We have previously discussed the alarming demands of former Special Counsel Jack Smith for the phone records of members of Congress. Despite the efforts of members like Rep. Dan Goldman (D, NY) to downplay the gravity of such demands, they represent a serious intrusion into the confidentiality of legislators’ communications, including the potential disclosure of journalists, whistleblowers, and others. Now, it appears that AT&T did supply the records of former House Speaker Kevin McCarthy, the second in line of succession to the presidency of the United States.
The new disclosure contradicts earlier denials that Smith obtained the record. AT&T had indicated to Senate Judiciary Committee Chairman Chuck Grassley that the company had not shared any of the former speaker’s phone records.
However, a letter from AT&T to Grassley now indicates that McCarthy’s records were given to Jack Smith after a separate demand that did not identify him as the Speaker of the United States House of Representatives. The FBI’s Criminal Investigative Division tied the demand to a “significant case notification.” AT&T admitted that it had processed the separate request and turned over the records. It emphasized that the subpoena “sought records for a personal cellular phone number” and that it did not in “any way indicate that the information sought related to a member of Congress.”
McCarthy responded to the news by warning that “if corrupt justice will do it to the speaker, they’ll do it to anyone.”
He is right. Indeed, in an equally chilling acknowledgment, the company noted that the number of these demands is so high that it rarely exercises much scrutiny or review unless the government flags their position or status:
“AT&T’s Global Legal Demand Center receives hundreds of thousands of legal demands each year, and unlike the May 2023 subpoena discussed in our October 24 response, the subpoena we produced today did not seek records from a campaign account. Rather, as confirmed from press accounts, the subpoena sought records for a personal cellular phone number. It also did not in any way indicate that the information sought related to a member of Congress.
As a result, the subpoena processing center had no reason to believe that the phone number was associated with a member of Congress, and AT&T did not make further inquiries to the Special Counsel and produced the information as required by the subpoena.”
Goldman’s dismissal of any concerns over such records being exposed is hardly surprising. However, the media has shown only muted or passing concern about the implications of Smith’s intrusion into legislative communications.
The sweeping and reckless demand by Smith is a signature of his career. He has shown a sense of impunity in how he conducts investigations, an abandon that has led to major losses such as the unanimous overturning of his conviction of former Virginia Governor Bob McDonnell by the United States Supreme Court.
These records are not the trivial matters portrayed by Democratic members. That is why Smith and others seek them. They reveal who called members, when they called, and how long each call lasted. They reveal contact information on a wide array of people seeking assistance or giving information to Congress.
To acquire such information on the man second in line for the presidency is particularly outrageous. It could expose embarrassing or personal information on a member of the opposing party and someone who might ultimately exercise authority over the Justice Department.
The lack of outrage from Democrats and the media shows how ideology now blinds many to their institutional and professional interests. As someone who has worked closely with members and represented the House in court, I always assumed that such information would be confidential. I am certain that the members operated under that same assumption. That has now been shattered, and all the many Democratic members and pundits can muster is a shrug and a smile.

c) For those whom lawfare is ineffective, SCOTUS and other DOJ “agents” or SCOTUS justices themselves will dox those they believe have brought it on themselves (see Couric, Kimmel, Jeffries, . . . opinions), hoping they will be massacred (with their families) and replaced with those of thinking like the oligarchical progressives – Now THAT would solve the court issues.
d) Use circular investigation, manufactured evidence, hidden evidence to prolong “investigation” beyond any statute of limitations which will encourage those who ignore actual legal process to use it as a weapon of destruction and power assurance with hatred, fear, and (when necessary) murder and assassination. Since you will never be held accountable (statute of limitations), you needn’t fear reaction.
e) Hide and suppress evidence using obvious tactics – which can be destroyed when it reaches limitations (Example: store the IRS and State Department servers and data in the Capitol Police Evidence bays, labeled in an unidentifiable labeling and indexing manner, perhaps, “Grandma’s Meatloaf and Pie Recipies, Vol I, Vol II” would work.
2. Hold the evidence in one hand and spout propaganda with the other raised – Philby Broadcasting Corporation (oops, BBC) ABC, CBS, . . . did a brilliant job of this and look at their net costs – a microcosm of the purchase of political advertising – what a huge net gain in value for them (especially if you consider the taxpayer funding of NPR and BBC – the slaves pay for it!!)!
3. Display the issues in manner so complicated, the only actual understanding and utilization is:
a) Hate, fear, destroy others that the “Popular Oligarch” funded by the progressive wealth in America identify for you!
b) Take from others (Call it “The Government Should . . .”, and no one is intelligent enough to ask “Who pays for this when “The Government Should. . . “). Live off the blood, flesh, and future of the children and those who do NOT live in the appropriate Blue Urban kingdoms which are fed this way – and feed yourself and your children with great enjoyment and satisfaction.
4. Attack others. Maria Florinda Rios Perez de Velasquez was shot and died in Indiana. Curt Andersen has been charged with voluntary manslaughter. He called 911 AFTER he shot through the door.
He’s awaiting trial and the Indystar newspaper has given a recent update well done including court papers.
It’s in the hands of defense and prosecution, judge and a jury now.

It is my responsibility – usually handled by the property managers, to provide notice, to knock and announce, and not to attempt to force entry.
You can not move the burden for that onto the resident.

No respectable hitman shoots through a door. Any intent and expectation of success would have required the shooter to open the door. This was clearly a justifiable warning shot that randomly and unpredictably hit Maria, who was acting as a criminal who was breaking and entering, causing the unfortunate incident.

But they have ignored two very important facets.
The determination of whether an order is illegal is not subjective.
If in your opinion an order is illegal and you refuse to follow it, the consequences for you if you are wrong – especially in the military could be disasterous – they could even land you in prison.
Your duty with respect to illegal orders particularly outside the military is to resign, Not resist.
Outside the military the consequences for not following an order are lower, but you are not bound to the role in the same way as in the military.
If you are given an order you beleive to be illegal outside of the military and you can not persuade those giving it to rescind it, then you must quit.
Outside the military your choices are simple – obey or quit.
I would note this is true of orders even in private business. There is no right to resist doing what your boss wants.
There is no right to a job. If you are being asked to do something you do not wish to do – regardless of the reason,
either overcome your reticence or quit or persuade your boss to rescind the order.
This is not only how things are, it is how things must be.
You can not make anything work if everyone is free to object to anything.
