We previously discussed the bizarre case of Rachel Dolezal, 37, the head of an NAACP chapter accused of lying by her own mother. Worse yet, some have suggested that Rachel Dolezal, who is the head of the NAACP’s chapter in Spokane, planted hate mail at her office. Now it appears that Dolezal once sued Howard University over discriminating against her for being white — before she claimed she was black. If true, it makes a truly bizarre story all the more bizarre.
Dolezal reportedly sued Howard for discrimination in 2002 when she graduated from the historically black college with a Master of Fine Arts degree. She was then known as Rachel Moore and sued Howard and Professor Alfred Smith, chairman of Howard’s Department of Art. The lawsuit is quoted as alleging “discrimination based on race, pregnancy, family responsibilities and gender.” She alleged that she was denied a teaching assistant post and that her application was rejected for a post-graduate instructorship in favor of African-American students. The lawsuit was dismissed by Judge Zoe Bush and Bush’s decision was upheld by the D.C. Court of Appeals. In addition to an order forcing her to pay a “Bill of Costs” of $2,728.50, she was ordered to pay the university nearly $1,000.00 in connection with an “obstructive and vexatious” court filing.
The unfolding background reveals a tragic obsession (and transformation) with race. That obsession would lead to the alleged falsification of information on government forms. It is also unclear whether this controversy will produce criminal charges.

Only: I don’t have any problem with the Bible being part of anyone’s education. When I was in high school I attended a public school and took a class called “The Bible as Literature.” It was one of the best courses I ever had, but I doubt that it would be allowed these days. And my grandmother attended a rural school until the 4th grade when she had to quit to work on the farm. She said the only books they used were the Bible and McGuffy’s Reader. But despite only 4 years of education, in her letters she writes and expresses herself better than most of the high school graduates and many of the college grads that I employ. Nonetheless, homeschooled children should ALSO be taught science, math and history so that they will be fully rounded adults. I agree that Ms.Dolezal is well-educated, as is her brother who has a Ph.D and teaches English at an Iowa college. I suspect their academic and professional success is based on native intelligence and the work ethic that is required to survive as homesteaders. But nonetheless both of them seem to be emotially damaged by their upbringing.

The fact is that when we talk about race we frequently are also talking about the social construct of ethnic group as well. In the case of Native Americans the social construct has real implications for who is and who is not entitled to access many resources. The fact is the social construct of race and ethnic group have lead to real actions and sometimes still produce real damages.
That recognition of real damage is one aspect that has lead to affirmative action programs. Regardless of the controversy and the rationalizations related to affirmative action, those programs are an attempt to deal with specific populations that have suffered real damages.
Race may be a null concept in a biological sense. But we live in society composed of social constructs. It is precisely social constructs that determine whether people get into desirable schools, can belong to certain clubs or are hired for well paying jobs.
We know real damage has been done. We have programs that attempt to mitigate those damages. In the context where society has chosen to take action it is clear we must look beyond the claim that race is an arbitrary choice and make hard decisions about who does and who does not belong to the injured class.
There is nothing in the strange case of Rachel Dolezal that contradicts the view that in some contexts the social construct of racial/ethnic group is far more than an arbitrary choice.

Nick: I agree that this woman has major “issues”, to say the least. And if the charges against her older brother are false, then she should be prosecuted, because false charges of being a child molester are particularly ugly, and will damage his reputation forever even if his is acquitted. However, the police did find enough to arrest him on 4 felony counts and the District Attorney did find enough to bring charges, so they must think they have a 5!% chance of proving their case…I would think, anyway. I really have no idea how much evidence is required to bring someone to trial on these charges, but in any event, the court will have to sort it out. But all that aside, I still appreciate this woman for (albeit unwittingly) turning the whole racial identity industry into the farce that it is. And it’s now being reported that she has been offered a t.v. reality show, so the circus will go on….hopefully to the point of rendering “race” increasingly meaningless:

It’s true. We all belong to the same race according to the biological definition. We are literally one people. Hence this hyper focus on our basal melanin concentration, or from which region our ancestors lived, is divisive.
Focusing on giving the poor better access to education, helping kids with homework, or similar programs, help address our society’s problems in a unifying, rather than dividing way.
No one should be passed over for college entrance, jobs, or promotion because they are the “wrong” skin color.
Of course affirmative action is unconstitutional. The American thesis of freedom and self-reliance does not mandate nor allow for the introduction of bias. One “fair” wrong does not justify another. Inexplicably, the SCOTUS has not found that bias violates the founding documents. The only possible constitutional position on race is neutrality. And yet racist policies against Americans (i.e. Caucasians) persist pervasively as affirmative action.
Nick – I get the impression that Whoopi Goldberg is treating this like Dolezal did a sociology experiment documentary “Being Black” in which a white person disguises her appearance and passes for black to understand what it feels like.
Whoopi seems to ignore the relevant aspects that got everyone so upset in the first place: lying on job applications to allegedly take advantage of preferential hiring practices, getting on a police commission via the same, teaching “The Black Woman’s Struggle”, AND filing racial discrimination charges as both a white and a black person. The police department stated that the “hate mail” that was allegedly mailed to her office never passed through the post office, and that it could only have been delivered by someone with a key to the mail box. With all the back up of real police cases – the rapes and murders and real hate crimes, and this self absorbed woman allegedly made all this up for attention? They should charge her with filing a false police report. How far would she have gone? Did she have plans to frame someone?
Many of us would find the hypothetical documentary “Being Black” interesting. What Dolezal did was allegedly file false police reports, gain attention and sympathy by falsely claiming to be a victim, and lie to get ahead. This needs to be investigated to ascertain the extent of the damage.

What is unfortunate is that this well documented history of lying has destroyed her credibility better than any Aesop’s Fable. And like the Boy Who Cried Wolf, we have to doubt every single story she’s ever told until it’s been proven. That includes the claims of cervical cancer, spousal abuse, physical abuse at the hands of her father, sexual abuse of her brother, and every other claim this litigious person ever made. Some of her stories might be true, others not, but no one should ever take her word for anything again.
On the one hand, perhaps her family is aware of a lifelong pattern of lying, and so did not believe her allegations of the abuse of her brother. Or perhaps she made the entire thing up. Perhaps the brother supports her story, in which case he’d either be telling the truth or brainwashed.
In any case, I hope they follow this story so we can find out if the child was actually abused, what the full extend of her lies were and if the jobs she obtained to further her successful career were the result of this fraud.
The nature vs nurture question is interesting. We don’t know yet if the allegations of abuse by her father are true. We’d also need to examine all the other kids to see if there are behavioral problems. If both the biological and adopted children all have behavioral issues, then that would point to the nurture side. We’ll have to find out more about the family and their upbringing.

A few people do not believe that I am a dog. I dont want to be put in the same boat as this itchBay or Bruce Jenner for Christ sake. If this lady sued Howard University for race discrimination and alleged in the suit that she was White then she is estopped from denying she is White. Or estopped from asserting she is Black. Unless, she had a transformation surgery like Bruce Jenner. On Bruce we need a body inspection to see if he has a uknow what instead of a weeny. Bruce without a weeny is not necessarily a Caitlyn. He could be an in-between meaning neither man nor woman. Now if Bruce went all the way with LBJ and has a hole in the wall so to speak then he can be believed. As it was with Genghis it is still with race horses. There just might be something to a strong strain of something or other in a blood line. The old nature and nurture routine. Then it might get confusing, “I’m Genghis.” “No, I’m Genghis.”……
This girl definitely was nurtured in some way to make her become so egocentric and then proceeded to nurture that egocentricity. She will probably continue inventing and reinventing herself, now that she is out there. It might not even of been for any nature to be involved.
