Turley Testifies on Censorship Before House Select Subcommittee

This afternoon I will testify at the first hearing of the Select Subcommittee on the Weaponization of the Federal Government. Below is my written testimony.

The Twitter Files raise serious questions of whether the United States government is now a partner in what may be the largest censorship system in our history. The involvement cuts across the Executive Branch, with confirmed coordination with agencies ranging from the CDC to the CIA. Even based on our limited knowledge, the size of this censorship system is breathtaking, and we only know of a fraction of its operations through the Twitter Files. Twitter has 450 million active users but it is still only ranked 15th in the number of users, after companies such as Facebook, Instagram, TikTok, Snapchat, and Pinterest. The assumption is that the government censorship program dovetailed with these other companies, which continue to refuse to share past communications or work with the government. Assuming that these efforts extended to these larger platforms, it is a government-supported censorship system that is unparalleled in history.

Regardless of how one comes out on the constitutional ramifications of the government’s role in the censorship system, there should not be debate over the dangers that it presents to our democracy. The United States government may be outsourcing censorship, but the impact is still inimical to free speech values that define our country.

It is my sincere hope that there is room for bipartisan agreement on exposing the past government involvement in censorship systems implemented by social media companies.

I also believe that we can have a civil and substantive discussion of these important questions. Despite our political divisions, we share a common article of faith in our Constitution. These are difficult questions arising as a very divisive time for our country. However, there are issues here that should transcend partisan politics as we work through the proper role of government in regulating speech. I look forward to joining these distinguished panelists.

    In my mind, nothing.
    It’s all about what position Big Tech and Big Information” decide to do about it. I am not holding my breath.

  2. THE SINGULAR AMERICAN FAILURE HAS BEEN AND REMAINS THE JUDICIAL BRANCH, WITH EMPHASIS ON THE SUPREME COURT

    Under the Constitution and 1st Amendment Freedom of Speech, censorship is unconstitutional.

    Under the Constitution and 5th Amendment absolute Right to Private Property, only the owner may “claim and exercise” dominion; censorship on private property is constitutional.

    If the right to private property is not absolute, there is no right to private property and all property is public.

    There is an absolute right to private property in the 5th Amendment.

    The judicial branch must fulfill is sworn-oath duty and support the “manifest tenor” of the Constitution.

    The judicial branch has no power to amend the Constitution, legislate, modify legislation or modify legislation through “interpretation.”

    Members of the judicial branch who fail to support the Constitution must be impeached and convicted.

    I wish you were correct in this comment but I remember the Patriot Act passing when republicans were in control only to get renewed as is when democrats controlled all 3 branches of government. I heard my Rep Raskin unequivocally support censorship during the Twitter hearings. It appears to me the common faith is to trample those Constitutional freedoms as much as possible.

    It’s undeniable that government cannot use a private sector entity to do its bidding as a way to get around the constraints imposed on the government by the constitution.

  5. My question is: why in the world would any serious Congressional committee have Turley, a paid hack for Fox, testify? Testify about WHAT? Turley doesn’t have any actual, first-hand knowledge about any facts PROVING there is “censorship by proxy”, which is a Fox theme Turley is paid to promote. But, do the disciples understand this distinction or even care? Read the posts on this blog by the faithful disciples: of course not–they take as proven fact that the government is censoring social media by proxy because Fox pundits say so, just like they believed Trump’s vainglorious “landslide victory” was “stolen”. They also believe that Republican members of Congress never proposed cutting or sunsetting Social Security, Medicare, Medicaid or food stamps, even though there are videos and campaign brochures proving that they did make such proposals. No proof of facts is necessary for the disciples, and that is the true threat to American democracy–lack of critical thinking and vulnerability to lies. I wrote down the following weasel-words used in Turley’s little toilet piece above that bear out the simple case that he has NO facts, and that he is “testifying” based on assumptions, which would not be allowed in any actual court setting: “may be”, “limiited knowledge”, “the assumption is”, “assuming that”,”the government MAY BE outsourcing censorship”. Because Turley doesn’t have any factual proof that such censorship is happening, of what use or value would his testimony be? He’s just a paid hack who trades on his credentials. Nothing he has to say has any probative value.

    In other time and taxpayer money wasting Congressional House Committee news, yesterday it was revealed that the only POTUS who asked Twitter to remove posts was Donald J. Trump. An allegedly offensive tweet that came before the Committe was part of some urinating contest he started with Chrissy Tiegen, wife of John Legend, in which he called her names, and she replied by callling him: “puxxy axx bi*tch”. That description of him is in the official records of Congress, and will stay there for all eternity. You go girl!

      1. Turley is a PAID HACK employed by a media outlet that peddles lies and conspiracy theories. Nothing Turley can ever say will change the fundamental fact that Twitter, Facebook, etc. are PRIVATE COMPANIES and their customers use their platform based on a contract called “terms of service”. They are not the government, and if you violate their terms of serivce, you can get kicked off. It’s as siimple as that. Tweets are not protected by the First Amendment. Turley knows that, and he also knows that the faithful disciples don’t understand this and believe all of the conspiracy theories and misinformation put out by his employer.

          This new committee has two years to get this right. The Dems should have set up a similar committee after 9/11, but failed to do so.       He testifies on issues of constitutional law.
      He has an excellent track record.
      Democrats called him to testify at the Clinton impeachment.
      Republicans called him to testify at the Trump impeachments.

      Turley is slowly getting red pilled – but that is because the left and democratic party have become so incredibly illiberal.

One study found that getting the Flu vaccine STRONG correlated as effective at preventing Pneumonia – BEFORE getting the Flu vaccine. Essentially what they discovered is that those least likely to get the Flu and Pneumonia are the ones getting vaccinated.

      And just to be Clear – Fauxi and company KNEW that Before Covid.

      So that IO am clear – they did NOT Know the mRNA vaccines would not work – there is a sound basis for beleiving that mRNA vaccines MIGHT be different. But We – They – Fauxi – KNEW that was False likely by Feb 2021.

      There is even preliminary Data indicating that NO, the Vaccines do not reduce your likelyhood of serious infection or death.

      And we have idiots from Twitter testifying that she sought to get Trump banned for months – because – She alone was able to truly understand his Dog whistles and Coded speech.

      But I doubt you are sane enough to understand how absurd that lie is.

      Regardless, I will fully support a “bill of impeachment” against EVERY current and former government official that is subject to impeachment, that permanetly barrs them from public service ever again.

      Democrat, Republican. Lets run it through the house and to the Senate.

      The standard is simple – any communication to Social Media or regular media asking them to block, ban, flag or in any way disfavor speech that is protected under the first amendment – that is everything but SOME Obscentiy and immediate incitements to violence.
      Or documented communication to someone else in govenrment requesting them to seek censorship.

      Everyone who did so gets treated the same – Republican, Democrat. President, down through absolutely anyone in govenrment that can be impeached.

      I am using imperachment for two reasons.

      Impeachment is the only constitutional means to bar someone from seeking office int he future.
      Impeachment only requires the house and senate.

      Separately any non-impeachable member of Government whao has done this MUST be fired. But that requires a law signed by whoever is president when the dust settles.

  10. I sure hope some of these representatives still believe in the First Amendment because we know some do not, Mr. Schiff et al. If we had a real DOJ, there would be investigations into the denial of Constitutional rights.

  11. Most government employees are probably good people trying to be good public servants, so the focus should be primarily on constitutionalizing the “system”.

    Agency top-management are the real villains here not constitutionalizing these “systems”. One of the most fatal mistakes agency managers make is allowing “Guilt By Association” – strictly illegal for any government official under the First Amendment and their Oath of Office (where they make a promise to GOD to uphold the U.S. Constitution in their job authority).

    For example: 99% of gun owners are law abiding and non-violent. 99% of both Trump and Biden supporters are law abiding and non-violent. Guilt by Association is not only disloyal and illegal, but a highly inaccurate investigative tactic.

    An agency manager can’t take the less than 1% of violent or dangerous people in any organization of 99% non-violent and law abiding, then use those handful of people to stereotype an entire group to perform illegal surveillance/searches.

    Throughout American history, this type of “Guilt By Association” has been used against women, LGBT-Americans, African-Americans, Democrats, Republicans, gun owners, environmentalists, animal rights activists or any group. LGBT-Americans were once viewed as “mentally defective” by the federal government and investigated by the DOJ/FBI.

    These types of illegal government practices are largely performed “Covertly” so voters can’t connect cause & effect – so voters can’t self-govern.

    Simply requiring “overt” disclosure of these illegal practices would not only let the voters decide, but would also deter many of the abuses in the first place. If a Bush era interrogators knew they would one day face their torture victims in front of a judge, they would have behaved much differently back then. Simply being “covert” also allowed material evidence to be lost making justice nearly impossible (ie: witness memories, cell phone records, email records, defendants/witnesses that died over the past 20 years, etc). The DOJ effectively destroyed most war crime evidence since 9/11 simply by running out the clock.

    When the agency top-management allows it’s employees to be disloyal to their own Oath of Office, it destroys the integrity of the institutions themselves.

    Even when these otherwise “good” bureaucrats realize they made mistakes (destroying innocent Americans) – they simply walk away from their victims. Never apologizing or making amends.

    The old saying “the road to hell is paved with good intentions” is a great narrative of how these “systems” destroy innocent Americans. This all starts with “covert” censorship, covert warrantless surveillance and covert warrantless search & seizure!

    Former Nuremberg prosecutor and U.S. Supreme Court Justice/AG, Robert Jackson, believed that “arbitrary search & seizure” was the foundation for tyranny. Jackson said this in part not just because he convicted Nazis, because years earlier the U.S. government itself placed U.S. citizens into detention camps that happened to be of Japanese descent. For some reason this didn’t happen to U.S. citizens of German descent during WW2.

    Jackson prosecuted and hanged Nazis war criminals following World War Two and he viewed arbitrary surveillance and searches as the most dangerous practice of any government official. It allows an investigator to nose around in a private citizen’s personal business, with no evidence of a past crime. Although every American investigator swears a constitutional Oath of Office, top agency managers give “unconstitutional” orders to their subordinate employees/contractors to do things like censor or perform warrantless domestic surveillance.

    1. I think 9/11 came at an unfortunate time — just as the digital age and technology made a global surveillance state a possibility. We, maybe not you, but certainly I, turned a blind eye to the creation of this global surveillance state during the Bush years, because the abuses were directed at Muslims and mostly foreign Muslims who may have been engaged in terror plots. I ignored the Snowdens and Assanges. I was willing to look the other way, put aside my classical liberal tendencies, ignore violations of civil liberties, because I feared a resurgent Muslim world and wanted revenge for 9/11. We, again I, was short sighted. I never imaged that during the Obama administration that that global surveillance state would be turned against the administration’s domestic political enemies. But here we are. My bad.

We may be too far gone. Many will hear your words, but will not listen, assuming you are a toady of Putin or are carrying Vladimir’s water. As you point out in your statement, our nation has gone down dark roads like this before, like during the McCarthyism times, however, never during the digital age, with the seeming universal acceptance by media, big tech, big corporations, academia, law enforcement, the intelligence community, and government bureaucracies.     Comforting thought but probably not true.

    As leftist Ezra Klein has said, it’s old [therefore bad we must assume] and hard to understand [likely true in his case]. Too many on the left think the same way. How could they not emerging from our decayed educational systems?

  14. A big factor in all unconstitutional practices, is a clearly flawed interpretation of the “Supremacy Clause” clearly worded under Article VI (Section 2) of the U.S. Constitution.

    Article VI clearly makes the “U.S. Constitution” the supreme law of the land, not any government agency.

    The problem with this flawed interpretation (current practice today), is it removes checks & balances from the federal level when executive branch agencies violate the U.S. Constitution.

    For example: there is no deterrent on the DOJ/FBI’s “Cointelpro” tactics, no deterrent on torture or war crimes by the federal officials/contractors. There is no deterrent on a federal immigration agency declaring 100 miles of any U.S. border a “No Constitution Zone” (lawless zone that covers the majority of the U.S. population). In this zone no American has any constitutional rights.

    It’s the same mindset that allows government-driven censorship. The U.S. Constitution is no longer “supreme” under the Supremacy Clause – federal officials are essentially kings with unlimited authority.

    LOL! They don’t raise the question. The Twitter Files answer the question with a resounding “Yes!”
