Texas Sheriff Declares Undocumented Migrants “Crime Victims” to Secure Visas

Bexar County Sheriff Javier Salazar made national headlines by opening a criminal investigation into the recent flights arranged by Florida of undocumented migrants to Martha’s Vineyard.  I have previously written about the dubious claims of kidnapping and human trafficking made by figures like Hillary Clinton. Now, however, Salazar is certifying the roughly 50 individuals as “crime victims” despite the lack of any criminal charges in order to qualify them for visas.  While this is clearly not human trafficking, Salazar is working with immigration advocates to use a law designed to protect victims of human trafficking and other crimes, even before any such charge is brought by prosecutors. The move could be denounced as itself an inducement, even a political exploitation, of migrants who must cooperate with an investigation to qualify. Immigration advocates were only able to get three migrants to join the initial challenge.

Salazar opened a criminal investigation into Governor DeSantis based on the allegation that the Venezuelans were “lured under false premises” to leave the Migrant Resource Center in Bexar County to fly to Florida. Three filed a complaint against the state. Florida has responded with signed waivers by the migrants.

While no criminal charges have been filed, Salazar is working with Massachusetts immigration advocates seeking to secure “U visas” for the migrants based on their alleged status as victims of crime or witnesses to criminal acts. Given the small percentage of the migrants who joined the initial lawsuit, the inducement of the U Visa program could change the situation.

In order to qualify, the migrants must claim that, being given free passage to the East Coast, qualified as “substantial physical or mental abuse.” That would be highly challengeable, but it would be up to the Biden Administration.

Florida could object that Salazar is himself inducing the participation of the migrants by certifying U Visa for cooperating with the investigation. While he is suggesting that all 50 will be declared crime victims, they might be induce to support the claims to qualify under the program.

The U Visa program was created by Congress with the passage of the Victims of Trafficking and Violence Protection Act in October 2000. It is meant to enhance the ability of law enforcement agencies to investigate and prosecute cases of domestic violence, sexual assault, trafficking of noncitizens and other crimes. It also protects victims of crimes who have suffered substantial mental or physical abuse due to the crime. They are expected to assist law enforcement authorities in the investigation or prosecution of the criminal activity.

Under the program, eligibility requires that:

You have information about the criminal activity. If you are under the age of 16 or unable to provide information due to a disability, a parent, guardian, or next friend may possess the information about the crime on your behalf (see glossary for definition of ‘next friend’).

You were helpful, are helpful, or are likely to be helpful to law enforcement in the investigation or prosecution of the crime. If you are under the age of 16 or unable to provide information due to a disability, a parent, guardian, or next friend may assist law enforcement on your behalf.

Thus, the visa could be an inducement for the other migrants to join efforts by immigration advocates in Massachusetts who were only able to secure three migrants in the initial filing.

In most cases, the certification under the U Visa program before a charge is not particularly controversial. However, Salazar’s claims of crimes like human trafficking and kidnapping are, in my view, wildly off-base. There are other allegations of misuse of pandemic funds, though various blue states have been accused of similar violations.

The Biden Administration has launched an investigation through Treasury into the funds, but that is not likely to be a criminal matter. Moreover, Florida insists that it consulted with Treasury.

Salazar has had controversies as sheriff, including (ironically) improper transfers of inmates.

It is not clear if the Biden Administration will oppose giving these undocumented migrants visas, but the basis for the certification could be used as a major avenue for legalization of status by cooperating local law enforcement.

  1. Up here at Ground Zero on Cape Cod, a few miles from the “concentration camp-*” where they were-** kept after being deported from the Vineyard, this is causing a little confusion. We are keeping a list of about 10 open questions and this is a tangent off of the second of those questions:
    1. How much did Florida spend per person to house them temporarily, get them to the San Antonio airport, fly them to MVY, and then get them from MVY to downtown Edgartown, the social services center on the Vineyard
    2. How did all these aliens enter the United States and where had they been previously and for how long?
    — The previous tangents to question 2 related to TPS status for the Venezuelans (is it automatic? retroactive? meaningless unless you were here in March 2021?) and how many countries had the non Venezuelans passed through first that could have given them asylum (making them ineligible here)
    — The new tangent: the local press have all been reporting since day 1 that they were all already cleared through the asylum “credible threat” process and given hearing dates (which we all know won’t happen for years). If so, why would they want or need one of these U-Visas which appear to last 6 months
    3. Did they stay in a hotel all expenses paid, as claimed by this San Antonio sheriff, and was it for three days before the flight (or less?) giving some/all (at least those who did not go to the “concentration camp” at all – 15 est.?) time to make plans for their arrival in Massachusetts? Is that why not all joined the class action lawsuit or is there an even more interesting reason?
    4. Didn’t the aliens sign the waivers that have been published in both Spanish and English? Why does that not simply end all the rest of this malarkey
    5. Didn’t someone file a flight plan? Who? When? Why did MVY not know about it (supposedly Nantucket did on a similar flight last week that turned out not to include unlawfully or lawfully present aliens)?
    7. What was the Biden administration DHS’ involvement in this prior to boarding as alleged by a Boston immigration lawyer? Was it illegal? Was it in TX or FL?
    8. How many alien “families” are actually involved (looks like two, maybe three, from the photos and that all the rest were 20 something unattached males)
    9. Was Perla Huerta (his or her involvement is of course only alleged) “discharged from the Army” as stated by the New York Times or did he or she retire?
    10. Why did Governor Baker say about five times that the remaining aliens “volunteered” to go to the nearby “concentration camp?” Could they have decided to stay on the Vineyard? Was Baker afraid of being accused of coercing them to leave the Vineyard?

    *The barracks on the Massachusetts Military Reservation (unclear if former Air National Guard barracks not used for about 15 years or National Guard barracks still in use all the time) is as much a “concentration camp” as the ICE and HHS barracks where all the parentless teenagers were kept during the period when Trump was enforcing the immigration laws back in 2018
    **All have now reportedly left Cape Cod and even Massachusetts and have gone to wherever they planned to go when they agreed to the free flight to our off shore progressive paradise

  2. Border states are expected to handle over 2 million illegal border crossings a year, plus all the legal migration. Most of the illegals go to rural areas and poor communities. Wealthy democrats virtue signal, by calling those who live in border states racist xenophobe for calling for a secure border, yet they do not suffer the consequences of their policies.

    This hypocrisy was revealed when De Santis offered to fly homeless illegal immigrants, camped out in parking lots in the hot Texas summer, to wealthy Martha’s Vineyard. He received their signed consent, and provided multiple opportunities for them to decline. These illegal immigrants had been released into the US, and were free to travel anywhere in the country. They were sent to Martha’s Vineyard to bring national attention to the illegal immigration crisis, and because Martha’s Vineyard had immense resources to build housing, shelters, and to open their schools to provide a high quality education. Instead, the elites of Martha’s Vineyard panicked, called in the National Guard, declared a humanitarian crisis, and immediately sent them to a military base.

    To deflect criticism from their shameless hypocrisy, they have cried foul ever since. They have declared that flying them anywhere was illegal, which would make things a bit awkward for Joe Biden, who has been flying illegal immigrants to red states for the duration of his presidency. It would also create some difficulties for the people of Martha’s Vineyard, too, as they also sent illegal immigrants elsewhere.

    2 million illegals a year is not sustainable. The country’s support system will collapse and millions will go homeless. Open border and sanctuary city polices are destructive and irresponsible.

  4. Jonathan: The political stunt by DeSantis is having both legal and political consequences. Trump is mad at the FL governor because it was the former president’s idea to send migrants to “Democratic sanctuary cities”. Fortunately, WH lawyers talked Trump out of the idea. DeSantis and Abbott simply picked up where Trump left off. What you omit from your post is the fact that DeSantis illegally used money from the $12 million fund the FL legislature set aside to remove migrants “from Florida”. That was the language in the legislation. Instead, DeSantis flew the Venezuelan migrants out of Texas. A lot of people are upset by DeSantis’ flagrant violation of the fund. Notice that DeSantis has not repeated his inhumane stunt. Probably because it would be unseemly for him to keep using money for an unlawful purpose when FL citizens are suffering from Hurricane Ian.     Trump lost his appeal to the SC over his claims over the Mar-a-Lago docs and it appears the 11th Circuit is about to knock Judge Cannon, Trump’s appointee, on her backside. Then this week the Jan.6 panel issued a subpoena for Trump to testify. So what is Trump doing in response? What he does best–more funding raising scams. As his legal fees keep piling up Trump is using money from his “Save America” PAC tp pay his lawyers. The PAC has taken in about $250 million that was supposed to go to an “election defense fund”. For those who donated to “Save America” they were promised all sorts of added benefits–trinkets, awards and membership cards. All proved to be worthless. Sorry guys, if you donated and received a gold plated “Trump’s Inner Friend Circle” card–that resembles a credit card–you can’t use it at the Trump Tower bar!

    But Trump’s daunting ability to raise a lot of money is running into problems. Bloomberg is reporting that Trump raised $24 million in the third quarter–but he spent $22 million to do it. Trump spent 91 cents to raise every dollar–a high-cost, low margin fundraising effort. Since he lost the 2020 election Trump raised an astounding $387 million–but little of that money is going to support his party’s candidates this year. Trump has endorsed 280 GOP candidates but “Save America” has given only $910,500, spread among 181 candidates–at a time when they are being out raised by the Dems. Sorry MAGA donors. Trump needs that money for lawyers to represent him in the 20 lawsuits he faces.

    Finally, in an effort to avoid the lawsuit by NY AG Letitia James, Trump has formed a new company “Trump Organization II”–on the same day James sued the Trump Organization. James has asked the NY Supreme Court to prevent Trump from moving his assets into the new entity. Of course, this is what criminals do. They create a new business with the same criminal operating it. I doubt the NY SC will approve such a fraudulent conveyance–with no other purpose than to avoid legal liability. But I suspect Trump will try more of this to protect his criminal enterprise.

  6. First, Bexar County is an island of Democrats in a Republican state. Second, it is in TEXAS, not Florida. Salazar has no authority over Florida officials. In short, this is a political stunt. Third, as far as I know, none of the illegals sent to New York, Chicago and DC came from Bexar County. I don’t know if Salazar is up for reelection or not since I don’t live in Bexar County but I suspect he’s attempting to help Beto, who has a snowball’s chance.

  7. My guess is this sheriff is part of the cartels who are transporting these illegals and he is getting paid off to facilitate the illegal entry of these immigrants. He may also be making money off of the illegal drugs, weapons, and sex trafficking that these cartels bring to our country. Sheriff Salazar needs to be put o administrative leave and investigated for his role in these potentially illicit activities.

    There is no requirement that charges be filed in order to justify a U Visa. 8 CFR § 214.14 clarifies that “investigation or prosecution” includes even details leading to the “detection” of a qualifying crime. Given the deception used in luring these migrants, there is absolutely enough to justify seeking more information to determine whether criminal charges should be brought.

      1. Did you read the waiver that was given to the migrants? The English and Spanish versions are not the same. Find the word “Massachusetts” in the Spanish version. What legitimate purpose could they have to have different waivers in each language?

        Also the brochure for inapplicable benefits was clearly deceptive.

Cool temps, gorgeous reds, gold, yellow, green, breathtaking views of mountains and valleys from 2500-3000 feet elevation. It was like being in God’s Hands, telling us, “see how I love you”, blessing us with His power and creation, as the leaves whimsically fell on the highway. Just Stunning. People along the stops seemed so much more pleasant and deferrential towards each other. We took many photos and thought of you.

  12. It’s all about leverage. I suspect that if the Republicans win the House or Senate or both, this problem will disappear. Because if the Republicans want to play hardball right back then I think all legislation will cease and probably no new appointees will be confirmed (if the Republicans win the senate) unless this stops. Two can play this game. San Antonio might also find themselves short of Federal Funds. Mitch McConnell might fold but Mitch may no longer have the freedom to fold that he once had. Many of his votes have retired. It’s about time to prune a lot of funding for NGO’s and “non profits” and maybe also time for some investigations into many of them and their donors. Also time to corral the “sue and settle” program that was so popular with Obama and now again with Biden. Justice Dept also needs funding. I like to play rough for a good cause. Boardroom brawls leave bruises and marks even if you can’t see them. Been in a few. Shareholder meetings with Doctors can be a brawl. Not much empathy and understanding there but very vicious. And if sending 50 illegal immigrants to Martha’s Vineyard constitutes “substantial mental or physical abuse,” then the Dems have succeeded in downgrading and trivializing the whole concept of “abuse.” The next “investigation” ought to then be into Biden’s flights of immigrants around the country in the middle of the night; the Martha’s Vineyard wealthy shipping out of migrants to an alternative site within 48 hours of their arrival; the Democratic mayor of El Paso’s flights of illegals to various cities, etc. It’s telling that the lawsuits didn’t start flying until the wealthy were threatened with migrants in their backyard.

    1. On 9/16/22, Senator Ed Markey (D-MA) and five other Honorables asked Departnent of Treasury (DoT) for an investigation.
    2. Sheriff Javier Salazar (Bexar County, TX) noted that the migrants, have legal rights to pursue asylum claims.
    3. On 10/7/22, Richard Delmar, Deputy IG of DoT, confirmed planned investigations. [1]
    4. Salazar certified that as they were victims of a crime, they are allowed to apply for U visas.
    5. On behalf of migrants “Lawyers of Civil Rights”, Boston, MA [2] have filed a federal class action lawsuit suit against Govenor Ron DeSantis (R-FL) and other officials.
    6. Florida Sen. Jason Pizzo (D) has also filed a lawsuit in Tallahassee’s state court in Tallahassee because the migrants were not in Florida at the time. The Legislature authorized $12 million for the relocation program that specifically cites migrants within Florida borders. [3]

    Common sense has it that an unnecessary detour and stop at CEW (to pick up document) as the only Floridian aspect doesn’t qualify for anything.

    2. Thanks for the article. The government frequently does things to injure law abiding citizens. This is one more way. I hope if the Republicans win, they will make sure all of the soldiers have the unjustified entry removed. If not Trump will do so. If not Trump DeSantis will do so.
