Parental rights are emerging as one of the major civil liberties movements of this generation — and one of the greatest conflicts between the right and the left in this country. For example, the United States Court of Appeals for the First Circuit ruled schools can hide a change of gender in young children from their parents. Now, Colorado is poised to pass a law that would threaten the custody rights of parents who “deadname” or “misgender” their own children. If a parent does not adopt a child’s new pronouns or name, they could be found to have exercised “coercive control” and lose custody in divorce proceedings in favor of a more enlightened parent.
As someone who grew up in an Italian family, I must confess that I thought “coercive control” of a parent was called . . . well . . . parenting. I can still remember my Sicilian mother brandishing a broom in front of our door to prevent one of my sisters from going out with a boy that she did not like. She simply declared “I gave you life, I can take it away” and my sister went back upstairs.
I admit the Italian parental style can be a bit shocking for outsiders and misunderstood by many. (My Irish father would sit bemused in the kitchen). In reality, it was all drama but you knew that it conveyed not anger but love.
Under the new proposal, House Bill 25-1312, Colorado would use the “Kelly Loving Act” to make “deadnaming” and “misgendering” children a factor in child custody disputes. Referring to your child’s biological gender or given name or pronoun would now be considered harmful and abusive, inviting a court to take your child away from you as a coercive parent.
“Section 2 provides that, when making child custody decisions and determining the best interests of a child for purposes of parenting time, a court shall consider deadnaming, misgendering, or threatening to publish material related to an individual’s gender-affirming health-care services as types of coercive control. A court shall consider reports of coercive control when determining the allocation of parental responsibilities in accordance with the best interests of the child.”
So the state will require parents to adopt a gender, name, and pronoun that they believe are harmful for their children. Many such parents may believe that a young child should proceed slowly and not make such changes as they consider the implications of such decisions.
One question is whether this would be limited to custody proceedings or eventually expand to families generally. If this is deemed abusive or harmful during custody battles, it would also be presumably abusive or harmful outside of such proceedings. The fear is that the underlying conclusions could support a view of a household being abusive and not being in the best interests of the child.
Notably, the Supreme Court will now be considering a Colorado case involving a ban on counselors offering “conversion therapy” for children. Under the state rule, a counselor can lose her license if she agrees to such counseling at the request of her parents. The U.S. Court of Appeals for the 10th Circuit tossed the challenge, ruling that conversion therapy is harmful and the rule is part of an effort to regulate the healthcare profession.
Rep. Lorena Garcia, D-Denver, insisted that:
“This bill is the bare minimum of what we can do as a state, and the fact that we have to legislate for people to not bully and misgender and deadname people because of whatever insecurities they might have is sad to me. Why can’t we just respect one another? Why can’t we just understand that someone else’s identity has nothing to do with me or you?”
The bill passed the committee on a straight party vote with Republicans in opposition. I believe that the Democrats are not just ignoring parental rights but political realities. They will find that this is not a partisan issue. It is a primal issue. For parents, Democratic politicians like Garcia fail to “understand” that it has a lot “to do with them.” They are the parents of these children. If Democrats do not “understand” that, they are likely soon to find that out.
It is sad to see the left of the Democrats mimicking Germany. I think they got it wrong — they are more like Hitler than they want to acknowledge. When free speech goes, there goes the rights of man. They will blow themselves out of the water and a new Democrat party must emerge. This is about the survival of our country and the Dems are so filled with hate and entitlement that they don’t see that we are still a country of laws. Sadly — neither do their leaders.
Do not move to Colorado.

Next there is no recorded vote on the Garcia order.
However Sotomayor, Kagan and Jackson files a separate opinion that went further – so this is not a 9-0 decision.
I would note Sotomayor’s opinion is a mess full of false claims regarding the actual facts of the case.

Padilla LOST his appeal to the supreme court – which 20+ years ago decided exactly as they did recently that you can not file a habeuas petition wherever you wish.
Sotomayor cites Boumadiene which is more favorable – except that Boumadiene decided that a non-citizen held by the US at a US overseas military base, has the right to file a Habeaus petition. Boumadiene did NOT order the government to return Boumadiene to the US.
It merely granted him the right to a habeaus petition. DHS has been argueing that Garcia and the TdA members in CECOT still have the right to file a Habeaus petition, but that they do not need to be returned to the US to do so. Boumadiene arguably supports that.
More importantly it is thousands of miles from supporting Sotomayor.
The facts are substantially different between Garcia, Boumadiene and Padilla.
Padilla LOST and was an actual US citizen. Boumadiene WON the right to file a Habeaus petition from GITMO, but was not returned tot he US.
Boumadiene WAS in US custody. Garcia is not.
Next, the ACTUAL Scoutus decision – which you misrepresented.

grants the Trump administrations request for a Stay and returns the case to Judge Xinis asking her to clean up or withdraw her order. And finally the SCOTUS decision notes that Garcia’s return may not be possible, essentially saying that Xinix can ASK for Garcia’s return, but she probably can not order it.
Essentially SCOTUS said that the administration must Try.
While I think even this is an error on the part of SCOTUS.
The details in this case matter.
Garcia was not legally in the US. The left keeps claiming he was. That is false. There is a valid deportation order for him. There was one in 2019 and it was renewed recently.
Garcia was adjudicated as a MS13 Gang leader – and he failed to preserve his appeal on that issue – so it is OVER, and not reveiwable by the court.
Xinis is way over her skis on that claim. She is not entitled to re-litigate that.
The “order” that DHS purportedly violated was an order preventing Garcia’s deportation to El Salvador. For the past 5 years and even if he is returned, he can be deported to any country that will take him EXCEPT Al Salvador.
Next AFTER Garcia was deported the Order preventing his deportation to El Salvador expired.
Next, even if it was still valid – the Rosario Gang in El Salvador was eliminated, and the basis for the order was Garcia’s alleged fear of death from a gang that no longer exists. While the Trump administration should have allowed the order to expire or asked for it to be lifted before deporting Garcia, the former has occurred, and the latter is accomplished trivially.
Whether the left likes it or not Garcia is being deported.
I have no idea whether DOJ is going to respond that they tried to “facilitate Garcia’s return and failed, or whether they are going to find a way to succeed. This unsigned order that you think is 9-0 calls into question whether Xinis has the authority to order that Garcia’s return be “effectuated”. There is a difference.
My Guess is that somehow Trump will get Garcia back, because the administration will win on this in the long run regardless.

Jonathan: Let’s see. DJT yesterday paused most of his worldwide tariffs for 90 days. And he got no concessions. And that’s supposed to be the “Art of the Deal”? How many times has DJT paused his proposed tariffs? I have lost track.
Over the weekend and into Tuesday DJT and all his administration officials said this time there would be no pause in the tariffs. DJT’s trade rep Jamieson Greer testified for two days before Senate and House panels reiterating that there would be no pause in the tariffs. Yet yesterday Greer was caught flat footed, while testifying, when he looked at his phone and discovered DJT had, in fact, done a 180. Kind of embarrassing that the US trade rep was not consulted before the abrupt change. That caused one House Rep to remark “WTF is going on here?”
It’s pretty clear the Keystone Cops are in charge of the WH in Trump 2.0. There was a newspaper cartoon that summed up the problem. It depicts DJT wearing a T-shirt, smiling with the caption: “I destroyed the global markets and all I got was this lousy T-shirt!”

It would be hard for me to dream up a statement showing less understanding of what parenting is all about. Do I have the right to insist that my 7 year old son not be out after 10PM by himself and to use physical force to bring him inside? As a society, we have appropriately been lenient in allowing parents wide latitude in how they raise their children. And that’s how it should be. There always are gray areas; i.e., how much and what kind of physical force a parent can use under what circumstances before it becomes a criminal offense. But our society has always believed in tolerance and understanding of others who are different from us. To narrow parental “rights” as this legislation would do goes way beyond what most citizens feel appropriate.

Jonathan: Considering your family history of “coercive control” it’s understandable why you think parental rights is a “primal issue” that trumps the rights of trans genders. So let me take some time to explain my own family history that might shed some light on the current trans gender controversy.
My wife has a gay nephew. He came out to his parents and grandparents when he was about 14 yrs. old. His family went ballistic and tried to put him into conversion therapy. He refused. For the next few years it was living hell for this young man. Every summer he would visit his divorced mother in another state for a month to get away from his dad and grandfather who would not accept his gayness. He biological mother accepted and loved him for what he was. At the end of the summer he would spend a couple of weeks with us just to avoid having to go back home. He is now 20 and still calls my wife every week. They spend hours talking about his predicament and oppressive environment at home.
My own family history is somewhat similar. On my mother’s side my aunt and uncle had no children. But my uncle had a sister with two gay sons. My uncle refused to acknowledge them. They were, for him, the “black sheep” of his family. They were never invited to Thanksgiving or Christmas dinners at his house. For all intents and purposes they didn’t exist.
As a kid growing up I never met my cousins. My mother would tell me stories about the youngest of my cousins who she described as “quite artistic”. Fast forward to the early 1980s. My aunt died after a long illness and my uncle had a funeral for her and invited the entire family for a luncheon afterwards. There I met my cousin “Ryan” for the first time, the “artistic” one, along with his long time partner “Mac”. We sat and had lunch together–apart from the rest of the family. After lunch my cousin and his partner invited us for dinner at their home in the Hollywood Hills. Their home, a sprawling Spanish style house with a red tile roof, sat overlooking the LA basin with a spectacular view. Inside the house Mac gave us a tour and described how he and Ryan first met. Mac owned a well known art gallery and had put on Ryan’s first solo exhibition. Their house was full of Ryan’s work–sculptures and paintings. Mac showed us a recent “Interior Design” magazine that featured their home. Then Mac showed us a recent Architectural Digest with a cover photo showing one of Ryan’s large sculptures on prominent display in the lobby of the Hilton Hotel in Hong Kong. I was blown away. To think that my cousin grew up to be a prominent artist and I knew nothing about it! That was because my uncle refused to acknowledge my cousin as gay!
The whole point of this narrative is that acceptance and loving of “queer” members of the family can be painful. It often involves denial as was the case with my family. That denial prevented me from really getting to know my cousin. He died of AIDS a few years after we met for the first time.
Which brings us to trans genders who, like gays and lesbians, are now the object of ridicule and scorn by the anti-trans crowd and political pundits on the right, like you. Under the guise of “parental rights” trans kids are marginalized and their parents try to force them into conversion therapy. It doesn’t work with queer folk and it doesn’t work with trans kids. Parents think they are doing their kids a favor by denying them medical and other care so they can reach their full potential as human beings. It’s cruel and unusual punishment that the State of Colorado is trying to rectify. As Rep. Garcia put it: “Why can’t we just understand that someone else’s identity has nothing to do with me or you”. If parents just learned to love and support their trans kids we wouldn’t be having this discussion!
There is a BIG difference between a family with religious values not willing to accept what their religion (as many religions do) declares a sin against G-d, that is their choice and these young people were not “groomed” into thinking what their very young minds can’t even conceive. There is a shamefulness in miseducated parents pushing this agenda just to keep up with the latest woke ideology. There was not this avalanche of “trans” thinking back then which makes me think that this is just a social construct with no real basis in biology or sane mental health and to punish sane adult parents for not submitting to this insane concept of changing genders by mutilation of minors is obscene at best and evil incarnate at worst. If you want to mutilate yourself with piercings, tattoos, and dye your hair blue as an adult – more power to you, but to push young children (whom we have already determined to not have the ability at that young age to note the dangers of smoking or drinking or taking drugs, for instance) into such irreversible, damaging actions because of an insane woke fad is to be condemned by any sane adult.

In that capacity you will disagree with your child many times as to what is best for them and you will have to pick your battles while you work towards the best outcome possible. You might think you are all super enlightened today but the reality is lots of these adolescents have issues and working through them is a process. Someday when you have a troubled teen you will realize you can’t just go along with every boneheaded thing they come up with on their path to adulthood. I too was an expert on raising kids until I had my own. Reality isn’t the same as this pleasant fiction in your mind.
There is a vast difference between small minority of gay male and lesbian compared to the new trend of child mutilation by surgery and man made drugs.
That is why The U.K. And other European nations have abandoned these harmful drugs and surgeries. There was a time when big medicine thought frontal lobotomies were the thing or Thalidomide was safe.
There is no heterosexual youth (or any youth of any persuasion) who has any business engaging in sexual activity so early. We know it happens but it is to be discouraged and should not be normalized. Let kids be kids.

Parental rights are both a primal issue and a necessity for societal survival.
There are no “transgender rights” – all adults have the same civil and natural rights.
Children do NOT have civil rights.
It would be nice if parents were affectionate and expressed their love of their kids.
But it is a requirement that they protect them and prepare them to be adults.
That far more than affection is actual love.
If you allow your child to jump off the roof of the garage because they think they can fly – you do not love them.
It is the primary job of parents to give children enough latitude to learn and grow, while not so much that they kill themselves.

There is a reason that people with unusual sexual preferences were in the closet and persecuted for much of history.
When the average family had 7 or more kids and we were lucky to see 2 of them make it to adulthood, being gay or trans or having any form of sexual preference that was not productive was a threat to survival, of the family, the tribe, the nation, the race.
It is only in the modern era when nearly all children survive to adulthood that non-reproductive sexual preferances can be tolerated.
I would note – this is not my view. It is REALITY., in 10000BCE there were 2M people on earth. It took 300,000 years to reach that level.
It took almost another 12,000 years to reach 1B people.

I would further note – high estimates are 10% of the population is gay. more likely estimates are 5%. But aside from being non productive homosexuality does not truly disrupt society. Transexuality does. Estimates are that 0.3% of the population are actually trans.
I would note that bother the Gay and Trans percentages are consistent with the way unusual traits tend to distribute in humanity.
There is no cost to others to accepting homosexuality. Homosexuals do not claim or need any rights beyond those of heterosexuals.
Gay men participate in male sports, use male bathrooms, the remain male they only fundimental differences is that they chose different sexual partners.
People who claim to be trans are denying ACTUAL nature and biology.
If you are an adult that wishes to beleive you are a woman trapped in a mans body or visa verse. I could care less.

Children beleive in magic, that they can fly and in dragons. Human Teenage development is such that it is a miracle that humanity has survived.
For several years nature drowns teenagers in the ebb and flow of incredibly powerful steriods, while at the same time demanding – usually unsuccessfuly that we functions as adults in many ways and children in others. it is a tulmultuous period, and there is pretty much nothing we can do about that. Teens beleive many things about themselves and the world – and often they are right.
But not always. We do not let teens drive until they are 16 and we do not let them drive at night until they are 18, we do not let them drink until they are 21. While these constraints are arbitrary – they are not without any basis. Teens are just not capable of making all the same decisions that people must make as adults without significantly higher risk that adults. It is not without reason that car insurance is more expensive for teens.
My point is that while often teens are right about themselves – often is NOT the same as always.
the overwhelming majority of teens who think they are trans prove to be gay – or atleast that used to be the case.
Today the left has convinced most of the planet they are some form of significantly sexually abnormal – which only a moron would beleive was true. Survival of the species is instinctual. If you beleive the overwhelming majority of people are not heterosxual you are defying nature.

A parents job is not to entertain their children’s fantasies. It is to get them to adulthood without F$%King up their lives.

But the FACT is today there is no scientific test for gayness. We do not know why some people are gay and some are not.
We call this a sexual preference – suggesting it is a choice. I personally do not know that it is – but I also do not know that it is not.
We do not know if homosexuality is genetic, environmental, or the result of abnormal hormones during pregnancy.
We do not know – and the left refuses to allow people to even try to figure it out.
The rest of us are REQUIRED to accept that being gay is both a choice and not a choice as the mood strikes.

If a child – regardless of age incorrectly determines that are gay. there are no long terms consequences of that that are worse than many other poor decisions that children or teens make.

What these people perpetrate upon their children *is* child abuse, as far as I’m concerned; after 21, do whatever the hell you want (but do not go after children). Ditto for school counselors etc. that follow suit. 20 years ago this would have been the subject matter for the plot of an episode of ‘Law and Order: SVU’, and these would not have been the good guys – it is absolute madness, and it isn’t sustainable.
