Nadler: Hunter Biden Must Not Be Called

hunter-bidenI have been writing on the obvious relevance of Hunter Biden  as a defense witness and the equally obvious hypocrisy of some Democrats in demanding their own witnesses while refusing to consider key White House witnesses.  Now. House Judiciary Chairman Rep. Jerry Nadler, D-N.Y., has suggested that, if a trade is needed to secure House witnesses, the managers will not agree to any witnesses if Hunter Biden is part of the deal.   If true, is the House prepared to give up on proving its case to protect the Bidens from the ignoble moment of answering questions about the Ukraine contract?  That is a considerable price to pay to protect Joe Biden.  It is also another reason why the decision to rush the impeachment vote was such a historic blunder by Speaker Nancy Pelosi. If they had waited a couple months as I called for in my testimony, they could have called these witnesses and not handed over control to the Senate. Instead, they impeached by Christmas and then waited a month.

Nadler insisted on Face the Nation that all “relevant witnesses must be heard” — meaning their witnesses.  Yet, if allowing witnesses meant Hunter Biden being called, he suggested that they would reject any deal — and any witnesses.   He dismissed any negotiation as a cover up:  “Any Republican senator who says there should be no witnesses, or even that witnesses should be negotiated, is part of the cover-up.”

As I previously noted, under Federal Rule of Evidence 401, courts will often review possible testimony under the standard of whether “it has a tendency to make a fact more or less probable than it would be without the evidence.”  Even before the adoption of the Bill of Rights, Congress enacted a statute reaffirming the right of the “defense to make any proof that he can produce by lawful witnesses” in cases of treason and capitol cases.  This right to present a defense has been repeatedly reaffirmed by the Supreme Court including in the 1967 opinion in Washington v. Texas, where the Court ruled that “the right to offer the testimony of witnesses and to compel their attendance, if necessary, is in plain terms the right to present the defense, the right to present the defendant’s version of the facts  . . . Just as an accused has the right to confront the prosecution’s witnesses for the purpose of challenging their testimony, he has the right to present his own witnesses to establish a defense.”

Of course, if Biden is called, the House managers would be allowed to cross examine as well as argue their claim of a cover up.

Nadler suggested that Chief Justice John Roberts should make the decision on relevance.  He may want to be careful on such an option.  Roberts might  rule that Biden is a relevant defense witness or, alternatively, he could reaffirm that this is a matter properly left to the Senate on who should be called.

    First, let us assume that Joe and Hunter Biden actually committed some crimes in the Burisma business. Even if they did that, it would have no bearing on the question of whether Trump committed a “high crime” or “misdemeanor” by attempting to extort Zelensky/Ukraine to force Ukraine to publicly announce that Ukraine will investigate them by withholding Congress’s approved military aid for Ukraine. In short, Hunter Biden’s (assumed) Burisma crimes cannot exonerate Trump of guilt for his extortion attempt.

    1. Just like a policeman may make a driving violation while chasing a criminal so may the current administration make what appears to be a violation when trying the rein in corruption of the previous admin. You are wrong it’s completely relevant.

    2. The executive branch, which has sole responsibility for foreign policy, has every right to vet aid recipients. Just because the corrupt state Dept declared Ukraine not corrupt and thus eligible for foreign aid do you think Trump may have his own questions and not trust inept state Dept employees after all he’s witnessed while in office? Don’t you think the state Dept approval of the aid was actually a rubber stamp? Do you think they investigated Burisma and cleared govt officials both there and in the US of any corruption? No, most likely it was approved as it crossed some bureaucrat’s desk. The GAO’s opinion is of a rule violation not some criminal act that anyone could be prosecuted for. If the dims wanted to make something of withholding aid they should’ve sued and taken it through the courts.

    5. First let us assume the treaty President Clinton signed with Ukraine is still in effect and President Trump had the right to ask for Ukraine’s co-operation,
      Also assume the guilty are trying to muddy the water to cover their tracks.
      Also assume the investigation was already on going.
      Also the former Ukrainian president was suspected to be involved and President Trump couldn’t ask him for help investigating himself.

      When the new president was elected on a law and order platform it was time to ask for help with the investigations.

      Understand the difference between asking an ally to abide by a treaty and extortion is in the eyes the beholder.

      Because of the events in the US the Ukrainian PG has limited the investigation to a period prior to 2014 (when Biden joined the board) and after April 2019 (when Biden left the board). So Biden IS doing exactly what President Trump said he was doing, protecting Burisma from investigation.

They do not want him investigated, period. (However, Lindsay Graham has indicated that there will be a Senate investigation after the removal trial has concluded.) Furthermore, there may be other Democrats implicated. Rudy Giuliani says he has evidence of massive corruption in Ukraine involving numerous Democrats.   10. We’ve long ago entered the realm of “mental crimes” for lawful acts, so how can anyone pretend Hunter Biden is NOT relevant. Trump didn’t invent or plant the suggestion of HB’s corruption. It was publicly speculated in the press for weeks before the phone call or the freeze. Don’t you think the press was secretly investigating him? That’s OK for the free press, but when Trump publicly raises the same issue, it’s treason. Biden’s testimony will spotlight whether Trump’s belief was reasonable. The trial doesn’t need to prove his corruption. Trump is covered if there is a reasonable suspicion of corruption, that’s all.

The WSJ, Bloomberg News, the WaPo, and NYts have all done investigative reporting on it and found he was implementing SD policy – SD witnesses, including GOP appointees testified to the same under oath recently – as well as that of our allies the EU and IMF. That policy was to remove a do nothing and corrupt prosecutor who had already damaged a case in the UK by his inaction.

      But even if he wasn’t you don’t want future presidents weaponizing their power to try and damage political rivals, and especially through foreign governments. This is not a difficult concept.

  12. There is no more “relevant” witness than Hunter Biden and anyone who is being honest knows this. President Trump asked the Ukrainian President to look into alleged corruption involving Hunter Biden. Was that a valid question or not? I think Americans need to know this.

      You might also note that the administration sought a public announcement from the Ukraine on opening an investigation, a clear indicator that it cared nothing about Ukrainian corruption and everything about the 2020 election. If Trump harbored legitimate concerns about UkrainiAn corruption, he should have referred it the DOJ, which by the way, had not opened an investigation into these suspicions.

It is not the same to say being in debt is not admissible motive for a robbery (although it clearly is), and that the presence of corruption is a valid motive for asking for an investigation. In fact, the presence of corruption is an issue the United States requires its diplomats to take account of. More importantly, if there be corruption (as we can all see), the request for an investigation was well founded, and cannot be an abuse of power. No, the US DOJ cannot investigate corruption in the Ukraine, at lest not without the cooperation of the Ukraine.

        As to your second point about a public announcement, your point is equally unpersuasive. Causing a suspect and corrupt country to be on the record about its intentions to remedy corruption is the means by which you hold them to those commitments.

        Amazingly, what you are uncurious about is why a sitting US vice president took the unprecedented step of becoming involved with the firing of a single prosecutor. I can think of zero other examples of a US government official meddling in the low-level internals of a foreign country, right down to the individual personal level of firing one man. yes, I’m sure you’ll argue that various European allies also had a personal grudge with one insignificant man in the Ukraine. Amazing the influence of a US Vice President ready to withhold the financial assistance of the United States.

        Hunter Biden was hired to provide access to his father and the influence of the United States. Joe Biden sold that influence. That is why Nadler would sooner accept zero witnesses than to have Hunter testify.

          We have had FBI personnel in the Ukraine helping them deal with the legendary corruption and as an ally our DOJ can make referrals for help on matters of concern. In fact, a sitting GOP congressman from Penn was one there for that purpose in 2015 and has stated thAt VP Biden’s behavior was US policy and the prosecutor hr helped remove was a corrupt obstacle to progress.Several SD witnesses in the recent House hearings testified to the same fact. I refer you to investigative reporting on this matter by the WSJ, WAPO, Bloomberg Nes, and the NYTs which has so far confirmed the legitimacy of VP Biden’s work there.

          Perhaps it is you who should be more curious about his actions in the Ukraine.

    Trump won’t let any of the people who were actually involved in the actions related to the charges or the policy making discussions. Those people are relevant but their testimony is being obstructed.

    Let’s have Ivanka, Jared and the boys testify. They certainly have more relevance to what their father and father in law did than Hunter Biden.

However, if there were shenanigans going on, then President Trump’s question was totally justified.       The President had a right to do what he did and Congress had the right to object. Impeachment is one of the ways Democrats have tantrums.. The basic claim by the Democrats was that the President was targetting another candidate running for office. They say he targetted that candidate by asking for his son to be investigated (which the President didn’t do). Everyone finds something suspicious about the amount of money Hunter received from a corrupt Ukrainian company so there is merit to any claim that Hunter might have had some involvement in a quid pro quo. Therefore, he is without question one of the people needed to be called to resolve the issue.

      Adam Shift and the Whistleblower should be called as well so Hunter won’t be their only objection. Nothing Bolton says would be grounds for impeachment the way the Constitution intended and the President will not be convicted by the Senate so the Democrats have proven once again that they are irresponsible and dirty.

      The president will have a stain on his record, but he will also have a positive record of benefitting the nation and its people.

        1. the key things they want are:

          1- to take control of the senate, too. then they can have their way with most anything
          2- retake presidency even though that’s super unlikely
          3- restock America with tons of foreigners who are 90% likely to vote Democrat if they can get the franchise and their kids maybe 75% likely too. Demographic warfare against the legacy population of America, flat out.
