Des Moines School Superintendent Arrested by ICE as Protesters and Politicians Call for his Release

Des Moines Public Schools Superintendent Ian Roberts was arrested this week after fleeing ICE officers and abandoning a school-subsidized car with an illegal handgun inside. Roberts has a criminal record and a long-standing order of removal from the country. The case has become a flashpoint over immigration policies with protesters demanding his release and Democratic politicians denouncing his arrest as evidence of a fascist regime. The controversy is also spilling over into the Senate race, as the district board is headed by Board Chair Jackie Norris, a former Chief of Staff to Michelle Obama and a current Democratic candidate for the United States Senate. Norris called for Iowans to rally around Roberts with “radical empathy.”

The DHS statement says Roberts entered the United States on a student visa in 1999. Roberts had a “final order of removal” in May 2024 for the deportation.

The District maintains that a third-party comprehensive background check was conducted on Roberts, and he was required to verify employment eligibility for all employees. If that is the case, Roberts may have lied on school forms about his eligibility. The District says that “Dr. Roberts completed the I-9 employment eligibility verification form and submitted the required documentation.”

His hiring by the Des Moines School District was conducted in secret, and there are conflicting reports on whether some in the district may have been aware of his illegal status. The District denies that allegation, but did acknowledge that they were aware of a prior gun charge related to a hunting rifle.

When ICE and Iowa State police moved to arrest him, Roberts sped off. He was later found hiding in high grass, and his car contained a loaded handgun, a large amount of cash, and a hunting knife.

Associate Superintendent Matt Smith will serve as interim superintendent and quoted Roberts as a guide on how they would move forward. Smith expressed how “devastated” the district is over the arrest, but “In the words of Dr. Roberts, ‘if you paddle together, you will survive the tide. If you paddle alone, you will likely drown.’ As we learn more, we chose to paddle together.”

Paddling together does not seem the case in the public statements and could become more difficult if the federal government pursues the district for the hiring of an undocumented person.

Hundreds of protesters gathered to denounce ICE and demand the return of Roberts. Politicians and protesters brushed aside the illegal gun in his car and his flight from law enforcement. That includes a possible charge from the Bureau of Alcohol, Tobacco, Firearms and Explosives over the firearm found in his car.

It also appears that Roberts may have violated the district policies barring weapons, which state that “weapons are prohibited on school grounds or at a school-sponsored or school-related activity.”

In its statement Friday evening, the Des Moines district said a third-party comprehensive background check had been conducted on Roberts and he would have been required to verify employment eligibility for all employees.

In a post on Facebook, Iowa Rep. Larry McBurney, D-Des Moines, said he was “furious” about Roberts’ arrest: “This is not only unacceptable, it is an outright disgrace.” He added:

“I hold President Trump and Iowa’s delegation — Congressman Zach Nunn, Senator Chuck Grassley, and Senator Joni Ernst — directly responsible for this action. Their silence or complicity will not go unnoticed. If they have any shred of leadership, they must intervene immediately.”

Mazie Stilwell, executive director of Progress Iowa, joined McBurney in the expression of outrage:

“No Iowan is safe. We’re living under a fascist regime because Nunn, Miller-Meeks, Hinson, and every single Iowa Member of Congress has been in lockstep with the MAGA administration that is terrorizing our communities. President Trump is willing to use political power against anyone who disagrees with him.”

Roberts, 52, claims a Bachelor of Science degree from Coppin State University in Baltimore and received his doctorate in Urban Educational Leadership and a Master’s degree in Education from St. John’s University in Queens, New York City. He was previously superintendent in the Millcreek Township School District, which covers suburban areas outside Erie, Pennsylvania.

That means that he filled out this paperwork previously and either revealed his undocumented status or lied.

He also worked as the superintendent of the St. Louis Public Schools High School Network, as well as a chief schools officer, superintendent of secondary schools, principal, and senior vice president of a charter management organization in Baltimore, the South Bronx, and Washington, D.C.

As Des Moines’ 15th superintendent, he received  a base salary of $270,000 annually as part of his two-year contract. It also includes a payment to a “tax-sheltered annuity” of 14% of his annual salary, as well as a $600 monthly car allowance and reimbursement for “all in-district related travel.”

The question is how the federal government will respond to these multiple school districts hiring Roberts. It is unlawful to hire someone with an illegal status under immigration laws.

DHS classifies an employer as “knowingly” hiring an “unauthorized alien” if, after November 6, 1985, the employer “enters into, renegotiates, or extends a contract or subcontract to obtain the labor of an alien you know is not authorized to work in the United States.” Under Section 11.8, ICE allows for a “good faith” defense when determining if an employer knew the illegal immigration status of an employee.

The government can seek injunctive relief against employers who fail to properly vet their workers.

  1. The Gun-Free School Zone Act is a federal law with stiff penalties which prohibits unauthorized firearms on school property, and the Act was enthusiastically supported by Democrats. At the time, no one suggested it applied only to white people in Iowa.

    ICE could give Mr. Roberts a choice: fierce prosecution under the Act or self deport. In any event, he can’t work here due to his illegal status.

    Given his record in education, race grifting, and firearms smuggling, I’m sure he can find gainful employment abroad.

      Doctors could be paid more except for the amount that is siphoned off by for-profit insurance companies, for-profit medical groups, and for-profit big-pharma. Democrats have been trying to cut off that siphon, but the Republicans keep working to eliminate employment protections and corporate oversight.

    So this guy is raking in ~$660,000 in two years plus car allowance!, and the school district was so blasé about conducting a proper background check and I-9 clearance. I was an
    I-9 clearance official for my office and the guidelines and steps to take are very clear, as is the type of documentation required, as is the penalties for both the applicant and the official. If I was the I-9 certification official, I’d might be kind of worried about my job, and maybe think about hiring a lawyer.

    As to the background check, this school district apparently was willing to believe that an illegal alien wasn’t going to lie about his status, that they apparently took him at his word on many issues. I guess picking up the phone and calling DHS to inquire about his status, especially since he was a foreign born individual, wouldn’t cross anyone’s mind. But I get it, any $ and anything to advance DEI over the students.

    I wonder how the Des Moines school district stacked up in standardized testing of their students over this criminal’s terms?

    As we all know there was no riot or insurrection on January 6. It was simply a peaceful demonstration, and law enforcement actually opened the doors and allowed the crowd to enter the Capitol.
    We also know that 274 FBI agents were secretly sent into the crowd as agitators to instigate a riot, that didn’t actually happen, because there was in fact no rioting on that day.

    Trump just posted the following on Truth Social:
    “It was just revealed that the FBI had secretly placed, against all Rules, Regulations, Protocols, and Standards, 274 FBI Agents into the Crowd just prior to, and during, the January 6th Hoax,” Trump wrote. “This is different from what Director Christopher Wray stated, over and over again! That’s right, as it now turns out, FBI Agents were at, and in, the January 6th Protest, probably acting as Agitators and Insurrectionists, but certainly not as ‘Law Enforcement Officials.’ I want to know who each and every one of these so-called ‘Agents’ are, and what they were up to on that now ‘Historic’ Day.”

    Now Kash Patel has corrected this statement:
    “Patel has now said in a statement to Fox News that President Trump is incorrect, stating that 274 FBI Agents were not in the crowd prior to the start of the riot, and only entered to carry out crowd control once the violence began and demonstrators attempted to force their way into the Capitol Building.”

    So apparently the story is now as follows.
    There was no rioting, only peaceful demonstrators who were let into the Capitol by law enforcement. But the FBI law enforcement who were sent to instigate a riot that never happened were not there at the start of the riot that never happened. According to Patel, the FBI agents were sent in to carry out crowd control AFTER the beginning of the rioting that never happened when the peaceful demonstrators tried to force their way into the Capitol after the law enforcement officers opened the doors and invited them in.

      Speaking on “Jan 6th” is a misnomer. There were three different events that happened, and both the left and the right purposefully conflate them for their own political purposes:

      1) A riot of about 250 people broke out on the steps of the capitol building where rioters attacked police officers, broke windows, and entered the capitol building. All the images you see from the left of are of this incident.

      2) About a mile away from the capitol building, a crowd of something on the order of 100,000 gathered to hear Trump give a speech.

      3) After Trump’s speech, around 1,000 people marched from his speech to the capitol building. When these people arrived, the riot had long ago passed inside the building and capitol police simply waved the crowd into the building. These people followed the ropelines chanting their slogans and waving their signs and left out the other side of the building. This is what the right-leaning media focuses on.

      As someone who is neither left, nor right, the group in the 1st instance should be prosecuted to the fully extent, but the people in the 3rd group should not have been prosecuted. Biden prosecuted both groups ruthlessly, so Trump just pardoned them all. Neither has the moral high ground.

      With the report of 274 FBI agents on January 6th, things are not more clear. If there were 274 FBI agents in group 1, that is a massive scandal of epic proportions. However, I rather suspect that those agents were embedded in group 2, which makes it a non-event (274 agents in a crowd on 100,000 is irrelevant). Since the announcement didn’t specify, the right has immediately leaped to the conclusion they were in group 1.

        Inaccurate
        There was no rioting at the capital steps at all. The “violence” took place at the est tunnel entrance after the CP tear gassed themselves and tear gassed peaceful protesters forcing two groups that had been separated into each other while they were irratated by Tear Gas.

        I am not sure of the precise timeline – but this did not occur until AFTER larger numbers of people had already arrived from the elipse.

        One the capital steps which is a different location entirely, there were “bicycle fence” barriers which somebody moved away before the bulk of protesters arrived. The protesters proceeded unimpeded to the doors to the capital which were opened from the inside and protesters marched peacefully through the capital.

        If you say the crowd at the elipse was 100,000 – maybe that is so, but the estimates I have heard are lower.

        Your timeline has significant deviation from anything I have ever heard prior.

        There is plenty of video of the events leading to the violence at the west tunnel entrance
        and more than 250 people were at the west tunnel entrance when the CP went nuts with Tear Gas.

        There were multiple different groups moving through the interior of the capital. But I have never heard that the West tunnel entrance where the violence was was successfully breached.

        There were SLIGHTLY more militant groups that entered the capitol – such as the groups that Alishi Babbit moved with. That group moved more aggressively. the CP stage several delaying actions to that groups – to allow the members of congress to exit the chamber before the protesters arrived.
        The group that Alishi was part of reached the speakers lobby – which is where many congressmen were exiting from, Before they had all left. But the CP refused to allow them to pass until after the congressmen had all existed the chamber and the speakers lobby.

        There were efforts to break down that door – including breaking glass BEFORE the CP allowed the protestors to continue. But no one went through the glass until the speakers lobby was empty and the CP moved away from the doors.

        Alishi’s group appears to have been the most violent INSIDE the capital. breaking a few windows inside the capital.
        Alishi’s groups is also the group that We KNOW had Antifa in it – as the primary video of that was taken by a person who is part of Antifa.

        Almost all the actual violence was very near the west tunnel entrance on the OUTSIDE of the capital.

        I am not aware of any evidence as to who moved the bicycle fence barriers – but it occurred BEFORE the protesters arrived and before any violence.

        I do not think it has been established how the capitol doors were opened either.

        Even that is complicated. It is absolutely true that outside the group at the west tunnel entrance nearly everyone was peaceful. And again with few exceptions there is zero reason at all that nay of them ever should have been prosecuted.

        But even everyone who was at the west tunnel did NOT initate violence.

        The CP initiated the violence at the west tunnel entrance – not the protestors.
        That does not exhonerate every single act of violence at the west tunnel entrance.

        There is a duty to retreat – when you can – but people were being pushed by the crowd after the tear gas grenade landed in the crowd, and the CP responded to people being pushed into the with violence.

        First there is absolutely no one at J6 that should have been treated differently that overall more violent protesters at the Kavanaugh hearings. Few of which were prosecuted.

        In general we arrest protestors who refuse to obey the directions of law enforcement and even engage in pushback.
        But so long as they did NOT engage in anything an ordinary person would call a violent assaultwe later release them after the event is over and we do not prosecute them.

        That is the norm for ALL protests – and the left would be wise not to change that, there is far more left wing protests and far more pushing and shoving.

        One of the reasons Trump pardoned/commuted everyone – is that no one got a fair trial. The president does NOT have the power to give them a new fair trial. He can commute – and that is what he did with many who were violent. or he can pardon.

        We still do not really know what that means EXCEPT that DOJ was lying about it – to the public and to congress and to the courts, and most important to the defendants. No matter why those agents were there – the defendants were entitled to know about any agents that were even witnesses to the conduct they are alleged to have committed.

        Some on the left here are reporting that the 274 agents are people who were sent AFTER the violence started.
        That is different from present before.
        But the people saying this are not credible so I am waiting for credible information.

        What is more problematic is that the FBI/DOJ has lied for 4 years about this.

        1. The west tunnel was the tunnel where Rosanne Boyland was murdered or died. The tunnel became a trap as gas was released. People could not continue in the direction they were moving, while others were entering the tunnel from behind. I saw several videos of a woman being hit with a baton or stick by a black female police officer while on the ground. She died around that time.

    3. I received my invitation to president Trump’s ‘Stop the Steal’ shindig-hootnanny almost two weeks prior to the event.

  12. ICE enforces immigration law ‐- they’re not the ATF. Ian had pleaded guilty to a charge of having a loaded firearm in his vehicle, and guess what? — he had a loaded firearm in THIS vehicle. Illegal aliens cannot possess firearms in this country.

  15. How does a search firm fail to assure that the candidates it puts forth, especially for taxpayer-funded jobs, are eligible to work in the USA? (Federal law is very clear about the kinds of documents that employers must require to demonstrate eligibility to work.) I must wonder if this alien illegally in the USA and illegally working in the USA was tipped off that he was being sought by ICE; an AP article mentions that he was found with a LOADED gun and a hunting knife … and $3,000 cash. BTW: The same AP article says he graduated from Coppin State in 1998 – but entered the USA on a student visa in 1999!

  17. Even if this felon didn’t possess the immunity shield of being a black criminal, Democrats would still be outraged, The fact he had been through all his due process and was hiding from the deportation order wouldn’t matter.

    The fact that their favored criminal was committing several federal gun felonies, having a gun near or on school property and being a convicted criminal possessing a gum, it still wouldn’t matter.

    “Nobody is above the law” only applies to white Republicans.
