Nadler: Hunter Biden Must Not Be Called

hunter-bidenI have been writing on the obvious relevance of Hunter Biden  as a defense witness and the equally obvious hypocrisy of some Democrats in demanding their own witnesses while refusing to consider key White House witnesses.  Now. House Judiciary Chairman Rep. Jerry Nadler, D-N.Y., has suggested that, if a trade is needed to secure House witnesses, the managers will not agree to any witnesses if Hunter Biden is part of the deal.   If true, is the House prepared to give up on proving its case to protect the Bidens from the ignoble moment of answering questions about the Ukraine contract?  That is a considerable price to pay to protect Joe Biden.  It is also another reason why the decision to rush the impeachment vote was such a historic blunder by Speaker Nancy Pelosi. If they had waited a couple months as I called for in my testimony, they could have called these witnesses and not handed over control to the Senate. Instead, they impeached by Christmas and then waited a month.

Nadler insisted on Face the Nation that all “relevant witnesses must be heard” — meaning their witnesses.  Yet, if allowing witnesses meant Hunter Biden being called, he suggested that they would reject any deal — and any witnesses.   He dismissed any negotiation as a cover up:  “Any Republican senator who says there should be no witnesses, or even that witnesses should be negotiated, is part of the cover-up.”

As I previously noted, under Federal Rule of Evidence 401, courts will often review possible testimony under the standard of whether “it has a tendency to make a fact more or less probable than it would be without the evidence.”  Even before the adoption of the Bill of Rights, Congress enacted a statute reaffirming the right of the “defense to make any proof that he can produce by lawful witnesses” in cases of treason and capitol cases.  This right to present a defense has been repeatedly reaffirmed by the Supreme Court including in the 1967 opinion in Washington v. Texas, where the Court ruled that “the right to offer the testimony of witnesses and to compel their attendance, if necessary, is in plain terms the right to present the defense, the right to present the defendant’s version of the facts  . . . Just as an accused has the right to confront the prosecution’s witnesses for the purpose of challenging their testimony, he has the right to present his own witnesses to establish a defense.”

Of course, if Biden is called, the House managers would be allowed to cross examine as well as argue their claim of a cover up.

Nadler suggested that Chief Justice John Roberts should make the decision on relevance.  He may want to be careful on such an option.  Roberts might  rule that Biden is a relevant defense witness or, alternatively, he could reaffirm that this is a matter properly left to the Senate on who should be called.

    Parnas was charged last October with funneling foreign money to U.S. political candidates and campaigns. He’s pleaded not guilty.

    Parnas and a second man, Igor Fruman, were carrying one-way tickets to Vienna when they were arrested at Dulles Airport outside of Washington on Oct. 9.

    The indictment unsealed the next day accused the pair of making illegal straw donations, including $325,000 to a pro-President Donald Trump political action committee. Federal prosecutors say the two also engaged in a scheme to force the ouster of the then-U.S. ambassador in Ukraine.

    NBC News has previously reported that Barr was briefed by federal prosecutors in New York on the then-undisclosed case into Parnas when he took office earlier last year.

    In his letter to Barr, Parnas’ attorney cites the president’s July 2019 call with Ukrainian President Volodymyr Zelensky in which Trump mentions Barr as a point person for a possible investigation. It also notes the August 2019 whistleblower complaint, a call for recusal by Senate Democrats on the judiciary committee and one from the New York City Bar Association.

    The letter says federal prosecutors have refused to meet with Parnas and delayed the production of discovery evidence in his case. As a result, Parnas “was rendered unable to comply with a duly-issued congressional subpoena in time for congressional investigators to make complete use of his material or properly assess Mr. Parnas as a potential witness,” the letter says.

      This NBC story reminds us that Lev Parnas and Igor Fruman were strawmen transferring $325,000 to a pro-Trump political action committee. Since Parnas had well-documented financial problems, that $325,000 was most certainly not his. Therefore the true source of that money becomes an issue arguably more ominous than those at the heart of the impeachment.

      It seems peculiar then that Professor Turley cannot acknowledge Lev Parnas. We would welcome his response regarding this mystery man.

After living through Johnson’s “Great Society” and his war, I was more aware of how politics could destroy a country by twisting, spinning, and deceiving the people. Johnson. Well, it happens all the time. I don’t care about politics anymore, but I’m fascinated by how people believe the stuff politicians say and alter their lives because of empty words. These comments are great examples. So many versions and opinions of so many lies. I’m re-reading Eric Hoffer’s “The True Believer” that explains comments like these. Amazing book. Right on.   4. If reports are true that Paul Pelosi Jr. was employed by another Ukrainian energy company, then Nancy Pelosi has a glaring conflict of interest as bad as Joe Biden’s. Shebused the impeachment process to delay/stop an investigation into widespread influence peddling, money grubbing, possible mail/wire/bank fraud, money laundering, and other corrupt acts in Ukraine by family members of the political elite in the United States.
    If they call Hunter Biden as a witness, that will surely lead to Speaker Pelosi’s door.

        Hunter Biden will not testify. Just about every Senator has relatives that are working at jobs they got due to their connection to the Senator. They are not going to open this can of worms that might start a chain reaction of investigations of the relatives of politicians.

    In that case, the House should be allowed to establish whether Donald Trump has been consistent in fighting corruption, or whether he focused only on the Biden family. Relevant witnesses for this would include Donald Trump Jr., Eric Trump, Ivanka Trump, and Jared Kushner, all of whom seem to have profited by their connections to the President of the United States. This would also be an appropriate time to review Donald Trump’s tax returns. In addition, we should hear from Rex Tillerson about Donald Trump’s efforts to remove the Corrupt Foreign Practices Act: according to the new book “A Very Stable Genius” by Philip Rucker and Carol Leonnig, Trump told Tillerson that he wanted to make it possible for Americans to bribe foreign officials.

    Democrats are trying to choose a candidate to beat Donald Trump, the most corrupt president in history. Some think nominating Joe Biden, a moderate white man who calls himself “Middle Class” Joe, makes sense.

    But Biden has a big corruption problem and it makes him a weak candidate. I know it seems crazy, but a lot of the voters we need – independents and people who might stay home – will look at Biden and Trump and say: “They’re all dirty.”

    It looks like “Middle Class” Joe has perfected the art of taking big contributions, then representing his corporate donors at the cost of middle- and working-class Americans. Converting campaign contributions into legislative favors and policy positions isn’t being “moderate”. It is the kind of transactional politics Americans have come to loathe.

    There are three clear examples.

    First, Biden’s support for finance over working-class Americans. His career was bankrolled by the credit card industry. He delivered for it by spearheading a bankruptcy bill that made it harder for Americans to reduce their debts and helped cause the financial crisis. He not only authored and voted for that bill, he split with Barack Obama and led the battle to vote down Democratic amendments.

    His explanations for carrying water for the credit card industry have changed over time. They have never rung true.

    The simplest explanation is the most likely: he did it for his donors. At a fundraiser last year, Biden promised his Wall Street donors that “nothing would fundamentally change” for them if he became president. Now the financial world is raising huge money for his campaign. It clearly thinks he’s going to be its friend if elected. Most Americans, who get ripped off by the financial sector on a daily basis, aren’t looking for a candidate who has made their life harder.

    Second, healthcare. On 25 April, the day he announced his campaign, Biden went straight to a fundraiser co-hosted by the chief executive of a major health insurance corporation. He refuses to sign a pledge to reject money from insurance and pharma execs and continues to raise money from healthcare industry donors. His campaign is being bankrolled by a super Pac run by healthcare lobbyists.

    What did all these donors get? A healthcare proposal that preserves the power of the insurance industry and leaves 10 million Americans uninsured.

    Third, climate change. Biden signed a pledge not to take money from the fossil fuel industry, then broke his promise. Right after a CNN town hall on climate change, he held a fundraiser hosted by the founder of a fossil fuel conglomerate. He is pushing climate policy that has gotten dismal reviews from several leading environmental groups.

    Corrupt politicians always use whataboutism. With Biden, we are basically handing Trump a whataboutism playbook. The comparison won’t be fair, but if you think he won’t use Biden’s closeness to donors as a cudgel to try to keep people home, you haven’t been paying attention. Unlike Democrats, who must give voters a reason to come out, Trump doesn’t need voters to love him. He just needs to convince people the whole game is ugly.

          The official story in Ukraine of why Shokin was forced to resign was because he had not investigated the sniper killings during the Maidan revolution. Biden was no where near Ukraine at the time Shokin resigned. There were IMF funds being withheld at the time Shokin quit but the conditions that Ukraine had to meet to get the funds released many months later had nothing to do with the prosecutor.

          Looking at the evidence for the firing of Shokin it appears Biden bragged about something which he really had little or nothing to do with.

    Professor Turley offers 3 columns today addressing various aspects of the impeachment. All 3, however, portray Democrats as bungling and, or, disingenuous. But Turley has yet to acknowledge the highly mysterious Lev Parnas.

    Parnas is that Ukrainian-born money-bunlder who grew up in Brooklyn and became a donor to the Trump campaign despite well-documented financial difficulties. Implausibly Parnas became a regular companion to Rudy Guiliani, the president’s personal lawyer.

    Parnas, and his friend Igor Furmam, traveled throughout Europe with Guiliani on business that included stops in Ukraine. There Parnas and Furman assisted Guiliani’s efforts to undermine former U.S. Ambassador Marie Yovanovitch.

    Last week Parnas released a trove of documents and photographs to substantiate his involvement. Donald Trump claims he never met Parnas but the latter was photographed with Trump, the Kushners and Don Jr. What’s more, Parnas’ odd friendship with Guiliani is beyond denial. Rudy is even on record as referring to Parnas and Furman as ‘friends’.

    Democrats most certainly want Parnas to be a witness at the Senate impeachment trial. His testimony would no doubt overshadow any appearance by Hunter Biden. Yet so far Professor Turley has yet to acknowledge the emergence of Parnas as a person of interest. Instead Turley quibbles with technicalities concerning statements by Democrats.
