Diss Barr? Trump Returns To Attacking The Justice Department

Despite a public condemnation by Attorney General Bill Barr, President Donald Trump is back tweeting and atacking a wide range of Justice Department attorneys and investigations. That includes the recently resigned prosecutors in the case of Trump associate Roger Stone. These irresponsible tweets continue undermine Barr and magnify the problems for the Administration with both the courts and Congress.

President Trump lashed out this morning in the tweet series below.

In the tweets, he not only insists that the “Everything having to do with this fraudulent investigation is badly tainted and, in my opinion, should be thrown out” but adds that he may sue everyone involved.

Once again, it is difficult to comprehend the meaning, let along the purpose, of such tweets. Nothing can be “thrown out” in the Mueller investigation in that the report is complete and no conviction was based on its findings. Any convictions were the result of separate trials that were based on grand jury and other information made part of those records. As for suing everyone, such lawsuit could be technically filed but would be quickly rejected as frivolous.

Some of us agree with the criticism of the Russian investigation, a criticism that has been reinforced by findings that there was no probable cause for the renewal of the FISA surveillance and there was no collusion with Russia. In addition, the investigations by the Inspector General found considerable and raw bias by key players in the investigation.

That brings us back to the purpose. This is obviously putting Barr in an impossible position, as he stated publicly. Indeed, Barr stated just two days ago, that “I think it’s time to stop the tweeting about Department of Justice criminal cases. I’m not going to be bullied or influenced by anybody … whether it’s Congress, a newspaper editorial board, or the president.” He added “I cannot do my job here at the department with a constant background commentary that undercuts me.”

It would seem like Trump is fully aware that the tweets could be viewed as calling Barr’s bluff, if he thinks it was a bluff. It would seem obvious that this would create pressure on Barr to either resign from his office or resign himself to Trump’s tirades. That would be a huge mistake for Trump, but Trump may still be angry over being publicly criticized. Whatever his intent, the tweets further paint Barr into a corner either by default or design.

    Attorney General William P. Barr faced criticism from congressional Democrats and former Justice Department officials when he acknowledged last week having created an “intake process in the field” to accept Giuliani’s information, which seems designed to damage Biden’s political prospects as he seeks the Democratic nomination for president. Barr said at that time that the department had an “obligation to have an open door to anybody who wishes to provide us information that they think is relevant.”

    Taking information from Giuliani is particularly fraught for the department because the president’s personal lawyer is under investigation by federal prosecutors in Manhattan in a case that has led to campaign finance charges against two of Giuliani’s associates, Lev Parnas and Igor Fruman. The pair helped Giuliani try to conduct investigations in Ukraine and lobbied for the ouster of Marie Yovanovitch, the former U.S. ambassador to Ukraine.     They are neither irresponsible or undermining the Attorney General. This is a citizen of this country speaking out about the fraudulent origins of the Mueller investigation and the fruit that fell from that poisonous tree. He’s saying what millions of Americans haven’t had a voice to say. He’s communicating with them and it works.

    As for Barr, Trump is not going to intimidate him to do anything he doesn’t want to do. I actually believe it works to Barr’s advantage to appear to be at odds with the President. Barr and Durham are doing their thing and this social media stuff is keeping the workings of the deep state front and center, so when the findings drop, it will prove the President was right all along.

Then after months and months of investigating this nothing-burger Mueller charges Flynn and Flynn admits to lying in court.           The whole storyline was a phony performance to fool the rubes in the stands. Everybody knew it was phony. Trump, Comey, Flynn, Mueller and his band of phony investigators all knew that Flynn had not lied and yet went thru the motions of making it real for the viewing audience watching.

    The ONLY reason why Mueller could not obtain probable cause was Trump’s refusal to cooperate, commanding witnesses not to testify, refusing to turn over documents, and hiding his financials. You can’t be exonerated if you hide evidence, and Mueller found that Trump obstructed justice. You can’t have it both ways, and you can’t come up with any legal precedent saying that Trump can do as he pleases, refusing to testify, commanding witnesses not to testify and hiding documents. TRUMP WAS NOT EXONERATED. Stop pretending he is. Stop validating Trump’s arrogant lack of respect for the rule of law. Are you auditioning for a job as a Fox pundit? Sounds like it to me. As a law professor, you do know better. As a lawyer, you should be promoting respect for the rule of law, not praising someone who trashes it.

      1. The Mueller Report didn’t acquit anyone. The Republican Senate, by predetermined vote, wouldn’t hear evidence, wouldn’t subpoena witnesses or documents, and voted to acquit along party lines except for Romney, who voted with his conscience. Having 48 U.S. Senators vote “guilty” is not exoneration. Having Republicans vote according to their party, instead of the rule of law, is not exoneration, especially when several of them publicly admitted they knew he was guilty but they still wouldn’t vote to convict. There aren’t any presumptions in impeachment proceedings. Trump is an impeached, fake President. He is a disgrace to this country. He needs to go. Now.

Eventually, they submitted written answers to questions, drafted by Giuliani, that were not responsive, and they refused to amend the answers to respond to the substance of what information was being sought. That is not cooperation. It is obstruction. Why won’t Trump release his financials or the actual transcript of the Ukrainian call? Even you know why. Why wont banks loan Trump money? Trump initially agreed to meet with Mueller, but his handlers figured out that he’d only hang himself, so they drug things out for months, and then finally agreed to respond to written interrogatories.
