The Gaetz Scandal Is Long On Speculation And Short On Facts

The scandal involving Rep. Matt Gaetz (R-Fla.) continues to rage in Washington as Gaetz alleges a conspiracy to extort $25 million and the New York Times has reported an investigation into his traveling across state lines with a minor for sex. Both are serious allegations and someone is clearly lying. The question is why, after a year of reported investigation, the underlying facts appear unresolved.  Either this girl was 17 or she was not. Either Gaetz traveled with her or he did not. Then there is a taped call that could prove the veracity of key witnesses.  In other words, there is raging speculation over facts that should be easily and already established. Why?

The investigation of Gaetz occurred during the tenure of former Attorney General Bill Barr — another example of how his department conducted nonpartisan investigations. Indeed, reports suggest that Barr avoided Gaetz during his tenure due to the investigation.

The Justice Department has long been criticized for leaks, including leaks tied to the Russian investigation.  As a defense attorney, I have had to deal with such leaks that clearly are calculated to pressure defendants.

Of course, the Justice Department has also been criticized for speaking about cases that do not result in charges as shown by the James Comey press conference before the 2016 election.  The Justice Department is not in the business of clearing subjects or addressing public controversies.

That is why Congress may have to step forward to seek confirmation of basic facts on the allegations against Gaetz.  It has ample authority and reason to do so. If Gaetz is guilty, he would likely face criminal charges and probable expulsion from Congress. However, it has reportedly been under investigation for a year and the age and relationship with this girl should have been easy to confirm.

Of course, assuming the girl was underage, there can be complicating factors. For example, they may not have traveled together but she could claim that they arranged to meet on such trips. (So Gaetz’s suggestion of reviewing his travel records will not answer the legal question of facilitating or enabling such travel). Once again, however, such travel (and her status as a minor) must already be established. Gaetz insists that he knows of no such person. Period.

There are reports that the investigation of Gaetz began with a sex trafficking investigation of a third party. That larger case could also result in delays in the issuance of indictments.

Then there is the call that is being cited by Gaetz as part of an effort to extort. If the call was recorded by one of the parties, it is not clear why it cannot be released.  Gaetz wants it released and presumably his father (who is reportedly on the phone) would agree. The other party is reportedly former Justice Department lawyer David McGee, currently with the law firm Beggs & Lane. McGee denies being part of any such conspiracy and says that he has no objection to the release.

The call is one area to test the credibility of Gaetz who insists that it will demonstrably show extortion while McGee insists that it was a harmless call with a concerned father.  The written extortion offer is perfectly bizarre.  Extortionists usually do not offer a detailed written offer, including a pledge to seek a presidential pardon for Gaetz. This is all part of a bizarre claim to be seeking the $25 million to free a captured former FBI agent.

If the call was orchestrated by the Justice Department, it is unlikely to release the transcript or the recording solely to address the controversy. (Gaetz’s father said that he wore a wire at the behest of the FBI).  Indeed, absent an indictment, it may not be released. The only other avenue would be for Congress to seek the transcript or recording citing oversight and legislative authority.  With the parties raising no objection to release, the only question would be law enforcement privileges and any privacy concerns if the girl’s identity is disclosed directly or indirectly.  Yet, it is possible to address such issues through redactions or summaries.

What is curious is that Gaetz is still, after a year, reportedly a subject not a target in the investigation. If the prosecutors confirmed the girl was underaged and traveled with Gaetz or had a sexual relationship with him, he would clearly be a target.  Obviously there is a tendency to keep the lower status as long as possible but I would have expected a grand jury submission after a year on such a relatively straight-forward case or at least a change in status for Gaetz.

There is a categorical denial by Gaetz that there was ever such a girl or such trips or such a relationship.  That should be easy to confirm. While Democratic members have called for his immediate resignation, it would be useful to have facts and an investigation. I hold no brief for Gaetz who I have previously criticized. Moreover, I took the same position with Gov. Andrew Cuomo.  You cannot say that you are defending the rule of law when you discard any notion of due process.  These are facts that should not be difficult for Congress to confirm even without disclosures from the Justice Department. If there is such a girl, she is now an adult but her identity can still be protected from public disclosure in any congressional investigation.  The first issue is a matter of a birth date.  That does not require speculation. Just a calendar.

  4. Jonathan: There is more to the Matt Gaetz controversy then meets the eye and why you should have not jumped in so early to defend the Congressman. You failed to advise Gaetz to just stay quiet. The other night Gaetz appeared on Tucker Carlson’s FoxNews program. After the interview Carlson said it was “one of the weirdest interviews I have ever conducted”. Considering the many weird interviews Carlson conducts that’s saying a lot. Gaetz started out by denying he travelled across state lines to have sex with a 17 year old girl and even denied she exists. He said just look at “my travel records.” The only problem with that defense is that personal travel records are not subject to disclosure under House reporting requirements. Even travel on official business does not require reporting the names of every person travelling with a Congressperson. Gaetz could be facing a Catch-22. If the girl at the time exists and Gaetz took her with him and paid for her expenses out of campaign or taxpayer funds he was committing a crime–like the Duncan Hunter case.. No doubt federal prosecutors will or already have requested Gaetz’s personal travel records to find out where he travelled and with whom. Carlson was left scratching his head and angered by Gaetz’s attempt to draw the host into the controversy. Gaetz said he was “not the only person on screen right now who’s been falsely accused of a terrible sex act”. Then Gaetz went on: “You [Carlson] and I went to dinner about two years ago. Your wife was there, and I brought a friend of mine, you’ll remember her”. Carlson immediately denied any knowledge of the dinner. Then Gaetz bizarrely claimed the controversy was tied to an alleged extortion scheme involving him and his family being conducted by a former DOJ official who made up the 17 year old. While federal prosecutors looking into the sex allegations against Gaetz have been tight-lipped they have said the alleged extortion scheme is unrelated to their investigation. The main problem for Gaetz is that he keeps running his mouth. A former federal prosecutor has said Gaetz’s lawyer should tell him to shut up. But Gaetz is like his mentor Donald Trump who never missed an opportunity to stick his foot in his mouth!

Back in 2018 Gaetz invited Charles Johnson, a notorious Holocaust denier, to attend Trump’s State of the Union address. The night before Michael Cohen was to testify in the first impeachment inquiry Gaetz sent Cohen a note to try to keep him from testifying threatening to divulge a claim that Trump’s former attorney was involved in an extra-marital affair. The claim was false and Gaetz was referred to the House Ethics Committee and prosecutors for witness intimidation and tampering. Gaetz was forced to apologize. He has also been charged with numerous ethics violations. After the storming of the Capitol on Jan. 6 by Trump rioters Gaetz falsely claimed many of the rioters were not Trump supporters but Antifa followers masquerading as Trump supporters. From day one Gaetz has never deviated from his support for Trump. He is also a close associate of Roger Stone and Joel Greenberg, the latter being the former Seminole County, FL tax collector. Greenberg had to resign after he was arrested and charged with child sex trafficking of girls as young as 14. Sounds like Jeffrey Epstein redux! This prompted a separate criminal investigation into allegations Gaetz had sex with a 17 female teenager. What is it about politicians that they think sex with underage girls is just a perk that goes with the office? Just to be clear. This is the same Matt Gaetz you are now defending?

    On a positive note I just received my second covid vaccine shot. I should acknowledge that I owe this to Donald Trump who single-handily accelerated the production and distribution of the vaccine. At least that is what the Trumpster claims. He recently said that without his Herculean efforts the vaccine would not have been available for 5 years. So naturally I am grateful. Now that I am fully vaccinated I decided to celebrate by inviting a friend to have “churros” ( the long fluted Mexican sugar coated pastry) at our favorite “pasteleria” (Mexican pastry shop). This bakery specializes in the famous Mexican layered cakes for weddings and birthdays– called “tres leches”. But after he started building his wall along the border I had second thoughts. What happens if we no longer have cheap labor. Our housekeeper, gardener and plumber are all from Mexico.     Astonishingly she described Floyd as a “small, slim man”. There go her powers of observation. Floyd was huge, strong, and easily bigger than the officers.

    She was combative and unhelpful at the scene of the arrest and during her testimony she was combative with the defense attorney AND the judge and the jury had to be sent out so the judge could admonish her on the record. I doubt that she, or any of the state’s witnesses thus far, have helped the state’s case and she may even have hurt it. Emotions are in evidence and not much else. If it keeps up the judge would be justified in granting a motion to dismiss for failure to present a prima facie case. He likely won’t. There is a mob waiting outside anxious to do the Septemberist Proceedings.

    To me she is a good example of one of the problems with affirmative action. This endomorph does not appear to be capable of performing the duties of a fire fighter. I have done them and I doubt she would last a full 24 hours without someone else helping her.

    Apart from her physical limitations, she seems to have a difficult personality and I shouldn’t be surprised if at some point when she has to be corrected by a supervisor she snaps back at him rather than simply learning from him.

    If she is reprimanded and alleges sexual discrimination the boss has a freebie for dealing with her. Not sexual discrimination. You are demanding too much because of your white privilege. Wokeness vs Wokeness.

        From 2015 to 2017, Ben was in Hawaii, working as the editor of Standup Paddle Magazine and Samata Magazine.

        As of September 2018, Ben is back in Santa Cruz, enjoying the fall weather, hoping to see someone he recognizes and working on a variety of projects for MERGE4, EnVont, The Local Malibu and a couple of books.

            1. Oh I still get lots of assignments but after 130 issues of a magazine and 25 books I’m tired of my own voice.

              So I help other people get their books written and published.

              And I just did a crossword puzzle for Nancy Pelosi’s 80th birthday.

              She got it yesterday and I hope she calls me and invites me to one of her deep state star chamber parties.
