“Those People Will Pay”: Did Biden Just Prejudice the Border Investigation?

The comments of President Joe Biden on Friday left many of us surprised, if not stunned, when he appeared to announce a finding to the ongoing investigation into allegations that mounted Border patrol officers whipped or “strapped” Haitian migrants trying to enter the country. During the Trump Administration, many of us correctly chastised the President for crossing the line in discussing ongoing Justice Department investigations and calling for particular resolutions. The response to this inappropriate statement is more muted from the media but it should be no less concerning. Biden’s statements are clearly prejudicial to the investigation of the incident and should be corrected in the interests of a fair process for all involved.

If agents whipped migrants, they could not only lose their jobs but face criminal charges.

Many in the media, including on National Public Radio, have already reported as fact that the Border patrol agents were “whipping” migrants in the now familiar pictures. However, critics and agents have objected that the media is using still pictures and not the video that shows agents using their long reins to control the horses who were jittery near the water’s edge with people around them. The photographer himself says that the still photos are misleading and that he did not see any agent whipping any migrant.

Nevertheless, the call for an investigation was the right move particularly after Democratic leaders and Vice President Kamala Harris objected to the images as reminiscent the abuse of slavery.

Biden however announced both findings as well as the intended punishment before the investigation reached any conclusions:

“To see people treated like they did, horses barely running over, people being strapped – it’s outrageous. I promise you, those people will pay. There will be an investigation underway now and there will be consequences. There will be consequences.”

Presidents long resisted pressure to get them to comment on pending cases or investigations to avoid charges of undue influence or bias in the results. This is one such case. It was wrong for Biden to say what he did in promising punishment for agents before any investigation is complete. It sends a message to investigators about the expected conclusions of their work. It also suggests that a finding of no whipping or wrongdoing would contradict the President and would not be supported by the White House. That could present serious career issues for investigators. It is unfair to the agents. It is unfair to the investigators and it undermines the integrity of the investigation.

It seems to me that there are two separate issues here. The most discussed is whether migrants were in fact whipped or “strapped.”  Biden stated that they were indeed strapped, but many are now saying that that was not in fact true. The investigation will hopefully establish the truth, but now investigators may be concerns about embarrassing the President with any contrary finding.

The second issue is whether it is wise or appropriate to use mounted officers to block migrants. Most cities use mounted units to control crowds. People are more reluctant to confront a horse in comparison to an officer on foot. Police insist that the benefits of mounted units have been proven repeatedly and most countries deploy them to bar entry or control crowds.

Moreover, border agents maintain that horses are still the best way to traverse parts of the difficult terrain of the Southern border. Yet, they also can create dangerous moments like this one on the water’s edge for tired and unstable individuals seeking to enter. That is why the investigation is a useful step.

You cannot promise agents a fair and unbiased investigation when the President has already declared that they strapped migrants and will be punished. That is why Biden’s comments were clearly inappropriate and he should publicly withdraw them in the interests of preserving a fair process for all involved in this controversy.

          The comment from S. Meyer that I quoted strikes me as a breach of that policy, and he posts many personal attacks. Clearly the decision is up to Darren and Turley, but if it were up to me, I would give S. Meyer the same warning as was given to Jeff.

        Not so uneven.

        Enforcement appears to be tolerant of many types of expression, including those that are rude or emotional. I think I have been called rather rude things but I don’t complain. I prefer that to censorship.

        However, Darren has made a clear distinction between mere rudeness on the one hand and overt threats of harm or encouragements of self destruction. Most of us find that distinction reasonable.

        S. Meyer’s quoted comment expresses emotional despair consistent with the history of the destruction of members of his family by a vicious regime. Nothing in that comment expresses an intention to inflict harm on any other person [quite the opposite] and nothing in that statement expresses a desire for another person to harm himself.

        Perhaps your acquired nickname should change from Anonymous-TS to Anonymous the Sissy.

          An interesting comparison, seeing as how I have a DD214 under Honorable conditions and awarded the good conduct medal twice along with other medals, and more than a few highly positive reviews from my leadership.
          I personally am not keen on the level of rudeness, name calling etc. on this site. I just commented on a section of high interesting and discussion comments with you, S Meyer, Parier Rose, n.n and others.
          Like to see more of that.

        First, I would express my sympathy to Darren for having to peruse all these uncivil comments since I don’t believe AI can filter those sufficiently egregious personal attacks worthy of his attention. That’s a job I would not wish even on S.Meyer.

        Second, I wish I could review the exact wording of my post which triggered Darren’s warning, but since it has been deleted, I must work from memory which is no easy feat. I believe I stated I would *presume* that Oky1’s disappearance from here would mean that he is no longer physically “available” to contribute to this blog. I did say I would rejoice, but I I don’t think that is tantamount to “hoping for his death.” But I admit it’s too close for comfort, and a snarky comment I had some reservation to express which I now regret and for which I apologize.

        Third, I won’t appeal Darren’s decision to a higher court even though as the good professor hastens to point out in similar situations that there is often a lack of due process when there is NOT a “bright line” defining offending and non-offending speech. Everyone knows that I have been the recipient of many personal attacks- antisemitic ones as well. Sexual assault is so rife on the illegal immigration route that long before Trump was elected, HuffPo ran a piece on how mothers were sending their unaccompanied daughters with Plan B One Step to deal with the unwanted pregnancies from the inevitable rape. Why were they unaccompanied? Because unaccompanied minors were allowed to stay. Not even this level of rape, murder, and abuse was enough for Democrats to stop supporting illegal immigration.

        – Biden’s Administration claimed it would deport the 17,000 Haitian illegal immigrants, but it released them into the country, anyway. Unvetted. Untested for Covid. Unvaccinated. Haiti is a country infamous for rape and other violence against women, so one would think that the background checks of the legal immigration system would have been particularly important.

        It’s not words that matter; it’s actions. Judge by the fruits. Under Democrat leadership, we have throngs of illegal immigrations clogging the border, all saying that Biden invited them to come with his rhetoric. Biden said never before had a president told illegal immigrants not to come, which was a baldfaced lie ignored by a media fawning over ice cream.

        You can say all day long that your party does not support open borders. But it opposes all efforts to stop illegal immigration, its sanctuary cities protect convicted rapists and murderers from deportation, and even when a court orders deportation, the party argues that it took so long the illegal immigrants have established themselves in society so it’s unfair to deport them.

        In fact, I can’t find a single qualifier that would trigger a Democrat to want to deport anyone, ever. A duck can claim it’s an eagle, but if it walks like a duck, quacks like a duck, and looks like a duck, it’s a duck.

  14. I had an interesting thought: The Minnesota Supreme Court overturned Mohamed Noor’s third degree murder conviction but left intact his manslaughter conviction.

    NBC says: “The high court ruled that prosecutors did not prove that Noor had acted with a “depraved mind, without regard for human life,” which would be needed for the third-degree murder conviction.”

    I am not sure I agree with that conclusion, it sounds peculiar, but I haven’t reviewed the decision and I am not going to review it.

    What has occurred to me is that the court may be preparing the public battle space for overturning convictions in Officer Chauvin’s case. The justices can’t help but know that the trial was grossly unfair and that unless they cower before the mob–as the trial judge seemed to me to be doing–they will have to overturn at least part of the judgment.

    Now they can say that “Well we did something just like this with Mohamed Noor who is black.” That’s the kind of racial balancing we seem to need to do these days.

        Dogs can do amazing things with good training and a skilled handler.

        I do have horses. Horses used in law enforcement undergo significant desensitization training. You can’t just grab any horse and subject them to hostile crowds.

        The horses on the border looked like Quarter Horses. They were being used to block people from getting past them, kind of like a cutting horse at a ranch sorting. I never say any photos or video of any horses in the Border Patrol horse unit rearing or trampling anyone. I really wish people would stop conjecturing, out of fairness to the riders and their horses.

        Cutting horses are some of the most independent thinkers in equine sports. The rider indicates the calf to cut out, and then it’s all up to the horse. The rider just has to stay balanced.

        Here is an example of what a cutting horse can do. Around 1:06 is when the horse locks on to the calf the rider wants. The rider sits deep, puts his rein hand down and quiet, and lets the horse work. That horse’s chest will hit the dirt before he lets that calf past.

        Joe Biden will not control the border. He’s created a humanitarian nightmare. It might be up to the states to make the border impenetrable. With Democrats in power, we need riders like Gandalf, “You SHALL NOT Pass!” Only then will people go through the legal immigration system, in numbers we can support.
