The Gaetz Scandal Is Long On Speculation And Short On Facts

The scandal involving Rep. Matt Gaetz (R-Fla.) continues to rage in Washington as Gaetz alleges a conspiracy to extort $25 million and the New York Times has reported an investigation into his traveling across state lines with a minor for sex. Both are serious allegations and someone is clearly lying. The question is why, after a year of reported investigation, the underlying facts appear unresolved.  Either this girl was 17 or she was not. Either Gaetz traveled with her or he did not. Then there is a taped call that could prove the veracity of key witnesses.  In other words, there is raging speculation over facts that should be easily and already established. Why?

The investigation of Gaetz occurred during the tenure of former Attorney General Bill Barr — another example of how his department conducted nonpartisan investigations. Indeed, reports suggest that Barr avoided Gaetz during his tenure due to the investigation.

The Justice Department has long been criticized for leaks, including leaks tied to the Russian investigation.  As a defense attorney, I have had to deal with such leaks that clearly are calculated to pressure defendants.

Of course, the Justice Department has also been criticized for speaking about cases that do not result in charges as shown by the James Comey press conference before the 2016 election.  The Justice Department is not in the business of clearing subjects or addressing public controversies.

That is why Congress may have to step forward to seek confirmation of basic facts on the allegations against Gaetz.  It has ample authority and reason to do so. If Gaetz is guilty, he would likely face criminal charges and probable expulsion from Congress. However, it has reportedly been under investigation for a year and the age and relationship with this girl should have been easy to confirm.

Of course, assuming the girl was underage, there can be complicating factors. For example, they may not have traveled together but she could claim that they arranged to meet on such trips. (So Gaetz’s suggestion of reviewing his travel records will not answer the legal question of facilitating or enabling such travel). Once again, however, such travel (and her status as a minor) must already be established. Gaetz insists that he knows of no such person. Period.

There are reports that the investigation of Gaetz began with a sex trafficking investigation of a third party. That larger case could also result in delays in the issuance of indictments.

Then there is the call that is being cited by Gaetz as part of an effort to extort. If the call was recorded by one of the parties, it is not clear why it cannot be released.  Gaetz wants it released and presumably his father (who is reportedly on the phone) would agree. The other party is reportedly former Justice Department lawyer David McGee, currently with the law firm Beggs & Lane. McGee denies being part of any such conspiracy and says that he has no objection to the release.

The call is one area to test the credibility of Gaetz who insists that it will demonstrably show extortion while McGee insists that it was a harmless call with a concerned father.  The written extortion offer is perfectly bizarre.  Extortionists usually do not offer a detailed written offer, including a pledge to seek a presidential pardon for Gaetz. This is all part of a bizarre claim to be seeking the $25 million to free a captured former FBI agent.

If the call was orchestrated by the Justice Department, it is unlikely to release the transcript or the recording solely to address the controversy. (Gaetz’s father said that he wore a wire at the behest of the FBI).  Indeed, absent an indictment, it may not be released. The only other avenue would be for Congress to seek the transcript or recording citing oversight and legislative authority.  With the parties raising no objection to release, the only question would be law enforcement privileges and any privacy concerns if the girl’s identity is disclosed directly or indirectly.  Yet, it is possible to address such issues through redactions or summaries.

What is curious is that Gaetz is still, after a year, reportedly a subject not a target in the investigation. If the prosecutors confirmed the girl was underaged and traveled with Gaetz or had a sexual relationship with him, he would clearly be a target.  Obviously there is a tendency to keep the lower status as long as possible but I would have expected a grand jury submission after a year on such a relatively straight-forward case or at least a change in status for Gaetz.

There is a categorical denial by Gaetz that there was ever such a girl or such trips or such a relationship.  That should be easy to confirm. While Democratic members have called for his immediate resignation, it would be useful to have facts and an investigation. I hold no brief for Gaetz who I have previously criticized. Moreover, I took the same position with Gov. Andrew Cuomo.  You cannot say that you are defending the rule of law when you discard any notion of due process.  These are facts that should not be difficult for Congress to confirm even without disclosures from the Justice Department. If there is such a girl, she is now an adult but her identity can still be protected from public disclosure in any congressional investigation.  The first issue is a matter of a birth date.  That does not require speculation. Just a calendar.

  1. “The congressman’s office confirmed to The New York Times that Luke Ball, the communications director for Gaetz, has resigned.”

A statement says they “agreed that it would be best to part ways.”

Hmmm. I wonder what Mr. Ball knows about the allegations against Gaetz.

    1. Mr. Ball did not want to go down with the ship.

      Gaetz is history.

      Another Creepublican bites the dust.

      Trump is next.

(I just coined a new word, Creepublican along with Schadenfraud and Fauxcist. Republicans are good for that.)

  2. Jonathan: There is more to the Matt Gaetz controversy then meets the eye and why you should have not jumped in so early to defend the Congressman. You failed to advise Gaetz to just stay quiet. The other night Gaetz appeared on Tucker Carlson’s FoxNews program. After the interview Carlson said it was “one of the weirdest interviews I have ever conducted”. Considering the many weird interviews Carlson conducts that’s saying a lot. Gaetz started out by denying he travelled across state lines to have sex with a 17 year old girl and even denied she exists. He said just look at “my travel records.” The only problem with that defense is that personal travel records are not subject to disclosure under House reporting requirements. Even travel on official business does not require reporting the names of every person travelling with a Congressperson. Gaetz could be facing a Catch-22. If the girl at the time exists and Gaetz took her with him and paid for her expenses out of campaign or taxpayer funds he was committing a crime–like the Duncan Hunter case.. No doubt federal prosecutors will or already have requested Gaetz’s personal travel records to find out where he travelled and with whom. Carlson was left scratching his head and angered by Gaetz’s attempt to draw the host into the controversy. Gaetz said he was “not the only person on screen right now who’s been falsely accused of a terrible sex act”. Then Gaetz went on: “You [Carlson] and I went to dinner about two years ago. Your wife was there, and I brought a friend of mine, you’ll remember her”. Carlson immediately denied any knowledge of the dinner. Then Gaetz bizarrely claimed the controversy was tied to an alleged extortion scheme involving him and his family being conducted by a former DOJ official who made up the 17 year old. While federal prosecutors looking into the sex allegations against Gaetz have been tight-lipped they have said the alleged extortion scheme is unrelated to their investigation. The main problem for Gaetz is that he keeps running his mouth. A former federal prosecutor has said Gaetz’s lawyer should tell him to shut up. But Gaetz is like his mentor Donald Trump who never missed an opportunity to stick his foot in his mouth!

  3. “The Gaetz Scandal Is Long On Speculation And Short On Facts”

    More facts are coming out.

“A Justice Department investigation into Representative Matt Gaetz and an indicted Florida politician is focusing on their involvement with multiple women who were recruited online for sex and received cash payments, according to people close to the investigation and text messages and payment receipts reviewed by The New York Times.
“Investigators believe Joel Greenberg, the former tax collector in Seminole County, Fla., who was indicted last year on a federal sex trafficking charge and other crimes, initially met the women through websites that connect people who go on dates in exchange for gifts, fine dining, travel and allowances, according to three people with knowledge of the encounters. Mr. Greenberg introduced the women to Mr. Gaetz, who also had sex with them, the people said.
“… Mr. Gaetz denied ever paying a woman for sex.
“The Justice Department inquiry is also examining whether Mr. Gaetz had sex with a 17-year-old girl and whether she received anything of material value, according to four people familiar with the investigation. The sex trafficking count against Mr. Greenberg involved the same girl, according to two people briefed on the investigation. … Some of the men and women took ecstasy, an illegal hallucinogenic drug, before having sex, including Mr. Gaetz, two people familiar with the encounters said.”
    https://www.nytimes.com/2021/04/01/us/politics/matt-gaetz-justice-department.html

There’s more in the story, including about the alleged extortion plot.

“Gaetz gained a reputation in Congress over his relationships with women and bragging about his sexual escapades to his colleagues, multiple sources told CNN. Gaetz allegedly showed off to other lawmakers photos and videos of nude women he said he had slept with, the sources told CNN, including while on the House floor. The sources, including two people directly shown the material, said Gaetz displayed the images of women on his phone and talked about having sex with them.”

    1. Again the guy is a creep. He looks like a creep. He talks like a creep. He engages in creepy behavior – supporting Trump wholeheartedly.

      He’s just a selfish, money-grubbing pussy-grabber.

      To wit: A modern Republican/Conservative.

He’s a sex scandal no longer waiting to happen.

      1. “He engages in creepy behavior”

Speaking of “creepy”. “Creepy Joe” Biden’s serial pedophilic behavior towards little pre-teen girls is clearly documented in multiple videos over the years.

Then there’s the widely seen pics of Hunter Biden having sex with his 14 year old Niece, taken by Hunter.

That apple obviously fell right to the bottom of the tree.

So, the faux outrage about an alleged and unproven sexual tryst between Gaetz and a 17 year old girl leaves Democrat partisan trolls like you skating on extremely thin ice.

And none of this addresses what Dementia Joe is allowing to happen to children being transported by Mexican Cartels on the way to the border.

        Even more thin ice.

Go peddle your BS elsewhere, Ben.

        1. Peddle your own BS elsewhere, Wallower.

“the faux outrage about an alleged and unproven sexual tryst between Gaetz and a 17 year old girl”

Guess you didn’t read the articles, since the allegations of illegal or creepy behavior go far beyond that.

        2. You are interpreting Biden’s grandfatherly contact as pedophilia probably because you are a pedophile yourself.

Pedophiles don’t do that stuff publicly.

Have you seen these supposed photos of Hunter Biden with his niece?

Or all the child pronography he supposedly collected?

No one has seen it because it doesn’t exist.

That was all tactics and a smokescreen put up by the Republicans trying to win an election.

          And it didn’t work.

None of it worked, from pedophilia to rioting.

          They failed.

          Stay classy, prole,

    2. CNN and the NYT — yeah, those are real unbiased “news” sources, as everyone knows LOL — doofus.

      1. CNN and NYT at least attempt to get it right.

        Fox does not.

They are a corrupt news organization – completely.

        As is Breitbart, OANanistic, etc.

  4. Jonathan: You must be kidding. Why in the world would you want to defend Matt Gaetz in this column and also on FoxNews? He’s ethically challenged and a laughing stock among he colleagues in the House. He has promoted all of Donald Trump’s conspiracy theories. Back in 2018 Gaetz invited Charles Johnson, a notorious Holocaust denier, to attend Trump’s State of the Union address. The night before Michael Cohen was to testify in the first impeachment inquiry Gaetz sent Cohen a note to try to keep him from testifying threatening to divulge a claim that Trump’s former attorney was involved in an extra-marital affair. The claim was false and Gaetz was referred to the House Ethics Committee and prosecutors for witness intimidation and tampering. Gaetz was forced to apologize. He has also been charged with numerous ethics violations. After the storming of the Capitol on Jan. 6 by Trump rioters Gaetz falsely claimed many of the rioters were not Trump supporters but Antifa followers masquerading as Trump supporters. From day one Gaetz has never deviated from his support for Trump. He is also a close associate of Roger Stone and Joel Greenberg, the latter being the former Seminole County, FL tax collector. Greenberg had to resign after he was arrested and charged with child sex trafficking of girls as young as 14. Sounds like Jeffrey Epstein redux! This prompted a separate criminal investigation into allegations Gaetz had sex with a 17 female teenager. What is it about politicians that they think sex with underage girls is just a perk that goes with the office? Just to be clear. This is the same Matt Gaetz you are now defending?

On a positive note I just received my second covid vaccine shot. I should acknowledge that I owe this to Donald Trump who single-handily accelerated the production and distribution of the vaccine. At least that is what the Trumpster claims. He recently said that without his Herculean efforts the vaccine would not have been available for 5 years. So naturally I am grateful. Now that I am fully vaccinated I decided to celebrate by inviting a friend to have “churros” ( the long fluted Mexican sugar coated pastry) at our favorite “pasteleria” (Mexican pastry shop). This bakery specializes in the famous Mexican layered cakes for weddings and birthdays– called “tres leches”. As we were devouring our churros and sipping “cafe con leche” my friend remarked: “You know I voted for Trump the first time. But after he started building his wall along the border I had second thoughts. What happens if we no longer have cheap labor. Our housekeeper, gardener and plumber are all from Mexico. What happens if they leave and there is no one to replace them? Not to mention all the Mexicans who work here in this bakery. Where would we go to find our churros?”. “Good point”, I answered. “Maybe it was good that Biden won and stopped construction of Trump’s wall. He may have actually done Trump a favor. Had Trump been successful in completing the wall he would also be hurting–no cheap undocumented workers from Mexico and Central America to work in his hotels and golf resorts. Talk about shooting yourself in the foot!”.

    1. Gaetz has “sex scandal” practically tattooed across his forehead.

He’s a classic New Republiconservative creep who wants to be like Trump: Grab pussy, get rich and get away with everything.

      But he’s not gonna.

      Who are these people?

        1. I am neither a hipster nor a millennial nor do I want to be so I had to look up “toggaf.”

In Yiddish it means “Well-shaped penis – statuesque,” so thanks.

    2. As for Trump’s claim he accelerated the vaccine by five years. He is completely full of crap and anyone with an IQ over 120 recognizes that. You can’t believe a word he says.

The silver lining in Coronavirus is it swept Trump from office.

If he were still president, he would have screwed up the distribution of the vaccine, played favorites with Red States, etc .etc.

Thank Odin that creep is gone and stifled.

Too bad a half million Americans had to die and the economy lost tens of trillions to remove him from office.

But at least he’s gone and back to cheating at golf and screwing sad strippers.

      1. “The silver lining in Coronavirus is it swept Trump from office.”

Actually, the silver lining in Coronavirus is it swept Joe Biden INTO the White House.

If Joe had to get on the campaign trail to actually campaign and work hard at getting elected by engaging with people, answering hard questions on the campaign trail, etc, there is no way old Joe would have been elected.

No way Joe Biden becomes president WITHOUT Covid pandemic allowing him to stay in the basement.

        1. Biden is fine at engaging with people.

Read the preamble to his press conference.

That is MAGA: leaving America into the 21st century.

Trump just billowed and blathered for four years and didn’t accomplish bupkis.

          He’s all talk.

The dumbest 50% of America had their Vulgarian Candidate for 4 years with the expected result: economic humanitarian and constitutional catastrophe.

Coronavirus might have been God’s punishment for a country so venal they would elect a p**** grabbing wife cheating student defrauding charity stealing Thrice bankrupt draft dodging tax evading charlatan and fraud as their leader.

Trump couldn’t con his way out of a pandemic.

    3. Why not let the facts be determinative as to whether Gaetz is guilty or innocent. There has been a long history of smear tactics engineered through leaks by partisans in the DOJ, and it is not surprising that Gaetz would be a target.

    4. What Turley doesn’t note but should is Gaetz’s long history of lying and histrionics. I don’t much trust Gaetz. He may be innocent, but his attitude toward truth telling does not offer much hope.

    5. Matt Gaetz is being setup like all politicians that have one spec of voting against the communist Democrat Jews’ agenda which Trump was doing rather well. Now that we have the devils in control of Congress the demise of America begins again as when the Jewish Manchurian Democrat was in office!

      1. Here is Ben showing his contempt for the workers again. What’s a “prole” Ben, someone beneath you? What a snot you are

        1. Prole is a word from 1984. The definition is below. I use prole as a term of disgust for people who don’t seem to have a brain in their head and voted for Trump and watch Fox News and believe everything they’re fed and are constantly ranting about George Soros and the Deep State and Chemtrails and Agenda Whatever and other nonsensenical prole BS.

It’s more about brains than money or class.

You can be a stupid prole and still be rich. See: Donald Trump.

  5. Oh come now. We’ve moved well beyond the bourgeoisie notion of criminal charges being solely used to charge, try and convict criminals to the modernist notion that criminal charges are to be used by the party power structure to hamstring and harass those under-indoctrinated buffoons who are still refusing to see the manifest justice of the collective. Come on JT, class and racial warfare is all the rage on campus. In the streets, not so much but who cares about those irrelevant proles anyway? Che is the Way!

  6. A few people posting here were salivating over the prospect of the endomorphic, rookie firefighter, Genevieve Hansen testifying.

Recall that when I watched the video of her yelling at the police and holding up her phone during the Floyd arrest I said here that I thought she would make a poor witness for the state.

She was a poor witness. Part of her testimony can be seen here along with commentary by an expert attorney

    https://legalinsurrection.com/2021/03/chauvin-trial-day-3-wrap-up-floyd-was-high-with-foam-around-his-mouth/#more-349056

Astonishingly she described Floyd as a “small, slim man”. There go her powers of observation. Floyd was huge, strong, and easily bigger than the officers.

She was combative and unhelpful at the scene of the arrest and during her testimony she was combative with the defense attorney AND the judge and the jury had to be sent out so the judge could admonish her on the record. I doubt that she, or any of the state’s witnesses thus far, have helped the state’s case and she may even have hurt it. Emotions are in evidence and not much else. If it keeps up the judge would be justified in granting a motion to dismiss for failure to present a prima facie case. He likely won’t. There is a mob waiting outside anxious to do the Septemberist Proceedings.

To me she is a good example of one of the problems with affirmative action. This endomorph does not appear to be capable of performing the duties of a fire fighter. I have done them and I doubt she would last a full 24 hours without someone else helping her.

Apart from her physical limitations, she seems to have a difficult personality and I shouldn’t be surprised if at some point when she has to be corrected by a supervisor she snaps back at him rather than simply learning from him.

If she is reprimanded and alleges sexual discrimination the boss has a freebie for dealing with her. Not sexual discrimination. You are demanding too much because of your white privilege. Wokeness vs Wokeness.

  7. Exactly who is making what accusation? I’ll have better questions when this one is answered.

  8. Mass media smear artists are enemies of the people. They are the intelligence and propaganda arm of the globalist billionaire tyrants.
They need to be re-educated and rectified.

    Sal Sar

    1. Uh oh you used the “G word” = globalist.

You are disqualified from serious consideration.

For you are a conspiracy theory meathead.

Did you know chemtrails are a government conspiracy designed to make citizens so gullible and dumb they actually believe chemtrails are a government conspiracy?

      1. And who is “Ben Marcus” such that anybody should care for you? I know who I am, I am just a nobody. but a nobody with an informed opinion

You may be ignorant of economics. There is a such a thing as globalism. You could learn something about it. Here, I refer you to a book from Nobel Laureate Joseph Stiglitz

        https://en.wikipedia.org/wiki/Globalization_and_Its_Discontents

You are an insulting troll. I will not anticipate any thanks for this information. Fools like you think you know it all.

        Sal Sar

        1. The world just had four years of conspiracy theory stupidity. That’s enough. Put a cork in it. You embarrass me. You embarrass yourself.

          Define “globalist.”

IT’s right up there with Chemtrails and Deep State.

            1. So international relations shouldn’t be planted globally?

              It’s a complicated World.

It takes a PhD to understand it.

Unfortunately people like you struggle to spell PhD.

Did you know Chemtrails are a globalist conspiracy designed to make Americans so stupid and gullible they actually believe Chemtrails are a globalist conspiracy?

              1. So Ben, did you help write the book Wave Woman? Last week I heard a segment on American Voices with Bill Bradley on POTUS radio with the author sharing about her mom. She was really good. Made me want to buy the book.

                1. I did help her with Wave Woman. That’s what I do. I help people organize, polish, produce and publish their books.

Books are more work than people realize.

People say Karl Marx never worked and I say only someone whose never written a book could accuse him of that.

                  Books are work.

Good thing about that Vicky Durand’s mother Betty is she was Mormon and the Mormons are exacting perfectionists when it comes to genealogy and movement.

I can tell you the name of the ship her family arrived on from England, the name of the skipper, the day it left Portsmouth and the day it arrived in America.

And how they went from the east coast, to Salt Lake City to California and then to Hawaii.

She did a nice job on that book.

I also just helped another woman polish her memoir and got her a book deal in like three hours – a new world record.

It’s about a Catholic girl from Saint Martinville, Louisiana marrying a Jewish doctor from New York in the 1960s.

I gave her the title: “Crossing Bayou Teche” and I won’t be surprised if it goes big.

She writes well and has a smooth, soothing, intelligent voice.

I told her I want 10% of the movie deal and I’m not joking.

You never know what is going to take off.

                  1. Cool. May their memoirs grow wings or legs or whatever the expression is in the business. I’ve heard it said about Eat, Pray, Love that it was a book many in the business just knew had a special energy to it, and boy did it.

Just out of curiosity, how would you describe your voice? Cuz the way you go around insulting folks on here brings a few words top of mind. haha

                    1. My voice on here is angry and smartass because there is a lot to be angry about.

But my normal voice is smart and funny.

Like the Louisiana woman, my voice doesn’t fit me.

                      Hers doesn’t either.

Sometimes the inner person and external person don’t match.

If you read my stuff I am smart and sophisticated and worldly but I’m not, really.

People read my stuff and then meet me and they don’t put 2 and 2 together.

And I told the Louisiana woman that her book could be the next Eat, Pray Love.

IT has solid mid-20th-century manners: Cajun + Kosher + Kennedy.

                      Kinda similar to Forrest Gump.

She didn’t believe me but then I got her a book deal in like three hours with a Louisiana publisher who had sold 200,000 copies of a Cajun cookbook.

Which happened to be written by Marcelle Bienvenu – a cousin of the lady I helped – she has a mess of cousins in Louisiana.

                      Catholic, you know.

                      We shall see what happens.

You never know what is going to take off.

I helped a guy named Clark Little publish his book of wave photography.

I asked Jack Johnson to write a foreword because Jack and Clark are similar – they were just screwing around with music and photography and it took off on them.

I persuaded Clark to do a quality, $100 book and the book broker told him to do a $250 Special Edition.

So we did it – me, Clark and Art Director Joni – and he ordered 10,000 of them and I thought he was loco.

But he sold every one for $100 to $250.

                      That’s a successful book.

                  2. “Sometimes the inner person and external person don’t match.”

This is true. Donald Trump comes to mind. Ask Al Sharpton and Jesse Jackson (and many others) what they think of the man behind the scenes, behind the public persona, and you will have an entirely different read on Trump. Oprah used to like him, too. Just sayin.

                    1. No I know people in New York who know Trump and have dealt with him and they say the persona is different from the person.

I was communicating with The Mooch and he doesn’t like Trump at all – which is why he very publically turned on him.

And I live in Malibu and meet a lot of well known people and it’s sometimes illuminating to meet the real person behind the persona.

Don’t let Pam Anderson or Kid Rock or Lorraine Bracco fool you – they are much much sharper than they let on.

Trump is an act, but it’s an act that failed, thank Odin.

                      Power corrupts, and all that.

      2. Ah Ben Marcus, its calls itself. I’ve been trolled by your betters, boychick, but you can try.

Let’s have a look at the subject.

I doubt you are aware that “chemtrails” turned out to be a “thing” after all. Here, read the New Yorker magazine. Now they’re calling it “atmospheric hacking” and its the geniuses at Harvard who are intent on doing more of it. Sal Sar

        1. Yes chemtrails are a government conspiracy designed to make citizens so gullible and stupid, they actually believe chemtrails are a government conspiracy.

      3. Is this you, Ben Marcus? You sound very important.

        1. No I don’t know who that surfer dude is but I am the founder of the A.S.S (Anti Stupid Squad).

We roam the highways and the byways and internet, looking for stupidity and we shoot it down wherever possible.

          It’s a full time job.

I was just assigned this Turley website deal, and I see I will be busy.

          1. So you have failed to pick up any publications of late and now you have a job for California’s version of the wumao army? Sad fate for a successful chap like you.

            1. Oh I still get lots of assignments but after 130 issues of a magazine and 25 books I’m tired of my own voice.

So I help other people get their books written and published.

And I just did a crossword puzzle for Nancy Pelosi’s 80th birthday.

She got it yesterday and I hope she calls me and invites me to one of her deep state star chamber parties.

                1. Oh its from that song “Papa papa papa wumao mama poppa wumao mao.”

Surfin Bird by the Trashmen. They were from Minnesota.

I interviewed the guitar player for a book I did on surf culture.

I wondered about the origins of that song.

They just made it up on stage one night kind of in the same way Wipeout came about

      4. All of those conspiracy theories are not theory! The documentation of the chemtrails has been proven in military writings of fact!

        1. Yes the chemtrails are a government conspiracy designed to make citizens so gullible and dumb, citizens actually believe chemtrails are a government conspiracy designed to make citizens gullible and dumb.

            1. Actually I know him pretty well.

Ben is super smart and accomplished and has beautiful hair and drives a flash car and chicks dig him.
