New Video Allegedly Shows Alex Pretti Spitting at Agents and Damaging Car Days Before Fatal Encounter

A man kicking a car.A new video purportedly shows Alex Pretti spitting at federal agents and damaging a government SUV days before he was fatally shot by U.S. Border Patrol agents in Minneapolis. The video does not alter the analysis of whether the fatal shooting was justified. However, it raises some obvious questions, including why Pretti was not previously arrested on multiple grounds. The videotape also contradicts the family’s account of the earlier encounter.

The new videotape shows a violent individual who forced the confrontation with officers. Pretti is shown screaming “f— you” repeatedly while flashing double middle fingers. A second tape shows him yelling “assault me Motherf—ker.” He then destroys the rear signal light and the surrounding area.

The attorney for the Pretti family, Steve Schleicher, issued a statement that:

 “A week before Alex was gunned down in the street — despite posing no threat to anyone — he was violently assaulted by a group of (Immigration and Customs Enforcement) agents. Nothing that happened a full week before could possibly have justified Alex’s killing at the hands of ICE on Jan 24.”

While some of us have objected that the videotape of the fatal shooting did not support initial claims of the Administration on Pretti threatening officers before the shooting, this video clearly does not support the claims of the family. Damaging the vehicle and spitting at officers are violent acts that are threatening to law enforcement. It was not a “violent assault,” but a justified takedown by officers. What is curious is the fact that Pretti was then let go by the officers.

Pretti should have been arrested and charged with a felony for damaging the vehicle and attacking officers. Since he was armed, he could have been charged with committing a felony in possession of a weapon.

I am mystified why Pretti was not arrested. He clearly damaged the car and appears to be resisting arrest. I fail to understand why the agents took him down but then failed to complete the arrest. It may be due to the mob that was forming. (Protesters bizarrely express surprise that the agents would move against a man who just damaged their vehicle).

Again, the videotape does not have bearing on the lawfulness or unlawfulness of the shooting. While it shows a history that may explain Pretti’s resistance before the shooting, the question is whether his actions created a belief that officers or others were in imminent danger of serious bodily injury or death. We still have to see the body cam footage to see what preceded an officer screaming “gun.”  Many details still must be confirmed. Keep in mind, the question is not whether officers were right, but whether they were reasonable under the circumstances.

Most of the people they detain are just given a time out for a few hours and are released with out charges.     Point I make: However, when Kirk was killed, there was almost immediate negative commentary and media coverage discrediting his worth (‘vile bigot,” “wacko” “rightwing extremist,” “hateful rhetoric”). I learned more about him from the criticism tarnishing his memory than from the lauds.
    Conversely, I regret that it took this long for the new video to be released, -several days after the Church of the Public and the media had already canonized Alex Pretti. I learned more about him from this than family statements and prior media coverage.

    2. You’re judging Pretti based on one video showing him expressing anger. The negativity towards Charlie Kirk is based on multiple videos and statements over a long period of time. Kirk did indeed make bigoted and racist comments and supported his views by defending them.

      Those on the right are trying mighty hard to demonize or smear Pretti’s character based on ONE video. Especially after the White House, Kristi Noem, Bovino, and MIller immediately accused Pretti of being a domestic terrorist, an assassin, and someone who was planning a massacre because he had a legal weapon on him. Clearly there are distinct differences between the to incidents.

      2. It’s against the law to carry a weapon without having your ID and gun permit with you. Pretti had neither. There was a reason he didn’t bring them.

        He did the same thing in the video from 2 weeks earlier in his attack and interference of a law enforcement officer performing a law enforcement action (both of those actions are also illegal).

        If CNN had only done what a legitimate journalism news source should do, and that is run the complete tape. Pretti also had his weapon on him at the time. It was tucked into the back of his pants. You can clearly see it, and it was also said by the news person that Pretti also had his weapon on him at that time.

        Pretti thought he was a badass. He wasn’t…he was just plain stupid!

      Neither did I, and I disagree with at least half of his beliefs (I am not a religious conservative, I find that abhorrent), but he did it peacefully, without confrontation, and at the least in good faith; though I think he was incredibly naive, and at least a little bit ignorant. But we are talking about college campuses where everyone is green, and that at least fits the milieu he was in.

      He was killed for it. In cold blood. For being peaceful, if sometimes wrong. That tells me all I need to know, as someone that dealt with actual Nazi groups 40 years ago. The modern left are no longer a party, they are a disease. There is no longer any way to phrase it. I know some of the voters have just been mislead and are good people, but whether they see it or not, again: the modern, global left, is a disease. Nothing they represent is good for anyone. You can feel about Kirk what you want to, but an even passing analysis of his multiple efforts would identify the elements of a bad-faith technique that is not a search for some truth, but manipulation of the discussion from whatever the other person was speaking on into some predefined arena that is literally not debatable.

          Mainly it was to find some passage in the Bible from which Kirk would conclude “that’s what the Bible says.” That’s not a debatable point. It could be debatable that some passage was relevant, but the Bible is not a singular unassailable authority on any subject, so reliance on it in a discussion ends the debate as the participant who refers to it has stopped participating.

  18. Professor, you ask why Pretti was not previously arrested on multiple grounds. The answer should be obvious. With local law enforcement refusing to assist, even to the degree of simply keeping the multitude of “protesters” and the agents apart from each other, the agents overwhelminly have their hands full trying to perform their assigned duties while at the same time trying to keep all those “protesters” at bay, including those acting like Pretti. That is the whole point of both the “protesters” and those who are ordering local law enforcement to hold back – to prevent the agents from doing their duty. They couldn’t even secure the scene after Pretti was shot because local law enforcement allowed the “protesters” to swarm the scene and contaminate it before the agents could properly process it. All these people – the “protesters”, those who are coordinating and funding them, and the local and state politicians including those in charge of local law enforcement – all are doing everything they can to prevent the agents from doing anything to enforce immigration law. That is why Pretti was not previously arrested like he should have been. If the failure to arrest Pretti contributed to his death days later, it is not the fault of the agents. It is the fault of those people – insurrectionists all of them, including Pretti – who are determined to obstruct ICE to prevent them from enforcing federal law.
