As a native Chicagoan, I must confess that I have little patience for Mayor Brandon Johnson, a politician who has been a disaster for the city. One of the most unpopular mayors in the city’s history, Johnson has been using the increased ICE operations to try to ride a wave of rage back into popularity. His language has become more and more inflammatory in calling for citizens to “resist” and “fight” federal law enforcement. Now, he is claiming the authority to not only mandate “ICE-free zones” in the city but to arrest federal officers.
Ironically, Johnson has declared that President Donald Trump wants a “rematch of the Civil War.” However, it is Johnson who is pursuing antebellum policies. It was the South that claimed independence from the Union and fought to expel federal troops.
Johnson signed a ridiculous executive order creating “ICE-Free Zones” to ban federal agents from using city-owned properties and property of unwilling private owners as staging areas for immigration enforcement.
The federal government has its own jurisdictional authority and can enter city and private property in pursuit of lawful operations. In terms of “staging” operations, the Constitution, not Brandon Johnson, protects citizens from having their property seized or used for the quartering of troops.
Most importantly, the City of Chicago cannot arrest federal officers who are conducting federal operations. This point was correctly noted earlier by Chicago Police Supt. Larry Snelling, who said that CPD officers will not arrest federal law enforcement, “because someone deems what they are doing is illegal.”
Nevertheless, Johnson was back to his signature chest-pounding bravado: “We’re going to see people in court. As far as other authority that allows for us to be able to enforce this ordinance, we’re exploring.”
In the meantime, Gov. J.B. Pritzker has been using equally inflammatory language about a few hundred National Guardsmen “occupying” the city and, most recently, told Rachel Maddow that the National Guard would intimidate voters at polling places and it might even seize voting boxes or ballots to steal the upcoming election.
Both leaders are attempting to marshal the mob for political purposes. At a time of rising political violence, including the recent sniper attack on an ICE facility and the Charlie Kirk assassination, Pritzker and Johnson are fueling the rage.
The federal government has the right to enforce these laws to deport individuals. Congress passed these laws and, if these politicians oppose them, they can seek to rescind deportation laws in the democratic system.
Johnson has continued to double down on his reckless rhetoric, declaring that
“The Trump administration must end the war on Chicago. The Trump administration must end this war against Americans. The Trump administration must end its attempt to dismantle our democracy.”
Threatening the arrest of federal officers enforcing federal law is not defending the rule of law or democracy. Indeed, a similar claim was made by Southern politicians not only before the Civil War but during the Civil Rights era. It was governors like George Wallace who insisted that he could stop federal officials and the National Guard from enforcing federal law.
Likewise, it was George Wallace who objected to the “unwelcomed, unwanted, unwarranted, and force-induced intrusion” in his state by federal law enforcement.
Before Johnson attempts to arrest federal officials, he might want to take another look at the Constitution and review some history on the subject. Wallace also tried to ride the wave of rage to power after “standing at the schoolhouse door in person, if necessary.” It did not work. The federal government prevailed, and Wallace was left as a tragic relic of history.

Sanctuary Cities and States, despite dishonest denials, subvert Constitutional Immigration Policy that the Federal Gvt. is charged with. This Chicago/Illinois debacle is simply proof that NO migrant is illegal or should be deported in the minds of those who welcomed them here. Sure, Dems can showcase one or two that they want out and how cooperation with Feds was performed legally and within the confines of their “sanctuary” policies. This placates media and Leftists, but still stands in opposition to the new Administration’s legal authority to enforce Federal Immigration Law. Demanding their way while compromising nothing of importance, enhancing the conflict, and poking for reactionary responses is what Leftists do. What power do States and Cities have in crafting, enacting, and driving their own Immigration Policies with minimal oversight of the Feds? Then, when criminality is allowed to overrun the citizenry, what obligations does the Federal Gvt. have to defend them and restore order? The complication is the increasing vile Leftist ideology of a vast majority of Dem leadership. Agree. I think that Trump, for all his demonstrated ability to achieve results by misdirecting and confusing his opponents, is coming to a point where he has to deliver on some essentials about which his supporters at least believe that they received a good faith promise from him. You mentioned one. Another, to me, is the promise to permanently fire unnecessary Federal workers in the event that the Democrats in Congress caused the shut down of the government. Well, here we are on Day 8 of that shutdown, and I have yet to learn of any significant progress, or even an initial attempt, to fulfill that pledge. Yet another lack (although it may not rise to the level of an explicit promise) is going along with clearly unconstitutional decisions from lower echelon Federal courts to allow the appeals to work their very slow way up to SCOTUS. Trump has won the vast majority of those disputes that have made it to that level. IANAL but I would think that at some point sufficient groundwork has been laid in that regard to begin ignoring lower court opinions that ludicrously exceed the power of those judges. Some would no doubt comment that such behavior would precipitate a Constitutional crisis, to which my reply would be: “compared to what we already have? – you can’t be serious”
There’s another incident that plays into the mayor’s calls to have ICE-free zones.
There was an incident in Chicago. When a woman was shot by a CBP agent who claimed he and his team were surrounded by 10 cars and rammed by the woman. They were allegedly forced to fire “defensive shots” and struck the woman before she fled to a hospital.
Turns out CBP has been lying about what occurred and it is alleged the CBP officer fired his gun at her because he was mad at her. That poses a problem for CBP. There could be criminal charges for shooting her without provocation. The claim from CBP fell apart yesterday when it was revealed that she never brandished a gun and she and other drivers never boxed them in. It was the CBP who rammed her car, hopped out, and started firing into her windshield (5 shots) before she was able to flee.
CBP first claimed she was armed with a semi-automatic weapon, but she never brandished it and she had a legal concealed firearm license. Plus it turns out one of the officers had a bodycam that was turned on and recorded the crucial moment that CBP claimed the woman rammed them when in fact it was the CBP that rammed her vehicle. Multiple claims from the CBP fell apart when the evidence showed their stories did not match their reports. CBP was lying.
There is a pattern of lying and deceit from DHS, ICE, and CBP and it’s not helping their cases when they do go to court. They have already been caught making false 911 calls and intentionally provoking protesters into conflicts to justify their presence and tactics. Maybe there is indeed justification for threatening to arrest federal agents who are breaking the law.

I actually had a co-worker, who was from Chicago, come back from a trip to Chicago and was quite shaken. She had been sitting in a restaurant in a the suburb where she had grown up when a bullet came through the glass window and passed between her and her friends on the other side of the table and then proceeded on to bury itself in the counter. She had to keep going back to visit because of family there but I had no such compulsion.

The blacks I happen to know are not living in the Jim Crow era, they took advantage of the opportunities open to them got a good education and have great jobs and families. And in case you don’t know Asian Americans have higher education and income than white Americans. Anon, the problem is not with the Constitution but with the institutions that undergird it. Most have been captured, degraded, and weaponized by one of the major parties. Most notably it is the failure of the main stream media and its near monolithic alliance with the Democrat Party. Our system of self-government relies on an informed public to hold its representatives in check. That requires education about the founding principles and a media that reports accurately and without bias. Both institutions have been captured by the Democrat Party for decades. There has been no accountability for the Democrats and open hostility toward the Republicans. It is not by chance that we have come to this point where the party of the left is flirting with socialism and promoting violence. The false promises of socialism entice people to vote away their freedom and rights and the violence causes them to look to government for their security. It is the Democrats that represent a threat to democracy and our Constitutional, capitalist democratic republic.
Professor Turley is correct when he states that federal law enforcement agents such as ICE, DHS, and others cannot be arrested while exercising official government actions. BUT….That immunity is not absolute. Local police can arrest federal officials who commit crimes. For example yesterday it was reported that ICE agents were placing fake 911 calls to essentially “SWAT” protesters or individuals who were not doing anything illegal and diverting police officers to areas that were either empty or no crime was being committed. The Chicago police chief confirmed ICE was making these false 911 calls which is a crime. It’s an arrestable criminal offense.
Making false 911 calls is outside their official duties and therefore an arrestable offense.

There was also an incident where a Chicago police officer threatened to arrest an ICE agent attempting to drive a vehicle through a crowd of protesters when she had access to an alternate route. The officer was intent on provoking the crowd to get violent by driving through and the Chicago police officer knew what she was trying to do. The officer repeatedly threatened to arrest her if she attempted to drive through the crowd. That is not an official action. To drive through a protest when there was a safer alternative.
Shooting pepper balls at a CBS reporter from inside the fence of an ICE facility without provocation is also not an official government action. This is why the Chicago Mayor is threatening to arrest those committing crimes.
State officials are not going to arrest ICE agents for doing their jobs. But when they do things outside their official duties such as making false 911 calls and shooting pepper balls at reporters from inside an ICE facility when there are no protesters and no threats they can indeed be arrested.
So legally state police can arrest federal agents if they are committing crimes that are outside the scope of their official duties.

Whatever. I have written here on several occasions about my attempts to sign-up for a WordPress account. I have also mentioned that my ability to provide an ad hoc ID for a comment w/o such an account entirely disappeared after apparent upgrade made here several months ago. I use Proton VPN for 100% of my browsing, and many, of not all, of those issues appear to be related to VPN use. A more remote possibility is that some of that behavior might be incidental to use of the Firefox browser. I would bet good money that Darren Smith could re-establish the ability for a poster without an account to provide such an ID, but he seems to have chosen not to do so. So, while I enjoy reading many of Turley’s columns here, and occasionally feel compelled to comment, I will be d@mned if I intend to compromise my on-line security measures to induce any other particular person to read them. Nope. There was an alternative route the the ICE agent could take. There was no reason for her to drive through the protetsters. Aternatively if the protesters where on the street I assume they had a permit for that particular street to protest on. The protesters were not blocking the alternative route. That is why the Chicago police officer was threatening to arrest the ICE agent if she insisted on driving through the protesters. It was apparent to the officer the ICE agent wanted to provoke the crowd. He was having none of it. Particularly when she had a safer free route she could take.

I read the article. It contains no actual evidence of an ICE agent making such a call. The article even hedged about it when it used the words, “if true” when referring to the incident. A review of the calls made from the detention center will be carried out. If they find evidence that it happened, the story will be all over the news. And, rightly so. However, if no evidence is found, we will hear nothing and people will continue to believe that it happened.
The calls coming from the ICE facility are the evidence. What they can’t determine yet is which specific agents are making the calls. What is not in dispute is that they are making false 911 calls. They are traced back to the facility and someone is making them. They already know the calls are coming from the facility. They already know the calls are false. The only thing they would need is the name of the agent/s who made the calls and they can press charges.
What is not in dispute is that they are making false 911 calls.

In fact, it’s worse than a rebellion. The coastal metros don’t want a host of U.S. laws enforced in their counties, but they’ll be happy to hijack the federal government to spy on and imprison their critics anywhere they find them. “What’s mine is mine and what’s yours is negotiable” is the new creed of the Democrat Party, and yes, they’re coming even for the children.
This is why President Trump has ordered in the military, just like Andrew Jackson and Abraham Lincoln did. There’s plenty of precedent and plenty of justification. If they lay one damn hand on a federal officer, I hope Johson sits in the same cell occupied by Jeff Davis. The irony would be perfect.

If Pritzker and Johnson had their house in order, one might pay more attention to their pronouncements. There is a real psychosis taking a tight grip on some of the public and public officials. It amazes me that in my county executive race, both of the two candidates are pledging to fight Trump. This is a county executive race – not a race for someone aspiring for Congress or even Governor – where the top issues should be public safety, roads, public transportation, property taxes, small business support, commercial development, residential zoning and building regulations,… – the usual collection of issues that affect the voters. But no, somehow resisting federal authorities enforcing laws passed by Congress seems to get the juices going for the two candidates for the county executive.
I think the example of George Wallace provided by Prof Turley is good. Today we look back on it and are appalled at the thinking motivating Gov. Wallace. Perhaps, if history is to be an indication of the future, the nation will look at Pritzker and Johnson as the clowns that they are.
