“I Have No Idea”: Justice Department Official Raised Objections to Ill-Defined Biden Pardons

The House Oversight Committee is investigating the use of the autopen by Biden officials as allegations grow that President Joe Biden had little idea of some of the actions taken under his name, from executive orders to pardons. Now, the Committee has disclosed that at least one senior official warned that he had “no idea” what the parameters were for Biden’s blanket pardons and that the public was being misled about the pardons only applying to non-violent individuals.

Associate Deputy Attorney General Brad Weinsheimer told the Office of White House Counsel they needed an additional statement from the President as to his intent and the scope of the pardon:

“I think the language ‘offenses described to the Department of Justice’ in the warrant is highly problematic and in order to resolve its meaning appropriately, and consistent with the President’s intent, we will need a statement or direction from the President as to how to interpret the language…I have no idea what interpretation the incoming Administration will give to the warrant, but they may find this interpretation attractive, as it gives effect to the language but does not go beyond the four corners of the warrant.”

So, at least for this senior Justice Department official, it was not just Biden who may have had little idea of what pardons were being issued under his name. The confusion was shared by implementing attorneys. That is a serious problem in the use of this presidential power by unseen, unnamed staff members.

Weinsheimer also flagged how even the stated intent of Biden in barring violent individuals was being disregarded due to the ill-defined criteria:

“One other important note – in communication about the commutations, the White House has described those who received commutations as people convicted of non-violent drug offenses. I think you should stop saying that because it is untrue or at least misleading… As you know, even with the exceedingly limited review we were permitted to do of the individuals we believed you might be considering for commutation action, we initially identified 19 that were highly problematic.”

House Oversight Chairman James Comer is pursuing this investigation despite opposition from Democratic members and, of course, many in the media. Yet, there is mounting evidence that Biden was clueless on major decisions made in his Administration, including signing a major executive order on natural gas exports. In this latest controversy, a veteran Justice official did not have a clue about the scope of the pardons as staff members just compiled lists of people whom they wanted to include in the presidential order.

What is particularly disconcerting is how accountability for any abuse is made more difficult by the large number of staff contributing to these lists and lack of clearly defined decision makers.  With Biden abdicating his own responsibility, staffers were allowed to effectively add names to a signed blank page, exercising a presidential power with the level of circumspection of an inter-office memo.

Until Biden, we had been blessed with honorable men and women serving their nation in administrations led by honorable and trustworthy men who were elected president. Biden, of course, altered that procession of fine people and patriots immensely and for decades, perhaps centuries, to come.

    As we clean house and exorcise the political demons from our sacred national shrine, let us focus mostly on finding out everything that occurred, how it was caused, who caused it, and what did it do. The idea of retribution or revenge should be secondary as the likelihood of the same people ever being able to resume their treachery is nil.

    But finding the facts and dealing with them is essential, if for no other reason than to deter anyone in the future from considering the same path. As Frederick Douglass said, “We have to do with the past only as we can make it useful to the present and the future.” It seems Congress has a lot of useful things to do with what has been learned from the corrupt and evil Biden administration.

        Nixon led the country through the difficult days of the late ’60s — race riots, student riots, inflation and the Vietnam War, none of which he was responsible for. Voters in 49 States declared that they did trust him.

Her last moments filled with terror and agony.

      These criminals now face life without parole in supermax jails where they have no contact with other human beings except the guards. Many have said that this is a fate worse than death.

      On the other hand you fail to mention the large number of J6 criminals pardoned and released by Trump, who are now back in prison on other charges, many involving the sexual exploitation of children.
      There are now children who have been sexually violated by people released from prison by Trump.
      In other words, Trump is complicit in the sexual violation of children, something that he is quite familiar with unfortunately.

      Here is a very short list.

      Theodore Middendorf: Middendorf pleaded guilty to destruction of government property on January 6th. He was sentenced in 2024 to 19 years in prison for sexually assaulting a seven year old and remains in prison.

      David Daniel: According to prosecutors, Daniel was part of the attempt to break through a barricaded Senate door and pleaded guilty to resisting police officers. He remains in custody after Trump’s pardon on possession of child sexual abuse material charges brought in 2024.

      Andrew Taake: According to the FBI, Taake assaulted Capitol Police officers with pepper spray and a metal whip. He was sentenced to over six years in prison for his role in the insurrection. After Trump’s pardon, he was rearrested on charges of sexual soliciting a minor.

      Edward Kelley: Kelley was one of the first insurrectionists to breach the Capitol and was found guilty on several charges related to January 6th. He was convicted on charges of plotting to murder the FBI agents who investigated him in the January 6th case and is scheduled to be sentenced in July.

      Shane Jason Woods: Woods pleaded guilty to assaulting police and a press photographer. After Trump’s pardon, Woods was convicted in April for multiple counts including reckless homicide and driving under the influence in 2022.

      Zachary Alam: Alam was sentenced to eight years in prison for his role in the insurrection. After Trump’s pardon, Alam was rearrested in May for an alleged home invasion and theft.

      Brent John Holdridge: Holdridge pleaded guilty to parading, demonstrating or picketing in a Capitol building on January 6th. He was arrested in May for stealing tens of thousands of dollars worth of industrial copper wire and faces charges of burglary, grand theft and possession of stolen property

      Taylor Taranto: Taranto was convicted of several crimes related to January 6th including possession of an unregistered firearm. He was arrested in 2023 for illegal gun possession and making a threat to blow up the National Institute of Standards and Technology and was convicted this May.

They are all presumptively valid, and any prosecutor trying to bring charges against one of these people will have to PROVE, at least on the balance of probability and probably beyond reasonable doubt, that Biden did NOT consciously pardon that person, or a category that included that person, or that he was incompetent at the moment when he did so.

        Remember that Biden had good days and bad days. He wasn’t ga-ga all the time. So you’d have to prove that the pardon in question wasn’t made when he was having a good day, perhaps immediately after waking up from a refreshing nap.

It is not a “Get Out of Jail Free” card that can be used by a defendant for whatever he may be charged with.
