There is a major ruling in Scotland where a court declared that it is generally unlawful to house a transgender biological male in a women’s prison. The decision follows the ruling of the top UK court that a woman is defined by her biological gender at birth. The timing is notable as we await a couple of transgender rulings from our own Supreme Court this week. The decisions also highlight the anomaly of police continuing to arrest people who object to transgender policies under the aggressive anti-free speech laws in the United Kingdom.
In her published opinion, Lady Ross declared that “in all the circumstances, the prison’s guidance is unlawful.” The decision came after a controversy involving convicted rapist Isla Bryson – formerly known as Adam Graham. Despite being convicted of raping two women in 2023, Bryson was initially sent to the Cornton Vale women’s prison.
Scotland continues to crack down on free speech through draconian laws.
The Hate Crime and Public Order (Scotland) Act 2021 illustrates how these laws create a slippery slope of speech criminalization as more and more speech is banned. We previously discussed the law when it was first introduced.
The new crime covers “stirring up hatred” relating to age, disability, religion, sexual orientation, transgender identity or being intersex. That crime covers insulting comments and anything “that a reasonable person would consider to be threatening or abusive.”
It is enough that a person is found to have likely understood that the comments would be abusive or insulting as opposed to intending to be abusive or insulting.
Figures such as J.K. Rowling have been threatened with arrest for her public position in opposition to transgender laws.
This creates a curious conflict, as courts support such views when enforcing biological limits on access to prisons and other areas.
In the United States, there is a division on the issue. Some states, like Maine, require correctional housing to match the gender identification of the inmate rather than the biological sex at birth. Faced with lawsuits and legislative inquiries, the Maine Correctional Department continues to defend its policy. Other states have barred such transgender placement.
This coming week, we are awaiting major rulings on transgender controversies in the United States.
In Little v. Hecox, the Court is considering whether laws that categorically require sports participants to compete based on their biological sex violate the Equal Protection Clause of the Fourteenth Amendment.
In West Virginia v. B.P.J., the Court is considering two questions: (1) whether Title IX prevents a state from limiting sports teams to biological sex at birth, and (2) whether such a limitation violates the Equal Protection Clause.

Once upon a time, there were “sports”. Schools had sports teams at all appropriate levels. Since they existed in an age where feelings were less important, only the best players made these teams. Naturally, the players were all boys. Girls were not necessarily excluded, they just lacked the attributes to successfully compete with the boys.
However, girls being girls, they wanted to do the same things that boys were doing. It was uncontroversial that they could not compete with the boys; rather they wanted a “league of their own”. This caught on widely, of course.
My point is is that the sports were not originally cast as “boy’s” or “men’s” sports. They were just sports without a qualifier. Girl’s sports were designed to be just that: sports teams so the girls could enjoy competing on their own level.
Nothing prohibits a girl or woman, of unusual gifts, from competing for, and winning, a position on a varsity team made up of males, if she was able to truly excel. I’m not talking about a silly spectacle like the female student at Vanderbilt attempting a field goal while everyone stands by waiting to applaud. I’m talking about true competition, not a performative display where the opposing team condescends to pull their punches for one play. If a woman is capable of putting a 100 mph fastball over the plate, she will make the team. Because they are not “boy’s” sports. They are just sports. But the pressure is never in that direction, is it?
Many boys and young men will be mediocre athletes when competing in boys’ sports. That’s fine if they realize what counts is their personal efforts at improvement, playing honestly by the rules, and doing they can to avoid serious injury to themselves and others. If they are sane, well-adjusted human beings, they will be able to live with that state of affairs. It’s really not so bad.
If, on the other hand, they are sickos, then winning will be all they care about and they will pretend to be girls as a means to that end – e.g., “Lia” Thomas. In that way, they can steal prizes from actual girls, beat the crap out of girls in sports such as volleyball, and take scholarship opportunities away from actual female athletes that have trained practically their whole lives for such opportunities.
But that could never happen if the adults in charge behaved like actual adults and protected the girls from such usurpations. The problem arises when you get adults who are sick, twisted, evil people and allow the boys to crush the girls. Such people are the scum of the earth. They willingly fail at the only task they are charged with: protecting the sheep from the wolves. Today we call them “woke.”
I agree with you, to a point. I would put it a bit differently. A sports as a cultural entity is typically defined by two sets of rules: written and unwritten (“sportsmanship”, if you will). The point is to win while complying with both sets of rules, but within that context, winning is clearly the objective. In that sense, I believe that an analogy to a correctly functioning society is sought, although frequently not achieved.

It does pose a problem of how to account for those at the extreme ends of the bell curve. I think that judges, legislatures, prosecutors, and police would all benefit from having a legal system that is based, within the limits of the English language, on objectively defined terms. Vague or subjective terms will certainly promote endless litigation and debate. So having the justice system be put in the position to take on faith the declared gender of a convicted criminal (someone demonstrated to violate laws) is shear madness. I had thought, perhaps naively, that the separation from the population that they would prefer or the one that could kill them, would cause them to think about what they did and who they really are. Since the population would be small perhaps only a single cell, the amount of extra resources would be small. This would provide the safety for all involved, which no matter who they are or what they have done, deserve to be in a safe space. We provide so much to other questionable programs that the funding for this could easily be found.

The state is required to make prisons safe for those who are put into prison – fopr the most part beyond that the administration of the prison is the business of the govenrment – not the prisoners.

Many of the systems that the left sees are alternatives to incarceration are actually supplements not alternatives – and they cost us MORE – but when used as a supplement they do reduce recidivism which is a benefit to all.
We are an affluent society and we can afford to pay more for a criminal justice system that both works better and increases the odds that criminals will not repeat offend.

No free market solution? The private sector is getting into the prison business. It’s not working out as expected. It’s worse.
No free market solution? solution to what exactly? Prisons for criminals? we have prisons for criminals at home. Deters crime. solved.
Why not, Have a separate area for Trans people in a prison so that there are no associated risks.?
Prison is not a publicly funded resort and spa with al la carte services. What right does a convict have to violate the law, victimize someone or something, consume public resources associated with their investigation, arrest, conviction, and incarceration and then demand special accommodations? No taxpayer should have to pay one additional cent because a convict chooses to identifies to identify as something other than what they were at birth. If a convict doesn’t like the risks perhaps they should have complied with the law.?
AND there would be some trans TRYING to get into those prisons.
Why not just put them in a State mental hospital where they can get the help they need?
What happened to equal treatment under the law?
Accommodating the crazy is no way to deter from it.

I confess, thinking of it every time I passed the Women’s Huron Valley Correctional Facility off Mich. Hwy 23 going on the way to Ann Arbor.
