The First 100 Days: The Method Behind the Madness in Court Challenges

Below is my column in the New York Post on the first 100 days of the Trump Administration in court. It is too early to handicap many of these lower courts decisions. I have been critical of some of these orders as either premature or unconstitutional. There is a reason for the hyperkinetic pace of the Administration. However, it needs greater focus and discipline in picking cases.

Crimson Chide: Harvard Makes the Case Against Itself

Below is my column in The Hill on Harvard faculty organizing in opposition to the Trump Administration’s measures targeting the university for failure to protect Jewish students and its lack of diversity of viewpoints on campus. Despite being a vocal critic of Harvard’s culture of orthodoxy, I have encouraged the Administration to moderate some of these measures and oppose the denial of tax-exempt status of the university. However, the Harvard faculty members may want to sit this one out. They are not helping their cause.

“No One is Above the Law”: New York AG Letitia James Accused of Alleged Mortgage Fraud

Below is my column in the New York Post on the criminal referral of a mortgage fraud case against New York Attorney General Letitia James. After her scorched-earth campaign against Trump, the irony of the allegations is stunning. If James were to move from prosecutor to perp, her own words may come back to haunt her. There could be statute of limitations issues, though James herself showed such such statutory periods can be stretched. James has issued a statement of defiance and suggests that this is lawfare or bullying by the Trump Administration.

Biden’s Administration May Have Suppressed COVID Evidence Contradicting Chinese Claims

Below is my column in the Hill on recent disclosure that the Biden Administration may have withheld evidence contradicting the Chinese on the origins of COVID. Millions of Americans lost loved ones and would like to know who was responsible. It appears that our government and many experts were less motivated to find that answer.

The American Jacobin: How Some on the Left have Found Release in an Age of Rage

Below is my column in the Hill on the rising political violence on the left. Many have found an irresistible release from both reason and responsibility in rage. A new study found more people embracing political violence. Joel Finkelstein, the lead author of the report,  stated that “what was formerly taboo culturally has become acceptable… We are seeing a clear shift – glorification, increased attempts and changing norms – all converging into what we define as ‘assassination culture.’” Roughly 40 percent reportedly found it somewhat justifiable to burn a Tesla or even to kill Donald Trump.

Oh, That Influence Peddling: Times Finds Evidence Suggesting Hunter Acted as Foreign Agent

For years, some of us have written about the Biden family’s multimillion-dollar influence-peddling operation and the Justice Department’s refusal to charge Hunter Biden with being an unregistered foreign agent. Now, years later, the New York Times has found evidence suggesting that Hunter Biden was acting as a foreign agent as early as the Obama Administration, when his Dad was Vice President. Celebrate Saint Patrick by Chasing Censors Out of Ireland

Below is my column in the Hill on truly celebrating St. Patrick on this holiday. Despite our shared history and values, the United States and Ireland are moving further apart on free speech. Ireland has followed the European Union in embracing speech regulation and censorship. If we truly want to honor the legacy of St. Patrick, we can start by honoring free speech. We need to chase the censors from Ireland.

The fight over parental rights could become the defining issue for many in the coming years. Panic Politics: Law Professors’ Umpteenth ‘Constitutional Crisis’ Falls Flat

Below is my column in the Hill on yet another letter from law professors declaring a “constitutional crisis” over the Trump policies. Despite the claims that this is a rogue president ignoring the rule of law, the Administration continues to prevail in some of these cases, including another ruling in favor of the Department of Government Efficiency late on Friday. As stated in the column, it has also lost some cases as did the prior Administration. The point is that, rather than witnessing the collapse of the constitutional system, these cases show that it is continuing to function as designed in sorting out these disputes.

“Which Country is he Loyal to?”: Democrats Go Full McCarthy in Attacks on Musk

Below is my column in The Hill on the disgraceful Democratic attacks against Elon Musk over his status as a naturalized citizen. For years, some of us have raised concerns over the adoption of McCarthyite tactics and rhetoric by the left to demonize those with opposing viewpoints, including critics of the massive censorship system under the Biden Administration.  Those attacks are now reaching a dangerous crescendo after the 2024 loss in the presidential election.
