Mobocracy: Democratic Politicians Compete in Race to the Bottom Over ICE Shooting

This year, there has been a race to the bottom as Democratic politicians fuel the rage in our streets against Immigration and Customs Enforcement (ICE) officers. That continued this last week when Minnesota Gov. Tim Walz again rushed to judgment after a shooting, adding that the public should not treat Border Patrol or ICE officers as real “law enforcement” officers. However, rock bottom was finally reached by Arizona Attorney General Kris Mayes (D), who not only said that she does not consider ICE officers to be “real law enforcement,” but raised the possibility of citizens shooting them under state law.

First, the obvious.  Mayes said, “I put [“officers”] in air quotes because I don’t think they are real law enforcement.” These are real law enforcement officers under federal law, enforcing federal law. Period. The effort by Walz, Mayes, and others to question their status or treat them as impostors is clearly designed to inflame citizens and encourage greater confrontations. It is a dangerous form of demagoguery. It is sending citizens into harm’s way, encouraging them to impede federal operations involving the arrest of criminal suspects.

Mayes later stated that she was “mischaracterized” and that “the idea that I would want the life of any member of law enforcement put in danger is wrong, offensive, and an outright lie.” Mayes’s “mischaracterizations” came at a time of growing unrest and the “Attorney General” rushed forward to add to the reckless rhetoric.

Again, repeating Walz’s talking points, she referred to these officers as “poorly trained.” She obviously has no idea about the training of these officers. The officer involved in the Alex Pretti shooting was an experienced officer with the Border Patrol. The officer involved in the prior Renée Good shooting was also an experienced officer.

While mischaracterizing the officers, figures like Walz are sending demonstrably “untrained” citizens into highly dangerous situations. Walz specifically called out citizens into the streets to record these operations, which is precisely what Pretti was trying to do before his fatal confrontation with officers.

Mayes, however, was not looking for a tie in that race to the bottom. She told citizens that Arizona’s “Stand Your Ground” law might be cited as grounds for the use of lethal force against officers.  She declared:

“You have these masked, federal officers with very little identification — sometimes no identification — wearing plain clothes and masks and we have a ‘Stand Your Ground’ law that says if you reasonably believe your life is in danger and you’re in your house or in your car or on your property, that you can defend yourself with lethal force.”

She later added, “It’s a fact that we have a ‘Stand Your Ground’ law and, in other states, un-uniformed, masked people who can’t be identified as police officers.”

It was a reckless statement of the law. These laws only protect “reasonable” uses of self-defense. However, they have an express exemption for using force “to resist an arrest that the person knows or should know is being made by a peace officer or by a person acting in a peace officer’s presence and at his direction, whether the arrest is lawful or unlawful, unless the physical force used by the peace officer exceeds that allowed by law.”

It is not uncommon for law enforcement to use officers in plain clothes to make initial arrests or contacts with suspects who might flee or resist.

Mayes’s comments could encourage an already enraged and irrational segment of our population to use lethal force under the false pretense of standing their ground.

Attacks on these officers have increased exponentially with the violent rhetoric of these politicians. Just last week, a rioter bit off the finger of an officer.

Mayes also vowed to prosecute any ICE agent who violates state laws in these operations. She is also mimicking Walz in spreading legal disinformation. While federal officers do not have absolute immunity in all cases, it is extremely unlikely that state officials could successfully prosecute such cases without facing a transfer to federal court and likely dismissal.

Walz made the same misleading claim in saying that Minnesota would investigate the shooting and that the federal government would not be allowed to conduct the investigation. He has no authority to dictate who or how the shooting will be investigated.

While the state can conduct its own investigation, the federal government will investigate a shooting by a federal officer. Walz further pandered to the mob by raising the debunked “bait boy” story and telling citizens that ICE was “shooting them in the face when they come out of donut shops.”

Rage is hard to maintain for months and the Pretti shooting, as described by one Democratic operative according to Fox’s Chad Pergram, is a “new wild card” in the politics on the Hill over funding.

There remain legitimate questions about this shooting. The videotapes do not show, as suggested in early accounts from the federal government, that Pretti approached the officers brandishing a weapon.

Pretti does not obey the commands of the officers in returning to the middle of the road during their operation. However, he did not appear threatening until after the officer pushed him to the side of the road. At one point, he appears to shove the officer as he tries to assist a woman who was pushed to the ground.

What happens next is hard to determine. There is a video that suggests that an officer may have removed his weapon from its holster just before another officer yells “gun.” It is hard to see Pretti’s hands and we do not know what happened in that split second. We may get a better idea as new videotapes emerge.

Law enforcement officers do not expect blind deference on shootings. However, they have a right to expect a fair chance for an investigation to hear their side of a shooting — not a governor or a mayor rushing before cameras to effectively accuse them of murder.

At this point, it may not matter. Only the mob matters.  Minneapolis Brian O’Hara explained: “even if there is an investigation that ultimately proves that at the time of the shooting it was legally justified, I don’t think that even matters at this point, because there just- there is so much outrage and concern around what is happening in the city.”

Walz has demonstrated politics of the lowest kind, stoking anger as citizens and officers alike are injured. Walz is pledging to go to court to stop further operations—a lawsuit that would be another frivolous filing. Previously, the state, including Attorney General Keith Ellison, filed to prevent the federal government from increasing forces to investigate fraud and immigration violations.

Walz, Maye, and others are following a long line of demagogues who sought to use social unrest to advance their political careers. For Walz, sending people into the streets has the benefit of not having them at home watching and reading about the growing fraud scandal in his state.

It is not a defense of democracy, but mobocracy in Minnesota.

  1. Hasn’t the insurrection vitriol inducing the desired radicals to attack ICE officers met the standard to justify deploying the military?

    1. Hire an agency to do crowd control as ICE arrests. Off duty standard cops will do. Cheaper. They’re trying to arrest some felons.

It is sad that political polarization has gotten to the point that a large swath of the population will ignore multibillion dollar fraud and actively protect violent criminals all because the other side is against both. I am conservative but would applaud any liberal who punished the theft of my tax dollars or arrested deported a violent illegal alien.

    If may be sometime, or possible never before we get a clear and reliable answer to that question.

    But what is NOT in question is that Pretti was engaged in Bad conduct.
    He and otherw were actively interfering with Law Enforcement.
    He was ignoring the orders of Law Enforcement to get off the streets.
    He was resisting arrest, and he was ignoring the orders of law enforcement to stop.

    None of that is sufficient to justify shooting him.

    But Pretti was not an innocent bystander documenting ICE.
    He was a lawless actor disrupting law enforcement.

    But for his own misconduct there would be no shooting.

    While we are allowed to do all those things without losing out life.

    ICE was acting lawfully right up to the instant pretty was shot.
    Pretti was not.

      Until we know what the police saw, what happened is unknown. I saw multiple officers tumbling around with a man engaged in a physical struggle with police officers. I couldn’t make out the details of the encounter. For all we know, a police officer might have perceived Pretti’s gun and yelled ‘GUN,’ reflecting a belief of imminent danger. Another, or more, officers might have perceived the phone as a gun, so rather than be shot, they shot at him. This is only one possibility of what happened.

      But for Pretti’s decision to physically resist during the encounter, the sequence of events ultimately led to his death; absent that resistance, he likely would have survived.

      1. There are many possibilities here – it is very hard to decipher from the Audio, but it SOUNDS/APPEARS that there is the SOUND of a single gunshot followed by all the ICE offers rapidly BACKING away from Prettzi and THEN lots of shots.

        One Claim is that PRettzi’s gun has no safety and is KNOW to misfire easily.

        It is possible that in the struggle it went off – without ANYONE doing anything deliberate.
        And the officers responded to that.

        There are many other claims, but ALL require subjective interpretation of the video and audio.

        Under the WORST of circumstances for ICE this is an unintentional unjustified shooting.
        I do NOT think that is likely. But if true – it is highly unlikely to result in a prosecution by DOJ.

        Further that is how it SHOULD be.

        While We want ZERO police shooting. and especially zero unjustified police shootings.

        We do NOT actually want to punish LEOs for accidents that we WOULD punish others.

        We REQUIRE police to enforce the law and sometimes that means US deadly force.
        For the act of an LEO to be a crime it must be INTENTIONAL.
        For an ordinary person – often Reckless or negilgent is sufficient.

        If this shooting is unjustified and not deliberate – then the officer should be fired.
        And the family should win a civil suit.

        But I do nto expect that to be the conclusion.

            The claim the Hunter Biden laptop was russian disinformation was completely absurd and the people who signed that statement shoulfd NEVER get a job in clandestine work ever again. While we have end to end provenance on the laptop data – lets assume we do not.
            There is hundreds of megabytes of data. if it is “faked” Either a massive amount of it has to be true with only a tiny bit faked or it would take millions of people to construct a fraud that was not trivial to dismental. Every single bit of metadata has to be perfect, every email can be verified by getting the mate from the other partu to the email. Emails are not sent to yourself. If you fake a photo the people in the photo can be checked as to whetgher they actually were at a specific place and time.
            In other words an undetcectable fake has to be so perfectly close to the truth that is MUST be the Truth.

            VIPS examined the information from Guiceifer II and was pretty trivialy able to prove that he had nothing to do with the DNC email hack.
            The meta data in his files was wrong.

            They also examined the leaked DNC files and were able to demonstrate through a variety of factors they could NOT have been exfiltrated over the internet – there is no link from the DNC to anywhere in the world that was fast enough.
            The transfer times matched those of USB sticks. the DNC email leak was an inside job.

            By February 2020 it was pretty obvious that the Covid imperial war college and Los Almos predictions were alarmist – they were ultimately off by an order of magnitude. it was also pretty obvious that Covid was not stoppable, that even if masks etc worked as well as claimed – alone or together they were just not good enough. While the LOs Almost and Imperial WAr College models were OBVIOUS garbage, it is in fact quite easy to model the spread of a disease, and like many other things a simple spreadsheet model outperforms complicated models – the same has proven true about climate. An economist David Romer in a paper about 20 years ago demonstrated what Austrian economists have been saying for a century – though it is much broader than economics.
            If you have a mathematical model of something with a sufficient number of coeficients – really 7 or 8 is enough, that you can get to PERFECTLY hind cast – it is Still near certain to be wrong going forward. There are just too many different values for the coefficients that will perfectly hindcast and still have nothing to do with reality. Economic models often use 20-30 coeficcients. Climat models often have 50 or more. Those models are garbage. It is mathematically impossible to get them right.

            You can derive coefficients for simple mathematical models from regressions – but you will still only have simple models.
            They will work reasonable well but they will only be able to answer really big questions – like will more government spending be beneficial – and the answer will always be NO.

            Regardless it was possible to tell in February 2020 that barring a miracle vaccine or a miracle drug – covid would either become endemic, or it would go away with herd immunity. What has happened was predictable – it has mutated to be highly contagious and sufficiently mild that most people do not even know they have it anymore. And it has become endemic.
            Developing the Vaccine as quickly as we did was a miracle – Only under a Trump administration would that have been possible.
            But by the early testing it was absolutely clear it WOULD NOT WORK.

            And on and on

            Math and probability.
            They do not tell us perfect answers to everything all the time.
            But they are very good at getting rid of absolutely stupid choices.

            In the real world we pretty much never make perfect choices. We are lucky if we make good enough choices.

            We are fighting here about the decisions a bunch of ICE officers made. They had less than a full second to make their decisions.
            If they were wrong one way – one or more of them would die or be seriously injured.
            If they were wrong the other – Prittzi would die unnecessarily

            They did NOT have a middle choice.
            I beleive they likely made the right choice.
            But even if they did not – they did not do so with malice of forethought.
            At worst they overestimated the threat to their own lives.
            A threat that was REAL regardless.
            The gun was real the only question is if they decided differently would Prittzi have used it.

            It is possible with the information we have that he DID try to use it.

          3. Andrew Branca is far more of a gun expert than I nd far more knowledgeable on Gun law and the lw of self defense, and he concludes this shooting was fully justifed, even though he concludes that one ICE agent had already removed Pretti’s gun.
            He also rejects the accidental discharge theory.
            I do not know if I agree with Branca regarding the accidental discharge or that the vido shows the officer with Pretti’s gun before the shooting.
            But he is by far the most knowledgeable on the Law of Self defense.
            Branca also confirms – as I have stated in other posts that Pretti was clearly guilty of Felony Assault.
            In Fact Branca notes that Pretti first committed Simple assault – with an up to 1yr sentence followed by Fellony Assault with up to an 8yr sentence and that is BEFORE the Officer pepper sprays him.

            I personally STRONGLY disagree with the extreme escalation of Assaults on police officers.
            While I do agree that it MUST be illegal for people to intentionally make unwanted contact with a police officer – there is just far too much that can go wrong – and as Branca notes – Police are legitimately very concerned about people getting close to them, because they can take any of their weapons and things go to h311 very fast after that. Numerous police every year are killed with their own guns.

            Regardless, do not touch a police officer – especially under tense circumstances.
            While I have problems with the magnitude of the crime you can be charged with,
            in my state if you are involved in a traffice stop, you are asked out of your vehicle – which LEOs do if they have concerns for their safety,
            and you merely shove a police officer – you are guilty of aggravated assault that can easily get you 10-20 years in jail.
            That is just overkill to me.

            At the same time – I still fully support
            DO NOT make unwanted intentional contact with a police officer – there is an enormous possibility that things go south VERY rapidly.

            Branca is confirming the gun removed by the officer is Pretti’s and rejects the claim that there is an accidental discharge that sets off a chain of events. But there are many others frame by framing the video who clim that there is evidence of an accidental disharge,
            and others saying the weapon in the officers hands is NOT prettis.

            What I would say is that none of the video of this is good enough to be certain bout any of these conclusions.
            I saw one video by a gun expert who was able to get the same weapon that Pretti had to accidentally discharge 5 times in a row without touching the trigger.
            As many people said – that particular gun is a cheap gun and it is dangerous.

            Regardless, at this point though I think Mr. Branca’s judgements concerning the law are correct,
            and he beleives the shooting is justified even if the weapon was removed and did not accidentally discharge,

            as to exactly what did happen – what we have thus fr is NOT clear.

            There is a debate over whether the officers had Body Cams – Biden’s Budget did NOT have money for body cams so MOST current ICE do NOT have Body Cams – but the BBB ICE budget that Dems are now trying to rescind has lots of money for Body Cams.

            Regardless atleast one source I have seen cites ICE saying they are reviewing body cams.

            1. For ease, I look at shootings on a 1-5 scale. Byrd’s killing of Babbit is barely a 1. A police officer who shoots the bullet too late is a 5, and we see his family at the graveyard. My guess is that this shooting was a 3.

    when the SDS carried out its campaign to demonize the then reigning American values (“cops are pigs”, “GIs are baby killers”, America is “Amerika” or “AmeriKKKa”).

Rather, it is that bad law enforcement that actually shows up, tries to effect the arrest and depart that causes all the commotion, right? This is why the National Guard would be effective as a perimeter ring buffer at any operation.   10. 18 U.S.C. § 111(b) You can in fact lawfully carry a concealed weapon with the requisite permit to a protest in that state. What you CANNOT do is engage in violent criminal obstruction and assault of federal officers carrying out their duty to arrest and remove other violent criminals at your chosen mob scene: the Democrats’ criminal Illegal Aliens.

    Democrat criminal mob violence is not protest, and no Amendment makes it so.

    The question from those who have carried daily for decades is this. The purpose of carrying is for defense against criminal attack. Law abiding gun owner means that, ALL laws. Minnesota’s concealed carry permit laws also mean exactly that: you must continue to be law abiding concerning federal and state law.

    So when planning to concealed carry while joining a mob not peacefully protesting to one side, but instead engaging in violent hands-on obstruction and assault, WHO are you expecting you might end up shooting in defense?

There is a narrow avenue that the Supreme Court has never foreclosed to potential damages liability—where the plaintiff brings a state tort claim to vindicate their constitutional rights, a claim that arguably falls within an exception to that 1988 statute (Westfall Act) that otherwise converts those claims into (very-hard-to-win) Federal Tort Claims Act claims against the federal government.

    The Westfall Act does not bar a civil action “brought for a violation of the Constitution of the United States”.

    The 2023 Ruling in Buchanan v. Barr: The D.C. Circuit Court of Appeals ultimately rejected the plaintiffs’ damages claims, holding that extending liability in this “new context” (national security near the White House) was barred by Supreme Court precedents that have severely narrowed Bivens remedies.

    However, in their concurrences, two of the three judges on the panel credited these arguments about the Westfall Act exception. They suggested that while they felt bound by recent Supreme Court decisions to dismiss the case, the law should theoretically allow for such a remedy.

    They have given up the blue nylon jackets to put on full battle costume play, camouflage uniforms straight off the battlefields of Iraq and Afghanistan. The worst of the worst have long gone to hide out in Texas and Florida with far larger populations of undocumented immigrants. What is left in Minnesota are documented immigrants at various stages of the citizenship process; they are being taken like fish from a barrel because they are easy and non-violent.

    This is a terror campaign against states that voted against Trump. The change of tactics, the change of targets. The public displays of violence are all key to punishing the citizens of those states for daring to vote against Trump.

    1. There’s not a word of truth in any of that. The violent criminals remain in the “sanctuary” cities and states, where at least the local police are under orders not to touch them. They certainly haven’t moved to Texas or Florida, where the roundups are proceeding without any fuss, with the local authorities’ full cooperation and assistance.

          that would resisting a lawful order – Still not sufficient to justify the use of deadly force.

          Byrd could justifiably have arrested her.
          But he had no justification for the use of deadly force.

          Good had a deadly weapon and was recklessly or intentionally threatening the ICE officers life as well as serious bodily harm to the officer reaching into Goods car.
          Prittzi had a deadly weapon, refused to follow a lawful police order, obstructed an officer, assaulted an officer – You may not like that but initiating intentional contact with law enforcement is assault. If you do not beleive that – test it some time by trying to interfere in a traffic stop. Followed by resisting arrest.

          None of that justifies the use of deadly force, but ALL of that is much worse than Alishi’s bad conduct.

          The open question is did Prittzi reach for his gun, which the officer claim, or did his gun go off accidentaly as some are claiming.
          Either are sufficient to justify the use of deadly force.

          What I have seen in the videos is unclear – but strongly suggests Prittzi made a very threatening move, and ALL the ICE officers QUICKLY stepped back from Prittzi and started firing.
          You do not step back in the midst of an effort to arrest without facing a very serious threat.

          But that is speculation not proof.

          We will have to see as this moves forward.

          Nothing in the constitution is pro forma or cerimonial.
          Certification is a DECISION by congress it is not an unnecescary rubber stamp.
          It is the last chance to thwart Fraud or error. It is a VOTE and congressmen are free to vote as they please.
          They are also free to conduct the proceeding however the please.
          In point of constitutional law – one Congress can not even by law dictate to another how it must conduct its business.

          The choices of congress regarding its own proceedings are not reviewable by the courts. Only voters at the next election.

          I would further note that SCOTUS just found that Candidates ALWAYS have standing to challenge elections.
          There goes nearly all your supposed myriads of courts siding against Trump.
          SCOTUS just said they erred in denying standing.

          Something many of us have been saying for 5 years.

          One of the major issues with all the standing decisions is that – SOMEONE ALWAYS has standing.

            ICE hass arrested 3400 criminal illegal aliens so far in Mineapolis – they have 60,000 total criminal illegal aliens in Minneapolis with current outstanding deportation orders they are seeking.
            They are currently getting about 1200 a week.

            In 2025 they have arrested 980,000 illegal aliens – 70% of which are convicted or charged criminals.

            They care a great deal about arresting criminals.

            They would also like to arrest violent protestors so that they can more easily arrest criminal illegal aliens as the violent protestors rot in jail.
            Unless you are a criminal illegal alien in Mineapolis with an outstanding deportation order – the only thing you have to fear from ICE is arrest if you interfere with their arresting criminal illegal aliens.
