Letitia James Appointed Special Counsel Despite Suggesting the Guilt of the Accused

Below is my column in the New York Post on the Cornell rape case and the appointment of Attorney General Letitia James to investigate the allegations. With Democratic politicians and pundits already pronouncing guilt before any charges, let alone a trial, the appointment of James follows an all-too-familiar pattern in high-profile criminal cases. James previously pronounced the guilt of the students before she was appointed by New York Gov. Hochul as the special prosecutor. James publicly denounced what the accuser had “been forced to endure” and called her case “horrific and unacceptable.” She added that, with “all survivors,” that “we stand with you.” It is a signature of James’s notorious approach to prosecutorial ethics.

Here is the column:

“Seven men drugged and gang raped a 20-year-old woman.” That verdict in the alleged Cornell rape case was delivered by Rep. Alexandria Ocasio-Cortez, who has joined a chorus of others in pronouncing the guilt of Cornell students accused of raping a fellow student.

Mind you, not a single witness has testified under oath publicly and not a single charge has been brought. However, guilt is now being collectively declared from the usual figures and outlets who have never been late to mob justice.

Ocasio-Cortez declared, “I want to be clear that the culture of rape, sexual assault, and pedophilia is protected in elite institutions across the United States and including Cornell University in this instance. It has got to stop.”

We have been here before. Twenty years ago, Duke students were accused of gang raping a stripper at a campus party. The media quickly lionized Durham District Attorney Michael B. Nifong as he pandered to the media in portraying the students as personifying a racist rape culture in the United States.

The problem is that, from the start, the facts did not fit the allegations and there was a total lack of forensic evidence to support the claim. Crystal Mangum later admitted that she had lied.

Nifong was disbarred and Mangum, who was still not prosecuted for lying about these students, later went to jail for murder.

All the politicians and pundits who declared the Duke students guilty simply shrugged and moved on to the next scandal, demanding instant, uninformed judgments.

Conflicts in testimony, as are evident in the Cornell case, does not mean that there was no rape. Indeed, this is a stronger case than Duke in my view. However, there is ample reason to withhold judgment until more is known.

Much of what we know comes from a 101-page civil complaint filed by Doe against Cornell, fraternity-related entities, seven individual defendants and other defendants.

The alleged rape occurred on the night of Oct. 19, 2024. Doe admits that she drank heavily at a sorority house and then, despite being underage, drank more at a couple of bars before, around 11 pm, going to the Chi Phi fraternity house to meet a friend. It was there that she claims to have been drugged and gang raped.

The Snapchat messages sent after 1 am from the fraternity brothers are disgusting and horrifying. Frat brothers announce that there was “free” sex with a woman upstairs, and one later asked, “Shop still open?”

Yet the case also includes countervailing statements from the alleged victim herself, including suggestions that the sex with the first couple of men was consensual.

Friends recounted that Doe later laughed about the incident and said, “Oh my goodness, isn’t that crazy?” (Notably, some also added that they believed Doe was still traumatized by the experience and had not fully processed it).

She also later told her sorority “big sister” that “You may hear some rumors about me, and unfortunately they are true.”

On October 22 and 23, Doe exchanged messages with one of the men who expressed regret about “how things went down.” Both said that their memory of what occurred was cloudy because they were intoxicated.

However, she told him “non(e) of the sexual stuff was illegal.” She reportedly added that she liked being with him and another man and wanted to come over and smoke more “but like leave out the extra 5 billion men and ketamine.”

On Oct. 22, Doe did go to Cornell Health and was diagnosed with a urinary tract infection and tested positive for sexually transmitted diseases.

On October 28, Doe reportedly wanted to go to the fraternity’s Halloween party, and her frat friend said she was welcome because “chi phi is your house and you are welcome here.” She responded with “thank u i really appreciate … i’ll bring my cigs tomorrow.”

Later, the president of the fraternity contacted her to rescind the invitation and she responded angrily to her friend that “I knew this was going to happen. The woman will always get the short end of the stick. Yall aren’t my friends. Yall are covering your asses.”

On Nov. 7, Doe did seek a rape kit test (which was not useful after the passage of so much time). The next day, she reported the alleged rape to the Cornell University Police Department.

Cornell then moved quickly that day to suspend the Xi Chapter of Chi Phi and temporarily suspended the seven men later named in her civil lawsuit.

In her later accounts, Doe admitted to heavy drinking and drug use. She also reportedly told investigators that she was okay with the initial sex, adding, “Yeah, as much as I can be because, again, I was super drunk when I got there … But I was pretty OK with all of this.” However, she also said “I can say with 100% confidence I was raped.”

Legally, the extreme intoxication and drug use undermine claims of consent. While she admits that her memory was “super clouded,” it is hard to imagine anyone believing that a student in her condition was capable of giving knowing consent.

However, there are obvious problems with the case, which likely contributed to the decision not to bring criminal charges or make a criminal referral.

In New York, one threshold issue will focus on her voluntarily drinking to excess. Like other states, a mentally incapacitated individual cannot legally consent to sex but there is an exception for those who voluntarily consumed alcohol to the point that they became incapacitated.

Roughly 20 states have the same exception — where an accuser must show that her incapacity by intoxication was involuntary due to being drugged or brought to intoxication without knowledge or consent.

Faced with a prosecutor who had previously declined charges (but was reopening the case), Gov. Hochul condemned the university and played to her base. She promised her own prosecutor.

She then picked the one prosecutor who surpasses Nifong in the Duke case in her reputation for putting politics ahead of prosecutorial integrity: Attorney General Letitia James.

James was elected on a pledge to weaponize the legal system against President Donald Trump, promising that she would prosecute Trump without specifying any crime. She is known as one of the most political prosecutors in the country, using her office to pursue groups and individuals on the right. Former staffers recently condemned her for converting them into “Tish’s personal attorneys … targeting her political enemies.”

Hochul’s appointment of James maximizes the chances of a criminal charge in the case. James has always followed the policy of the Queen of Hearts in “Alice in Wonderland”: “Sentence first, verdict afterward.”

      We will have to see what happens. Jeff Bezos has been trying to get WaPo to balance its reporting to appeal to more people for over a decade and failed. The result was mass layoffs. We will have to see if that worked.

      X loves to rant that the left title of colleges may be what professors and students want.

      Which would be fine if the american people were not subsidizing them.

        You are correct, Bari Weiss is NOT MAGA. She is very much a traditional liberal who had the audacity to call out the NYT floor room for their advocacy journalism and their anti-semitesm. She resigned and started a news letter called Common Sense. It got so popular, she then turned it into The Free Press. And has been very successful. The Free Press is NOT MAGA. By their own internal polling, they are like a third liberals, a third conservatives and a third independents. And they all get along quite well by their own reporting. They even have dinner clubs nation wide. I would attend but college prevents me.
        She got hired to make CBS news into something like The Free Press. And the internal staff, the advocacy journalists are resisting her efforts to make return CBS news back to it’s honorable, objective, watched news apparatus that it once was.

They will never relent, and if dems ever have majority power again it will be the Biden years on steroids, picking up right where they left off quite quickly, and likely virtually irreversibly. Vote like your life depends on it, because it does, in the midterms, folks. This is our world if we don’t stand firm. People need to understand the gravity of that.

      Presuming that is not something else hiding in the unreleased parts of Jane Doe’s statement,

      The only charges possible are the distribution of illegal drugs, and proving alcohol to minors.
      Those are both crimes even where there is consent.

      Jane Doe may well have a civil case against the fraternity.

      DNA is irrelevant here – there does not appear to be any dispute over who did what to who.
      There does not appear to be any dispute that the conduct was all consensual.

      All of these students are morally reprehensible and should be expelled.

      But the only crimes are drug and alcohol offenses.

    GOP gov candidate Bruce Blankman is within margin of error of NY gov Hochul. She needs to rile up her base and a distraction from rising utility prices that she help cause by her and then gov Cumo passed some climate change act in 2018. Long time Dem supporter and donor actress Debra Messing is endorsing Blankman and said recently,
    “The decline in this city over the last four years has been so exponential and devastating — economically, socially and on every level. And obviously, we’ve lost so much business here. People are leaving,”
    And hedge fund CEO Ken Griffin gave a impressive $3b donation to the new Carnegie Mellon Miami FL campus and 1$b to the Pittsburgh PA campus, snubbing the Manhattan one. Business leaders in NYC are calling it a loss for NYC and not a coincidence.
    So, Hochul brings in James to make a clown show of a trial, just like she did with Trump.
    And after the Lindsay Clancy trial, what jurist or jury would dare NOT return a guilty verdict?
    Be interesting to see what the defense finds in discovery.

      1. Gentlemen, I just got very bad news. It’s true that much of upstate NY is red, but Thompkins County is a massive exception. For perspective, that county voted 75% Democrat in 2024. NYC voted only 68% Democrat and still managed to railroad convictions and judgements against Trump. Thompkins is where Cornell is. There is no law in NY state anymore. It’s mob rule.

        If I were one of those white defendants, I’d pray for a plea bargain or expect years of appeals (megabucks) just to get it to the Supreme Court.

        I am at a community college and it seems like a mix bag.
        The general ed classes like math, could lean right or left. I can say one side of the class room seems more like high school and the other side is a lot more serious.
        The more degree or career focused courses seem to tend more right.
        Also, the socio-economic varies widely. One young woman in my chem class, it was Thursday, she already had 33 hours in at work and had a 10 hour shift that day. She is going for her nursing degree and does not have time for useless DEI classes or useless, waste her money liberal arts requirements.
        From what we have read and seen, sure, those elite colleges and universities might pander to those who can afford tuition at those prices, but for people who actually work or are going for real jobs doing real work, they do not have time for the leftist indoctrination. They, or I should say, we, are not interested in what those leftist indoctrination camps are selling.

While the case is both horrific and ah, messy, the appointment of Ms James as prosecutor reeks of Laverenty Beria: “Give me the man and I’ll give you the case against him.” The term criminal justice takes on whole new meaning in some jurisdictions. In the previously mentioned Duke case, if at least one of the parents of the students accused hadn’t had serious money, they’d likely all still be in jail.

    Professor Turley, how can you – in good conscience – summarize that as James “pronounc[ing] the guilt of the students before she was appointed by New York Gov. Hochul?”

    At least based on the referenced article, she has done nothing of the sort. So, either you have not properly cited your sources, or you are blatantly making things up.

    In that post, she neither declared those specific defendants are guilty of any charges, nor does she even acknowledge a crime has been committed, period.

    Turley is just “fueling the Age of Rage” yet again.

    (Before I am attacked, a disclaimer: In no way does this mean I defend James or the selection of James. This is merely about the ridiculously unfounded conclusions drawn by the good professor in this post.)

      2. What she had to endure was the realization of shame over her hedonistic behavior that she engaged in by attending a solicited gang bang. She has been reported to have texted and bragged to her friends about her sexual exploits and drug use of the event. Only after it all became common knowledge about campus that she was a promiscuous did she suddenly realize her reputation had become besmirched by her own doings. Alas, someone else must be responsible for her failures in judgment….

        She (they) will now drag all of these men into the same level of chaos rather than accepting personal responsibility. If you’re going to be stupid you had better be strong.

        What you do in your youth can stay with you throughout your life, a hard concept for many to learn, self included.

        Everyone using the word FORCE either has evidence that has not been made public – which is highly unlikely as the local DA refused to charge anyone, or they are LYING.

        James did not Prejudge the case – she LIED.
        AOC is LYING.
        Hochul is LYING.

        The conduct these teens engaged in was disgusting – but aside from drug dealing, and providing alcohol to minors – there are no crimes.

        Revolting behavior on the part of Jane Doe.

          And beyond that, you’ve ignored the even more critical part – which is that there is nothing in the post linking the subject of her claim to any defendant.

          If you take issue with this, I suspect that you may want a refresher in basic reading comprehension. Maybe Turley can join you.

      The conduct described was immoral and hedonistic – but it was not a crime – aside from alcohol and drug crimes.

      Even there – Jan Doe was not the only underage person being provided with Alcohol which she consumed con-sensually.
      She was not the only person being provided with drugs that were being consumed con-sensually.

      From Jane Does statement – at EVERY step in this – Jane was asked if she consented to whatever was next.
      Sometimes she said no – and those involved listened. Sometimes she said yes.

      In NY as in several other states – you can not claim that you were too drunk to consent if you voluntarily got yourself drunk.

      Regardless, Jane Doe did not endure any “ordeal” different from hedonistic consensual sex anywhere.

      These teens are all equally immoral and equally innocent – atleast criminally.

      Whatever the culture at this fraternity – it was a culture Jane Doe wanted to be a part of.

  12. We are reaching the point where vigilante justice is the only response reasonable. We used to tar and feather recalcitrant tax collectors. Perhaps this should be extended to rogue prosecutors and the governors who use them? The bastardization of the legal system has been allowed to go on far too long and must be stopped lest it tear the country apart. The democrats want to remove the only barrier keeping us from descending into anarchy and civil war. They are the very definition of mob rule and are the main thing the constitution was designed to prevent but once a party gets power to change that aspect all bets are off and we are all screwed until enough killing has occured.

  13. This is my personal opinion only, but based on professional experience and observation. I am a white cisgender female.

    1.) Women (mostly white females) tend to blame men, irrespective of their own immature, ill-advised, and dubious contribution to events. I am in no way defending or excusing macho males intent on overpowering women in some situations, including sexual.
    2) Women’s limbic response mechanisms seem to prevail over logic.
    3) A single, non-sexual example: the recent FlyDubai incident involving co-pilot attacking pilot: Women hysterically screaming. Out of control screaming. Top-of-lungs non-stop screaming.
    (I once was on a plane when this happened. We were going to the Pentagon for a training class; I was a mere clerk-in-training. The plane landed safely after the receiving airport* lined the runway with white foam. Sorry, *don’t know the correct terms.) Since that day, I have regarded screaming women with disdain.
    4) My advice to ALL women. If you are not contributing to the solution, just Sit Down and Shut UP until you have something to CONTRIBUTE in resolving the crisis. Please STOP ALL THAT SCREAMING.
    5) My distant perception of Letitia James is that her initial response to cases is limbic, whether political or criminal in nature. She then later structures the logic elements to a case and her response is more controlled, professional, -although one can feel the bias still leaking through the seams.

    2. Appreciate the candor, Lin. My guess is that Letitia Shames will milk the case for all the votes (and donations) it can get and then bury it after the election. This case ain’t no mounted trophy; it’s a roadkill that’ll stink with too much sunlight. By going away quietly, it does what a lot of liberal lore does: it gets brought up over and over again without ever being proven–like Trump’s “good people on both sides” quote that was repeatedly quoted out of context by people who knew better.

      Then, again, the mob is often too stupid to be cynical. I guess we’ll see.

      Interesting observations. Men and women likely will react differently under challenges because of biology. That has generally been true across cultures whether sophisticated or hunter/gatherer. If you are usually physically weaker and with more gracile bones it isn’t a winning strategy to launch yourself into physical combat as we too often see in stupid movies. Other tactics are needed and strong women find them.

      Another problem is the wussification or sissification of society in general and particularly with women. It doesn’t help to be conditioned to be infantile. Ridiculous ‘trigger warnings’ and ‘hydrating’ every time you break a sweat are simple examples.

      That said, I have been fortunate to have known strong women, including my grandmother and great aunts who were essentially frontier types. In her statement and text messages, Jane Doe alludes to “cigs” and ketamine. The cigs likely refer to marijuana, which, in NY State, is legal for recreational use only if you’re over the age of 21. Jane Doe was 20 when this episode at the frat house occurred.

    Ketamine, on the other hand, is a very serious controlled substance and regulated as a Schedule III drug by both NY and federal laws. TV star Matthew Perry died from a ketamine OD, and his supplier was sentenced to 15 years in prison. His doctor and assistants are under investigation and may go to the slammer, as well.

    So, for the moment, let’s forget about the sexual stuff; it’s a she-said, he-said deal at most, and the legal issues right now do not favor a prosecution because of all the contradictions.

    The easiest way to get to the bottom of all this is through the drug-related evidence. OK, Jane Doe, where did you obtain the marijuana, from whom, when, and how much? What else do you know about underage marijuana use at Cornell?

    OK, frat boys, who brought the ketamine to the party? Jane Doe says the drug was “on” the private part of so and so. OK, so and so, what can you tell us about this drug? Where did you obtain it, from whom, for how much, and how much did you buy? What more can you tell us about ketamine use at Cornell by students?

    None of these people, including Jane Doe, is a hardened criminal likely to clam up and hide behind their lawyer. They are at Cornell because they are smart, ambitious, and the family can pay $75-$90 thousand a year in tuition for a first-rate education that guarantees success in life, not time in the slammer. This episode could ruin that plan. It could also land one or more frat boys in the slammer.

    So, line up, everybody; it’s true confession time. Cornell’s new motto for the occasion is mus esto aut musem patere (Latin for Rat or be Ratted). You can not choose to get drunk and/or high go to a Frat intent on having sex and then cry rape. And Jane Doe has admitted all of that.

      You are arguing that once a person is drunk – any sex with this is rape – you are arguing strict liability or a version of statutory rape that is not in the law.

      If two people are drunk – and all those involved were drunk – who is it that committed the crime ?

      Why is it you are claiming that Drunk and High Jane Doe was raped by Drunk and High Frat Boys.
      Why is it not just as true that drunk and high Frat Boys were raped by Jane Doe.

      There is LOTS of evidence that she came to the Frat specifically to have sex.

      Just to be clear I do not like NY’s consent law – though I think it is correct in THIS CASE.

      I think that conviction is appropriate. While the women got drunk on her own, and allowed the Cabie to escort her to her apartment and then consented to sex – The cab driver had a duty, and was not drunk.

      1. I love it when people tell me what I believe and what I’m arguing. I think the Sorority which gave her drinks while she was underage shares responsibility. It was her sorority; they knew her age. The bar which gave her alcohol after the doorman marked both of her wrists as underage was civilly liable. I don’t especially blame the second bar where she apparently wasn’t served, but there may be information I’m unaware of. I never claimed statutory rape, she was twenty and able to consent to sex in New York. I don’t know how you arrive at her giving consent each and every step of the way. She may have agreed to a threesome. You’ll have to document she invited the rest of the frat to have “free pussy.” The ketomine is a problem for the frat, there’s no suggestion she brought it with her. I don’t see evidence (it may exist) that all of the men involved were drunk or high (on their own supply). Being drunk doesn’t excuse anything legally. If you rob a bank or commit murder while drunk, try using that as an excuse. If all involved were drunk (nowhere near proven) the ones that committed the crimes were responsible. Is being raped a crime under the New York Penal Code?

        Select misdemeanors, including: sexual abuse, forcible touching, unlawful surveillance, and certain assault charges

        Once collected, profiles are entered into New York’s State DNA Identification Index (SDIS), which feeds into the federal CODIS (Combined DNA Index System) national database.

        Donald Trump seems to have qualified for having committed 34 felonies in New York and having been found liable for acts which included sexual touching and sexual abuse.

        Why was his DNA never taken and compared to the National Database?
