Dr. Leana Wen, CNN analyst and Distinguished Fellow at the Fitzhugh Mullan Institute of Health Workforce Equity at George Washington University, has caused a stir due to her recent declaration on CNN that “it needs to be hard for people to remain unvaccinated.” With France implementing a mandatory “health pass” and private companies like Morgan Stanley requiring vaccinations for employees to return to work, we can expect more protests and challenges around the world. Those cases are likely to focus on whether mandatory requirements are based on medical or political imperatives. Wen’s comment is likely to be repeated in many filings as another case of “saying the quiet part out loud.” She appears to advocate measures defined to coerce people to take vaccinations due to the continuing refusal of a sizable number of people.
Wen is a well-known medical analyst and the former head of Planned Parenthood. She is a visiting professor at George Washington University.
Wen made clear that health measures should be used to make life hard for people who refuse the vaccine so that they yield to public demands: “[b]asically, we need to make getting vaccinated the easy choice.” In the Washington Post, Wen also called for “Biden to make the case for vaccine requirements.”
There is already open pressure from the White House on private companies to require vaccinations. Morgan Stanley responded by doing just that this week. They can likely do so. The most serious challenges could come from those with religious objections. However, even if they are allowed to work remotely, Morgan Stanley CEO James Gorman stated in July that “If you want to get paid New York rates, you work in New York. None of this, ‘I’m in Colorado…and getting paid like I’m sitting in New York City. Sorry, that doesn’t work.” The message could not be clearer that working remotely will come at a penalty.
The Biden White House is clearly concerned that making vaccines mandatory will cause not just court challenges but a public backlash. However, such mandatory programs have been upheld. As I discussed in a column last year, there is a 1905 case where the Supreme Court upheld a state mandatory vaccination program of school children for small pox in Massachusetts. In Jacobson v. Massachusetts (1905), the Court found that such programs are the quintessential state power rather than a federal power. It also held that “every well-ordered society charged with the duty of conserving the safety of its members the rights of the individual in respect of his liberty may at times, under the pressure of great dangers, be subjected to such restraint, to be enforced by reasonable regulations, as the safety of the general public may demand.” States are allowed to subject citizens to restraints to protect “general comfort, health, and prosperity of the State.”
The fear is that, as with social media companies carrying out censorship of political and social viewpoints, companies will now serve as surrogates for the state on vaccinations. The Administration would prefer to do precisely what Wen advocated: ratchet up the private penalties and difficulties for anyone who wants to remain unvaccinated.
The problem is when you have leading analysts arguing for such measures as coercive devices. While there is considerable deference on such matters, the courts could take note of such demands to make life hard on those who are not “getting with the program.”
As of July 11, a total of 159,266,536 Americans have been fully vaccinated. That is 48 percent of the country’s population. When you consider the extremely high rate of vaccination for those over 65, the percentage of adults under 65 is even smaller. Despite all of the press and bizarre reward systems, the government is clearly hitting a wall with many people declining the vaccines. (For the record, I took the vaccine and all of my family has been vaccinated).
That is a sizable number of voters and the Democrats are leery of openly forcing vaccines before the 2022 election. That is why the push is to make life more difficult through private companies. However, if these measures are viewed as designed to coerce, courts may be more scrutinizing of the public health necessity for the measures.
How and why am I being held responsible for the health and well-being of millions of people I do not know, nor will ever meet?
And IF I AM to be held responsible, then I demand they eat only whole foods, quit drinking and smoking, walk 3 miles a day, limit their screen time to 2 hours a day, and spend at least one hour a day outdoors in the sunlight.
Now if you will excuse me, after my cigarette break, I am driving down to McDonald’s for a number 3 combo meal, supersize it, diet coke.
When the federal govt wants to do something that it should not or is afraid of getting backlash, it is now pushing industry surrogates to do what it wants by coercive action.
First, we had unnecessary masks. Now that we are largely free of that except for medical offices, we have reached for medical coercion to get the vaccine.
This is a violation of “informed consent” because these vaccines are experimental.
Also, the world-renowned Cleveland Clinic did a study of 55,00 people . The results, released on June 8, found that those with Covid antibodies don’t need a vaccine.
Nevertheless, my doctor refused to give me a medical exemption. I tried 30 other doctors in my Medicare Advantage plan, but none gave medical exemptions.
The Cleveland Clinic can’t do virtual appointments with people in CA. and they charge $1,850 for a second opinion.
So, my choice is to get a religious exemption or present this material to my employer who demands vaccinations or medical or religious exceptions (exemptions).
With the pandemic winding down, it seems like a new way to gain control over people’s lives and health choices through industry pushing people to get a vaccine in order to work or travel.
We don’t know the long term effects of these vaccines. There are already several types of adverse reactions including heart problems for young men 12-20 taking a vaccine. There’s no need for young children to be vaccinated since their risk is extremely low.
By contrarian theory, whenever the majority is pushing us t do something, it’s normally right to do the opposite.
There are attorneys suing over these Experimental Gene Therapy “” Vaxxes”.
Robert Kennedy is working on the lawsuits involving Kids & Robert Barnes is working on the lawsuits involving adults.
The employers, Big Pharma & even the govt need to know from the people that they have Legal Exposure.
For example employers illegal coerce employees into taking these Gene Theropies & then they become injuried or die, at that point those employers can be sued & their Workers Comp Rates will be going through the roof.

I would like to make a comment that has nothing to do with the topic at hand because there is nowhere else to make the comment:
Due to a family emergency I had to fly cross country twice in a few weeks and of course me and the other millions of people that flew had to wear masks basically all day long. Now if let’s suppose there are a million people flying every day that will mean that at least 500,000 vaccinated people wil be forced to mask up for hours for no discernable reason. I assume that 500,000 people a day are not happy with Biden’s DC for this asinine mandate and it will be reflected in future polling and/or elections.
PS. For some reason on September 13th the mandate will end which begs the question, why is it dangerous on September 12th to fly maskless? This is your government at work.

There are stark differences between those two examples you posed. One doesn’t involve the spread of a highly contagious virus. The other is a personal decision that doesn’t send you to the hospital and incur costs.
The delta variant is more transmissible and it is affecting teens and younger adults more. The majority of people getting infected and going to the icu are those who are unvaccinated.
I wouldn’t be surprised if insurance companies started paying less for care if you end up in the hospital because of a perfectly preventable illness.
COVID tests are no longer free in some places and businesses will not cover time off if one gets sick from covid. In the end it will be much more expensive and possibly disrupt people’s lives because they are going to be forced to stay home for nearly two weeks without pay.
So yes you are perfectly free to refuse the vaccine, but I suspect it will be costly.

Actually not being vaccinated for covid will not be costly for most people. This is a virus with a 98.2 % survival rate overall and 99% survival rate under age 65. For those under 25 a person is more likely to die of a household accident of car crash.
Insurance companies are denying payment for some who had adverse effects after a covid vaccination since this is an experimental treatment after all.

No “vaccine” is needed when there are cures AKA Ivermectin or Quercetin (no prescription needed). The FDA says there are no FDA approved vaccines for Covid. It is illegal to force anyone to take any medication that is not FDA approved. Apparently our government doesn’t no the meaning of illegal.

In my first postdoc I was a subinvestigator for a vaccine clinical trial. I strongly support vaccines.
BUT… it needs to be remembered that giving jabs to adults who do not want them is assault. I oppose assault. Furthermore, the government has failed the public when it comes to informed consent on this issue. We are essentially in a global clinical trial for various vaccines. The risk: benefit ratio varies by age. Has anyone out there seen a plot of log(risk: benefit) versus age for any COVID vaccine? I haven’t. We have enough data now to generate this. The public has not clearly had such information presented in an easy to understand format such as this plot. If you ask a physician about the risks: benefits, the answer will be a very qualitative “Oh, the benefits greatly outweigh the risks.” That is most likely true for older adults, and I’ve been fully vaccinated myself. But there are risks. My wife’s cousin went from healthy to almost dead after taking the AstraZeneca vaccine in a matter of hours. My points are that (1) we’re in a global clinical trial of unapproved vaccines (yes, they are not FDA approved, only for emergency use), and (2) the government has failed the public in conveying quantitatively the risks versus the benefits according to age. The message that we need to make it hard to remain unvaccinated is the wrong message. The right message is to accurately present accurate information and abide by the ethical imperative of informed consent.

Maybe you could point out what the Govt rules are in running an Experimental Vaccine Program or even a FDA approved Vaccine when there are Viable Therapeutic Treatments with high Efficacy Rates?
I think the efficacy rate for a Therapeutic Treatment only had to be 5% & at that point it isn’t legal to use an Experimental Gene Therapy for a vaccine.
BTW: Last week I heard was reported the Gene Therapies killed more people then Dr Fauci & Bell Gates’ Bio-Weapon Covid 19.

James, you are exactly right. Now, I am prepared to believe that at least some of our senior public health bureaucrats are not stupid. So what accounts for their failure to collect the relevant information in a timely way, analyse it and publicise on an ongoing basis a risk/benefit assessment of the vaccines v Covid by age group?
Also, it is surprising to me that it could be lawful for any organisation, federal, state or private, to mandate the use of an experimental vaccine or penalise anyone for not taking it. I understand that in the case of the military, the President can waive the general rule that EUA treatments may not be made mandatory. But that seems to me to be very much a limited exception to what ought to be the general rule. Has anyone researched this question of law?
James– Very good comment! I know a number of medical people who have not been vaccinated for the reasons you articulated so well. Not long ago it was admitted that roughly half of the CDC staff had not been vaccinated and about the same percentage of Fauci’s staff. The reasons were not given but it is not unlikely that they were similar to the concerns you gave.
I would add that nobody knows the long term risks that come with the vaccines. Could there be autoimmune problems? Could the vaccine accelerate an underlying or hidden autoimmune progression? I know of one such death where that appears more likely than not. A patient (a relative) with a disease that usually progresses slowly crashed after getting the vaccine.
It is harder to make an informed decision when hateful politics has polluted everything. The same people (some here) who warned that HCQ and Ivermectin were dangerous and should never be used for Covid despite years of wide use of these drugs around the world with minimal side effects now demand that everyone take a jab that is not FDA approved and that has not undergone enough trials to estimate longer term risks. Meanwhile some of the vaccines appear to be causing graver side effects than HCQ or Ivermectin ever did.
Add to the mix that trust in government is justifiably at historic lows and I suspect a significant number of people will never risk this vaccination.

What is needed for herd immunity? The experts, despite 100’s of years of experience and data, cant seem to science out that specific percentage. Back in March the CDC said 80 million had contracted the virus and survived. Now what is that number? Added to the number of vaccinated? This is back of the envelope calculations, not some closely held state secret.
Last week the disaster of the moment was Missouri, cases going through the roof. Proof more vaccinations were required. Except when you look at the facts, deaths are unaware of the emergency, continue their downward trajectory.
Its the experts that are to fault of citizens doubting the agenda of the experts.
Upon entering the US Marine Corps this Marine was given multiple (lost count) injections via an aerogun. At that time there was scant fear concerning the inoculation’s since the government was making sure we were healthy enough to die for our country. That being said….

The elderly are the most at risk. Children under 18 are more at risk from the flu and pneumonia an automobile accidents and any number of other misfortunes. That leaves the people between the ages of 18 and 60 who need to be ‘coerced.’ But they also rarely die from the virus, so why should vaccines be mandatory for them, especially if 90 percent of those over 60 have been vaccinated?
