Clinton Contractor Who Reportedly Destroyed Emails After Preservation Order Was Given Immunity By FBI

Hillary_Clinton_Testimony_to_House_Select_Committee_on_BenghaziWe previously discussed the controversy over the FBI granting immunity to former State Department staffer, Bryan Pagliano, who set up a server in Mrs. Clinton’s home in Chappaqua, N.Y., and worked for her at the State Department. Pagliano had refused to cooperate after invoking his Fifth Amendment right against self-incrimination. He was an obvious target of potential criminal charges if he knew that the server was meant to circumvent federal laws, including the mishandling of classified information. The granting of immunity removed the threat for his cooperation, a leverage often used to implication others who may be higher up in the chain of command. Now, as the record appears to confirm that email records were knowingly destroyed after the issuing of a congressional subpoena to preserve such record, it also appears that the Justice Department gave immunity to the other person most at risk of a criminal charge — and the person some are likely to argue would have been the most likely to be able to implicate others. He is computer specialist, Paul Combetta.

The Clinton campaign is now putting all blame of Combetta, who of course is now beyond the reach of prosecutors and pressure. Brian Fallon, a spokesman for Mrs. Clinton’s presidential campaign, said that Combetta, who worked for a Colorado company called Platte River Networks, acted alone and “neither Hillary Clinton nor her attorneys had knowledge of the Platte River Network employee’s actions. It appears he acted on his own and against guidance given by both Clinton’s and Platte River’s attorneys to retain all data in compliance with a congressional preservation request.”

Many are likely to view this defense with suspicion as a constructed scapegoat. Having given immunity to both of the most likely targets for indictment, both specialists are the perfect fire walls for anyone who had knowledge or failed to move to preserve the material. In fairness to the Clinton camp, the account of the FBI could support a claim that the specialist realized on his own that the final record had not been scrubbed and took this action unilaterally in what is described as an “Oh Shit” moment.  Indeed, that conversation with unnamed Clinton aides could be exonerating rather than incriminating if they stressed that all records should be preserved. Most investigators however would be curious why a contractor, if expressly told by a client to preserve any emails, would unilaterally destroy them.

What is particularly interesting is that Combetta reportedly changed his testimony on critical elements but ultimately acknowledged knowing about the subpoena. Combetta reportedly told the bureau in February that he did not recall deleting the emails, but then changed that account in May. He added to speaking with unidentified Clinton aides in March 2015 and then decided on his own to use BleachBit to delete the messages. While he denied knowing about the preservation order in February, he reversed that critical fact in May and said that “he was aware of the existence of the preservation request and the fact that it meant he should not disturb Clinton’s email data” on the Platte River server.

Some might argue that the Justice Department would most likely move to charge him and then offer a plea bargain if he could implicated others and remember names like those on the telephone call. Instead he was given immunity.

The House appears to be moving to seek his testimony and he may not be out of the legal woods. Witnesses are generally given “use and derivative use” immunity rather than the broader form of transactional immunity. If so, Combetta would be protected from the use of his statements or any evidence derived from those statements against him. If testifying in Congress, he would face the risk of perjury as well as other collateral crimes. It would create a messy situation with a previously immunized witness. Generally, the prior grant of immunity does not roll over to separate investigations by another branch, though he would remain protected from the use of his statements in the prior proceedings. Thus, he could carefully repeat those answers and try to stay within the scope of his prior statements. If he does not want to risk the uncertainty, he could invoke his privilege against self-incrimination and refuse to testify absent a granting of immunity from Congress.

Among the hundreds of suspicious actions associated w/9/11…the Twin Tower’s Judaic owners were saddled w/hundred of millions of dollars in required earthquake and other retrofits. Shortly before 9/11, the owners modified their insurance policy, increase their payout in case of incident like 9/11. The owners profited hundreds of millions of dollars as direct result of the “attack” (false flag event).

    One of the authors of the 9/11 Congressional Report/Whitewash has blood and/or marriage relationship to the person at the insurance company who wrote the payoff check to the Twin Tower owners, a fact the Report did not disclose.

The latest is the bribery scandal against Bondi, since she is obviously guilty using the same criterion he uses against Clinton. It looks bad so it must be true that she was bribed. She admitted calling Trump personally, and a few days later he ILLEGALLY gave her PAC $25,000 from his foundation. He then had his foundation pay the IRS fine for using a non-profit for political donations. There is NO word as to whether or not she had her PAC return the ILLEGAL donation. THAT is a good question that needs to be answered. If she did not SHE is also GUILTY of illegally KNOWINGLY accepting such a donation. Now I can believe Trump since he says he did not talk to her since he cannot remember what he said yesterday. He also can hold two incompatible views at the same time, a true feat of incompetence unmatched by most people. So I think the FACT is that she DID call him, and he does not remember since $25,000 is chump change for Trump.

    Now we should have ICE investigate the illegals that Trump has hired in his modelling agency. He brought them over on tourist visas and put them to work, just as he did his current wife. So much for his idea of enforcing immigration laws. They apply to all employers except himself. Then we have Trump’s payment to Texas AG Abbot for ignoring Trump U’s fraud and giving him a slap on the wrist. Then we have the fact that the PA AG rated a full story for malfeasance, and silence on Texas AG being indicted and arrested for FELONIES in which he defrauded people out of hundreds of thousands of dollars. Incredible this blindness and waste of time on gnats while ignoring felonies. At least the PA AG did not steal thousands of dollars, and ignore other criminal conduct, OR get arrested for a misdemeanor DUI as the Travis county DA did, which rated a full column. Why this difference?

FWIW, I was once a Hillary supporter (in 2008) and even worked as a volunteer along with my BFF, Penelope Dreadful, Esq., an attorney. And I supported her in the full knowledge that she was a liar, a crook, and a grifter. BUT, I presumed the Republicans would run somebody just as crooked as she was, only more sophisticated.

              I admit to that being a cynical stance. It was only after the email stuff came out that I decided not to support her, because that is beyond just crooked, and shows her to be downright stupid and careless. Plus, the Republicans have run someone I believe to be a genuinely good, and basically honest person. So, it is possible to divest yourself of the personal investment in the party, and see things for what they are.

        Not really, at least not vociferous Catholics in fora like this. When all the grunge came out, the usual reaction among Catholics was to blame the bishops, often in ways that were unfair. Traditionalist Catholics of various sorts had been alienated from the hierarchy for some time; they were not surprised at what had transpired and were not all that disarranged by it: they had no emotional investment in the bishops. Eastern-rite Catholics could let it slide because it was not much of a problem in their eparchies. Liberal Catholics just blamed Authority or pretended what was happening was not happening or was a consequence of the celibacy requirement or a consequence of the all-male priesthood. Conservative Catholics had a variety of responses, mostly centered on blaming the Lavender Mafia (a problem, to be sure), liberal bishops (a problem, but the worst bishops weren’t liberals), Vatican II (a problem, to be sure, but the grunge was worse among priests formed in the 1950s than among priests formed in the 1980s). What was not often remarked upon (because you could cherry-pick stories of luridly bad judgment by bishops) was that bishops were being asked to evaluate accusations from laymen which were typically lodged 15 years after the fact and modally concerned groping. Making correct decisions in those cases in a reliable way was well-nigh impossible.

Period. End of story. As for Pagliano and Combetta, they had a choice. Play ball and shut-up about Clinton, and be granted immunity. The most recent (known) dead C associate was within the last five weeks, a youngish DNC employee apparently associated w/the alleged DNC hacking was found dead in suspicious circumstances.

      The most obvious case of assassination was that of three close Arkansas C buddies together in a Starbucks coffee shop. Pro assassin enters, corrals the three horizontal face down in the back office, shoots them in the back of the head, and leaves, taking no valuables. It is getting ever more so obvious that Clinton fukt up royally, that there was easily multiple violations of the law, but the FBI intentionally cast a blind eye here, gave immunity to witnesses there that they didn’t use any of their inculpatory testimony – almost using the immunity to avoid getting their testimony.
    It was an unspoken gentlemen’s agreement that they would make all motions of an investigation, make all the appearances of them trying, but at crucial intersections of the investigation they would not look there, or would go down a path that they knew would go nowhere.
    The problem in their plan is that there are too many loose ends, such a major conspiracy always has dozens of people who know what happened and are also trying to CYA, including the people as noted here who still face investigation and ancillary prosecution from other entities.
    I just hope no one drops the ball on this one and joins the gentlemen’s agreement, the truth on this needs to be revealed.
    There is just too much smoke and obviously a fire, but when the investigators don’t want to find what is obviously there, they will give passes and passes on top of passes just to avoid the raging bonfire right in front of them.

  17. Why risk testifying to anything other than his Sixth Amendment right if DOJ has given him blanket immunity without the condition of purposeful, helpful testimony? He was probably long before now given the “we take care of our own” speech from some sleazeball Clinton foundation donor, so he’ll be set for life by just staying quiet.

    DOJ has more important matters like ruining John Kiriakou.

  18. As a person compelled to appear before a grand jury to persecute my fellow VVAW members I can tell you that use, AKA useless, immunity is just that. I went to jail. The DA screwed up and while I was listed as a co-conspirator I was not indicted. Nothing but a blatant attempt to silence VVAW to prevent the truth about the American War in Vietnam. The jury in the “trial” was out for an hour or so, lunch time. Members including the foreperson came to our reunions. Gainesville 8+4.

    These guys have the useless immunity, they better stick to the 5th. This is not the same as the government knew we had committed no crimes.
