F— Around and Find Out”: Krasner Referred to U.S. Attorney for Criminal Investigation

Below is my column in the New York Post on the referral of Philadelphia District Attorney Larry Krasner for possible criminal prosecution by a federal judge. Judge Paul Diamond is only the latest jurist to reach the breaking point with Krasner, who has used a mix of rage and race politics to stay in office.

Here is the column:

Philadelphia District Attorney Larry Krasner has long been to the law what Philly fans are to football: they are simply willing to do things that others will not do. While Philly fans are known for taking their demonstrations to shocking levels, Krasner has long denounced adversaries as Nazis and pledged to arrest federal immigration officials.

However, a federal judge has finally had enough of the anger and antics that have long been the special brand of Philadelphia’s top prosecutor.

For full disclosure, Krasner and I went to college together at the University of Chicago in the same class in the 1980s. Since then, we have debated and disagreed on fundamental legal and ethical principles.

Krasner has long worked as a second public defender for the city, running on his work to reduce the prosecution and incarceration of accused felons. He has portrayed the criminal justice system as racist and oppressive. At the same time, he has held chest-pounding press conferences pledging to arrest FBI agents and to “hunt down” ICE officers.

His theatrics have delighted his political base and the far left. The George Soros-funded prosecutor actually adopted a campaign slogan of “F— around and find out” in 2025. He was not referring to the criminals victimizing the city, but to federal officers seeking to enforce the law.

Even liberal Democratic judges have had enough.

Last June, the Pennsylvania Supreme Court hit Krasner with a scathing opinion finding a pattern of misleading and mendacious filings by his office to undermine the criminal cases of murderers and other convicts.

The rebuke prompted a signature response from Krasner. Citing the Juneteenth anniversary, Krasner accused the Court of attacking “the value of a vote in Philadelphia” and defending his staff as merely furthering the work of racial justice.

Now, District Judge Paul Diamond, a George W. Bush appointee, has reached his own limit with Krasner. He has referred the District Attorney for investigation after taking the rare step of removing him and Assistant District Attorney Matthew Stiegler from involvement in a 2009 murder case.

Diamond wrote he had come to this decision “reluctantly” but had “concluded that Philadelphia’s highest law enforcement official and one of his top assistants may have violated the law.”

He was referring to testimony alleging a pressure campaign against employees who raised concerns within the DA’s office over the handling of the case and the conduct of Stiegler.

Staffers were allegedly told that they could face “consequences” if they did not fall in line, and Diamond found that Krasner and Stiegler’s conduct may have amounted to perjury, obstruction of justice, false statements under oath, and conspiracy.

The underlying case involved the conviction of Dennis Johnson in 2009 for killing Kenyatta Smith.

In 2022, Krasner’s office filed to seek to help Johnson in a habeas action based on ineffective assistance of counsel.

Krasner and his assistant Stiegler assigned then-Assistant District Attorney Jaclyn Mason to the case. Diamond noted that Mason had a background in patent and trademark law and “no experience as a criminal litigator.”

What followed was a series of alleged misrepresentations to spring Johnson from prison, a pattern long associated with Krasner’s office. As Krasner and Stiegler circled the wagons in the office, there was a virtual mutiny among prosecutors who felt that the office had a conflict of interest and should not continue to handle the case.

Krasner is accused of coercing prosecutors and allegedly encouraging false and obstructive conduct. Mason was trashed, but she insisted that she was scapegoated to protect Krasner and Stiegler.

In another signature moment, Diamond accuses Krasner of referring to state lawyers in the case as “Nazis,” his favorite label for any political adversaries.

The ultimate losers, however, are the victims like Kenyatta Smith and the others cast aside by Krasner in his use of his office to fuel racial politics and a radical agenda.

As I have written in prior controversies, Krasner appears to have exhausted the patience of courts and the loyalty of staff. He is accused of being a prosecutor who not only worked to undermine criminal cases but the justice system itself. For a man who ran on the slogan “F around and find out,” Larry Krasner may soon find out.

  1. Hopefully he will get F-arounded in Prison. It’s a good possibility that his vasoline allotment will runout far before the end of the month. Surely he will get to see the gratitude of his fellow inmates whose length of sentences have been shortened due to his generosity. Then again, they probably won’t give an F if his vasoline has dried up. In this case the quality of mercy will indeed be strained. Deservingly so.

    Todd Blanche Is Out Of Line

    Since August, Mr. Blanche has come under fire for making campaign-tinged public appearances and comments. Last month, at a rally-style event on Long Island, he praised Bruce Blakeman, the Republican candidate for governor of New York. Last week, Mr. Blanche delivered remarks at the Republican Party’s midterm convention.

    On Tuesday, he stood at the White House podium and disparaged Democratic lawmakers while invoking the coming election, dismissing their concerns about artificial intelligence as “nothing but an effort to influence the midterms.”

    And on Wednesday, Mr. Blanche spoke at a campaign rally for Michael Whatley, the Republican Senate candidate in North Carolina. Echoing his convention speech, he portrayed crime rates, which continued a long-term downward trend to reach new lows in 2025, as “President Trump and Vice President Vance delivering on a promise.”

    After Watergate, a firewall was supposed to insulate the Justice Department from politics. We didn’t want Attorney Generals subservient to the president. But with Trump all that has fallen by the wayside. Todd Blanche was formerly Trump’s lawyer and he still functions in that capacity.

      Blanche has appeared at political events – that is the excercise of free speech.

      No there is not now or ever a fire wall isolating the Justice Department from politics – that is just nonsense.
      Eric Holder was agressively political and described himself as Obama’s wingman.

      You can argue that Holder or Blanche’s conduct is inappropriate – but it is not unethical or illegal.
      Krasners conduct has been FOUND to be unethical by the courts. Perjury is illegal, and a Federal Judge beleives that Krasner perjured himself.
      With near certainty SOMEONE committed perjury in this case – either the Democrat DA or some of his DEMOCRAT subordinates.

      Regardless, as has been the case in myriads of SCOTUS cases – Every member of the Executive branch is answerable to the president.

      There is no “firewall”. There is no 4th branch of government. Thomas Jefferson ordered his AG to prosecute Aaron Burr for Treason and oversaw the trial on a daily basis.

      Have you been paying zero attention ?
      Numerous supreme court cases under Obama, Trump, Biden and Trump have UNIVERSALLY found – those with the executive branch are answerable to the president.

      There is absolutely no such thing as an independent federal agency.

      Our constitution lays out 3 branches to govenrment – the legistlative, executive and judicial.
      There is no 4th branch.

      There is no position in the federal govenment that is not answerable directly to one branch or another. PERIOD

      Nor would any sane person want otherwise.

      In what world would you give unelected members of the executive branch power without presidential oversight.

      The AG is not the Co-President in charge of the Department of justice.

      Watergate confirmed – it did not establish, that ANYONE in the executive branch that sincerely beleives they are being asked to do something unconstitutional MUST resign – there is no ethical or constitutional ability to ignore the directives of the president and remain in the executive branch.

      This is not a Trump thing. It is how our government was constructed from the start.

      If you wish it to be different, you need to amend the constitution.

      Regardless, AG’s or other cabinet officials engaging in politics is not even slightly unusual.

      There are actually congressional rules for precisely how the executive branch appointees must separate their political activities from their executive branch jobs. NONE are barred from politics – that would violate the constitution – you would need to repeal the first amendment to do that. What they are required to do is keep their time and expenses related to politics clearly separated.
      And this applies even to the president.

      As an example when Air Force One flies to a campaign rally – the Republican party must pay for the flight.

      Pelosi got into ethics trouble over mixing political and legislative travel a decade ago.

      Trump fired a cabinet official in his first term for using govenrment planes for personal travel.

      DHS Secretary Noem similarly resigned over spending tax payer funds on personal politics and over intermingling her personal and govenrment roles.

      Trump actually enforces these ethical rules – unlike democrats.

        I think Holder’s ‘Fast & Furious’ operation shipping guns to Mexican drug cartels was illegal.

        The Bummer Administration was trying to make a case that American gun shops were arming cartels. I think that Holder’s operation was intended to create evidence for that argument. Sort of like the SPLC funding Nazi and KKK groups so they could point and say “See, America is Fascist.”

        Turns out the cartels were apparently getting their weapons from Mexican police and military.

It looks like Blanche lacked the spine to allow the investigation to pursue the target that was logically indicated by the evidence uncovered, Barack Obama, because Blanche feared the public hue and cry that could result. In fact, the passive reaction by other deeply involved individuals to this probable miscarriage of justice, including Dan Bongino, and even Trump himself, suggests that there may be some unheralded mechanism of deep control at work here. Are they all sock puppets charged with keeping the voting public angered and entertained by their feigned conflict Punch and Judy show while they carve up all of the current and future assets of the US between them?       Philadelphia police have arrested three men they say were involved with three unrelated homicides.

      Detectives from the Homicide Fugitive Squad made an arrest yesterday of Kevin Weaver, 22, of the 5300 block of Locust Street.

      Weaver is charged with murder for the March 8 slaying of Idris Jackson, 21, of the 5400 block of Montgomery Avenue. Police said Jackson was shot in the head and multiple times throughout the body while in the 5200 block of Irving Street.

      About 5:30 a.m. yesterday, detectives and members of the U.S. Marshals Task Force arrested Dennis Johnson, 23, of the 700 block of Broad Street, Chambersburg, Pa.. Johnson was charged with murder for the slaying of Kenyatta Smith, 26, of the 2400 block of Cumberland Street. Smith was shot in the chest Aug. 17, 2007, about 3:15 a.m. at 30th Street and Lehigh Avenue, police said.

      Also yesterday, fugitive detectives arrested Tyree Wilson, 20, of the 1900 block of Nichols Street for the shooting deaths of Hassan Baldwin, 25, of the 1800 block of North 22nd Street, and Daheem White, 21, of the 1300 block of North 10th Street. Baldwin was sitting in the driver’s seat and White in the passenger’s seat of a burgundy Ford Taurus parked on the 1300 block of North 10th Street when they were shot Feb. 23. Baldwin was shot multiple times throughout the body and head. White was shot multiple times in the chest and back.

      1. Prosecutors should uphold the truth. Prosecution should only happen when there is truth of a crime. Too often prosecutors lie to those who have been arrested and make misrepresentations to the judge and jury about the quality of the evidence. They hire experts who will back whatever nonsense claim as established science. If they aren’t getting convictions their political opponents say they are soft on crime, regardless if those who are prosecuted are actually criminals. Likewise, if they don’t make these prosecutions, then the police will screw them politically for making it look like the police are doing what the police actually do, which is railroading innocent people to make their arrest records look good. Police especially love to make an unfounded arrest for which the person is released without charge so in the future they can make a second arrest to establish a pattern of arrests, in other words, a career criminal who may never have committed any crime.

  9. This argument below, regarding AI regulation, or lack of, presumes the constitution is frozen in the 1780’s. As if no branch of government can possibly act on anything not mentioned specifically in the constitution. This type of thinking has triggered the backlash calling for a packing of the Court.

    1. There is a way to update the constitution. It’s called an amendment. Keep in mind that the most important thing about our constitution and form of govt is that it rests on a charter of negative liberties. If men were angels there would be no need for government. And since governments are composed of men governments need to be limited .

    AI—Artificial Intelligence

    Congress has absolutely NO power to regulate the technology and software industry per Article 1, Section 8.

    The technology and software industry in 1789 would have been equivalent to the precision-manufacturing and scientific-instrument industry.

    Article I, Section 8, makes no mention of regulating that sector or any similar sector.

    Any attempt to regulate AI would be irrefutably unconstitutional, understanding that the Constitution limits and restricts government while providing maximal freedom to individuals.

    For all you sophists and rules lawyers, and chicaners, AI is not subject to the Commerce or Necessary and Proper Clauses.

    1. Holy-moly, you do have a sense of just how many “inventions” have been regulated since the Constitution signing, correct? I don’t disagree with you necessarily that government needs to stay out of AI, but the single statement in the Preamble (promote the general Welfare) would seem to give a busy body government leeway to regulate it’s little bureaucratic heart out!
      I’m sure there is a Constitutional Lawyer here (Professor?) that could explain the reasoning better than a retired Engineer, but the EPA alone has taken jurisdictions over dirt, air, trees, etc., at various times in the past…..

        1. Crime. Crime-fighting is an enduring reason for having government. Criminal law regulates individual behavior and corporate behavior. Example, corporations cannot print US currency. Corporations cannot own, buy or sell persons.

          Torts. The threat of being sued is a form of behavior regulation — constraining individuals and corporations on taking actions that cause harms, but which are not criminal (prosecutable). Example: Allowing impurities into a drug sold that then causes sickness is actionable as a tort.

          Major sections of the Constitution enable crime-fighting and torts-handling.

          Therefore, the AI companies are regulated by existing law, and always at risk of being sued. Congress can enact law defining new crimes bearing on AI. E.g., though not presently illegal, a dead person’s face, voice and likeness could be protected from use to synthesize deep fakes as a means of intended deception — Congress very well will end up adding these protections to a person’s estate. Or, they could legislate such protections as part of torts law.

          These examples clearly show AI being regulated consistent with the Constitution.

          1. AI and the Constitutional Limits of Federal Power

            Crime and torts are not themselves “government regulation.” Criminal law establishes prohibited conduct and punishments. Tort law establishes civil liability and remedies for legally recognized harms. Both can constrain the conduct of individuals and corporations, but neither constitutes a general governmental power to regulate an industry.

            There is no enumerated constitutional power to regulate the technology industry, and there is no enumerated constitutional power to regulate artificial intelligence as such. The federal government possesses only the powers granted to it by the Constitution. The emergence of a new technology does not create a new federal power.

            The founding-era context is significant. In 1789, technologically sophisticated private enterprises—including precision manufacturing and the manufacture of scientific instruments—already existed. Article I, Section 8 did not grant Congress a general power to regulate those industries. The modern technology and software industry is functionally analogous: technological sophistication does not itself create federal regulatory authority. The advancement of technology cannot enlarge the powers enumerated in the Constitution.

            The Commerce Clause does not provide a general power to regulate industry. It grants Congress the power “to regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.” Properly understood, commerce concerns buying and selling—the exchange of goods and services. The Clause therefore addresses commerce within the relationships specified in the text; it does not establish a general federal police power over technology, industry, production, employment, or private conduct.

            Consequently, Congress cannot obtain a power to regulate AI merely by characterizing an AI law as criminal law, tort law, or commerce regulation. A criminal prohibition must rest upon an actual constitutional power, and federal tort legislation must likewise rest upon an actual constitutional power. Neither the criminal classification nor the tort classification creates constitutional authority that otherwise does not exist.

            AI companies, like other individuals and corporations, remain subject to existing laws that are constitutionally applicable to their conduct. If an AI company commits an existing crime, the applicable criminal law may apply. If its conduct constitutes an existing tort, the applicable tort law may provide a remedy. These facts do not establish a general congressional power to regulate AI.

            Congress could enact additional laws concerning particular AI-related conduct only where an enumerated constitutional power authorizes those laws. For example, legislation addressing deceptive use of a person’s likeness would require an identifiable constitutional basis for federal legislation. Simply declaring the conduct to be a crime or creating a tort would not supply that basis.

            The fundamental issue is therefore not whether AI can be subjected to legal consequences. It is whether Congress possesses constitutional authority to enact the particular law imposing those consequences. Without an enumerated constitutional power, Congress has no authority to regulate AI or the technology and software industry as an industry.

            The principle is consistent with Alexander Hamilton’s argument in Federalist No. 78: the Constitution is fundamental law, and courts have the duty to refuse effect to governmental acts that conflict with it. A limited Constitution can remain limited in practice only if governmental acts that exceed constitutional authority are treated as void.

The coverage came entirely in a single segment framed around the response to the story from Trump Jr.’s wife, Bettina.

    Update (9/16/26): Special Report provided an additional 2 minutes of coverage on Tuesday about a Russian oligarch bankrolling Donald Trump Jr.’s wedding. Bret Baier asked correspondent Aishah Hasnie for an update on the story and later noted in a panel segment that “there would have been a lot of coverage of this” if it involved the son of a Democratic president. After Axios reporter Stef Kight said that “we are not hearing anything from Republicans” about a “very similar situation,” Baier commented: “Well, we want to cover it, cover it all.”
