Wisconsin Supreme Court Erupts Into Name Calling and Finger Pointing

Wisconsin voters are experiencing a different judicial campaign in the bid of Justice David Prosser to remain on the state Supreme Court. The issue? Prosser calling Chief Justice Shirley Abrahamson a “total bitch.” Prosser has gone public to say that he did in fact call Abrahamson the name, but he stressed that he meant it. He also promised to “destroy” her. The controversy has now pulled other justices into the fray on both sides.


Prosser insists that Abrahamson was working against him politically as well as other court conservatives. He said that he “probably overreacted, but I think it was entirely warranted. . . . They (Abrahamson and Justice Ann Walsh Bradley) are masters at deliberately goading people into perhaps incautious statements. This is bullying and abuse of very, very long standing.”

Bradley recounted the confrontation in an email: “In a fit of temper, you were screaming at the chief; calling her a ‘bitch,’ threatening her with ‘. . . I will destroy you’; and describing the means of destruction as a war against her ‘and it won’t be a ground war.'”
Bradley’s email led another justice to criticize her for airing the issue to a wider audience. Justice Patience Roggensack wrote to Bradley, stating

“You were trying to make David look bad in the eyes of others, as a person who uses language that we all find offensive – and I include David in that ‘we,’  . . .Do you think that copying others on your e-mail increased the collegiality of the court or decreased it?

You are a very active participant in the dysfunctional way we carry-on. (As am I.) You often goad other justices by pushing and pushing in conference in a way that is simply rude and completely nonproductive. That is what happened when David lost his cool. He is not a man who attacks others without provocation. Until you realize that you are an active part of the provocation, not much will change. Perhaps a third party will help you realize that you are not part of the solution; you are part of the problem.”

As the article below details, there continued to be angry exchanges between the court members.

Ironically, I recently met Abrahamson when I was a panel member at Marquette Law School in Milwaukee. She stayed for the awarding of public interest commendations to law schools and local lawyers and was extremely gracious.

    That is some incredible stuff. The Supreme Court Justice of the State of Wisconsin is admitting that he is in the pocket of the Executive Branch! I hope his opponent beats the crap out of him.

I have this sense that in “traditional” or conservative cultures there is a big overt push that “men are men” but that there is a constant, undermining subtext that “men are children.” The “man’s man” is supposed to aggressively pursue casual sex, but when he is accused of rape, the “she was dressed and acting provocatively! How could he resist?” excuse is rolled out. In other words, “men are children and we should have low expectations of their ability to act responsibly.” Yep, the poor conservative male judge was “goaded” by the woman into verbally assaulting her….

    My take is that if he can’t handle some pressure from his fellow justice then he’s a f’ing crybaby and doesn’t have what it takes to be a state supreme court justice. (Or in conservative-speak, “That’s right twerp, a girl made you cry.”)

    Some background here. Prosser’s seat is up for election on April 5th, and he is running against JoAnne Kloppenburg, currently an assistant Wisconsin State AG. Back in December, Prosser’s campaign made the following statement:

    “”Our campaign efforts will include building an organization that will return Justice Prosser to the bench, protecting the conservative judicial majority and acting as a common sense complement to both the new administration and Legislature.”

    Yep – a judge’s political campaign promising to “compliment” an administration and legislature that had just changed to highly partisn hands. His campaign manager followed up criticism of this statement with a statement to the press which included the following:

    “…his personal ideology more closely mirrors that of the incoming administration and Legislature, but his impartial approach to applying the law won’t deviate.”

    Yeah, sure.

    I’ll bet that he is feeling a lot of stress and pressure as a typically low-key judicial election is now the focus for outrage against the theft of the state by a bunch of tools … or more specifically, a bunch of tools of the self-destructively, short-sighted wealthy.

  9. and really, if adversarial and inquisitorial were the only facets of behavior open to the courts then taxes and property sales and titles and other everyday obligatory civic responsibilities would be endangered by going through those channels…….

  10. Buddha as usual I don’t disagree with you…(completely) but you are addressing the ideal. In reality and in fact, the courts are not acting in a judicious manner. They are out of control and behaving erratically (unless you look carefully at who is ultimately benefitting from thier current crappolla-fest). I hesitate to use the term corrupt but starting in the 2000 election cycle, my usually naive political sense has been assaulted by US court weirdness. and I am usually the last to know about these things….for what it’s worth…

  11. This Supreme Court Justice is acting more like a school yard bully and he got called to the principal’s office and he has to start pointing fingers in order to save his ass. This guy and the Justice who stood up for this kind of behavior need to be looking for new jobs. Wisconsin is going through a complete overhaul and will eventually rid itself of these narrow minded radicals who only have power and greed on their agenda.

    The form of the courts (adversarial as contrasted to inquisitorial) has no direct relationship to what you describe which is the simple tyrannical abuse of power created by applying two separate standards to society as a whole instead of the one standard promised by the Constitution and specifically named in the equal protection clause of the 14th Amendment. The indirect connection between court forms and tyranny is that tyranny can arise faster under an inquisitorial form because the judges act as prosecutors and judges at the same time creating an inherent conflict of interest by order of operation that can bias hearings for the state. Inquisitorial courts would make the problems we are facing worse, not better. The problem isn’t the adversarial form of courts. It’s the misapplication or non-application of good law combined the application of bad law born from the campaign graft system that encourage this very inequity that you see.
