D.A. Clears Police Officer Who Killed Innocent Man Wearing Same Color Shirt As Robbery Suspect

The District Attorney has cleared Chino police Cpl. Claudia Lisner in killing an innocent man, Daniel Balandran, 23, because he was wearing the same colored shirt as a suspect in a pizzeria robbery.

Balandran walked out of a McDonald’s and was wearing the same color shirt as the suspect. Lisner insisted that, because Balandran came from the same direction as shots being fired and was wearing the same color shirt, she was legitimately fearful for her own life and killed him. She says that he did not respond to an order to show his hands.

The two suspects also suffered gunshot wounds and were charged with murder.

    The story doesn’t say that the officer identified herself as a police officer, so I’m wondering if an order to “show your hands” wouldn’t be a confusing order for an innocent bystander who was apparently unaware of the situation. And the family’s attorney is apparently the master of understatement in Fresno – yes, I imagine at the very least the family is “unhappy.”

    Trigger-happy cops have become the rule rather than the exception everywhere in the country, it seems.

    Probably not a lot of what happened in the news, but seems like a tad of overreaction.

    And I have to wonder if a guy would have been as “fearful” of his life as a woman cop in the same situation. Would he have gone straight for deadly force or used pepper spray/taser/baton???

    Another argument for women being “equal” to men…just keep in mind that they are NOT THE SAME!

    There is not much information at the link; however, my first impression is that this appears to be an unjustified use of deadly force by the LEO against an alleged “suspect.”

    Well John you wouldn’t have to wonder if you actually followed the news on police violence against the citizenry and knew whereof you spoke. Women police involved shootings are the minority; an extreme minority. It’s not about male v female but about us v them, the citizenry v the power. Women cops have a lot of catching up to do on the ‘wreaking senseless violence on the citizenry’ front but they’ll catch up to their male counterparts I’m sure.

    That beats the Menendez case hands down for the most blatant case of an innocent being killed by really stupid people. “I feared for my life because he had the same coloured shirt on” but he didn’t have a weapon or was acting in any way which threatened the “peace” officer

    Innocent citizens are beginning to understand that some cops are more of a threat to one’s survival than criminals.

    It may be getting to a point where we as citizens have to have video cameras in our cars and video phones on our person to prove who we are and what we are doing and where we or going.

    Ah, but then you get charged for illegally intercepting communications.

    I do believe it should be presumptively lawful to record an on-duty LEO who is in a public place; when wiretapping laws are selectively enforced against citizens who record LEOs (I’m looking at you, Massachusetts …) it’s just a different flavor of abuse of power.

    Another reason to stay indoors or just use the drive-through. Did you know you can even order pizza securely online now too? No fear of getting shot while getting my grub OR my phone tapped!

    Another good reason to stay away from McDonalds! This is just one more case of criminal activity by the police being dismissed. The police are becoming “bulletproof”!

    . . Wearing the same color shirt as a Suspect can put anyone of us in a stress situation before we have an opportunity to wolf that Big Mac.
    . . Remember how fond Bill Clinton was of those Big Mac Cholesterols at MacDonalds? Lucky for him he never wore the wrong color shirt on the wrong day.
    . . Will Balandran’s family be compensated at approximately the same rate as the Clinton Family for his mistaken and wrongful death?
    . . We can bet that Balandran’s family does not have a clue that they might have a Claim.
    . . How would the Republican Party and the Water Boarders see this?

    Somebody needs to explain to Cops that innocent people do not respond to somebody yelling at them, cop or not, when they know that they are doing exactly what they should be doing.

    Just like drivers who are not speeding do not pull over and stop and get out their drivers license, because they know they are not breaking the law.

    There is also the point that people who know they are doing what they are supposed to be doing simply aren’t on the alert for police to be yelling at them, so this victim likely didn’t know what the cop was doing since it didn’t relate to him or her.
