Below is my column in The Hill on the release of the tapes from former President Joe Biden’s interview with his biographer. The Biden team fought for years to keep the public from hearing the tapes. We now know why.
Here is the column:
For years, former President Joe Biden has fought to prevent the release of tapes acquired by former special counsel Robert Hur in his investigation. After those efforts collapsed this month, it became clear why Biden and his aides were so determined to keep the public from seeing the evidence.
In addition to showing Biden’s mental diminution even before he was elected president, the tapes show that Biden effectively confessed to the crimes Hur would later excuse on the grounds of his mental infirmity.
Biden’s interviews with his biographer, Mark Zwonitzer, conducted four years before he would be elected president, show that Biden was already having trouble remembering names and dates.
Hur was tasked with determining whether Biden had committed the same crimes that led later to charges against President Trump — retaining classified material, mishandling such material, and related crimes.
It turns out that Biden had already admitted to these alleged crimes, years before the documents were found in various offices and the garage of his home.
I wrote for years about Biden’s absurd denials after files were found in offices where he was working on his book. There was also evidence that the material had been divided, distributed, and transported between different locations.
Despite all the evidence of knowledge and use of the classified materials, Biden and his aides suggested that no one had been aware of its removal and repeated transfer. In the meantime, after the raid on Mar-a-Lago to search for classified material removed by Trump, the Justice Department granted Biden and his team every possible accommodation.
Then came the searches of his home, with the pictures of files in his garage, office, and other locations. These included clearly marked classified material.
Hur then issued his report, concluding that there was evidence of the crimes, but that he would still not charge Biden as Special Counsel Jack Smith had done with Trump. The report stated that “President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.” It further stated that the clearly marked classified material was “stored in unsecure places” and posed a risk of “serious damage to America’s national security.”
For his part, Biden was defiant and, when confronted about the documents, insisted that “They’re mine,” and that other presidents had done what he did. This was the same president who condemned Trump for retaining classified information. Biden mocked Trump’s defense and asked CBS 60 Minutes how “anyone could be that irresponsible.”
We now know that Biden himself was that irresponsible, if not more so. Biden not only kept classified material longer and in even less secure locations, but he did nothing to protect the material as he attacked Trump over Mar-a-Lago.
Nevertheless, Hur declared that he would not bring a single charge because Biden “would likely present himself to a jury, as he did in our interview of him, as a sympathetic, well-meaning elderly man with a poor memory.”
The tapes show Biden struggling to give answers even before he announced his candidacy for the presidency, despite denials from key aides such as Jen Psaki and Karine Jean-Pierre. However, Hur had actual tapes showing that Biden had clear memory and knowledge of his retention of classified material. Combined with Biden’s later public statements, the combination would have been deadly at trial.
In the interview, Biden read “nearly verbatim” from notebooks containing sensitive national security and foreign policy information, according to Hur. On the tapes, Biden is heard saying, “So this was, I early on, um, in ’09 I just found all the classified stuff downstairs.” At another point, he states, “Some of this may be classified, so be careful with it.” He repeatedly mentions that some of the items in his office and home may be classified.
He even brags to his ghostwriter, in a report made on Oct. 10, 2016, that “I have extensive notes over this period of time … They didn’t know I have this.”
Once again, the Justice Department had already declared and defended in court the idea that such removal and retention of classified material did constitute a federal crime by a president, let alone a vice president. Where Trump acknowledged his retention of classified material and agreed to security measures that the FBI requested, Biden did not inform anyone of his classified materials and kept them in his garage long after the Mar-a-Lago raids. Meanwhile, in public, he expressed shock that any president would act as recklessly as Trump.
It is hard to see how any of that would present “a sympathetic, well-meaning elderly man with a poor memory.” It sounds more like a cynical, shrewd politician with poor ethics. It also sounds like it would have been a strong foundation for a prosecution.
For many, the tapes will reinforce the view of a two-tier legal system, long maintained by the Justice Department, whereby key Democratic figures including Hillary Clinton and Joe Biden were given favorable treatment while others were indicted for similar conduct.
What is truly galling for some of us is that Biden knew all of this when he went public to attack Hur for suggesting that he had knowingly retained classified material and showed diminished mental faculties— at one point forgetting when his son Beau died. Biden savaged Hur at the time for raising this issue, famously demanding, “How the hell dare he raise that?” Even that was a lie, because it was Biden who had raised Beau’s death in the interview.
After the report, Biden was still denying that he had retained classified material, even though he had discussed that classified material with his ghostwriter years earlier and had admitted as much to Hur. But before the public, Biden declared, “I’ve seen headlines since the report was released about my willful retention of documents. This assertion is not only misleading, it’s just plain wrong.”
The record is now largely complete. So is the inescapable conclusion: Biden lacked clarity on most everything but his alleged crimes. His deception and culpability were established in both the Zwonitzer and Hur interviews. Biden gave Hur a virtual confession, and Hur gave him a pass.

There is a great irony here. We do not like to be confronted with either party doing politics with two tiered justice. Biden’s condition got past the entire cast responsible for the proper application of the 25th Amendment. Their decision loop gave us,well, Edith Wilson after Woodrow stroked. Politics over the Constitution. Then came the Trump Biden Presidential debate featuring the emperor with no clothes. Biden. Trump won the election. Both popular and electoral votes. The takeaway is that the same politics that bungled the check and balance of the 25th Amendment gave us an outcome that Abraham Lincoln told us about: “you can’t fool all of the people all of the time”.
No matter how out of it Biden was, Trump is far worse. He has zero grasp of reality.

Millions of illegal aliens have been deported or left voluntarily.
Crime is coming down nationwide.
Cuba will topple soon.
Maduro is gone and Venezeulla is kow towing to the US.
There are still things to fix, and things to finish but things are going in the right direction.

I an mystified about the basis for someone who claims to be, and usually appears to be, a rational actor showing such a marked preference for a victor in a war between two foes in which neither adversary has shown much morality. Frankly, it seems to me that a plausible historical and ethnic case can be made for Russia to reclaim Crimea, Donetsk, Luhansk, Kherson, and Zaporizhzhia. NTM that Zelenskyy has for over a year been an illegal ruler by the laws of his own country, and that one of the principal forces within Ukraine that he relies on to maintain that illegal power is the Azov Brigade, which is founded on neo-Nazi principles. It also seems that, while both sides have attacked targets that have caused civilian casualties, Ukraine has shown significantly less restraint in that regard. If Trump had not given lip service to approving Putin’s main objectives in that conflict and then tried to play games, maybe Russia would not be providing Iran with as much assistance as they are at present.
There can no longer be any question Biden was not running the White House IMO. Didn’t seem to even be particularly heavily involved. Now the people that were behind the scenes are front and center along with some old faces that never went away in the dem party (and across the aisle!), and it’s what a great many of us suspected the whole time.
The gaslighting, narrative, and lies were and are simply astounding. I do not know how any of these people look themselves in the mirror. Sociopathy would not be an unkind or inappropriate label for the modern left.
I do not know what it will take to wake sleepy blue voters up, I really don’t. Even the likes of Bill Maher still think this pales in comparison to Trump’s ‘lies’.

The president has the authority to declassify documents (even without formal procedures), the vice-president doesn’t.

Trump is correct – Except that a president can not declassify by merely thinking about it.
He must take an affirmative step, so long as that step – intentionally or otherwise removes protection from the document – the document is declassified.

Anything a president intentionally does with a classified document that removes it from security declassifies it automatically.

This is Why Smith was making this convoluted argument with Judge Cannon that Trump did NOT Steal the documents or intentionally remove them. That the removal was accidental – but the failure to return them was deliberate.
That is a really really hared argument to make. With a few exceptions the laws regarding classified documents only apply to those with a duty to protect them. On Jan 21, 2021 Trump become a private citizen. If he was at that time in possession of documents that he did not intentionally remove – and therefore were not classified, there is no duty to return them. This was littlerally decided by SCOTUS in the Pentagon Papers case. Those documents WERE stolen, and came into the hands of the press without NYT or WaPo committing any crime,
And SCOTUS determined not only that NYT and WaPo had committed no crime, but that they could keep the documents and publish them.
Biden knew he had classified information, and he retained it. Hur said as much in his report, and the tapes now allow us to hear Biden say it for himself.
Unlike Trump he had not even a colorable argument that the information had been declassified, or that he was entitled to retain it.
As a sitting President he could not have been indicted, but that is not the reason Hur gave for not indicting.

I agree that is what Hur found and wrote. It sounds like a decision based on an expectation of jury nullification. For a prosecutor, that is an odd basis on which to make a charging decision.
Hur clearly said Biden mishandled classified documents. A crime. Whether Hur expressly used the phrase “criminal” in describing him, or the word “incompetent” is irrelevant. The rest of us can read Hur’s report and listen to the tapes and rationally conclude Biden engaged in criminal conduct AND he was incompetent.
Our Presidential election system has some major recurring flaws. Biden and Trump both are seriously lacking in character and competence. Bush and Obama were unprepared and unaccomplished guys with nice smiles. Clinton? The campaign operatives and media do everything to cover-up the real person. The Sullivan decision allowing character assassination of candidates has narrowed the pipeline to those with Teflon egos, meaning insensitive to constructive criticism.
But it’s the voters (primary voters!) who are choosing these schlubs. Why aren’t we better judges of character?….of competence?… of authenticity?

Even more telling is Mr. Biden’s appearance and speech’s in public. I have watched him since the Clarence Thomas Supreme Court Nomination hearings in 1991. At that time he was sharp and focused but still not very impressive. Nothing really changed over the subsequent years even as vice president. His interview in 2015 discussing the $ 1 Billion that he held up until Ukraine fired a certain prosecutor showed again that he was sharp and on his game even with no apparent script. 2020 was a totally different matter with obvious decline in his overall appearance and uncertainty in speech not seen before and it was obvious that almost every event was heavily scripted as he further declined before and after the election. There was no doubt in my mind.
Any physician who had treated elderly patients with developing dementia could have made that diagnosis. It is a gradual process with slow progression at times and accelerated at other times intermixed with episodes of almost normal lucidity. Instead we were told to deny our “lying eyes”. From my point of view his whole presidency was illegitimate and The Autopen Presidency or the Jill Biden Presidency is more accurate.
Rehashing the crime of the records is the small crime. His whole presidency was a crime perpetrated on the American people. It was also a crime that no mental status exams were made (supposedly).

The interview with the Council on Foreign Relations was in late 2019. He bragged that he used the money to get the Ukrainian prosecutor fired. Everyone in the room laughed: he had been Obama’s “point man” on Ukraine, and yeah, that’s how real power is exercised! I thought it was reprehensible the first time I saw it.
Shortly thereafter was the time he called the NH coed “a lying dogface pony soldier.” Besides unnecessarily calling a young woman an ugly liar, his comment was utterly incoherent and barely explicable. The only credible explanation was that it was based on a line from a movie he and his brother saw when he was 12.

It is not an investigators job to determine guilt or innocence, that is in a trial, their job is to determine if there is enough evidence to charge a crime, turn if over to the DOJ and let a grand jury decide that question and then a jury to decide guilt or innocence and the judge the sentence if guilty.
