Former Judge Samuel Kent has been placed in the position of filing complaints as an inmate in Texas. He is serving 33-months for obstruction of justice after he lied about allegations involving groping and sexual assault of two female court employees. He claims to have been abused as a prisoner due to his status as a former federal judge.
His attorney, Dick DeGuerin, filed the motion in U.S. District Court in Houston asking for resentencing. One of the more troubling allegations — besides verbal and physical abuse — is that Kent has been denied access to a federal substance abuse program that would have allowed him to reduce his sentence by as much as a year. I do not see why he would be denied such access to the program.
The filing states “[t]he Federal Bureau of Prisons has subjected Sam Kent to abusive psychological and physical conditions that have jeopardized his ongoing recovery from severe depression and alcoholism, while arbitrarily prohibiting him from participation in rehabilitative programs.”

You are blogging anonymously because that way you can make b.s. statements and not be held responsible. The NonDetention Act, 18 USC section 4001, prohibits the U.S. government from holding U.S. citizens such as myself without a statutory basis. I am absolutely convinced that former judge Nottingham is a felon, at least towards me, who hasn’t been prosecuted. He didn’t have a right to jail me to force me to dismiss my lawsuit anymore than he has a right to jail someone to force them to have sex with him.

Yes of course I know this is a “lawyers’ blog”. That is why I am using it for confrontation instead of sending emails to those people who are already convinced that most lawyers are crooked. As far as the majority of lawyers being “deliberately cruel”, it is pathetic that they think that something as important as justice should be perverted to their financial needs.

Kay, I don’t know what your story is (and please don’t tell me…)but don’t forget where you are…a lawyers blog….I don’t think the majority of lawyers think in terms of victims (although I know some do..and i’m sure I’ll be corrected if I am wrong…)but the really good ones don’t victimize and are not deliberately cruel. And I don’t think that the bulk of the legal community is deliberately cruel either.
Lawyers have a warrior mentality and they think strategically. Good lawyers see good strategy and logic and potential positive consequence where victims often see big obstacles. You can choose another way to look at it. And of course it goes without saying that crappy lawyers, even the small minority, give the profession a really really bad name.
I am a lawyer. I’m just not your lawyer. Nor would I be.

In the civil sense of the term?
Because it sounds less like witness intimidation that it does a judge giving you an out instead of just locking you up for wasting his time. Which he could have. Legally. Or he could have fined you. Or both. That’s what civil contempt is: a method for the judge to coerce compliance from process non-compliant parties wasting his time. He could have jailed you, fined you and then accepted a Motion for Summary Judgment and dismissed with prejudice. As it is? Take it up with the appropriate judiciary committee and/or appropriate state bar.
As to Judge Nottingham, I wonder if he knows you go around telling people he’s an unindicted felon. That’s sure to make him happy. And by happy, I mean “really pissed off”.

He is in prison but needs substance abuse help.
So he is admittig he is abusing substances in prison.
That is the only way it makes sense.
If he isn’t getting drunk or stoned in prison then he has no abuse problem, in priso, becasue he isn’t abusing.
He may need to go to Nancy Ford when he gets out as part of his parol. But that would be so he won’t start up his habit once out of prison.

given the nature of U.S. prisons I’d expect the substance abuse programs are full. so for now ,he not only gets to find out what it’s like to be on the receiving end of a prison sentance but what it’s like to be on the receiving end of unwanted sexual advances.
the time spent in incarceration is punishment enough. Abuse and rape shouldn’t be a part on the sentance.
