Fellow Judge Delivers Blow to the Defense of Hannah Dugan

The trial of Milwaukee County Judge Hannah Dugan began this week. Yesterday, the defense was delivered a blow from the testimony of the judge, who Dugan enlisted to confront ICE officers seeking to arrest an illegal alien in the courthouse. Judge Kristela Cervera testified that she was pulled into the dispute by Dugan, who she said admitted that she was trying to help Eduardo Flores-Ruiz as he evaded officers.

Many of us were wondering who the second judge was who appeared in the hallway wearing her robes. It is irregular to see judges outside of their courtrooms wearing their robes.

Cervera said that Dugan specifically told her to keep her robe on and that she was reluctant to do so: “I didn’t want to walk in the hallway with my robe on.” Dugan, however, allegedly wanted the agents to see them in their robes as a sign of authority.

She said that the agent remained respectful but that Dugan was getting upset in the confrontation: “Her irritation seemed to progress to anger. I thought she could have been a little more diplomatic.”

That coincides with the testimony of FBI Special Agent Jeffrey Baker, who stated, “I would say angry is the best way to describe it.”

Likewise, U.S. Customs and Border Protection officer Joseph Zuraw stated that Dugan ordered him to “get out” of the public hallway and told him to go to the chief judge’s office. She then allegedly helped the suspect escape through a side door.

Cervera also testified that she was “shocked” by Dugan’s later conduct and that “judges should not be helping defendants evade arrest.” She added, “I was mortified. I thought that someone may think that I was part of some of what happened.”

Cervera said she was shocked by attorneys praising her for helping Flores-Ruiz escape. She described attorneys pumping their fists and telling her, “You go, Judge,” and saying, “Judge, you’re ‘goated’ now.”

She said that she avoided Cervera but ran into her in an elevator. She noted that Dugan told her she was “in the dog house” with the Chief Judge for trying to help Flores-Ruiz.

The testimony supports the allegation that Dugan knowingly sought to help Flores-Ruiz and that her actions were outside her role as a judge in the courthouse.

Dugan is charged with obstruction of a federal agency, a felony, and concealing a wanted person, a misdemeanor. As I discussed in earlier columns, the defense may be hoping for jury nullification in the liberal district. The reaction of lawyers lionizing the judges for facilitating the escape of a suspect may suggest that such a conclusion is possible in this district. The defense may be hoping that at least one juror will discard any testimony and stand with Dugan against ICE and the Trump Administration.

The jury pool can only be viewed as overwhelmingly in favor of Dugan. Kamala Harris won Milwaukee by a margin of 68%-30% over Trump.  The chances of getting politically motivated jurors are obviously significant, though that obviously does not mean that jurors cannot be persuaded in the end by the strength of this evidence.

        1. We raised a couple of guinea hogs a while back. They had an acre of woods to forage. No mess, no smell. They got all of our fruit and veggie scraps. Buckets of pecans and acorns. Damaged veggies and fruits from the farmer’s market. My neighbor gave them peaches, plums, veggies. I gave him one pig. Our son felt a bit bad when we sent them to freezer camp. After he tasted a grilled chop he said he doesn’t want to eat factory farmed pork again. There is no contest. Farming is a foundational part of a healthy country. Find a new insult motif🤣

            When I do raise hogs, they are pasture fed. Then come fall we feed them apples from the orchard. They have a much more intense porky flavor that some, having eating commercial pork all their lives, find pastured raised hogs off-putting.
            As for the annony moron, I do not watch Sponge Bob, but I would be willing to bet it would be more entertaining and informative than CNN.

  2. That is quite the blow to the defense. But I agree with the good professor, likely there is some leftist jury member who ignore law and order in order to defend some illegal alien and a lawless judge.
    This is the face of the Democrat party: Lawlessness.

          1. Not that you would know this: Judges hold significant authority during a trial, with control over courtroom proceedings from start to finish. They are responsible for ensuring that trials are conducted fairly and in accordance with the law, maintaining order, and safeguarding the rights of the accused as well as the interests of the public. One of their key roles is determining the admissibility of evidence and managing procedural aspects, such as witness testimony and legal arguments.
            In other words, they own every aspect of a trial. Even reverse jury decisions.

            1. What does that have to do with judge Dugan’s words and actions to help an illegal alien avoid and attempt to evade ICE? Based off those words and actions I would not trust her to administer a fair trail just as we are seeing other activist judges thwart ICE from legally conducting their duties as defined by Congress.

            2. The can reverse a conviction – they can not reverse and aquital, and their authority ends at the doors of their courtroom.

    1. There are 3 possibilities from the jury.
      Conviction
      Acquital
      Hung jury.

      An acquital is extremely unlikely.
      A hung jury will likely result in a retrial.

      Prosecutors usually win retrials.

      Separately the purpose of this trial is not to convict Dugan – just as the purpose of Trying Comey is not to convict him.

      It is to disuade others from doing the same. The testimoney of this other judge is telling.
      I would be shocked if she was “pro-ice” – this is milwaukee.
      But she was highly uncomfortable not only with What Dugan was doing, but what Dugan was asking her to do.

      To the left generally regarding Immigration and ICE.

      Follow the Law.
      If you do not like the law – Change the law.
      If you wish to protest – Congress is in Washington DC.

      If you actually see ICE officers violating the law – Report it.
      But do not interfere with the LEO’s doing their job – even if you do not like the laws they are enforcing.

      WE though our legislatures make our laws. WE are bound to obey those laws until we change them.
      Law enforcement is bound to enforce the laws we create.

      Do not protest or attempt to interfere with LEO’s following the law and doing their job.

      That has the potential for ending extremely badly for all of us.

      This is what the rule of law means.

  3. There are still places in this country that will not tolerate behavior like that of Judge Dugan. Those places grow a good bit of the food consumed by radical leftists. When the revolution finally explodes the cities could get hungry quivkly.

    In watching the FBI released videos of the Brown killer. It’s apparent that the killer is a slightly overweight 30-40 year old man. From his path and gait, it is apparent that he has traversed the path regularly. A hint would be to look for previous videos and prior engineering grad students. Look for cars parked regularly in the same areas. He is an immigrant foreign student by my suspicions, Middle East.

        I believe in evidence and there’s a mountain of it. The post was intended for the following thread, must’ve fat fingered. Dugan is undoubtedly guilty and with what we’ve seen so far, I don’t expect too much to come of it. When people no longer see justice being administered at the highest level, they will take matters into their own hands. History repeats itself.

Well if liberal juries and local podunk judges want to play savior with ILLEGAL immigrants and thus games with Federal Agents then I guess every joke-of-a -local courthouse needs to have agents posted during court hours to pick up the FEDERAL CRIMINALS as they attempt to enter the courthouse and then rendition them to another state within a few hours!!   9. Recently a judge overruled a unanimous decision by the jury in a fraud case. Is it possible that the judge in this case will have the guts to overrule the jury if they come back innocent?

    1. If the jury acquits, the judge can’t overrule that. It only goes against one way: if the jury convicts the judge can change it to not guilty based on insufficient evidence.

        1. Are you really that dull that you couldn’t understand the sentence without the comma? If the jury convicts, the judge can change it to not guilty. That meaning was clear from context, to which you are apparently oblivious . . . which in turn means that your reading comprehension skills are basically non-existent. The meaning you derived makes absolutely no sense, because the sentenced continued “. . . can change it to guilty . . .”

          Because that is so obvious, I realize that you know that and are just being an a’h0le, which is apparently your life’s goal. So GFY, a’h0le.

          It can not even be reversed if the Jury was bribed – but a bribery prosecution can go forward.

  10. I think Hannah Dugan, like Ketanji Brown Jackson, went into the law to make law, not to argue decisions on the behalf of law. BTW, your optimism that a local Milwaukee jury can be swayed by evidence is remarkable.

    1. That’s likely correct, gdonaldallen. I see it as a power trip. There are folks in the legal profession who really don’t possess the character and fitness to be admitted to the practice of law.
