
We have previously discussed how some media organizations told their journalists not to call violence after the death of George Floyd “riots,” including the recently much mocked headline of CNN calling the looting and violence in Kenosha “fiery but mostly peaceful.” Now, Chris Cillizza, an editor-at-large for CNN, is under fire for criticizing President Donald Trump for labeling the violence in places like Kenoska as “riots.” Critics have noted that the picture posted by Cillizza with his tweet shows a building engulfed in flames. Lawyers notoriously parse terms in ways that often deny their obvious meaning but this effort by some in the media would make a Philadelphia lawyer blush.
Cillizza tweeted “Trump’s efforts to label what is happening in major cities as ‘riots’ speaks at least somewhat to his desperation, politically speaking, at the moment.”
I do not deny that both sides are using these riots for political purposes. Trump is using the violence to reinforce a law-and-order theme while Democratic politicians are blaming him for the violence and calling for the 2020 election to be a referendum on racial justice.
It is the parsing of the term that intrigues me. In Portland, the Portland police have reportedly declared 13 riots in 80 days. Newspapers in these cities have referred to rioting from Portland to Minneapolis to Kenosa. David Brown, the Chicago Police superintendent, said, “This was not an organized protest, rather, this was an incident of pure criminality.”
The coverage of recent looting and rioting has been uneven with networks like CNN spending comparatively limited time reporting on the violence while Fox is covering it exhaustively. Other outlets like NPR have run segments on how the word “rioting” has racist roots. Whether there are riots depends on what news outlet you use. It is the new reality of echo-journalism.
Of course, this dispute turns on a noun that is clearly defined as “public violence, tumult, or disorder.”
The law often turns on subtle distinctions as discussed by Blackstone in his famous account of a case where English court interpreted a 1547 statute criminalizing the stealing of “horses” to be inapplicable when a defendant stole just one horse. William M. Blackstone, 1 Commentaries * 88. The Parliament had to enact a new statute to cover one-horse thieves.
Such arguments often lead to frustrating moments in courts or depositions like this exchange:

It would seem that rioting is equally difficult to picture in one’s mind even with a picture of a burning building in the background.
Courts often apply a plain meaning rule to such terms. Justice Antonin Scalia once opined in a dissenting opinion that “the acid test of whether a word can reasonably bear a particular meaning is whether you could use the word in that sense at a cocktail party without having people look at you funny.” He noted that in that case, “[t]he Court‘s assigned meaning would surely fail that test, even late in the evening.” Johnson v. United States, 529 U.S. 694, 718 (2000) (Scalia, J., dissenting). Since “no dictionary we have examined defines ‘device’ to encompass an animal,” the court concluded ruled out a DUI involving a “vehicle” that turned out to be a horse.
Nevertheless, courts continue to grapple over issues like whether a horse is a “device.” In one case, the court explored a DUI case on the basis of the definition of a vehicles as defined in Utah as “every device in, upon, or by which any person or property is or may be transported or drawn upon a highway.” State v. Blowers, 717 P.2d 1321 (Utah 1986).
Just as “a rose by any other name would smell as sweet” in Shakespeare, a riot by any other name would seem just as violent.
We have been discussing the concern by many that networks like CNN shape the news to fit a narrative. Fox and MSNBC have been accused of the same practice. Many in the public do not know where to turn for unbiased reporting on the left or the right, according to various polls. Even in acknowledging the importance of the media to our system, the majority of citizens believe that the media actively misrepresents facts. Roughly half view the media as biased.
This is why.
Of course, this is looting and rioting. Ironically, the effort to call its “fiery protesting” only undermines the majority of peaceful protesters. It is not that difficult. You acknowledge the looting and rioting while saying that the majority of protesters remain peaceful. While it does not fit any particular narrative, it has the added benefit of being true.

One man freed by the group’s bail was charged last week in connection with a brutal assault that occurred after he was released.”
“The fund also paid $10,000 bail for Lionel Timms, who was charged for an alleged July 11 attack in Bloomington, Minn. on a bus passenger who had rebuffed Timms’s request for money.
After being bailed out, Timms was later arrested on a new third-degree assault charge for an alleged beating in an alley on Aug. 14 that left the victim with “traumatic brain injury”, a fractured skull and a brain bleed, according to WCCO-TV in Minneapolis. ”

Law enforcement agencies refuse to send deputies into Portland
PORTLAND, OR (KPTV) – Law enforcement agencies around the state of Oregon say they will not be complying with a call from Governor Kate Brown to assist PPB with nightly protests in Portland.
Governor Brown released a statement Sunday, specifically calling on the Clackamas County Sheriff’s Office, Washington County Sheriff’s Office and Gresham Police Department to help bring an end to nightly violence in Portland. She called it a plan for a unified law enforcement presence in the city.
“This is routine mutual aid agreements that have happened over the years, possibly decades in this region,” Brown said. “And we think that it’s really important at this point in time for the region to come together and help end the violence in the streets of Portland.”
She said it’s something her office had been working on for a while.
“We had been working on this plan for a number of days. I had reached out to a number of local elected officials, but this is a comprehensive, unified law enforcement approach,” she said.
Her plan also stated that the City of Portland would take on the cost of bringing in officers from other agencies and that Mayor Ted Wheeler would find a way to pay for it.
But, now those law enforcement agencies called on by the governor say they are not going.
Both the Washington County sheriff and Clackamas County sheriff said they were not notified of this plan before it was released by Governor Brown.
In a statement, Clackamas County Sheriff Craig Roberts wrote:
“Had Governor Brown discussed her plan with my office, I would have told her it’s about changing policy not adding resources. Increasing law enforcement resources in Portland will not solve the nightly violence and now, murder. The only way to make Portland safe again, is to support a policy that holds offenders accountable for their destruction and violence.”
He went on to say that for this to happen, the district attorney needs to prosecute arrested protesters.
Washington County Sheriff Pat Garrett released a similar statement, saying:
“As Washington County Sheriff, I commit to support PPB through indirect ways, like analyzing risks associated with social media, air support, assisting with a specific criminal investigation, etc. At this time, I do not plan to send deputies to work directly in Portland. PPB is a terrific partner and I am very sympathetic to what they are enduring. However, the lack of political support for public safety, the uncertain legal landscape, the current volatility combined with intense scrutiny on use of force presents an unacceptable risk if deputies were deployed directly.”
A joint statement was also released by the Oregon Association Chiefs of Police and the Oregon State Sheriff’s Association, saying they could not recommend sending officers from outside agencies into Portland. The groups cited a lack of resources, as well as a “lack of accountability for those arrested committing criminal acts” as their reasoning.

4 years ago a coup began. It failed. Despite a mountain of evidence proving what happened and who was involved, only 1 person has pled guilty in exchange for a 6 month sentence. Election fraud will happen. It will be rampant. Low level people will be prosecuted. And none of that will matter because the damage will have been done years earlier.
It is interesting how the times change so quickly. This election was one for Biden to lose because trump has a knack for saying and doing idiotic things that appeal to the fringes of his party, but really turn off those in the middle that like his policies, but can not stand the man. They go from saying they would not vote for him, but would to saying they would not vote for him and won’t. And the media makes Trump the goat on Covid-19, while making Fauci the hero of the administration, even though Fauci made many errors, told people information that was 100% incorrect, scared the crap out of them and then reversed comments to look like the hero. So what happens. Trump keeps mouthing off (I will find recent comments if so ask), but Biden stays in the basement, but doesn’t stay quite. He stumbles on stupid comments and does not look presidential. He looks old and feeble. And those that support him the most are doing everything in their power to give Trump the vote with the riots and demonstrations causing death and destruction. Trump jumps all over law and order as well as security, flash points for middle class suburban America,
So now the poll are within 5% or so, tied in some swing states and too close to call in a couple others. Trumps fortunes have changed for the good because of another mismanaged campaign by a democrat.
Not saying Biden won’t get elected, but his road to the white house is narrower than it was just a few weeks ago.
And with the tightening of the polls, any idea of not debating is out the window. This could be what kills his campaign or sends him to the White House.
I most likely will not see it in my lifetime again, but having an election like Bush 41 v Clinton where there was a choice between good and best (not considering Perot who was right on many things) instead of choosing between bad and worst would be nice. I can not say I am happy with either one, so will have to choose the one that offers the least negative impact to policies I support. and I suspect there will be many voting the same as I will, not happy with either one.

That being said one has to recognize that a lot of things he said that caused me and likely you agita turned out to be correct. The media says nothing about what Trump does or what he wants to do. They won’t give him any press so he has to aggressively make it happen. When he wants to talk about something the media will not publish it but if he says it in a strange way they publish it as something he said that was wrong. It is now in the news and what he says on the subject gets published and makes sense. When he first took office he got bad press and did little about it or in some cases kept it going. The news media was focused on trivialities giving him the ability to focus on one of his most important agendas, getting rid of regulations. which he did.
Sometimes he says or does stupid things but that is true of all of us so I give him leeway because overall he has been able to at least partially break through the Washington bureaucracy and legislature. Remember, he is an outsider so insiders whether Democrat or Republican started out against him. He is taking away a lot of their bread.
The next time he says something you disagree with try and get the entire quote in context. Take note of the issue and the direction of the country is at that moment and then see how that statement plays out. Take note if the statement was nothing more than a ruse to change the topic of the day which is not favorable to him. That is the equivalent of taking a small loss in order to get rid of a bigger one.

The widespread use of postal ballots is a conduit to massive fraud (not to mention delays given the trouble you have tabulating them). If 2000 is replicated, you’ll have trial judges trying to do their jobs while Democratic Party operatives in the appellate judiciary disregard clear statutory language in an effort to rig the game. You’ll have that all over the place, not just in one state.
It’s indicative of how worthless our politicians are that given the mess in Florida in 2000, they took steps (under the guidance of a useless federal commission) to exacerbate problems in elections administration. They did this contra the advice of academics working in computer science and IT who had studied the problems of technological applications in elections administration. Now, this year, when there was an emergency, they enacted measures to make the whole business a horror.
Aside from the usual inertia and stupidity (and an aspect of the latter is the onanistic reaction to information technology), the Democratic Party’s sub rosa vote fraud schemes would be threatened by clean elections, so we only get reform in states which are too red for them to steal it. Not that the Republicans have distinguished themselves in these matters.

As for Biden, he ain’t never been Sheriff of anywhere. Long ago in a galaxy far away, he had a seat on a county council. He’s been in federal politics since 1972 and the federal government is responsible for only a sliver of law enforcement (and most of what it does do is interdict street drugs). It offers consultative services to local law enforcement (something state police can do outside of rarefied realms) and maintain some useful databases.

It may also be hard to believe that domestic manufacturing could unite so many households over generations against offshoring and socalled “free trade” in the midwest, and align both the managerial strata with the interests of organized labor, but in fact across the Rust belt there are many such households.
Out east, I suspect that “Republican” means something different than it does out here. And it always has. His latest was his speech in Pittsburgh today, from an undisclosed location (evidently Carnegie-Mellon hosted it; Democratic speakers don’t get disinvited). It runs on for 2,850 words (or shy of about 5 typed pages). About 20% of the verbiage concerns the rioting, and the bulk of that consists of blaming the president for it (and invoking mythical white supremicists).
Biden hasn’t any leadership qualities. The thrust of the speech aligns with the mental operations of partisan Democrats of my acquaintance. Whoever wrote the speech has his finger on the pulse of street-level Democrats, and it tells you something rather disagreeable about their hearts and minds.
Biden was a leader in the Senate – not an easy accomplishment – for most of his 40 years there. He was the Chairman or ranking member of 2 of the most powerful and prestigious committees – Foreign Policy and Judiciary – for much of that time and was the go to guy for negotiating bipartisan legislation.
His speech and positions are centrist and main stream Democratic, which also happens to align with the most popular positions of Americans on gun control, health care, comprehensive immigration, foreign policy, etc. The left wing agenda went down in the primaries.
Whatever his speaking abilities show, other than a long history, including at an early age of being a gaffe machine, he knows what he’s talking about, has been there, and has principles. The candidate TIA and most others here support often shows signs of losing it as his speech devolves into gibberish, and at his best he remains an ignorant liar who’s biggest applause lines aren’t aspirational, but put downs and insults aimed at other “elites” (other than himself) and who’s “principles” are an act – see upside down bible in Lafayette Park – which only thinly veils his true guiding light – seeking attention.
Joe Biden could have been the finest Senator in American history and that would not matter if he is in a significant cognitive decline

How ironic that Tulsi Gabbard is also of partly Asian Indian ancestry– her mother was white– but the Democrats carefully ignored Tulsi at their convention, even though she is a worthy candidate and earned herself at least one delegate. But the Democrats never worry about “Tradition” and just erased her from all mention. Sad!
The long term viability and authenticity of the Democrat party is important to our bipartisan system. Never has it looked so poorly as it does now, between the explicit endorsements of BLM, and the tacit endorsements of rioting, to the pick of Joe in spite of his difficulties, and the elevation of this bad lady to VP. Indeed batteries are not the entire answer…, but if you venture outside the broad brushes of how this article treated the battery question you’ll find battery tech is ever improving.
See, basically the power ‘storage’ question isn’t one of efficacy so much as it is one functioning from the old profit model of ‘how do you sell’ what you’ve previously produced. This is the thinking that stifled the fossil fuel companies when they made a big push into sustainable in the ’80’s. They couldn’t see around not being to able to license and own the source of the power they treat as a commodity and made the active decision to not venture further until they sold off what they could license and profit off in the biggest way.
So the question is limited. How so? Well, the actual territory of energy production is shifting far beyond the ‘map’ of that limited profit model. What does that mean? In short, it means decentralization. The super storms we’re getting through climate change have shifted the power distribution models. When power is knocked out for upwards of a month at a time what becomes clear is that rather than having one central power generation source that branches out through the grid you’re always going to be susceptible to the catastrophic event. What works much better is a grid system with many mini generation sources along the way. That way you can’t get knocked out of the blocks so easily. Sustainable sources such as wind, solar and hydro — and the hybridization models arising from such diversification — are perfect for this new modeling. It’s basically the idea of having many generators built into the system.

The question becomes how do we choose what source of energy to use. Are we told from above like has happened in California or do the various sources have to compete. Let’s take wind. The amount of fossil fuel necessary to build a wind turbine is huge and to get sufficient energy one has to destroy a significant area frequently forest or meadow. Those two things are major considerations. Add to that the destruction of habitat for animals and the fact that windfarms kill huge numbers of birds and one has to be very judicious as to where wind farms can be placed. The next consideration is the fact that windfarms aren’t really renewable energy for they end up having to be replaced at considerable cost in money and pollution. Then one has to recognize that the broken turbines add to the amounts of garbage we already have.

The point of paying respects to Lewis is that a POTUS is supposed to be a standard-bearer for all Americans and American values, so ignoring the passing of an icon of the civil rights struggle of African Americans is petty, immature and pathetic. Other countries did more to respect John Lewis than Trump, including Canada. At minimum, he should have paid his respects while John Lewis lay in state. As for principles, we might first have to define the term. The three salient issues for his presidency are fair trade over free trade, immigration restriction and reform, and an end to military interventionism, and military deconfliction with Russia. Domestically, he obviously favors law and order. At least from my point of view. These are nationalistic issues, which operate in a certain dialectic against the growing thrust of globalism. In my view as just one voter, he has delivered on these things to some small but significant degree.
Biden, I am not sure what issues he really represents. He is pragmatic. Just as Trump is. I consider that a strength in a national leader. Biden has been one of our top national leaders for a long time. We could have done worse than Joe Biden for whatever faults. But now I think he is too old for this and suffering from some sort of decline. This brings us necessarily to his VP pick. I am strongly opposed to Kamala. I do not want to beat up on Joe. I refuse to get nasty about Joe. Kamala should be getting the scrutiny now is my opinion. She is a shapeless mercenary. There is a difference between being pragmatic and being mercenary.

Trump’s willing to assert his own military policy at the cost of losing support among James Mattis’s supporters. How will Joe Biden handle fraught military questions? From strength, even disagreeable strength, or will he cave in to one sort of pressure or another, from his advisers, various groups in Congress, or foreign parties? I don’t know. I don’t consider Joe Biden’s response to one form of pressure or another to be predictable enough to consider him an acceptable candidate for President.
Harris’s responses are even less predictiable. Where Biden may show moral qualms about a course of military action, Harris, if she succeeds Biden, are unlikely to be grounded in moral considerations. Her alleged handling of the Jussie Smollett case, which left no political wire un-pulled in Chicago, showed her main talent is justifying illegal actions and calling in former Obama staffers to make it so.
I left the crux of my argument unstated. Successive disarmament deals and insane neglect of the national nuclear security infrastructure (we didn’t even plan well enough across four administrations to make sure we could enrich lithium (as an essential nuclear fuel for thermonuclear weapons) has made us critically weak in a crucial part of our national deterrent posture, if we must confront Russia and/or China (or both, they’re the linchpin allies of the Shanghai Cooperation Organization, the new version of the Cold War’s Warsaw Pact) we’ll be doing it in many ways from weakness.
Will Joe Biden have the strength, assuming his party keeps the House this year, to lobby the House Water and Energy Committee on Appropriation to repair the damage they’ve done to our first national line of defense? Will Harris? Jonathan: In your continuing crusade against CNN you criticize the news organization for not using “riot” in covering the continuing protests around the country. OK. Let’s use “riot” in reference to the protests last Tuesday night over the shooting 7 times of Jacob Blake, a black man, by a Kenosha white police officer. By most accounts the protests began peacefully. That is, until a white militia group appeared on the scene. Those in attendance describe a group of white men with assault weapons appearing in the street and on a roof top, sniper style, pointing their weapons at the protesters. At some point a young white 17 year old, Kyle Rittenhouse, shot and killed 2 protesters and severely wounded a third with his AR-15, He fled back to his home in Illinois where he is being sought on an extradition warrant charged with first degree intentional homicide. It appears Rittenhouse drove the 20 miles from his home to Kenosha after responding to an online message from a right-wing militia group, “Kenosha Guard”, who wanted to confront protesters and “hurt people”. High school classmates of Rittenhouse describe him as short-tempered, easily offended who worships the police , guns and Donald Trump. Protesters on Tuesday night also describe police cooperation with Rittenhouse’s white militia. Police were observed giving water bottles to militia members, including Rittenhouse. One police officer was overheard telling militia members: “We appreciate you guys”.
Now Rittenhouse has his defenders. A white Republican student group at Arizona State University is trying to raise money for Rittenhouse’s defense–as is a self-described Christian group. No doubt Rittenhouse will be the poster child for white supremacists everywhere. Even Donald Trump re-tweeted a message of support. Tomorrow Trump will fly to Kenosha to show his support for Rittenhouse and the police and reinforce his theme of “law and order” and solidify his support among white nationalist voters.
So “rioting” did occur in Kenosha–caused by Rittenhouse and his militia who wanted to provoke violence and were aided by the police. That’s the “truth” you choose to ignore. You prefer not to discuss this “truth” because it does not neatly fit into your definition of a “riot” as involving only peaceful protesters objecting to right-wing and police violence.
No Dennis your pretzel logic does not work. BLM and ANTIFA started the riots in Kenosha, Kyle was a citizen called to help protect law abiding citizens of Kenosha from anarchy, and he was feloniously attacked with a skateboard, molotov cocktail, and gun. He retreated and they gave chase. Then, he capably and effectively terminated their aggression with a competent use of lethal force to protect himself from grave bodily harm or death.
I’m on the side of Kyle, the right of self defense, and law and order.

My sister and I talked just this morning about the need for voters to vote OUT the local elected Ds who have been permitting the riots, civil unrest, arson, violence, looting to go on unchecked. Just assume that any elected D is part of the problem with crime.
I can’t join in rejecting all local Democrats across the big nation. There are a lot of small town Democrats and various local leaders who are true public servants and genuinely good people. Perhaps some at the national level too. We have within living memory some very fine Democrats across America.
However, in places where they have endorsed BLM, they have endorsed a racketeering operation and rioting and this is totally unacceptable. The blue state tandems of governor plus mayor like Portland are just awful horrible messes now and quite frankly it is all their fault. Illinois plus Chicago is another awful mess at hand and getting worse. Vote these scoundrels out if you are misfortunate enough to live in these places. Or if there are no opposing choices– often the case in Chicago– you might as well note cast a ballot in the downballot specific races at all
