Florida Man Arrested For Enforcing Social Distancing By Firing Shots In Hotel Lobby

download-4According to police, Douglas Marks, 29, has a curious method for reinforcing social distancing. After he spotted people without masks, he allegedly fired “four warning shots” at the Crystal Beach Suites Hotel.  The criminal charges contained one interesting element.  While Marks did not reportedly aim at anyone, he was still charged with assault. This follows an incident in California where a woman maced a couple who was eating with their child at a park without masks.

A woman and her son were in the lobby and encountered Marks.  She said that Marks told her “You all need to leave. you all aren’t social distancing.”  She was waiting for her boyfriend and ignored him.  She was sitting on the couch in the lobby and stated that she heard Marks tell staff “Let me take care of them, I have two people not following directions.”  She said that she heard him say again “you all need to leave” and then heard gunshots and ran out of the hotel and saw Marks with a handgun.

Marks is also reported as saying that he thought he was being followed – raising a possible mental capacity issue.

What I thought was notable was the array of charges: two counts of aggravated assault with a deadly weapon, firearm use and display while committing a felony and discharge of a firearm in public.

The aggravated assault charges are interesting since he did not appear to point the gun at anyone. The charges are the result of a broad assault definition and the criteria of the use of a gun in the aggravated assault “step up” for charges:

784.011 Assault.

(1) An “assault” is an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.

(Fla. Stat. § § 784.011, 784.03).

784.021 Aggravated assault.

(1) An “aggravated assault” is an assault:

(a) With a deadly weapon without intent to kill; or
(b) With an intent to commit a felony.
(2) Whoever commits an aggravated assault shall be guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Thus, any firing of a gun will be assault and the use of the gun will make that an aggravated assault.

  1. If you want “common sense gun laws” it can’t be more sensible than this. You terrorize people with a gun, discharge it in a public place, and endanger the safety of the public, you go to jail.

    Seems simple. If there are mitigating circumstances, the courts can sort them out.

You can’t be responsible for the biggest drop in GDP in history, boot every aspect of pandemic response, cause daily demonstrations, and cage children, all after being impeached, and survive for another term.

    Even if he survives the election by some miracle of foreign help/intervention, but the Senate goes blue, Trump will be impeached again by March. And then removed this time.

    First, the mutt’s nuts. He needs to be institutionalized. He is a threat to society. Sending him to jail will only make him worse and if he’s dealt with through the penal system he will be out in a few years. It’s a mental health issue.

    Secondly, this mutt should never, ever, have the right to ‘bear arms’. If he petitions to have this right restored some time in the future, it can only be because the gun industry needs money. If he is ever found with an arm again, then off to the pokey or institution for the duration.

    The main issue here is the safety of society, or all the individuals that make up society, however one comes to it. It’s not safe around this guy.

    So, let’s see who tags the left with this guy.

I would argue that these things are just as likely to be due to fear of getting sick, mourning the deaths of loved ones, worry about loved ones getting the virus and the economy collapsing, rather than closing up schools and businesses to prevent unnecessary deaths. The fat one bullied states to open up too soon, and the results speak for themselves: record numbers of new infections and deaths. And, Herman Cain, who eschewed wearing a mask and who attended the Tulsa rally, died yesterday of COVID-19. Res Ipsa Loquitur.

  7. I’ve got no problem with aggravated assault here. Marks made a “threat” (put on your mask or else) by an “act” (firing a gun) coupled with an ability to carry out the threat (by lowering his aim) and he did an act certainly creating a well-founded fear if imminent harm – isn’t that what a warning shot is? The assault was aggravated because he used a deadly weapon without intent to kill.
