Many years ago, as a law student, I had the honor of working with the great prosecutor William J. Kunkle Jr., who put away John Wayne Gacy. I was a young intern at the litigation firm of Phelan, Pope & John and loved listening to Bill’s stories about his famous cases. I even had to take a couple of calls from Gacy from prison when Bill was out. (I was asked to write down everything that he would say in the routine calls. On one call, Gacy told me, “Tell Bill he was wrong. I was not guilty of homicide. I was guilty of running an indoor funeral parlor without a license.”). One story of Bill’s came to mind last night when Democrats released their latest tranche of “bombshell” photos from the Epstein files to suggest that Trump is implicated in the scandal.
Bill told me how he would stage the trial room to maximize impact on the jury. In the Gacy trial, he was allowed to create an exhibit showing the pictures of the victims. He knew that defense counsel would not want the faces staring at the jury throughout the trial. So he made the exhibit so large that it would be difficult to move and waited for the defense to insist that the pictures themselves be removed. When they did so, they found that each picture was attached to the board by Bill with large red tape. Throughout the trial, the jurors stared at each name with a large red X beneath it. It was better than the pictures themselves.
Bill’s story came to mind yesterday when the Democrats released the photos from the Epstein files.
The White House accused Democrats on the House Committee on Oversight and Government Reform of spreading a “false narrative” with photos. It is more of an effort to create “false light,” a term from tort law where true photos are presented in a misleading and harmful way.
The photos of Trump show women with their faces obscured as “possible” victims of human trafficking with underaged girls. (The New York Post posted the unredacted picture, which actually came from an entirely unrelated event in Hawaii and was previously published with all of the faces shown).
Even a photo with a single woman on what appears to be a plane is blacked out. There is no context offered, but the blacked-out faces suggest that these women have to be protected as possible victims.
It has the same effect as Kunkle’s Xs.
However, the real question of false light is the inclusion with the other photos selected for release. The Democrats included pictures of sex toys, novelty condom boxes with Trump’s face (saying “I’m Huuuge”) and even Epstein in a bathtub.
The combination is meant to make the other photos seem more sinister, even though we have no information on where they were taken or who the women are in the images. Just Xs.
Trump is not alone in the framing of such photos. The release included a previously public photo of Harvard Professor Alan Dershowitz simply meeting with Epstein, who is wearing a Harvard sweatshirt. There is no information on when or where it was taken. (Epstein was a major donor to Harvard, and Dershowitz was a Harvard professor as well as someone who served as counsel to Epstein).
The Democrats have long despised Dershowitz, a liberal who broke ranks with the party and represented Trump in his impeachment. Now, he is included with the photos of condoms and Epstein in a bath.

Well, it was bound to happen. Professor Turley finally discusses the issue of the Epstein files…in a different light. Of course.
First of all it’s odd how he has these fond memories of his mentor using this technique which is ironic because he uses it all the time. That is why he recognized it and why he used it still in this article. I don’t blame him. It’s effective. But it is also a revelation about Professor Turley’s style of writing.
What Turley ignored, as nearly everyone in the MAGA sphere did was the fact that Trump has spent a lot, a LOT of energy and effort to distance himself from the Epstein files scandal that won’t go away. The issue is self inflicted and mostly MAGA’s fault. Trump’s most ardent supporters the crazy MAGA nuts who will believe anything are splintering from the other crazies who have long believed the Epstein files have been covered up for a reason.
Jefferey Epstein’s tentacles reached a lot of important people with influence and power. That makes him dangerous to most of those were associated with him or even interacted with him. Trump’s past as a playboy millionaire, wife cheater, creepy perv, and bragging about his sexual conquests. His friendship with Epstein is naturally in line with Epstein’s ability to facilitate sex encounters with young girls.
Has anyone noticed how Kash Patel and Dan Bongino gone silent about the Epstein files? They were the biggest fans of releasing the files, they promised to get right to it when they got to be in charge of the FBI. Seems the conspiracy theorists turned on them when they failed to do what they promised to do.
It was not just Trump who tried desperately to stop the release, Congressional Republicans fought tooth and nail to help him prevent it and this is what led MTG to realize who Trump really is. She won’t admit it but she came to the realization that Trump is a liar. Big surprise.
Lastly, nobody noticed that his grand ballroom plans are on hold? He fired the architect because he wouldn’t accept the fact that it would ruin the whole image of the White House. Now we have a huge pit sitting next to the White House and cost growing beyond the amount he promised it would “only” cost. I bet he will try to stiff the contractors to save money. Again.
Trump’s term will not fare well and this is barely a year into his second.

I have listened to Dershowitz’s podcast, Dershow, for years. You’ll see him in a completely different light, and Mr. Turley is correct in his subtle warning that he may actually be an innocent by-standing lawyer in all of this. In fact, Dershowitz was at the center as a lawyer to so much of the Epstein events. He gave Epstein the infamous Harvard shirt, and he explains it in detail on his podcast. He says wants all the evidence to come out, as he says he has nothing to fear, only to gain, as he did nothing wrong. He freely admits everyone hates him as he’s represented controversial folks from all of the political spectrum. He also maintains his Democrat political position while he proudly defends a far righter, as he fights for justice no matter what the circumstances.
It cannot be said enough: virtually everything that the left says is either a lie or misleading. The default must be that if it impugns Trump, especially, or a conservative, it’s not true and should be ignored. It’s sad that it’s this way, but it has to be for the foreseeable future.

There would have been no expired misdemeanors blown up into felonies, no usurious fines, no Letitia – they would have just run with this 24/7.
