It is Not “Karma,” It is a Crime: The Curious Silence Over Political Violence in New York

Yesterday, there was a curious aspect to the coverage of the video of a woman attacking a young man for wearing a MAGA hat. Ignored by many mainstream outlets, conservative news sites described the woman as a “Karen” who got “karma.” The video below was viewed as a funny payback as the woman fell while chasing the man from the New York subway car. However, the incident is not karma but a crime. This is political violence perpetrated on the New York subway, and yet no one in New York seems to be calling for the arrest of this person.

If you watch the video, the woman starts by harassing the young man in the subway car. She is shown yelling, “If you f—-ing voted for Trump, you’re a racist!… He’s a racist!”

One can dismiss the verbal attacks as an exercise of free speech. However, she then grabs and comes into contact with the young man (around the 45 second mark) as she chases him from the car:

I get the sense of karma as the woman does a face plant on the subway platform while trying to continue her attack on the fleeing individual.

However, this should be neither funny nor acceptable. It is political violence and the woman appears to believe that she has a license in New York City to assault anyone wearing a MAGA hat.

This is where what I call “rage rhetoric” turns into political violence. As I wrote in my book, “The indispensable Right,” that is the curious aspect of rage:

“What few today want to admit is that they like it. They like the freedom that it affords, the ability to hate and harass without a sense of responsibility. It is evident all around us as people engage in language and conduct that they repudiate in others. We have become a nation of rage addicts; flailing against anyone or anything that stands in opposition to our own truths.

Like all addictions, there is not only a dependency on rage but an intolerance for opposing views. The difference between rage and reason is often one’s own views. If one agrees with underlying grievance, rage is viewed as passion or justified fury at injustice. If one disagrees with those views, it takes on a more threatening and unhinged quality. We seem to spend much of our time today raging at each other. Despite the amplification of views on both sides, there is also an increasing intolerance for opposing views. Those views are treated as simply harmful and offensive—and, therefore, intolerable. Indeed, to voice free speech principles in a time of rage is to invite the rage of the mob.”

There should be zero tolerance for political violence like this on New York subways. Answer me this: if this was a man chasing and assaulting a woman from a subway car for wearing a Harris-Walz hat, would there be the same relative silence in terms of an investigation and criminal charges?

When this person moved from verbal assaults to actual physical assaults, it became a crime, not karma.

The problem is that New York only has an assault law, not a battery law. You can pursue battery as a civil tort in New York, but few Trump supporters would have faith in receiving a fair hearing before a New York jury on such a case.

The New York assault law allows for third degrees of assault charges. However, even the lowest charge of assault in the third degree requires that the individual intentionally or recklessly causes physical injury to another person.

§ 120.00 Assault in the third degree.

A person is guilty of assault in the third degree when:
1. With intent to cause physical injury to another person, he causes such injury to such person or to a third person; or
2. He recklessly causes physical injury to another person; or
3. With criminal negligence, he causes physical injury to another person by means of a deadly weapon or a dangerous instrument.
Assault in the third degree is a class A misdemeanor.

This could be established by the fact that she appears to grab and possibly strike the victim. However, the law is vague and prosecutors could claim that the touching was insufficient to bring a viable case.

There is also criminal harassment under Penal § 240.26:

§ 240.26 Harassment in the second degree.

A person is guilty of harassment in the second degree when, with intent to harass, annoy or alarm another person:
1. He or she strikes, shoves, kicks or otherwise subjects such other person to physical contact, or attempts or threatens to do the same; or
2. He or she follows a person in or about a public place or places; or
3. He or she engages in a course of conduct or repeatedly commits acts which alarm or seriously annoy such other person and which serve no legitimate purpose.
…
Harassment in the second degree is a violation.

I have always had qualms about some of this language in terms of vagueness and free speech, particularly subsection 3. However, subsection 1 clearly applies to physical assaults for the purpose of harassment.

The point is that police have the ability to charge this type of political violence. Yet, there is nothing but crickets from Democratic New York politicians and prosecutors. A video shows a citizen being struck and chased from the subway for wearing a MAGA hat and it is either ignored or treated as another humorous event on the New York subway system.

When did political violence become just a cost of riding the subway for conservatives or libertarians? The lack of outrage shows how this age of rage has dulled our senses to such extreme conduct. This is about conduct not speech. When this person went from raving to assault, she crossed over into the criminal code. The problem is that such protections are only meaningful if New York prosecutors and police are prepared to enforce them.

I hope that the NYPD will take this seriously and announce a search for this culprit. Otherwise, the enforcement of the criminal code becomes little more than a matter of fleeting karma.

        Yes, fact, trump called for Hillary to be jailed because she used a private email server for her official business.
        A reporter was included on a Signal Chat where the upcoming bombing of Yemen was discussed. 2 issues with that, 1) official communications are to be done via official channels so they can be archived. 2) these were war plans ahead of a bombing raid. Discussed with a person they didn’t even know was on the same chat. They were spreading information to a non authorized person.

        The new messages, which include screenshots of the full chat on the encrypted consumer messaging app Signal, make clear that Defense Secretary Pete Hegseth included specific details of the timing of the launches from aircraft carriers of the U.S. military jets that were to strike Houthi targets.

        Launch times are typically closely guarded to ensure that the targets cannot move into hiding or mount a counterattack at the very moment planes are taking off, when they are potentially vulnerable.

        You cannot install third party apps on secure government communication equipment, that includes. cell phones. They have their own dedicated encrypted network that is stronger than Signal.

        You could tell when Sen. Kelly asked NSC director Gabbard if she used her personal phone or her government secured phone when she was on the chat she got spooked. Her body language and facial expression showed a shocking realization. She knew she messed up. Because the only way you can install an app like Signal is on a personal phone, not a government phone.

        CIA director Radcliffe lied to the senator when he said a CIA staffer installed the Signal app on his laptop. What he didn’t say was if the laptop was his personal laptop or a government issued one. That matters because third party apps or programs are NOT allowed to be downloaded onto secure government communications equipment. That’s the whole point. Having a known and authorized secure system to communicate sensitive information, classified information, like detailed attack plans, time tables, weapons, and targets. All of that is automatically classified information and SecDef Hegseth, the moron, sent it out on a commercial app while a reporter was listening in on the conversation. THAT is why we have secure government communications equipment. THAT is why it exists. So stupid things like ‘inadvertently’ including a reporter with no security clearance and nobody noticing can happen.

  3. I agree with the professor that this is political violence. The fact that this is New York is no excuse. The only thing that this lady lacks is a brown shirt and a hat with a chin strap. Actually I think the gentleman she is accosting shows remarkable restraint (or maybe just good sense) He backs up on a closed door and then when it opens he withdraws but she persists in accosting him and seems to strike him. If he had fallen or tripped as he withdrew through the now open door and hit his head, then you could be dealing with something more like a concussion or death. Falling and hitting your head on concrete is not advised for daily activities. Injuries are unpredictable and sometimes catastrophic. I don’t blame the people not wanting to get involved because the way New York law is administered these days you simply don’t know what bag of worms you will be getting yourself into. I’m not sure you even have the right of self-defense there.
    I’ve been to NY City various times since 1954 and usually it was nice and pleasant. Even went to NY City 2-3 months after 9/11 to show our support and spend money since the news was spread that people were avoiding the city and the economy was suffering. A great sense of unity at that time. Seems like a lifetime ago.
    New York no longer intrigues or beckons me. I think I would rather go to Florida or Maui.
    The only problem with arresting this lady and charging her would, no drought, have her right back on the streets in just minutes.

    She didn’t strike the man. The video doesn’t show that. She was trying to grab the hat. Not the man. There was no injury or intent to injure. She was after his hat. Physical contact is considered assualt in NY but that brief contact seemed unintentional which is why there would be no charges. What is notable AND typical of NYC subway is that incidents like that regardless of who is engaging in them are completely ignored by subway riders. Notices nobody really cares. It’s just two people arguing. It’s not what Turley hilariously labels as “extreme conduct”.

        What IS obvious is that she was trying to grab the hat. The MAGA guy started to run and she chased after him. She caught up, still trying to grab the hat and ended up touching him rather than “striking” him. That could not even be considered an assault by NY law. The “strike” would have to be intentional. Clearly it wasn’t. She was just after the hat. It’s what triggered her.

        Faceplanting on the platform was funny and yes it was Karma for being an a$$. She did deserve that.

    For years, the Democratic political figures, liberal activists, and the resistance movement writ large have drawn morbid comfort from the fact that Donald Trump’s supporters were, frankly, quite old.

    The Trump phenomenon, they believed, had an expiration date sometime in the near future: Young voters would replace their parents and grandparents as demographics shifted, and all would be right — or rather, left — with the world.

    The 2024 election has shattered these hopes.

    Trump’s gains with young people are so massive that Gen Z might as well be called Gen Trump.

    Data guru David Shor laid bare this stark reality in an interview with The New York Times’ Ezra Klein last week; Shor walked Klein through the ramifications of his polling insights and voter analyses, which reveal a historically unprecedented rightward shift among young people, particularly young males.

    Trump won voters under the age of 26; white women, white men and black men in this demographic all leaned in Trump’s direction.

    What you wouldn’t see is Turley writing an article about it chastising Trump supporters and accusing them of committing political violence. Ironically it used to be a feature in past Trump campaign rallies. Even Trump encouraging it when his supporters beat anti-Trump protesters at his rallies. Turley said nothing.

    Personally, I have struck New York City off my list of tourism destinations I will return to visit. They have gone off the deep end and there are nicer places to visit.

    It makes one wonder how many visitors they have lost, conferences, and businesses? What business in its right mind would choose New York?

  19. Are you sure this was not staged? The video is very suspicious cutting from the inside of the car to outside of the car. How was that done so smoothly?

    1. That is a fair question.

      The manner in which it has been “reported,” however, is another subject.

    3. I did see at least one cut during the yelling, however, for the bit you are questioning, for that angle, he’d have to be beyond the platform in the void above the tracks. I think they just got a clean window. Surprising in the NYC subway system, I know.

While you are not very clear in your writing, you appear to be saying that Professor Turley is wrong to point out this crime – and it appears further that you see the woman’s attack as justified. It was not, and the victim would have been able to legally beat the hell out of her for this attack on his person. If she had been seriously injured or killed by the young man, it appears that you’d want him hung, though.

      Political violence? More like a petty crime of simple assault. Has Turley not been to New York? This is in a New York city subway. It’s New York. A woman chasing down a guy with a hat is not political crime. Turley is just using this incident to garner sympathy and outrage from MAGAs because it is a good distraction from the scandal that is currently on the News.

      Turley has been working hard avoiding discussion of the Khalil case, a clear free speech issue, and Trump’s attacks on Universities demanding they clamp down on Palestinian supporters free speech rights because anything critical of Israel is immediately labeled “antisemitism.”

      That’s a fancy way of saying someone is just angry. Turley seems to forget that even “rage rhetoric” is still free speech. Turley’s take on ‘rage rhetoric” only focuses on the rage aspect. He doesn’t do a deep dive into the causes. But he does get close.

      Ironically that happens a lot on this site and it comes from those on the right. Trump, is the biggest source of encouragement for those on the right to engage in behavior that deliberately and gleefully intends to trigger rage on those of the left. Bullying basically. Historically, the only way to stop it was to beat the crap out of a bully which is the point Turley makes. The flaw in his argument is he attributes this “bad behavior” or “rage addiction” to the victim of bullying, not the bully. Essentially victim-shaming.

When you use violence against a person or threaten them for hat they wear or interfere with a student peacefully attend class or prevent that class from even being held that is not speech, it’s terrorism and should be prosecuted accordingly. Maybe with a few of them end up occupying Ted Kaczynski’s old cell at Florence ADX others will think twice.

        1. It’s not terrorism. It’s just harrassment. You want to make the situation as extreme as possible so you can justify the punishment as harsh as possible. That’s not how things work.
