and pushing businesses to reshore back to the US. Tarriffs are not the only factor driving that.
      But they are an important one.

      The claims of the Ford CEO are disturbing – what he is saying is that Ford does not make cars in the US anymore.
      I do not expect that is going down well in Michigan. Regardless, long before Trump announced Tarriffs
      major global producers started moving back to the US.

      Airbus AND Boeing make aircraft in the US.
      All japanese automakers have plants in the US, german cars are made in the US.

      Where is this “hole” being blown in the auto industry ?

      Tarriffs are avoidable – make your product in the US.

      I do not know what has happened to the price of cars and trucks – but I doubt they are going up as sales are DOWN.

      John Deere, International Harvestor, Ford, …. What Farm Machinery is made outside the US ?

      Commodity markets have very little slack in supply and demand.

      Cutting spending reduces debt reduces fed printing of money reduces inflation.

    The Russian occupation of Ukraine is what is prolonging the war.
    Putin is the one causing the bloodshed in Ukraine, not Zelensky.
    The scientific method of making and reporting observations
    can prove this.
    It makes no sense that Zelensky is getting all of the blame
    when Putin does not get any of the blame.
    If Vance is really so concerned about the bloodshed in Ukraine, then he and Trump should persuade Putin to get out of Ukraine.
    When the Russians are gone from a place they should not be,

  8. Trump claimed that his administration was conducting rapid deportations. This is misleading: At the current pace, the Trump administration would deport half as many people as the Obama administration once did in a 12-month period.
