
A Florida fitness trainer, Elissa Alvarez, 20, and his girlfriend, Jose Caballero, 40, have been found guily in a notorious case where they were filmed having sex on a public beach in front of families with children. There is general agreement that Alvarez and Cabellero were disgusting and shocking in their conduct. There is little debate that they deserved to be arrested for lewd and lascivious exhibition, particularly with a videotape and calls to the police. However in a move that has become all-too-common , the prosecutors are set to punish the couple for not pleading guilty by pushing for an absurdly draconian sentence against Caballero of up to 15 years in jail.
Keep in mind that both Alvarez and Cabellero will have to register as sex offenders — a huge penalty that comes with social stigma and living restrictions. There is no need for a lengthy jail sentence. These two have been widely (and legitimately) called low-life pigs.
The two decided to go to trial despite the videotape and eyewitness testimony. They both insisted that they were not actually having sex. While it was a weak defense case, they have every right to seek a verdict. However, prosecutors now take the view that if they demand for a plea is ignored, they are relieved on any further duty to be reasonable and just in their indictments and sentencing arguments. I have seen this happen over and over again. It is vindictive and retaliatory against those who want to go to trial. I have had prosecutors tell me that “this is how the game is played” — you defy the state on a plea and they throw the book at you. However, the result is clogging our jails with excessive sentences and maintaining a crippling threat against those who simply want to seek a verdict on their charges. Assistant State Attorney Anthony Dafonseca voiced the same lack of any responsibility in seeking the maximum sentencing – blaming the couple the heavy potential sentence for seeking a trial: “We gave them a reasonable offer, what we felt was reasonable, and they decided it wasn’t something they wanted to accept responsibility for.”
Caballero is in the worst position because he served in the past for trafficking cocaine.
Once again, the conduct of these two deserves serious punishment, but 15 years? What do you think?

I think you have it backwards. Deep Throat didn’t “make porn legitimate to the middle class. ” Deep Throat is a film which tended to de-legitimize the middle class.
One thing that I keep saying is that we have a shrinking middle class because we have shrinking middle class values. Just look at the illegitimate birth rate among White women, which I think is now around 40%.

Squeeky – the birth rate of unmarried woman has nothing to do with the middle class. Although, values have changed. But they have been changing for some time.
OMG, you write about laws? No crime involving peeping through windows or holes in walls? Get a grip. There are, in fact, laws against that. Just like there are involving lewd acts committed in public.
Do you also flash people, in public, because you claim it’s part of your sexual freedom? If I don’t like it, I should just shut my eyes and walk away? How about exposing yourself to kids? If they don’t like it, should they just be told to run, in terror, from you, since you have your rights?

Um… you DO know at least some of the differences between the movies and real life, right? Which isn’t to say that plenty of people (of both sexes) haven’t peeped through windows or holes in walls—and that peeping usually has no consequences… unlike Jose Caballero and Elissa Alvarez, at least one of whom is about to be sentenced to 15 years in prison because not enough people are sane about sex.
Because, I do not want my grandchildren viewing people have sex on a beach they are playing on Mark. I have no objection to sex or even porn in the privacy of one’s own surroundings. I would not want my grandchildren to think that is was OK to do private things in public. Children do not need to be subjected to sex acts. Mark, I’m no prude, far from it.
Only because I wouldn’t want my grandchildren to have to leave a perfectly good beach on account of two exhibitionists.
And why exactly would they have to do that? The folks having sex weren’t touching anyone other than each other, nor calling out to them. It seems to me to be entirely possible for two people to have sex on a beach where other people are sunning themselves nearby, playing in the sand, surfing or swimming. The real problem, of course, is fear of sexuality. It’s why the loving couple were prosecuted and it’s why the Champs called the cops—the grandson asked, “What are those people doing?” and the grandmother was too frightened of sex to tell him. And it’s why you’d take your grandkids off the beach: Because THEY might ask you the same question and you’d be afraid to answer it truthfully.

How it happened was this. One of the persons here is a “Porn Reporter”, who makes his living I guess by reviewing dirty movies or whatever. Because I am sooo suuuurre that the discriminating porn viewer really wants to know if MILF-Fest 37 is up to the same standards as the first thirty six movies in the series or something. Plus, he probably has a “tie in” products line where he sells stuff like trench coats and galoshes to dirty old men. And maybe “tie up” products, too. Who knows??? You speak of freedom. Where is my freedom not to be exposed to such behavior? There are rules pertaining to public places. They are not the same for private venues. Get a clue.

Can someone, anyone, please tell me how a story, about a couple of horn dogs, on a public beach, in broad daylight, having sex, triggers a comparison to porn? This isn’t about porn. This isn’t about your freedom to watch porn. This isn’t about the porn industry. If you choose to spend your days and nights watching porn, that’s your personal choice. Equating one’s freedom to watch porn with a PUBLIC sexual act, foisted upon unsuspecting men, women and children, enjoying their day at the beach, is beyond ludicrous. People enjoying their time at the beach did not sign up to view the spectacle. If you get your rocks off watching strangers have sex, there are no shortage of opportunities allowing you that indulgence. There are well-established laws which outlaw this conduct in public. Equating it with porn is bizarre. Seems like endless hours and years spent watching porn may affect the brain.
Well, aside from the fact that the grandmother FILMED the act with her cellphone, the key here is sexual freedom, which isn’t confined to making sure porn films stay legal; it’s about American citizens’ rights not to spend 15 YEARS in prison for doing a harmless act on a public beach.

Mark, The local paper in San Diego did a great series on the brain. One of the pieces was on the senses, and how they affect the different parts of the brain. Men and women have differently developed senses, over millennium. Women’s olfactory senses are superior to men going back to having to be able to smell for mating purposes, not mating w/ family members. Men have superior sight, going back to the need to hunt. So, men’s dominant visual make them more excited by visuals. Men love porn. Women don’t get it. Pretty basic stuff when you break it down scientifically. The vitriol about porn always is intriguing to me. I’m sure you could write a book about it.

Sorry, Charlie, but many, MANY women watch and enjoy porn; not as many do as men, but the last time we gathered statistics on it at the magazine, something like 22 percent of adult video store customers were women. I can’t even estimate how many customers of online porn are female.
Nick – for a long time porn was made almost exclusively for the male market, however a few female directors starting making porn for women. With changing sexual mores more women have become interested in porn. Deep Throat is the film that made porn legitimate to the middle class. Then VHS and Beta, then DVDS and no streaming.
porn has been around for centuries in virtually all cultures. Porn is healthy. When Isaac and Squeeky agree on a subject you know they have to be wrong.
The only explanation for sex ‘in the face’ or however one wishes to term it, is repressed natural sexual movements. Society’s perversions vis a vis repressing sex creates the need for porn and all the other ridiculous stuff with which sex is associated. What a backward society.
Isaac: Much as I once held a similar view to yours—that if society were sexually sane, the porn industry would go out of business—I have come to understand that a lot of people just like to watch other people having sex. Hell, they even record themselves having sex sometimes. So absent clubs (like they used to have in NYC) where people can go to watch other people have sex live on stage, porn will continue to attract viewers.
I do not think that a “crime” was committed. This is no more of a crime than a woman not wearing a burka….. the only victims are people whose arbitrary sensibilities were challenged.
