Friendly Fire: Dan Goldman Demolishes the Biden Defense in Whistleblower Hearing

Below is my column in the New York Post on one of the most damaging moments in yesterday’s hearing on the IRS whistleblowers alleging special treatment for Hunter Biden in their criminal investigation. What was most remarkable was not just the content but the cause of the incriminating statement. Rep. Dan Goldman’s friendly fire incident produced Dresden-level damage for the Biden defense.

Here is the column:

One of the most basic lessons that we teach law students is that you should “never ask a question you don’t know the answer to.”

The peril of the poorly crafted question was on display in Wednesday’s hearing with two whistleblowers on political interference in the Hunter Biden investigation.

Most Democrats avoided any questions on the substance of the allegations, focusing instead on everything from systemic racism to the use of the term “two-tiered system of justice” and, of course, Donald Trump.

Rep. Dan Goldman (D-N.Y.) often goes where wiser members fear to tread. On this occasion, Goldman may have delivered one of the most damaging moments for the Democrats.

In the course of just a few minutes, the freshman New York congressman seemed to demolish the defense of President Biden.

Goldman was trying to get the witnesses to say that there is no evidence that President Biden was personally involved in the alleged felonies of his son.

He raised the shocking WhatsApp message that Hunter had allegedly sent to a Chinese official with foreign intelligence contacts. In the message, Hunter wrote:

“I am sitting here with my father and we would like to understand why the commitment made has not been fulfilled. Tell the director that I would like to resolve this now before it gets out of hand, and now means tonight. And, Z, if I get a call or text from anyone involved in this other than you, Zhang, or the chairman, I will make certain that between the man sitting next to me and every person he knows and my ability to forever hold a grudge that you will regret not following my direction. I am sitting here waiting for the call with my father.”

Most Democrats have avoided the message, which is incredibly damaging and seems to contradict the President’s long denial of any knowledge or involvement in his son’s dealings.

Goldman pressed veteran IRS investigator Gary Shapley about his suggestion that Joe Biden discussed the foreign dealing with his son. Shapley eagerly said that he would be happy to explain but Goldman cut him off and said that he did not have time for such explanations.

At this point, most lawyers would have reversed engines out of troubled waters, but Goldman plowed full speed ahead.  He said that the references to Joe sitting next to his son does not mean that they actually discussed his business.

Goldman then went even further and raised a “lunch where Joe Biden came to say hello at the Four Season’s hotel to a lunch that he was having with CEFC executives.” He then reads from the record in how Biden associate Rob Walker described the origins of the meeting with the Chinese officials to get his dad to stop by: “Hunter told his Dad that ‘I may be trying to start a company or try to do something with these guys.’ “

Goldman then pounced and said slyly “Now let me ask you something, that doesn’t sound much like Joe Biden was involved in whatever Hunter was doing with the CEFC if Hunter Biden is telling him that he is trying to do business with them, does it?”

That is when Shapley stated the obvious: “No, but it does show that he told his father that he was trying to do business and . . . ”

Goldman finally hears the train whistle and tries to get off the track: “OK, well that is true that Hunter Biden does try to do business, that is correct.”

Too late. Goldman was citing the testimony of Walker that Joe Biden not only came to a lunch on Hunter’s foreign dealings, but did so after being told that Hunter wanted to lay the foundation for such a deal.

This is the same Joe Biden who has repeatedly told the American people that he never discussed any of Hunter’s deals and had no knowledge of such deals. He has maintained that denial as evidence has mounted contradicting him. Even when he flew his son to China where Hunter cut lucrative deals, he insists that they never mentioned that deal.

There are also repeated references to President Biden as the “Big Guy” in emails who was to receive a 10 percent cut on a deal with the Chinese as well as other benefits. There are other references to Hunter Biden paying portions of his father’s expenses and taxes.

People apparently were told to avoid directly referring to President Biden. In one email, Hunter’s business associate Tony Bobulinski was instructed by Biden associate James Gilliar not to speak of the former veep’s connection to any transactions: “Don’t mention Joe being involved, it’s only when u [sic] are face to face, I know u [sic] know that but they are paranoid.” Bobulinski gave testimony that he met with Joe Biden and discussed these deals with him.

There are also the disclosures that Biden met with at least 14 of Hunter’s business associates from the US, Mexico, Ukraine, China and Kazakhstan over the course of his vice presidency.

Then there is the audiotape message from President Biden for Hunter that specifically discussed coverage of those dealings.

Finally, there is another audiotape of his uncle, Jim Biden, telling Hunter that he and his father had discussed his collapsing financial position and could arrange a “safe harbor.”

The culmination of this evidence was Goldman matter-of-factly eliciting testimony on how Joe Biden came to a lunch with Chinese businessmen after being expressly told it was meant to cut new business deals with them. His son was even thinking of creating a corporation with the Chinese despite a glaring lack of expertise for such a venture.

The meeting was previously described by witnesses and discussed by these whistleblowers, but Goldman brought it all together at the end of the hearing.

Unfortunately, that is when Goldman’s time ran out.

A few more minutes and we might have had an open-and-shut case for the appointment of a special counsel.

  1. We already have an open and shut case for a large number of special counsel apointments.
    There was more than enough for that at the conclusion of Trump;s term.

    It was clear at that time that the DOJ/FBI/IRS had pending investigations that potentially touched on the president elect.

    The purpose of a special counsel is to investigate where there is a conflict of interest involving the DOJ and/or the white house.
    That was already present.

    At this time no one wants a Special Counsel. For democrats that is practically an admission that Biden is corrupt.
    For republicans that allows the DOJ to redouble their efforts to stonewall – using the “ongoing investigation” nonsense on steriods.

    At this time the right answer is for The House to continue as it is, making everything public.
    And let us all be the judge.

    Joe Biden is not likely to be impeached and certainly not removed.
    He is not ever going to face prosecution or even the credible threat of prosecution.

    Honestly very very few people want that.

      1. We are debating political strategy – not the merits of the cases. There is a very large number of people in the current administration that should be impeached.

        But the reality is that will go nowhere.
        Nor will criminal referals to DOJ for lying to congress.

        Therefore the house should remain focused on what it is already doing – bringing more and more and more to light of the criminal and political corruption of this administration and its supporters.

        Startegically the goal of the house should NOT be the removal of anyone – that is NOT happening and we all know it and would do no good if it did.

        T%he house SHOULD and in fact MUST start an impeachment. But it should pick the target that give them the broadest grounds to fuirther investigate – and that target is Garland. Garland is in a pivotal position in ALL the nonsense going on.
        He is at the center of the probes of Trump, He is at the center of the probes of parents of school children of catholics, of failure to prosecute those targeting supreme court justices, of protecting Hunter Biden, of political corruption of all kinds.

        Starting an impeachment inquiry into Garland will result in Garland legitimately refusing to cooperate with the house – the fifth amendment does not mean you do not have to testify to your own guilt. It means you can nolt be forced to testify in investigations of you.

        But EVERYONE ELSE will have to testify. An impeachment inquiry into Garland “trumps” the executives favorite claim about ongoing investigations.
        Allegations of criminal malfeasance by the US AG are far more important than the FBI investigation of Hunter Biden’s taxes.

        Regardless, an impeachment inquiry into Garland brings EVERYTHING infront of the house in a way that the executive can not refuse to cooperate.

        It also makes clear to the american people the seriousness of the issue. Of ALL issues.

        Further this should NOT be a short investigation – there is no need to vote on impeaching Garland for atleast a year.

        There are only two reasons to actually impeach anyone right now. To send a message, and to tie up the senate in an impeachment trial.

        The reason for not impeaching a long list of others – is because you WANT those others to be scared of being impeached too, and you want them to be thinking about their own interests and the possibility that they need to cooperate with the house rather than hinder them.
        You want the same from less significant people in the executive – you want US attorney’s and US Assistant attorney’s and staffers to be thinking about their own future and their own risks as they testify.

        Biden and Garland made a huge mistake at the start of Biden’s presidency.
        That mistake was npot appointing a friedly Special Counsel to investigate all their malfeasance.

        That would have been the biggest roadblock to congressional investigation.
        Now it is too late. Any SC appointement would be viewed as political and would further undermine DOJ and FBI and Smith – who has no credibility as things are.

        Regardless, the strategic objective is to create the broadest possible oportunity to KEEP INVESTIGATING.

        More will come to light. The stories we are seeing are not going away – they are just going to get worse and worse.

        The foal is to go into the 2024 election cycle with the econopmy in recession – the house has no control over that – but it is happening regardless,
        And in all possible ways democrats looking as criminally and pollitically corrupt as possible.

        Not a few democrats – but ALL democrats.

        House democrats are doing themselves no favors impeding house republicans.

        The damage done to republicans bny Nixon was shortlived and small – because Republicans as a whole were not participating in covering up his misconduct.

        Democrats are already up to their necks in all the Biden scandals.

        The goal of house republicans is to bring the truth out and let the public see things as they are.

        Let democrats and the media play whatever games they want – they are harming themselves.
        In fact FEATURE them.

        I would further note that House republicans should GO SLOW. This is along game.
        The objective is NOT to knock Joe Biden out of the presidential race NOW.
        The objective is not even Joe Biden – he is just the Tar Baby that everything and everyone sticks too.
        The Target is not Biden – it is the entire left, most of the democratic party, the media.

        The objective is to shine the light where there has been darkness.

  2. One point that needs to be stressed as we “follow the money” is why did Obama put Biden in charge of the Ukraine portfolio? Does anyone think that Obama didn’t know that Biden was making $10 million off of Ukrainian interests? Now to extrapolate further we must ask that since Obama knew Biden and his little creepy kid were making TEN MILLION DOLLARS off of Ukraine doesn’t it make sense that maybe Obama skimmed a little off of the top?

  4. Watching the House hearing yesterday, it was so obvious nobody there sees their primary role as legislator — otherwise, they’d be asking experts “You’ve been studying financial crimes — how easy is it to bribe a US Official without breaking the law?”

    These are the responsibilities so visibly being shirked by both parties — closing loopholes in current law. For these performative actors, the work in Congress is primarily centered on winning the next election, and raising funds toward that goal. The Peoples’ business in keeping the law up-to-date and effective (our interest in good government) is way down the list. That was so obvious yesterday.

    1. FARA was never prosecuted until Trump, they worked on the dishonorable system whereby if any complaint rose to public prominence refining the paperwork was sufficient.
      Also, what is the Congress to do when all criminal activity documents , reports, and asks for prosecution were there, and yet those actions were stopped against demoncrats and the bidumb regime ?
      Further, it takes a year to get the executive branch agencies to do basic redacted non cooperation, so whistle blowers have to come forward because as they testify, the culture is hard core shut your mouth we are protecting demoncrats.
      Alternate real news like James O’Keefe has to go undercover and show the words from the very mouths of corruption while they’re on their bar dates to get things rolling. Or whistle blowers flee overseas after all the lies they expose, or wind up in prison for a decade plus.
      The laws are obviously fine, it’s the criminals in the agencies that are not.
      The demoncrats have been pushing job security, unionization of government, and endless red tape when it comes to discipline and also the we can’t talk about it excuse is ever present, so all criminal gov committee witnesses under the gun say far less than we have from alternate news sources already.       They don’t follow the laws we already have. They allow massive criminal misconduct in their government agencies. They attack every whistleblower who exposes it unless it’s lying demoncrats spewing their BS at Trump, then they count on filthy demoncrats and the useful idiots of the public to turn nothing into a federal offense and claim it stands tall and is regular order.

Jonathan: No. The “most damaging moment” in yesterday’s MAGA Republican Oversight Committee hearing was not Dan Goldman’s cross of the alleged “whistleblower’s” testimony but rather the bizarre and uncalled for performance of Marjorie Taylor Greene. In case you missed it, MTG held up an enlarged photo of naked Hunter Biden apparently performing a sex act. That’s right. MTG was accusing Hunter of “pornography”–and maybe illegally transporting minors interstate to perform sex. All sorts of bizarre claims. The photo of Hunter displayed by MTG drew a lot of audible gasps from the hearing spectators present. This was MTG’s voyeuristic attempt to divert attention away from the fact that MAGA Republicans in the House have come up with nothing, nada–in the way of credible evidence that either Hunter or his dad were involved in bribery schemes or other criminal activity. It was a new low in the history of House hearings. But MTG appeared to enjoy looking at Hunter naked and showing and showing the enlarged photo to those assembled. She will probably take the enlarged photo home with her.

    Now the guy or gal I feel sorry for is the intern tasked with the job of selecting which of Hunter’s naked photos to blow up and put on that poster board. I can imagine the intern saying to him or herself: “What am I doing here? I didn’t sign up for this!” MTG’s low and despicable performance pretty much sums up what we can expect for the MAGA Republicans in the House investigation of the Biden family. There is nothing they won’t stoop to in their witch hunt and they will call upon the raving maniac MTG to supply the dirt!

Merrick Garland was quite clear that we had a Trump appointee who had full authority. Specifically, he had full authority….to ask for full authority, even though he never asked for it.

    Thus, while David Weiss had full authority to ask for full authority, the whistle-blower’s testimony that Weiss asked for full authority is wrong because Weiss never asked for full authority.

    How much clearer can Merrick Garland be?

    The IRS whistleblowers in the Hunter Biden case present overwhelming evidence they were obstructed. BUT: Hunter was ALSO being investigated for FARA violations and public corruption. Not a stretch to believe those investigations were impeded too. We need an independent counsel.

As I watch what I can from these hearings, when I read my news feeds, when I read JT’s posts and the subsequent comments, I think back to that fundamental transformation quote by Obama and wonder why no one ever asked him what he envisioned we would look like as a country once we had been transformed. Because we have been fundamentally transformed. We have been transformed into something that no longer is a functioning culture, or functioning government. Before this transformation, we would debate policy issues. Today, we can’t even agree that child sex trafficking is a real problem. James Garfield had it right nearly 150 years ago.

    Now more than ever before, the people are responsible for the character of their Congress. If that body be ignorant, reckless, and corrupt, it is because the people tolerate ignorance, recklessness, and corruption. If it be intelligent, brave, and pure, it is because the people demand these high qualities to represent them in the national legislature. If the next centennial does not find us a great nation, it will be because those who represent the enterprise, the culture, and the morality of the nation do not aid in controlling the political forces.

      There are true absolutes and there are solid standards. There is right and there is wrong. When persons in power and citizen’ drift away from these absolutes and standards and create a “relative” truth, then our present condition is the result. Apparently (to some) it is offensive to some folks to accept standards such as: Do not kill; Do not steal; Do not lie; Do not envy or take that which belongs to another person; treat your parents and elders with respect.”

      The same hard fought liberties that made many people rich and the rich richer is no longer good enough for the hard working people with a dream and willingness to work for success. Now that the oligarchs have their own, they suddenly find it offensive that others should be able to pursue their dreams with equal circumstance.

  16. Hunter Biden’s tax tribulations are not the main issues here. There are two:

    1. Was Joe Biden at the heart of an influence peddling/extortion/bribery scheme that raises questions of criminal violations, potential compromise and impeachment. Aside from all the documented involvement of Joe Biden with Hunter’s schemes, there is also the seemingly uninvestigated Form 1023, which contains explicit allegations of bribery.

    2. Did Merrick Garland and the DOJ obstruct the investigation despite Garland’s having given fulsome assurances to Congress that Weiss had full authority. According to Shapley’s uncontradicted testimony, on October 7, 2022:

    A. Weiss said he was not the decision maker on bringing felony charges in D.C. and California;

    B. Weiss said he was denied authority by the D.C. recently Biden-appointed USA to bring charges there; and

    C. Weiss said he asked Main DOJ for special authority to bring charges there and was denied.

    Furthermore, Weiss was denied the authority by a California recently Biden-appointed USA to bring charges there and again asked Main DOJ for special authority and was again denied.

    These are the two issues that should be the main focus of the Republicans going forward. As facts continue to emerge, they could lead to the impeachment of both Biden and Garland. In my view there is sufficient evidence to authorise the Judiciary Committee to launch an impeachment investigation against Garland, and probably Biden as well. The Democrats had a lot less when they opened the impeachment investigation of Trump over Ukraine.

    1. Grassley just released the largely unredacted Form 1023. It is very damaging to Joe Biden.

      1. Daniel, I think Republicans have to implicate Democrats or the party in all the cover-ups and abuse. This could not happen without legislative acquiescence.

  17. Hide the location of Hunter when he made the call or smash Hillary’s phone with a hammer. What’s the difference. We should remember when the FBI said that it no longer could locate the cell phone of Peter Strzok. When they figured out that they couldn’t get away with it the cell phone suddenly reappeared. The obvious subterfuge is not a conspiracy theory. It is what it is and sadly there is no joy in knowing it.

  18. So not only was Joe involved with Hunters deals but so was the rest of the family. The bank accounts of twenty shell companies tell the story. Let me ask you, what kind of organization uses twenty different shell companies to hide its transactions? Kind of reminds you of organized crime doesn’t it. Just like all criminals they thought that they were just to smart to be found out.
